If they know the defendant, they are not allowed to represent him or her UNLESS the defendant and his/her family has agreed to work with them as defense attorneys.If all VYC members act professionally, the defendant is more likely to have a positive view of restorative justice and to successfully complete his or her sentence.

Back to quiz #7CONFIDENTIALITYBy law, members of VYC must keep ALL details about the case CONFIDENTIAL including the defendants name and facts of the case.VYC defense attorneys have attorney-client privilege. No one, not even the judge, can make them disclose this confidential information about the defendant. There are 2 exceptions to this privileged information rule: if the defendant tells the attorneys that he/she will commit a future crime OR plans to commit perjury (lying under oath in the courtroom)If VYC members are unsure whether they should disclose confidential information, they need to ask ONLY the VYC legal advisor.The prosecuting attorneys are NOT allowed to talk to the defendant UNLESS the defense attorneys are present.
