Fisheries Regulations (Amendment) Order No. \t t of 2012

In exercise of the powers conferred on me by subsection 79(1) of the Fisheries Act [CAP 315], I, the Honourable KAL VAO MOLI, Minister of Agriculture, Quarantine, Forestry and Fisheries, make the following Order.

1 Amendment

The Fisheries Regulations Order No. 28 of2009 is amended as set out in the Schedule.

2 Commencement

This Order commences on the day on which it is made.

A:MENDMENTS OF THE FISHERIES REGULATIONS ORDER 28 OF 2009

1 Clause 32 (Title)

Delete "licence", substitute "certificate"

2 Clause 32 Delete "licence", substitute "certificate"

3 Subclause 33(2) Delete "licence", substitute "certificate"

4 After subclause 33(1)

Insert,

"(1 A) If an operator of a Vanuatu flag fishing vessel wishes to conduct fishing or fishing related activities in more than one fishing area, the fee remains the same as set out in schedule 14."

5 Subclause 33(3) Repeal the subclause, substitute

"(3) If an operator of a flagged vessel with a valid Authorization to Fish Certificate submits a new application for the same vessel wishing to conduct fishing or fishing related activities in another fishing area, other than the one authorised under the existing valid certificate, it must pay an additional fee prescribed in Schedule 14."

The functions of the Vanuatu Commodities Marketing Board are withdrawn from the Office of the Prime Minister.

2 Assignment of the functions
