Dr. Bellmare and Dr. Samson were in attendance to present to Council and answerquestions.

Christina Beaton, Environmental Coordinator was in attendance to address Council andanswer questions.

6. PRESENTATIONS & REPORTS

a) Official Plan Review - C. Welsh

Ms. Cindy Welsh, Manager of Planning was in attendance to present the revised OfficialPlan to Council and answer questions. A resolution to direct staff to submit the plan to the

Ministry for Review will be brought back later in the meeting.

b) Direct Land Sale, McBride St. North - Acces Industriel Minier Inc. - M. Jensen

Mr. Mark Jensen, Director of Community and Development Services was in attendance topresent to Council and answer questions. A by- law to approve the sale will be brought backlater in the meeting for approval.

c) Declaration of Surplus Land/ Notice of Public Sale of the former Melrose Heights

Subdivision - M. Jensen

Mr. Mark Jensen, Director of Community and Development Services was in attendance topresent to Council and answer questions. A resolution to declare the lands surplus will be

brought back later in the meeting.

d) Tax and Water Relief Program Update - N. Moore

Ms. Natalie Moore, Director of Finance and Treasurer was in attendance to present to

Council and answer questions.

e) Lease Relief Program Update - N. Moore

Ms. Natalie Moore, Director of Finance and Treasurer was in attendance to present to

Council and answer questions. A by- law to amend the relief program will be brought backlater in the meeting.

f) Python Patcher Purchase - N. Moore

Mr. Gord Deacon, Purchasing Manager was in attendance to present to Council and answerquestions. A by- law to approve the purchase will be brought back later in the meeting.

g) Animal Control and Pound Services - S. Palmateer

Mr. Steph Palmateer, City Clerk was in attendance to present to Council and answerquestions. By- laws to approve both the Animal Control and Pound Services contracts willbe brought back later in the meeting.

WHEREAS 2019 the Government of Canada implemented Bill 75, which amended the

Criminal Code ( Canada) by amending the rules for granting bail and in particular givingthe courts more latitude in respect to releasing individuals charged with administration ofjustice offences, such as failing to appear in court or failing to comply with bail conditions;and

WHEREAS the judicial system and correctional system are currently operating underCOVID- 19 protocols that allow for accused to be issued a Form of Release ( Form 9, 10 or

11) when an individual is charged with an offence without having to serve time in custody,which permits the immediate release of the accused due to concerns with reducing thespread of COVID- 19 in the correctional system; and

WHEREAS, due to the handling of accused in this manner, many of those accused havebecome repeat or prolific offenders in the City of Timmins as reported by the Chief ofPolice, causing concern to members of the Timmins Police Services Board, Timmins CityCouncil and the community at large as the attached Timmins Police Services StatisticalOccurrence report illustrated that crimes such as Break and Enter and Mischief have

increased by as much as 35% during the period of March 24 to September 24, 2020 overthe same period in 2019, and

WHEREAS implementing appropriate measures during a pandemic to ensure the safetyof accused and convicted persons within the correctional system is important and should

be addressed by the Ministry of the Solicitor General; andWHEREAS the correctional system in Ontario has not had any publicly reported majoroutbreaks of COVID- 19, which was of concern when the pandemic started in March 2020

and led to the current practice of generally releasing accused persons prior to a hearing;and

WHEREAS the incident of repeat offences is increasing in our community and the needfor a resolution to these concerns is imperative to ensuring the safety of our citizens;NOW THEREFORE BE IT RESOLVED THAT the Council for The Corporation of the Cityof Timmins RESPECTFULLY REQUESTS:

A. THAT the Solicitor General UNDERTAKE A REVIEW of any policy, directive,guideline or operational change regarding the current practice of releasingaccused without holding during the COVID- 19 pandemic, with a view to ensuringnot only the safety of the correctional system, but also the safety of communities inOntario who are impacted by repeat offenders who are released pending ahearing;

B. THAT the Attorney General for Ontario UNDERTAKE A REVIEW of any policy,directive, guideline or practice by which the judiciary, including justices of thepeace, release accused without holding pending a hearing, despite the accusedbeing charged with multiple offences or repeat offences, with a view to ensuringthe safety of communities in Ontario who are impacted by repeat offenders; and

C. THAT the Minister of Justice and Attorney General of Canada UNDERTAKE AREVIEW of the amendments to the Criminal Code ( Canada), among other Acts,implemented by Bill 75, which modernized and streamlined the bail regime, todetermine whether those amendments do in fact ensure public safety andconfidence in the criminal justice system, as promised, or whether additional

amendments may be required in order to create a more robust process for thosepersons accused of multiple or repeat offences; and

D. THAT a copy of this resolution be forwarded to the Solicitor General for Ontario,the Honourable Sylvia Jones, the Attorney General for Ontario, the HonourableDoug Downey; the Minister of Justice and Attorney General for Canada, theHonourable David Lametti; the Member of the Legislative Assembly for Timmins ,

Mr. Gilles Bisson, the Member of Parliament for Timmins James Bay CharlieAngus, as well as the Association of Municipalities of Ontario with an invitation for

other municipalities across Ontario to join the City of Timmins in this appeal to theSolicitor General and the Attorney General for safer communities during theCOVID- 19 pandemic.

m) Waive Lease Payments to Organizations Leasing Space in City-Owned FacilitiesDuring Mandatory Closures

WHEREAS several organizations, ( Lessees) have lease agreements with the City ofTimmins ( Lessor) allowing them to conduct their activities in City of Timmins ownedfacilities.

AND WHEREAS during COVID- 19 some of these organizations were effectivelyprevented from totally accessing their leased facilities or were later allowed access withrestrictive limitations mandated by public health authorities.

AND WHEREAS after eventually being allowed to access city-owed facilities, thesemandated policies by public health authorities such as social distancing, maximumnumber allowed and sanitizing procedures, made it impossible for some groups torealistically operate the leased areas under those restrictions.

AND WHEREAS this situation of not being able to realistically comply resulted in theseorganizations furthering suffering the loss of their ability to raise revenue to support theirentities to various degrees by up to as much as 100%.

AND WHEREAS these restrictions are still in place and there is no definite conclusion to

this loss of revenue generating capabilities with respect to the current COVID- 19pandemic and mandated regulations.

AND WHEREAS several of these organizations are deemed to not qualify under theprevious Canada Emergency Commercial Rent Assistance ( CECRA) and will not likelyqualify under this week' s announced Canada Emergency Rent Subsidy (CERB).

BE IT RESOLVED THAT the City of Timmins waive lease payment due from theseorganizations, on a pro- rated basis during the entire time that they were either 100%completely barred, or partially, affected by public health restrictions, from fully usingleased City of Timmins facilities to conduct their activities. ( Example ratio 100% loos of

income = 100% waiver of City rent payments and so on a declining scale).

BE IT FURTHER RESOLVED THAT all waivers will be based on application and financial

information being provided to the City of Timmins for audit indicating the percentage lossof income incurred during the period March 2020 until such time as a return to normaloperating activities is possible.

BE IT FURTHER RESOLVED THAT any single entity be restricted under this program tomaximum waiver amounts of lease payments under total full closure or partial restrictions

not to exceed a maximum of $ 25, 000.

BE IT FURTHER RESOLVED THAT this resolution supersedes any other programapproved by the City of Timmins offering the waiving of lease payments for organizationsthat have suffered revenue losses during a full lockdown or compiling with restrictionsmandated by public health authorities.
