• Australia is one of 170 countries that is a member of the IMO
• 9 June 2014 the IMO issued guidelines for VGM to commence 1 July 2016
• Why?
• establish common approach to SOLAS
• AMSA obliged to implement as of November 2014

• Shipper to provide VGM
• Shipper is held liable for false data
• Two methods for obtaining VGM

Relationship to CoR
• Chain of Responsibility (CoR) already states driver must have correct weight!
• National trade measurement regulations 2009 apply to weighing
• MO42 applies once container is ready to be loaded on board vessel
• What are the changes to MO42?
Changes to MO42
• Give effect to SOLAS Regulation changes
• Move overloading of containers from MO44
• Move SOLAS Chapter VI Regulation 5-1 on MSDS from MO21
• Include SOLAS Chapter V1 Regulation (pesticide on ships/fumigation of cargo units)
• Rename order to make it appropriate
VGM process
• VGM to be signed by duly authorised person of shipper
• VGM to be submitted to terminal/master before container arrivals at terminal
• Shipper as per bill of lading (or identified through other documents) to be held liable
• Shipper means a legal entity who has a contract of carriage – what contract do you have in place to point of packing
How is this all to be done?
• Number of weighing methods available
• VGM can be supplied electronically, via F.I., CWD or any form shipper determines
• VGM submitted to shipping line as above
• PRA will be VGM for stevedores
• New field in 1-stop to name “shipper”
Weighing accuracy
• Accuracy can simply be manufacturers claimed accuracy to accuracy standards
• Could be NMI trade certified equipment
• AMSA not mandating use of trade measurements and compliant equipment

What should you do?
• Talk to all parties who pack containers
• How accurate is their weighing equipment – if any?
• Offer alternatives (weighbridge / portable weighing equipment)
• Decide how you want to receive VGM as discussed earlier – you pass this to shipping lines
• Explain liabilities

• Limited supply of weighbridges

• Shipper believes their weighing equipment not satisfactory for MO42 – what then?
• Portable weighing systems will be available – more detail later.
What are the liabilities?
• Chain of Responsibility has been in place for sometime
• Road transport laws already in place for load limits
• AMSA comes into play once container is placed in accordance with Master’s requirements for loading
