The assignment on Independent Monitoring Consultant for Resettlement of the Power Transmission

Investment Program, Tranche 1, ADB Loan 2848 VIE - 500kV/220kV Bac Ninh 2 – Pho Noi

transmission line and 500kV Pho Noi substation started in April 2014 until December 2016. Since

then, six survey reports have been prepared and submitted to NPMB and ADB by IMC.

A survey has been conducted in November 2016 to prepare for post-evaluation report. With the

support from NPMB leaders and staff i.e. Division of Resettlement and Compensation in terms of

logistics and inputs.

The team would like to sincerely thank DRC leaders and staff for their enthusiastic support and

encouragement and companion with IMC and the team during the pre-survey preparation, field

survey and analyzing and reporting. Staff from DRC have been kept in touch and usually called and

gave instructions/inputs to IMC to fulfill her assignment. We highly appreciate their supports and

cooperation.

I. PROJECT BACKGROUND

I.1 PROJECT DESIGN, COMPONENTS AND LOCATION

1. The Investment Program, which was proposed in November 2011 and approved by ADB in

February 2012, aims to expand power transmission network throughout Vietnam. As a part of the

Investment Program, the Project aims to expand power transmission network in northern and

southern Vietnam.

2. A layout of L2848 Project Area is provided below:

I.1.1. Project Components

3. Component 1: Expanded Transmission Network. (The construction of 2 transmission lines and 2 substations will be financed located in the northern and southern part of Viet Nam.

North: (i) 500 kV/220 kV Pho Noi substation and connections; (ii) 500 kV/220 kV Bac Ninh

2 - Pho Noi transmission line sub-project

South: (i) 220 kV Song May – Uyen Hung transmission line; (ii) 220 kV Phu My 2

Industrial Zone substation

4. Component 2: Operational Effectiveness and Efficiency of NPT. The Tranche 1 project

allows management and staff of NPT to strengthen capacity in (i) Strategic corporate planning,

business planning and management; (ii) Accounting, financial management, planning and control;

and (iii) engineering design optimization of transmission network

5. Component 3: Project Implementation Support: This component supports project

implementation with focus on detailed engineering, construction supervision; procurement;

safeguards compliance; and preparation of subsequent tranches of the investment program. It will

ensure a high degree of readiness for implementation of sub-projects financed under the investment

program with detailed technical designs, advanced procurement for most of the sub-projects, and

capacity to prepare and implement safeguard measures. The completion of detailed engineering

designs, safeguard compliance, and procurement documents will facilitate the preparation for

financing of subsequent tranches.

6. The Project was initially expected to be completed by June 30, 2015. There is an extension

for the closure of disbursement by December 31, 2016.

7. The loan includes the financing of the construction of the (i) 500kV/220kV Bac Ninh 2 – Pho

Noi transmission line and (ii) 500kV Pho Noi substation. The National Power Transmission

Corporation (NPT) is the executing agency and the Northern Power Project Management Board

(NPMB) is the implementing agency for the two sub-projects.

I.1.2. Location

8. The 500kV/220kV Pho Noi – Bac Ninh 2 transmission line and associated 500/220kV Pho

Noi substation are located in the northern part of Viet Nam. The starting point of the transmission

line is the 500kV bus bar of the Pho Noi substation that is located in the Hung Yen province and the

ending point is the 220kV bus bar of the Bac Ninh 2 substation located in the Bac Ninh province.

9. The Bac Ninh 2 - Pho Noi 500/220kV transmission line is one of the two sub-projects

under the Investment Program that National Power Transmission Corporation (NPT) and Northern

Power Project Management Board (NPMB) requested for financing from ADB.

10. BN2-PN 500/220kV T/L has a total length of 30km, starting from the 500kV Pho Noi

substation and ending at the 220kV/110kV Bac Ninh 2 substation. Figure 2 presents an overview of

the ROW of the transmission line and Table 1 and Appendix 5 provide information on the location of

the transmission towers and the compensation amounts by province, district, and commune. The

transmission line traverses two provinces Bac Ninh and Hung Yen. In Bac Ninh province, the length

of the transmission line is about 29.3km which passes through the districts Thuan Thanh, Gia Binh,

Que Vo, and Tien Du of Bac Ninh province. In Hung Yen province, the transmission line is about

1.2km and passes through Sam Khuc village, Viet Hung commune, and Van Lam district.

11. The 500/220kV Bac Ninh 2 - Pho Noi T/L has been closed for electrifying since January 04,

20161

12. The total approved cost for the resettlement is VND 20,540,083,411 (USD 938,331,7952);

this cost already includes compensation and allowance payment

13. The Pho Noi 500kV substation and connections (PN 500kV S/C) is one of the two sub-

projects under the Investment Program that National Power Transmission Corporation (NPT) and

Northern Power Project Management Board (NPMB) requested for financing from ADB.

14. The Pho Noi 500kV substation and connections (PN 500kV S/C) are built with following

specifications:

- Voltage level: 500/220kV

Area occupied: 239,872.7m2 (included substation and access road)

Location: Viet Hung, Luong Tai commune, Van Lam district, Hung Yen province.

15. The total compensation and assistance value is VND 66,454,000,000 (equivalent to USD

3,090,884).

16. 500/220 kV Pho Noi substation subproject has 04 line connections, as follows:

500 KV Bac Ninh 2 – Pho Noi has 05 locations in Viet Hung commune. The route length

is 600m (Including the segment to the substation). Starting point is from the Pho Noi SS

and end point is 500 kV/220 kV Pho Noi – Bac Ninh 2 transmission line.

500 KV Quang Ninh – Thuong Tin has 05 location in Viet Hung commune, in which

Connection line No. 1 (to Thuong Tin): route length is 662m (Including the segment to the

substation) and Connection line No. 2 (to Quang Ninh). The route length is 568m

(Including the segment to the substation). Starting point: newly erected tower in the

middle of two towers No. 273 – 274 of the existing 500kV double circuit transmission line

from Quang Ninh to Thuong Tin and Ending point: 500kV gantry tower of Pho Noi 500kV

Substation.

220 KV Pha Lai – Gia Loc has 16 locations, in which 01 location in Viet Hung commune,

Van Lam district, Hung Yen. Remaining locations are in Nghia Dao commune, Thuan

Thanh district, Bac Ninh province (04 locations) and in Cam Hung commune, Cam Giang

district, Hai Duong(11 locations). The route length is 5,107m (Including the segment to the

station). Starting point: newly erected tower in the middle of two towers No. 68 - 69 of the

existing 220kV double circuit transmission line of Pha Lai - Pho Noi - Thuong Tin. Ending

point: 220 kV Gantry tower of Pho Noi 500kV Substation.

220 KV Thuong Tin – Kim Dong has 19 locations out of 81 locations are related to 500kV

Pho Noi substation sub-project, in which: 04 locations in Viet Hung commune, 09

locations in Luong Tai commune, Van Lam district, Hung Yen province and 06 locations in

Ngoc Lien commune, Cam Giang district, Hai Duong. Starting point: Starting point: newly

erected tower in the middle of two towers No. 73 - 74 of the existing 220kV double circuit

transmission line of Pha Lai - Pho Noi - Thuong Tin. Ending point: 220kV Gantry tower of

Pho Noi 500kV Substation.

I.2 DESIGN AND RP PREPARATION WITH PARTICIPATION

17. During the project preparation, NPMB consultants3 conducted inventory on the possible

project impacts. The survey teams have also conducted discussions and consultations with local

authorities and local people on the possible impacts caused by the project, particularly the alignment

of T/L routes so as the selected line routes are the least impact option.

18. The consultations with affected communities within the proposed site of the substation and

along the transmission line route have been conducted by NPMB and PECC3 team since July 2011.

People from the communes of Tri Phuong, Cam Hung, Minh Dao, Tan Chi and Lac Ve in Tien Du

district and Chi Lang commune in Que Vo district, and Lang Ngam in Gia Binh district, Mao Dien,

Tram Lo, Nghia Dao and An Binh communes in Thuan Thanh district and Viet Hung commune in

Van Lam district of Hung Yen province have been engaged during the consultation meetings.

19. The proposed layouts of the T/L routes of Bac Ninh 2 - Pho Noi 500/220kV T/L (from Viet

Hung commune, Van Lam district of Hung Yen province to Tri Phuong commune of Tien Du district,

Bac Ninh province) was also displayed and discussed again in the respective RP community

meetings.

20. The draft layout of the substation and T/L routes has been communicated by NPMB to the

relevant bodies i.e. provincial, district, and commune Peoples Committees, Departments of Natural

Resources and Environment, provincial/district/commune cadastral services for comments and

public disclosure.

I.3 PROJECT'S RESETTLEMENT/COMPENSATION IMPACTS

I.3.1. Categories of sub-projects' impacts

I.3.1.1. 500/220kV transmission line sub-project

21. 500/220kV BN2 - PN T/L sub-project starts at 500kV Pho Noi Substation at Viet Hung

commune, Van Lam district in Hung Yen province, and then traverses across 11 communes of

Thuan Thanh, Gia Binh, Que Vo and Tien Du districts and ends at 220kV Bac Ninh 2 Substation.

According to the results of DMS, Bac Ninh has 86 locations (for more information please see

Appendix 5), total of 370 HHs and 11 organizations are affected with about 41,204m2 of permanently

affected agricultural land and 270 m2 of residential land; 7,250m2 of temporary affected agriculture

land and 5,650m2 of public land. Across the 04 sub-project’s districts, there is one AH being

relocated because his house and garden locate right under the transmission line4.This project is

classified as Category A based on ADB's Safeguards Policy Statement 2009 (SPS).

22. According to results of DMS, 500kV Pho Noi substation and its connection5 go through 02

communes of Luong Tai and Viet Hung, Van Lam district, Hung Yen province. Total of 379 HHs are

affected with about 192,957.2m2 of permanently affected agricultural land and 342.3m2 of residential

land; 2,900m2 of temporary affected public land. There are three AHs being relocated with only one

AH having house on land6. This project is classified as Category A based on ADB's Safeguards

Policy Statement 2009 (SPS).

23. In the 03 connections10, land acquired and restricted for construction and operation is

agricultural land (paddy land) Total 84 HHs are affected with about 17,689m2 of permanently

affected agricultural land and 797m2 of land managed by CPCs11, There is no residential land

affected; 450 m2 of temporary affected public land of 84 HHs and 02 organizations (CPCs) will be

affected under the subproject, in which 6 out of 84 AHs are seriously affected households (losing

more than 10% of total land holdings), These households have their production land affected by the

project from 10 - 20% total land tenure area, no households losing over 30% of total production land

II. SELECTION OF CONSULTING SERVICES

24. NPT selected and engaged three individual consultants for (a) environment monitoring (in

February 2014) (b) involuntary resettlement, in February 2014), and (c) an independent monitoring

consultant of involuntary resettlement, in April 2014), in accordance with procedures acceptable to

ADB for recruiting individual consultants.

III. OBJECTIVES OF POST EVALUATION

25. For the post-evaluation report, IMC has reviewed the activities since the project began to have

an overview, judgment and evaluation o the level of compliance to the safeguards policies of the

donor i.e. ADB and Vietnam. (See Table 5 for the whole monitoring places and timelines).

26. The objective of this survey is to evaluate the project’s compliance with ADB’s safeguard policies by analyzing:

The social-economic conditions of AHs at the baseline and after resettlement and

compensation

Compensation, assistance and resettlement14;

Public consultation, disclosure, participation and grievance resolution;

Effectiveness of resettlement planning;

Lessons learnt for the future.

III.1 MONITORING PROGRESS

27. IMC was contracted to provide independent monitoring service for the two sub-projects of

Bac Ninh 2 – Pho Noi 500kV/220kV transmission line and 500/220kV Pho Noi substation and

connections. The following Table showcases the progress and paces of the independent monitoring

IV. METHODOLOGY

IV.1 METHODOLOGIES APPLIED FOR THIS REPORT

29. Desk review: IMC reviews all legal documents, internal reports on safeguard compliance and

documents relating to compensation, assistance and resettlement i.e. Project Feasibility Study, Loan

Agreement and Facility Administration Manual of Tranche 1 Investment Program (FAM), RPs,

updated RPs and DDR of the two sub projects, Memorandum of Understanding from ADB’s missions (2014, 2015, 2016), ADB’s SPS 2009, ADB’s guideline on resettlement assessment, Land

Law 2003 and Land Law 2013, Decree 69 (guiding Land Law 2013), Decisions of Bac Ninh PPC,

Hung Yen PPC and Hai Duong PPC on prices of land, trees and crops, houses and structures and

other assets for compensation when the State recovers the land; NPMB and LIC’s quarterly reports which are taken as primary information for baseline review, analysis and assessing the related

issues.

30. Questionnaire interview: During the monitoring process, this tool is used as the main channel

of information collecting to assess the resettlement implementation. The questionnaire interview has

been designed for 100% of SAHs, 10% of partly AHs, accordingly 361 AHs have been surveyed.

Table 7 provides more details about the number of questionnaires, the questionnaires have been

input and processed to provide inputs for the final report

31. In-depth interview: IMC conducted in-depth interviews with officials from two selected

DARBs of Tien Du district and Que Vo district and Communal Peoples Committees of Minh Dao in

Tien Du and of Chi Lang in Que Vo district, Bac Ninh province and with Land Fund Development

Center of Van Lam district and Communal Committees of Luong Tai and Viet Hung in Hung Yen

province, Cam Giang district of Hai Duong province to assess the: (i) advantages and disadvantages

during the project implementation; (ii) positive and negative impacts of the project; (iii) resettlement

issues; (iv) the levels of recovery and the stability of AHs after the land recovery and compensation

and assistance process completed. Also, the design of the questionnaire interview provides plenty

rooms for in-depth interview. The interviewers were also encouraged to ask and write down any

further information from the respondents. All the information has been carefully read, noted down

and aggregated by IMC. Appendices 1 and 2 provide lists of questionnaire responders and in-depth

interviewees.

32. Focused group discussion (FGDs): 3 FGDs were held with in the surveyed communes with

the hamlets/villages officials and 3 FGDs representatives of villages. FGDs were designed to clarify

issues that are unable to be made clear by questionnaires (for instance, typical cases, opinions or

recommendations of APs etc.). FGDs are to find advantages and disadvantages and solutions.

Moreover, FGDs focus on AH entitlements, participation, livelihoods restoration, resettlement,

gender, etc.

33. Observation: During the field trip, IMC visited and interviewed AHs to observe their living

conditions and facilities. IMC also observe the construction sites to image how it may interfere in the

daily life of the local people and the potential inconvenience etc.

IV.2 SAMPLING

34. The sampling size is designed with 100% of severely AHs (resettlers, losing more than 10%

of land) and 10% of insignificantly AHs.

35. It was noticed during the past missions and this mission that AHs reside in close proximity to

each other (i.e. in the same hamlets) in all sub-projects, a supporting team and key informants (i.e.

chief of the surveyed hamlets) are engaged to facilitate the interviews. The AHs were interviewed in

a revolving mode.

V. FINDINGS

V.1 SOCIO-ECONOMIC INFORMATION ABOUT THE DISPLACED PERSONS

V.1.1. Source of information

36. IMC, with the support of a survey team, has conducted a socio-economic survey to collect

information based on a sampling design of 100% seriously impacted AHs (those who had to resettle

and lost more than 10% of the landholding areas) and 10% of partly affected households, with no

regard to gender or ethnic group. The objective of this survey is to provide information about sub-

projects' AHs to evaluate the impacts of the resettlement/land acquisition and compensation on

different aspects and to make sure that all the proposed entitlements in the Resettlement Plans have

been provided and used as the focal point for designing the restoration program and in resettlement

monitoring process. Information and data after collection was processed and analyzed to identify the

categories of AHs, vulnerable groups to propose the entitlements/assistance appropriate for these

groups.

37. Socio-economic profiles of AH have been reviewed for the people who are living in the

project area and are impacted by the project in terms of land and assets. The information supports

for the evaluation of the i) socio-economic characteristics in the localities as well as the AHs ii) living

standards of AHs; iii) Sources of income of the households; iv) Rate of incomes and the linkage to

poverty; v) Holding of assets.

38. The survey was conducted in November 2016 with the support from NPMB leaders and staff

i.e. Division of Resettlement and Compensation in terms of logistics and inputs. 07 affected

communes of 05 districts had been visited by the team for this reporting period: Tien Du, Que Vo,

Thuan Thanh (Bac Ninh), Van Lam (Hung Yen), Cam Giang (Hai Duong). Total surveyed

households were 361 households, covering 100% SAHs and 10% of partly affected households.

V.1.2. Characteristics of interviewed households

39. Based on the TOR of IMC and at the request of NPMB for post-evaluation report

preparation, a sample design has been drawn, taking into account of the targets of survey, methods

used and type of information and data to be collected. Total 361 AHs had been put together for a

sampling structure, including 25 severely AHs (100% under Bac Ninh 2-PN T/L sub-project) and 37

partly AHs, 296 severely AHs (100% under Pho Noi Substation sub-project) and 43 partly AHs,

(totally 278 severely AHs and 63 partly AHs) of the two sub-projects.

40. Total surveyed people are 1,320,845 of which are men (accounting for 64%) and 475 are

women (accounting for 36%). The average size of an AH is 4.1 person/household. Of the total

surveyed AHs, 222 AHs have 1-4 members in their families, accounting for 68.6%; 102 AHs have 5 -

8 members in their families, accounting for 3.4%, there is no AH with more than 8 members in the

family.

V.1.3. Gender, age and educational level

41. The results of the socio-economic survey showed that of 361 surveyed AHs, there are only

20 women-headed households (accounting for 6.2%).

42. Out of 361 households surveyed, total number of affected people has percentage of men

54% against 46% female. An average size of the affected families is identified as 4.1

persons/household.17

43. Regarding the age structure of APs (all AH’s members),the age groups of the surveyed AHs

are rather young. Percentages of persons under 18 years old, 18-30 and 31-45 are 17.8%, 22.6%,

and 10.6% respectively. Of them, persons over 60 years old account for smallest percent of 12.4%.

44. 208/361 heads of the households have the educational level of secondary school

(accounting for 57.6%), while 55% heads of the households have upper secondary level (accounting

for 15%), 79/361 heads of the households stop at primary schools (accounting for 21.0%). There is

as humble number as 19/361 heads of the households have vocational high

school/college/university degree (accounting for 5.2%).

47. There is a strong separation of nuclear family from their parents. Young couples, in most of

the cases, registered as an independent family in a residential register book. There are cases which

one old couple has five or six children who are all got married and are keeping separate Residential

Register Book

V.1.4. Income of AHs

48. Based on the data collected from the socio-economic survey, the households can be

identified as belonging to one of four income groups as follows:

49. Poor: This group includes those people who earn incomes that fall below the new

MOLISA poverty line18 (i.e. VND 700,000/person/month). Some of these people have availed of

credit and have managed to purchase livestock, but in general operate with very small cash

incomes over and above subsistence activities, and many are subject to seasonal cash incomes

due to the nature of the agriculture sector. The seasonality of production and/or income would

mean that these people would require a greater degree of support (than families in the

transitional category) to become food sufficient for 12 months per year.

50. Transitional: This group includes those who have moved above the official poverty line

(and earn between VND 701,000 and VND 1,000,000/person/month for rural area) but still

remain vulnerable to shocks and are less able to withstand either natural disasters or economic

trauma than the non-poor. These people have relatively low disposable income and particularly

those between 10% and 15% above the poverty line still have trouble meeting minimum basic

needs. This group is considered to be transitional as they are moving, albeit slowly, out of the

classification of poor into non-poor, they constitute the ‘upwardly mobile poor’.

51. Non-Poor: This group includes households with people who earn between VND

1,001,000 and VND 3,000,000/person/month. This income category captures those that are

non-poor and who have relatively high levels of disposable income. Beside the income from

crops, this group still invests in animal raising (buffalo, pigs, chicken…) to supplement their

income.

52. Better-off: Households in this category include those with members earning more than

VND 3,000,000 /month and are considered to be more than non-poor i.e. they are

comparatively wealthy and have very high levels of disposable income and have savings.

Usually for households in this category farming is not the main source of income, and they have

members who are engaged in salaried work, and small business or trade.

53. Of all the surveyed AH, 15.5% pass the primary level, 56.7% stop at lower secondary school

and is the highest percent and 19.2% have upper secondary grades and only 7.1% of them went to

higher education grades (vocational high school) while college or university graduated people are

only about 1.5%.

54. Agriculture is the main livelihood of the local people and is the main source of income for the

local people in general and affected households in particular. Data from Table 12 shown that 48.5%

income of AHs are from agricultural production i.e. planting rice, husbandry, fish raising etc.

Business/service takes small account in the income structure of AHs with 5.2%. Other sources of

income i.e. salary based/payroll, handicaps and seasonal laboring accounts for 44.1% of the income

structure overall in which the income from business/services in BN2-PN T/L and PN SS and

Connections are similarly low with 4.5%, 5.5% and 5.6% respectively and income from salary BN2-

PN T/L and PN SS and Connections are similarly rank second with 42.3%, 42.8% AND 47.2%

respectively.

55. In all two sub-projects, the monthly income between VND 3-5 million/month has the highest

probalities with 35.5%, 67.2% and 35.7% of BN2-PN T/L, PN S/S and connections respectively and

no AH has the monthly income of less than VND 1 million/month20).

56. There is correlation between rate of income and gender. With over VND 5 million/month,

male account for 3.3% while female accounts for half the percentage of 1.2%, while there is a

balance in gender structure in group under 1 of income of 46% and 48% of male and female

respectively, it is further noticed during the survey that those who belong to this group often rely on

agriculture production i.e. rice production without auxiliary business/affair/salary/pension etc.

V.1.5. Agricultural activities

57. Mostly the agricultural production activities in the project area fall under one or few of the

following categories: (i) rice and agricultural crops, (ii) livestock, (iii) small services related to

agriculture services i.e. hired seasonal farmers, selling pesticides, fertilizers, seeds, or running rice

husk separator etc. Through the survey result, it is noted that agriculture is the main source of most

of the AHs in particular and local people in general. Agricultural production activities usually

associated with crops such as rice, maize, cassava.

58. Livestock is an important part of agricultural based livelihoods. However, it is noted during

the survey that there is no big-scale livestock production or big animal herd. Most of the livestock

activities are small scaled and for self-subsistence in most of the case. An average of

0.7cows/buffaloes/household is made out of the socio-economic survey. Cattle are kept in styles and

grazed every other day and for pulling and meat provision purpose. Cattle and poultry manure is

piled and composted to use for improving the soil fertility.

59. There is no forest land area in the project area.

V.1.6. Non agricultural activities

60. There are 26 AHs informed that they have non-agricultural services/businesses aside from

agricultural activities. These take part of the income structure include providing basis necessities,

daily living supplies (grocery shops), handicrafts, hair cut, motorbike-bicycle repairing with very

humble income (from VND 1-3 million /month/business) similarly between Bac Ninh and Hung Yen

(Table 14).

V.1.7. Houses and house styles

61. The survey result shows that 67.5% AHs are living in a grade 3 - house, with one story, flat

and cemented roof and tiled floor. The most popular house area is 60-80m2 large on a premise of

200m2, with kitchen and bathroom. 34.8% AHs are living in grade 4-houses with steel/cast sheet roof

and brick floor. Almost all the houses were built since 1980’s with 76.5% of the responses.

62. 51% houses were built between 1960-1999, 42% houses were built during 2000 to before

2013 and 7% were from 2014-2016.

63. The survey result shows that The living condition of AHs in both sub-projects is general good

with 100% AHs use electricity from national grid. 82.8% AHs cook by LPG however, there is only 3%

AHs use electricity for cooking, 22% AHs can access to internet.

64. High percentage of durable goods used by AHs in both sub-projects as being shown in Table

16: 82% of AHs own at least 1 motorcycle and 18% of them own from two monocycles upwards.

81.3% of them using Refrigerator, there is only 0.8% of AHs using a car and it is as low as 3.6% of

them using air conditioner which is very low in view of the hot weather during 9 months (late spring-

summer-early fall) in a year in the Northern of Vietnam.

65. There is almost no AH who should resettle since the recovered area is agricultural

production land area. Most of AHs have been living their whole live in the same house, same area

and also did their parents. In Bac Ninh 2-Pho Noi 500kV/220kV transmission line sub-project, there

is one AH has house recovered and in 500kV PN S/C sub-project 3 AHs have residential land and 1

house on the land recovered. Other than that, no AH’s house is impacted by the two sub-projects.

V.1.8. Access to Infrastructure and Social Services

66. The infrastructure are satisfactory in terms of basic social services i.e. health clinic, transport

road, grid electricity, school.

67. Electricity: all AHs connect with national electricity grid.

68. Water supply: There is no tap water yet, all surveyed AHs said they kept rainwater tank and

drilled well for cooking, drinking and washing.

69. Markets: The sub-project areas have small market places scattering all over which provide

and satisfy basic needs for the local residents. Markets are available daily from early morning to

early afternoon, after that, it is much difficult to buy foods, fruits and meat. Markets are easily

accessed by inter-road systems

70. Schools: All communes surveyed reportedly had nurseries, kindergartens, primary and lower

secondary schools while upper secondary schools are only available at district level. For vocational

schools, students have to live far from their home but it is very convenient for them to travel in view

of the city-peripheral location of the project areas.

71. Health center: there is one health center of each commune and health services are provided

through public health workers. All national health programs i.e. vaccination, deworming etc. are

made available to all people in the commune including all APs.

V.2 COMPENSATION, ASSISTANCE AND RESETTLEMENT

V.2.1. Detailed Measurement Survey (DMS)

72. 500kV/220kV BN2-PN T/L sub-project: DMS of the sub-project was prepared in December

2013. All DMSs in the four project districts of Bac Ninh province have been completed.

73. DARBs in Bac Ninh province together with the Resettlement Division of NPMB, communal

inventory teams conducted the measurements, preparing DMS results with the participation of the

concerned land owners. After DMS, the results were delivered to the AHs. They checked and then

signed in the DMS lists. The DMSs were directly conducted by: (i) staff from NPMB/compensation

division; (ii) staff of DARBs in Bac Ninh province; (iii) communal staff; (iv) village staff; (v)

representatives of the AHs who participated in the measurement process. After agreeing on the

affected land and crops, all parties signed in the DMSs. This was the basis for preparing

compensation plans for the AHs

74. 500kV PN S/C sub-project: DMS of the sub-project was prepared in June 2014. All DMSs in

the two communes of Luong Tai and Viet Hung in Van Lam district, Hung Yen province have been

completed.

75. Center for Land Fund Development (CLFD) in Hung Yen province together with the

76. BN2-PN 500/220kV T/L sub-project was assigned for District Compensation, Assistance and

Resettlement Boards (DCARBs). Fours DCARBs of Gia Binh, Tien Du, Que Vo and Thuan Thanh

resettlement to the Hung Yen PPC. The PPC will be responsible for the transfer of budget to

subproject DPC/CARB to make payments directly to APs with respect to affected land, crops and

V.2.3. Before and after land acquisition and resettlement comparison

84. The survey results show that there are changes in terms of size of family, income source and

job of AHs. The baseline study shows that the average size of family was around 4.7

persons/household while the figure is 4.1 person/household, also, the rate of income of AHs was

about 80.0% from agriculture while the percentage falls down to 41.9% and 49.2% in BN2-PN TL

subproject and Pho Noi S/S sub-project respectively at the time of the survey. It is assumed that

because of infrastructure development programs as these two sub-projects and the booming of

industrial parks in the region, it is clear that most of the cases, worker’s monthly salary outweighs

incomes from smallholder agricultural production .

85. Through discussion with leaders and people of affected communes during the baseline

survey in April 2014, it was found that before project implementation, local people still worked as

freelancer for private sector. Moreover, income from agriculture is low when the investment for

agriculture increases (increase in the prices of fertilizer, insecticide, plough, working day). At the

time, each kg of rice costs VND 10,000-11,000 (while it is VND 15,000-16,000 at the time of 2016).

In addition, agriculture activities are seasonal and intermittent. AHs do not only gain income from

agriculture but also other sources such as freelance jobs, handicraft, worker and small business,

however agriculture activities account for the extremely high percentile in the income structure of

AHs.

86. There is a trend to move from other income categories to salary based occupations with

36.8% from the baseline survey to 44.1% in November 2016. With the boosting moves toward

industrialization, Hung Yen and Bac Ninh are attracting investors to invest in assembly facilities in

the close proximity with the project area which attract former famers to get new skills and new jobs in

the production facilities/industrial parks, especially young people.

87. There is a sharp downfall of percentiles of agriculture category across both sub-projects with

79.6 (2014) against 51.9 (2016) in Bac Ninh 2 – Pho Noi 500/220kV Transmission line sub-project

and 80.0 (2014) against 49.2 (2016) in Pho Noi 500kV Substation sub-project and connections. On

the contrary, a remarkable increase in salary/wage category after the project across the board with

10.7 in 2014 to 42.3 in 2016 and from 7.6 in 2014 to 42.8 in 2016 in Bac Ninh 2 – Pho Noi

Transmission line sub-project and Pho Noi 500kV Substation sub-project and connections

respectively. The strong trend of industrialization has made a clear impact on the movement of

occupations of APs. Bac Ninh23, Hung Yen24 and Hai Duong25 are among the fast industrialization

provinces in the North with many industrial zones and huge demand of young and skilled workers.

88. The resettlement/compensation/assistance planning in restoring the living conditions should

take account of the changing situation in the area, at this period and in the near future, it is beneficial

for AHs if they can get skill refining/awareness raising opportunities from such restoration programs

as vocational trainings, small credits etc. so that they can feel more at ease to enter into a new

working environment and get better income.

V.2.4. Severely Affected Household

500kV/220kV BN2-PN T/L sub-project

89. According to the RP, severely affected households mean all AHs that lose 10% or more of

total productive land, other assets and/or income sources or lose 10% or more of their total income

sources due to the Project. Accordingly, the results of Detailed Measurement Survey for foundation

show that 370 HHs in total have been affected by the sub-project in 4 districts of Tien Du, Que Vo,

Gia Binh and Thuan Thanh in Bac Ninh province, of which, 25 AHs were losing more than 10% their

agricultural land, and no AH being relocated or resettled, no AH having their houses/structures

affected. Notwithstanding, all of them informed that their incomes are no longer based on only

agricultural activities but also based on other off-farming businesses i.e. self-employed, providing

services, freelancers, pay-roll staff etc. All the AHs under BN2-PN T/L sub-project in Bac Ninh

province received assistance together with the compensation amount.

90. In Hung Yen province, it was identified in the DMS that there were 164 HHs losing from 10-

30% land area, 83 HHs losing from 30-70% and no HH losing more than 70% of total land holding.

In the connections, there are 6 HHs lost from 10-30% of total land holdings. While assistance

amount for livelihood stabilization is paid directly to the AHs, assistance for vocational education and

training for the severely affected households are transferred to the account of Hung Yen Department

of Labor, Invalids and Social Affairs to provide training for those AHs who have desires to get

vocational training for doing a new job.

91. 98% of SAHs have the income per month from VND 3 to 5 million. There are 120 SAPs who

are retired State officers coming back their hometown with 100% of them having pension from VND

5-10 million/month and 100% of them graduating from colleges/universities.

92. Table below shows there is only 1 SAH in 500kV/220kV BN2-PN T/L sub-project and 5

SAHs in 500kV PN S/C sub-project and no SAH in the connections expressing the need for

vocational training out of 278 SAHs and 99.3% of them commenting that their families are living with

the same/better conditions as compared to before the project.

V.2.5. Resettlers

93. In Bac Ninh 2 - Pho Noi 500kV/220kV transmission line sub-project, 1 AH has been identified

to be resettled, Mr. Nguyen Duc Quang’s in Van Chung village, Tan Chi commune, Tien Du district,

whose resident land was to be recovered by the sub-project since it lied under the transmission

which subject to limitation of all living activities. Tien Du DARB together with NPMB conducted

consultation with his family and he agreed to move. DMS had been completed and compensation

and assistance funds have been paid. However, he is requested to dismantle the house on land but

at the time of supervision (November 2016), he has moved to other house, but not yet removed the

house on the land.

94. There are 3 households with land locating in the access road to 500kV Pho Noi Substation.

IMC has worked with Luong Tai CPC and CLFD about this issue. It was reported that these houses

were allocated with non-residential land. They are Mr. Do Van Thuc's, Do Van Tha's (they are

brothers), Mr. Nguyen Van Hung. Mr. Do Van Tha has build a one-story brick house on the land

since August 2014, while Mr. Do Van Thuc and Mr. Nguyen Van Hung have their pieces of land

unconstructed (above is a panorama picture of the land and house). Of them, Mr. Nguyen Van

Hung agreed cash-for-land compensation while Mr. Do Van Tha and Mr. Do Van Thuc are

submitting application for land-for-land compensation. Their families asked for replacement land

area. As of the final evaluation time (November 206), Mr. Nguyen Van Thuc’s and Mr. Nguyen Van

Tha’s have been allocated another land in nearby area for rehousing. Before that, in February 2016,

Hung Yen CLFD has sent a request to Hung Yen PPC for approval of land-for-land compensation for

these two households. The request has been approved. CLFD has been preparing the

compensation and assistance plan based on the Hung Yen DONRE’s unit prices for compensation of land recovery in 2016 and NPMB’s cost estimate. As of November 2016, the two households still

stay put and have not yet handed over the site to the project due to the replacement land area has

not yet prepared by CLFD and CPC for housing (i.e. no dredging and no earth filling yet).

V.2.6. Vulnerable households:

95. According to the DMS results, there are 78 affected households that are women headed

HHs26 out of 370 AHs, no poor household and no ethnic minority ones in 04 districts of BN2-PN

500/220kV T/L sub-project. The survey results as of November 2016 of both surveys showed no

poor households in the surveyed villages. i.e. household with income of less than

700,000/head/month in 201627.

96. According to the DMS results, in PN 500kV S/C sub-project, there are 67 affected

households that are women headed HH out of 379 households. it was identified that there are 6 poor

households in the surveyed villages of Sam Khuc and Dong Chung of Viet Hung commune i.e.

household with income of less than VND 700,000 /head/month).

Interviewing Ms. Nguyen Thi Mo, a women-headed AH in Cam Hung village, Cam Giang

district, Hai Duong province:

“My 20-year-old son is working for a relative. He is young and unskilled. He earns about 1.2

million/month by assisting other skilled masonry to build houses. He stops going to school after

lower-secondary school (i.e. grade 9). I am living alone, I grow rice and raise ten chicken. I have

many elderly diseases. My son works far from home, just coming back once every two weeks. I

has been entitled for compensation, assistance from the project, but my most concern is my son

can get more money and be settled. The lady in the neighborhood told me there is some

vocational training from the project, it is free for APs like us, but we don’t know how to have that. Also, my son should have better income so that he can get married and bring up his wife and

children, then I can rest assured about him.”

97. In the project areas, many State subsidized programs and projects i.e.30A, 135 etc. reaching

out to those who are the most vulnerable in the community. AHs have not only receive support from

the project but also are being back-up by the programs and projects for different groups in the

community.

V.2.7. Income restoration program

98. The assistances payments were made in cash for livelihood improvement and the

occupation changing and job creation in both sub-projects.

99. In general, BN2-PN 500/220kV T/L sub-project has a small impact due to implementation of

transmission line. In Bac Ninh province, accordingly updated DMS, for foundation construction, there

are 25 household losing from 10% to 30% of total land holdings. Notwithstanding, assistance for

livelihood stabilization, occupation change and job creation have been provided in accordance with

the laws and project policy. The amounts were paid together with the compensation payment at a

time. The applications of unit prices are found in compliance with the current regulations, please see

Tables 27 for more details on the amounts paid under compensation, assistance and income

restoration categories of this sub-project.

100. In PN 500kV S/C sub-project, it was identified that PN 500kV S/C sub-project have three

resettlement AH, there are 83 HHs losing more between 30% and 70% and no HH losing more than

70% of total land holding. Notwithstanding, assistance for livelihood stabilization and occupation

changing and job creation have been provided in accordance with the current laws of Vietnam,

please see Table 27 for more details on the amounts paid under compensation, assistance and

income restoration categories of this sub-project.

102. IMC was informed by Viet Hung commune leaders and local people during the survey that

while assistance amount for livelihood stabilization is paid directly to the AHs, assistance for

vocational education and training for the SAHs are transferred to the account of Hung Yen

Department of Labor, Invalids and Social Affairs to provide training for those AHs who have desires

to get vocational training for doing a new job.

103. AHs feel very inconvenient with this set up, since Viet Hung and Luong Tai communes are

about 50km far from the capital city of the province, if someone wants to get training they should pay

more for logistics to get training than the funding for training itself. It was also asked by the Viet

Hung CPC staff and people in the questionnaires and in-depth interviews that if possible, they would

like to receive the assistance in cash so that they can have more specific and practical for vocational

training plans.

V.3 PUBLIC CONSULTATION, DISCLOSURE, PARTICIPATION AND GRIEVANCE

RESOLUTION

V.3.1. Public Consultation, Disclosure, and Participation

104. During LIC’s RP updating process, two rounds of consultation were conducted. The

purposes of the first round of consultation, and information dissemination are to initially inform the

local authorities about the sub-project, its objectives and principles on land acquisition,

compensation and resettlement in accordance with current GoV’s policies and ADB’s policies on involuntary resettlement, plan, and schedule for the SES, DMS and information needs for preparing

an Interim RP. The meeting was held at office of 04 sub-project districts to introduce to local

authorities and local NGOs about:

General information on the project;

List of the project affected districts, communes and scale of land acquisition under the

project;

Objectives and Principles of RP according to the requirements of GoV and ADB’s policies on involuntary resettlement;

Schedules of SES and public consultations;

Other issues.

implementation of the Program during period 2012-2015, thanks to that, vocational training and job generation initiatives have been made available to the wide beneficiaries categories in terms of significant skill improvement, job generation, income improvement in the communal level. The main agencies in charge of the vocational training initiatives are Provincial Department of Labor, Invalid and Social Affairs.

105. During the first round consultation, key issues had been discussed with local leaders and

staff in 04 districts of Bac Ninh and representatives of CPCs. Almost all opinions focused on the

following points: (i) compensation unit price should be met with market price; (ii) local government

and organizations supported the project implementation and would coordinate with project

stakeholders to disseminate the project’s information and objectives; (iii) a clear mechanism/requirements with contractors should be available during the construction execution, site

clearance, site reinstatement, assistance for APs during the construction.

106. At the end of May 2014, Consultant conducted the second round consultation (group

discussions with the project affected communities) to continuously disclose information to the APs

and collect comments of APs on different issues related to the compensation and resettlement. The

second round consultation also focused on the topics such as the scope of land acquisition,

entitlements of APs, difficulties of APs and income restoration methods.

107. During the second round consultation, the content of community consultation meetings in

sub-project communes was focused on following points: (i) Almost local people supported the project

as it brought many benefits to the community; (ii) APs requested to be compensated in accordance

with current regulations taking into account different kinds of assistance or allowance; (iii) APs

requested the contractors to execute the construction works during the their leisure time to minimize

the project impacts; (iv) APs would like to have payment for their temporarily affected land area

caused by the contractors.

108. During the implementation period, to the reporting time, the project information and

resettlement issues have been disseminated to the local people twice by the NPMB and the

DARBs/CLFD. The first time was before DMS and the second time when the compensation plan was

publicized in offices of the CPCs and communal houses of the affected villages.

109. During the public posting of the compensation plan, some households in the surveyed

villages had some complaints about the mistakes/errors regarding the inventory and the pricing, staff

of NPMB/Division of Compensation together with the DARBs/CLFD and the CPCs have checked

and revised and then prepared the final payment plan then reposting.

110. The timing for posting the compensation plan in both sub-projects was 20 days (20 days for

the first posting, after revising, another 20 days for reposting the revised plan). These practices in

500kV/220kV BN2-PN T/L sub-project and 500kV PN S/C sub-project were checked with the local

authorities and APs by IMC. They confirmed that the timeline for posting of compensation

plans/revised compensation plans was strictly followed.

111. Besides, the communal authorities also provide the AHs with information through communal

loudspeakers for them to know about the DMS plan, posting of compensation plan and payment

plan. It is noted by the consultant that most of the AHs know clearly about the project information i.e.

project impacts, project scope, DMS, payment of compensation and assistance, construction

projection of the project etc.

112. Aside from the official public disclosure and consultation, it is seen by the IMC that project

information was communicated with the local authorities and citizens in many ways, i.e. DMS when

the measurements were taken with the household’s participation, the publication of compensation plan, and through loudspeakers when the AHs were informed to go to receive compensation and

assistance amount. However, the survey results shown that still there are some certain restrictions,

such as (i) Information dissemination was mainly one way, there are no exchanging of opinions from

the project to people, the AHs did not have many opportunities to exchange and dialogue with the

investor and the local governments (ii) the information and compensation policy of the project were

provided mostly verbally during meetings, many of the AHs did not remember the details so the

community’s understanding about the project’s AH support policy is limited. It was cross-checked

with APs and the staff in charge from NPMB that in 500kV PN S/C sub-project, when AHs come to

receive the compensation money, if they were still confused about the project's policies (i.e.

discrepancies between cost-norms of the two sub-projects applied, he was there to explain very

carefully to them to avoid misunderstanding and unneeded complaints that may arise which were

confirmed by the APs interviewed.

113. According to interview results of the Independent Monitoring Consultant (IMC), 93.2% of

interviewees said they were informed of project information. Some of them were afar at the time of

the information disclosure and consultation activities, but they easily caught up with the information

about the project's land acquisition and compensation, etc. from other family members and

neighbors since such information was very concerned about and directly impacted their residence

and livelihoods.

V.3.2. Grievance Resolution

114. Under the sub-projects, grievance redress mechanisms have been established which allow

APs to appeal their problems arising from the compensation/allowance/assistance and to settle any

general project-related disputes.

115. In order to ensure that all APs’ grievances and complaints on any aspect of land acquisition, compensation and resettlement are addressed in a timely and satisfactory manner, and that all

possible avenues are available to APs to air their grievances, a well defined grievance redress

mechanism needs to be established. All APs can send any questions to implementation agencies

about their rights in relation with entitlement of compensation, compensation policy, rates, land

acquisition, resettlement, allowance and income restoration. Otherwise, all APs are not ordered to

pay any fee during the grievance and complaints at any level of trial and court.

116. During consultation processes by NPMB and LIC, representatives of the concerned

DARCs/CLFDs helped informed the grievance mechanisms for the affected households through

different meetings (please refer to Table 16 for the consultation process).

117. Before site clearance, information on the entitlement, project policies, environment impact

possibility of the project, project implementation arrangement, responsibilities of the stakeholders

and grievance redress mechanism etc. were informed to the local people through several

consultation meetings. DMS results were posted at village houses and CPC offices, for 20 days

according to the project policy, depending on each commune, Naturally, AHs were very concerned

about DMS and their entitlement. Information was carefully cross-checked by AHs and

NPMB/DARBs/CLFDs. After check and question-and-correction, the revised DMSs were posted in

public place another 20 days. Table 29 details the questions and complaints about DMS and

entitlement policies. In general, through several supervision missions, by talking to AHs, it was noted

that this step was conducted in compliance with the project policy.

118. Aside from the individual complaints listed above, it was verbally complained by some old

men, not all of them are AHs in Dong Chung village, Viet Hung commune, Van Lam district, Hung

Yen. They were displeased with the way of naming of the works in a very annoying and confusing

manner, for example: Cam Giang bridge, which is a bridge connecting the main road and access

road to Pho Noi Substation, located in Me Dau village, Viet Hung commune while Cam Giang is the

name of other commune in Hai Duong province about 10km far away from the place. Also the name

of the substation raises questions from villagers, because Pho Noi (500kV Substation) is named

after an urban district which is 50km far away from Dong Chung village.

119. There are CPC staff and local people, during the survey, expressed their concerns about the

Electromagnetic Field (EMF) problem as they anticipated that after the circuits are closed, they living

environment might be threaten by the EMF and this might barrier them from development

opportunities.

V.4 EFFECTIVENESS OF RESETTLEMENT PLANNING

V.4.1. Executing Agency and Implementation Agency and RP implementation

120. Under the Power Transmission Investment Program, four resettlement plans (RPs) have

been prepared through extensive consultation with stakeholders. Two of the sub-projects included in

Project 1 are category A for resettlement, namely the (i) 500k/220kV Pho Noi substation and (ii) 220

kV Song May-Uyen Hung transmission line, as the impact is significant. IMC has been mobilized

since August 2014 to monitor the compliance with the resettlement plans. With regard to ethnic

minorities, the provincial governments confirmed that ethnic minorities are not residing in the project

areas.

121. The National Power Transmission Corporation (NPT) and the Power Project Management

Boards (PPMBs) are wholly responsible for the implementation of ADB financed Investment

Program, as agreed jointly between the beneficiary and ADB, and in accordance with Government

and ADB’s policies and procedures. According to Paragraph 5 of the Facility Administration Manual

(FAM), NPT is the investment program’s executing agency and NPMB is the implementing agency of

the two sub-projects.

122. The National Power Transmission Corporation (NPT) is the executing agency of the program

and is responsible to:

(i) Provide overall management and coordination of the sub-project;

(ii) Liaise with PPMBs to carry out all sub-project components;

(iii) Coordinate with ADB to engage resettlement consultant services for the sub-project;

(iv) Support NPMB and SPPMB for updating RPs and/or the REMDPs of the sub-project

components;

(v) Consolidate sub-project progress reports on land acquisition and resettlement

submitted by NPMB and SPPMB for relevant ministries and ADB; and

(vi) Recruit and supervise independent monitoring services resettlement monitoring

Implementation Agency and RP implementation

123. The Power Project Management Boards (PPMBs) are responsible to:

(i) Actively participate in the updating and implementation activities in collaboration with

the concerned organization at the Province, District and Commune levels;

(ii) Liaise with the Province People’s Committee (PPC) to facilitate the establishment of the CARB at the provincial/city and district levels.

(iii) Provide an orientation, to the concerned People’s Committees of the province/city, districts, and communes, the CARB and related groups on the project, its Resettlement

Policy,

(iv) Process flow, and on the specific tasks of these groups relative to the updating and

implementation of the RP;

(v) Take the lead in the public disclosure of the Project RP in coordination with the

concerned People’s Committees, and participate in project information dissemination

and holding of consultation meetings with AHs and other stakeholders;

(vi) Monitor grievances related to the project and calls the attention of concerned

government offices where complaints have remained outstanding beyond prescribed

action periods;

(vii) Design and implement an internal monitoring system that shall capture the overall

progress of the RP updating and implementation; and prepare quarterly progress

reports for submission to NPT and ADB;

(viii) Engage and closely coordinate with an independent monitoring agency that shall

perform a third-party monitoring and evaluation of the RPs and/or REMDPs updating

and implementation

At local level, there are responsibilities divisions among the competent agencies, specifically:

124. Provincial People’s Committee. The main responsibilities of the PPC in each province include: (i) establishment and mobilization of Provincial Compensation and Resettlement Board

(PCARB) (ii) organization and mobilization of all organizations and individuals concerning

compensation, support and resettlement policies and ground clearance according to the land

recovery decisions of competent State bodies; (iii) updating the unit costs to reflect the replacement

cost of sub-project-affected private and public assets; (iv) planning resettlement arrangements, job

change training plans according to their assigned competence; (v) authorizing the DPC to approve

compensation, assistance support to APs; (vi) providing guidance to concerned agencies on the

neutral settlement of citizens’ complaints, denunciations related to compensation, support and resettlement; (vii) authorizing the DPC to apply coercion to cases of deliberately failing to abide by

the State’s land recovery decisions.

125. District People’s Committee. The DPC will be responsible for the following: (i) extension of

support for updating and preparation as well as implementation of the RP or REMDPs; (ii) review

and submit all RP or REMDPs to PPC as endorsed by DCARB; (iii) review the accuracy of and

validate the cost estimates for compensation and assistance; (vi) acquisition of Land Use Rights

Certificates (LURCs) for households and individuals who have lands and/or houses entirely-

recovered; (vii) adjustment of LURCs for households and individuals whose lands and houses have

been partially affected; (viii) responsible for the redressed of complaints and grievance from APs; (ix)

concurrence with the schedule of RP or REMDP implementation and monitor the progress thereon;

and (x) mobilization of the respective DCARB that will appraise the compensation and assistance to

APs; as well as (xi) the provisions of lands to APs.

126. District Compensation and Resettlement Board (DCARB) : The responsibilities of the

DCARB will be the following: (i) organize and carry out resettlement activities in the district on behalf

of the DPC; (ii) assist in the DMS, public consultations and disclosure activities; (iii) review and

submit to DPC proposed compensation, assistance and resettlement alternatives; (iv) assist in the

identification and allocation of land for the APs; (v) along with the CPC, assist NPMB in the timely

delivery of compensation payment and other entitlements to DPs; and (vi) assist in the resolution of

complaints and grievances:

(i) The dissemination of the Public Information Brochure and other publicity material;

ensuring that APs are aware of the LAR process.

(ii) Planning and carrying out the DMS and the disbursement of compensation

payments.

(iii) The identification of severely affected and vulnerable APs and the planning and

implementation of rehabilitation measures for these APs.

(iv) Help identify any resettlement sites and new farming land for DPs who cannot remain

in their present location.

(v) Assist in the resolution of AP grievances.

(vi) Facilitate the work of the agency appointed to undertake the external monitoring.

127. Commune People’s Committee. The CPCs will assist the NPMB and the DCARB in the

following tasks: (i) remind the APs about the compensation plan and the process of delivery, income

restoration plans, relocation strategies and land clearance requirements based on the approved RP

or REMDPs; (ii) maintain the list of eligible APs that will be provided after the DMS has been

conducted; (iii) assign commune officials to extend assistance in the update and/or preparation as

well as the implementation of the RP or REMDPs; (iv) identify replacement lands for the APs; (v)

sign the Agreement Compensation Forms along with the APs; and (vi) assist in the resolution of

grievances and in other related-resettlement activities and concerns.

V.4.2. Time frame and budget arrangements

128. As the work plan and budgets are sufficient in view of the objectives of the project and are

according to the current regulation of Vietnam, based on the approved RP, NPMB registered the

budget plan for the compensation plan on a yearly basis. The compensation/assistance costs are

making out of the counterpart funds of National Power Transmission Corporation (EVNNPT). The

annual budget proposal prepared and submitted by EVNNPT should include all the estimated costs

for compensation and site clearance/preparation.

129. EVNNPT uses the annual budget to prepare the compensation plans. When DARBs approve

the plan with the district level decision, NPMB will report to EVNNPT to disburse the funds.

VI. LESSONS LEARNT FOR THE FUTURE

130. In general, the compensation/assistance of these sub-projects has been good. However, for

smoother project progress of future program, some lessons learn can be drawn as follows:

Project information disclosure should be adequate to make sure that local people understand

about the project and know how to lodge complaint/going through grievance redress

process.

Project Information Book (PIB) for the AHs including all the project information and the

contact information of the persons in charge i.e. NPMB’s and DARBs’ officers are needed according to the donor’s SPS, for the information disclosure and consultation rounds in the sub-project on 500 kV Pho Noi substation, PIB should be made available.

Compensation and resettlement: NPMB works closely with the contractor and keep an

agreements with the contractors to take pledge/penalties to speed up the construction

process and asks the contractor to be more careful/responsible for the damages and

incidents that they may cause (which are sometimes unavoidable) during the construction

i.e. Requesting the contractors to deposit a sum of money to make sure that after

construction, the borrowed surface is returned like before the project.

A restoration program in combination with some on-going social welfare incentives need to

be plan right from the design of the project. Participatory approach is highly recommended

during the designing in this regard.

More community consultation meetings need to be organized to make sure that the project

components and project policies are made known to the local people, especially in DMS,

calculation of compensation/assistance and grievance redress mechanism.

Monitoring during the construction phase should be enhanced to ensure that any negative

impacts on the local people during construction will be measured and compensated in

accordance with the project policies

VII. CONCLUSIONS AND RECOMMENDATIONS

VII.1 CONCLUSIONS

VII.1.1. Gaps in the implementation of the compensation plans of the two sub-projects

131. Resettlement and compensation: DMS, compensation and assistance are strictly complied

with Vietnam's procedures and take account of ADB's safeguards policies.

132. However, there are some gaps in the implementation i.e. Communication before, during and

after the resettlement seem to leave much to be desired. Many AHs displeased about the

communication/information disclosure from the project. The information and compensation policy of the

project were provided mostly verbally during meetings, many of the AH did not remember the details so

the community’s understanding about the project’s AH support policy is limited.

133. DMSs in all sub-projects have been completed at different paces, starting from end of 2013

to July 2015. Most of the AHs reportedly witnessed and involved in the DMS and signed in the DMS

records.

134. Most of the affected land is agriculture production land payment plans with payment unit prices

applied according to the updated State regulations. A replacement cost survey has been conducted by

LIC. It was reportedly the unit prices applied is similar. However, AHs found that different unit prices have

been applied i.e. in the same sub-project31 which makes them unhappy.

135. The payment was reported as very convenient for the local people. Both

compensation/assistance and bonuses were calculated and paid at the same time. Due to the payment

were made during harvesting time, the families were busy ripping the rice so only one spouse could go to

get the compensation and assistance amounts and signed in the receipts. The payments were reportedly

correct and exact with the DMS results. As of the monitoring time, all households in the surveyed

communes received their money except 2 HHs in Luong Tai commune of Van Lam district, Hung Yen

province and 2 HHs in Cam Hung commune of Cam Giang district, Hai Duong province.

136. Assistance: While assistance amount for livelihood stabilization is paid directly to the AHs,

assistance for vocational education and training for the SAHs are transferred to the account of Provincial

Department of Labor, Invalids and Social Affairs (DOLISAs)32 to provide training for those AHs who have

desires to get vocational training for doing a new job. AHs feel very inconvenient with this set up, they

would like to receive the assistance in cash so that they can have more specific and practical for

vocational training plans.

137. Vulnerable AHs: The number of women-headed HHs listed in the URPs were based on the

LURC's holder which mean a female name on the red-book in most of the cases, the women are

living with husband and children/parents/relatives. In such the cases, these AHs do not belong to

women-headed HH category . Survey results show very small number of real women-headed HHs.

There are no poor AHs reported in IMC's survey in the two sub-projects according to 2015 poverty-

line of Vietnam.

138. Severely Affected Households (SAHs) and resettlers: Most of SAHs reported that their

living standards in general seem better than before the project and that they are in to many off-

farming businesses for income aside from farming and husbandry.

139. Resettlers: 1 AH in Bac Ninh2-Pho Noi T/L sub-project and 3 AHs in 500kV Pho Noi S/S

sub-projects having residential land affected. 1 HH in Bac Ninh2-Pho Noi T/L sub-project and 1 AH

in 500kV Pho Noi S/S sub-project accepted cash-for-land compensation. 2AHs in 500kV Pho Noi

S/S sub-project accepted land-for-land compensation. They are waiting for site preparation of one

resettlement site.

140. Grievances: The coordination between competent agencies to address the complaint seems

to be effective. The cases are satisfactorily resolved.

VII.2 RECOMMENDATIONS

141. There seems to have a need to re-evaluation of vulnerable AHs under these two sub-

projects taking into account of their actual status and needs to have assistance by the project, that is

in accordance with the project policy.

142. Project is to consider the request of Viet Hung commune on transfer money for assistance

for vocational training for SAHs back to each AHs so that can joint in the training courses of their

choice with more affordable costs.

143. Vocational training programs for the AHs should be tackling, as being observed by IMC, they

keen on jobs which need immediate skills (masonry, tailoring etc.). The project communes are

recommended to help put together the list of vocational training needs to submit to the Provincial

Departments of Labor, Invalids and Social Affairs to consider.

APPENDIX 6: LEGAL AND POLICY FRAMEWORKS RELATED TO SAFEGUARDS

The legal and policy framework for compensation, resettlement under the Project is defined by the

relevant laws and regulations of the Government of Viet Nam and the ADB’s policies. In case of discrepancies between the Borrower’s laws, regulations, and procedures and ADB's policies and requirements, ADB's policies and requirements will prevail.

Relevant Vietnamese Legislation

The Constitution of the Socialist Republic of Viet Nam (1992) confirms the right of citizens to own

and protect the ownership of a house. In addition, the Government has enacted a number of Laws,

Decrees and regulations that constitute the legal framework for land acquisition, compensation and

resettlement. The principal documents include:

The 2003 Land Law No.13/2003/QH11 passed by the National Assembly dated Nov.26,

2003.

Decree No.197/2004/ND-CP dated Dec.3, 2004 on compensation, assistance,

rehabilitation and resettlement in the event of land recovery by the State.

Decree No. 188/2004/ND-CP dated 16 November 2004 specifying methods for land pricing

and land price frameworks in the event of land recovery by the State.

Decree No.123/2007/ND-CP dated Jul.27, 2007 on adjustment and supplementation of

articles of the Decree No.188/2004/ND-CP dated Nov.16, 2004.

Decree No. 84/2007/ND-CP dated 25 May 2007 amending provisions of land use right

certificates, land acquisition, implementation of land use right, procedures and sequencing

of compensation, assistance and resettlement when State recover land, and solving land

grievances.

regulations on implementation of a number of articles of Land Law.

Decree No. 44/2014/ND- CP dated 15 May 2014 of the Government on regulations on land

prices.

Decree No. 47/2014/ND-CP dated 15 May 2014 of the Government on compensation,

assistance and resettlement when the State acquires land.

Circular No. 36/2014/TT-BTNMT, dated 30 June 2014 detail regulation on method of land

valuating, construction, adjustment of price unut, land valuating and consultation for

defining land price

Circular No. 37/2014/TT-BTNMT, dated 13 August 2014 detail regulation on

compensation, assistance and resettlement in the event of land recovery by the State

Notification No 103/TB-STC dated Octorber 2, 2012 of Hung Yen provincial Department of

Finance of on compensation price unit for tree and domestic animal in Hung Yen.

ADB’s Policy on Involuntary Resettlement

The ADB’s Policy on Involuntary Resettlement aims to avoid or minimize the impacts on people affected by a project, and to provide support and assistance for those who lose their land and

property, as well as for others whose livelihood is affected by the acquisition of land or temporary

construction activities. Resettlement planning has the objectives of providing APs with a standard of

living equal to, if not better than, that which they had before the project.

The three (3) important elements of the policy are (i) compensation for lost assets, livelihood and

income; (ii) assistance for relocation; and (iii) assistance for rehabilitation, to achieve at least the pre-

project level of well-being.

The Operations Manual Section F2/BP notes that the policy treats involuntary resettlement as a

“development opportunity” and allows planners to manage impoverishment risks and turn dispossessed or displaced people into project beneficiaries, particularly the poor and vulnerable,

who may be disproportionately affected by resettlement losses. To this end, the main objectives and

principles of ADB’s policy are as follows:

Involuntary resettlement should be avoided where feasible;

Where population displacement is unavoidable, it should be minimized by exploring all

viable project options;

People unavoidably displaced should be compensated and assisted, so that their

economic and social future would be generally as favorable as it would have been in the

absence of the project;

APs should be informed fully and consulted in resettlement and compensation options;

Existing social and cultural institutions of resettles and their hosts should be supported and

used to the greatest extent possible, and resettles should be integrated economically and

socially into host communities;

The absence of legal title to land by APs will not be a bar to compensation; particular

attention should be paid to households headed by women and other vulnerable groups,

such as indigenous peoples and ethnic minorities, and appropriate assistance provided to

help them improve their living standard;

As far as possible, involuntary resettlement should be conceived and executed as part of

the project; and

The full costs of resettlement and compensation should be included in the presentation of

project costs and benefits.

The basic resettlement principles of the project are:

Involuntary resettlement and loss of land, structures and other assets and incomes will be

avoided or minimized by exploring all viable options.

All APs will be entitled to compensation for all lost and affected assets, incomes and

businesses at replacement cost and provided with rehabilitation measures sufficient to

assist them to improve or at least maintain their pre-project living standards, incomes and

productive capacity.

The APs without legal title to land (non-titled APs) will not be compensated land by land

but they are allowed to use their remained land, which is not affected by the project. In

addition, they are entitled to compensation for their assets on land at replacement cost,

provided they cultivated/occupied the land before the eligibility cut-off date.

Compensation for affected assets will be provided at replacement cost.

In cases where relocation or displacement is required, efforts will be made so that the

existing social and cultural institutions of the people being resettled and host community

will be maintained to the extent possible.

Preparation of resettlement plans (as part of sub-project preparation) and their

implementation will be carried out with participation and consultation of affected persons.

Implementation schedule and budget for resettlement planning (including socio-economic

survey/census) and implementation will be incorporated into each sub-project and the

overall project.

EVN will ensure that civil works contractors are not issued a notice of possession of site for

any section of construction works unless NPMB has (i) satisfactorily completed, in

accordance with the approved relevant resettlement plan for that sub-project,

compensation payment and relocation to new sites, and (ii) ensured that the rehabilitation

assistance is in place and the area required for civil works is free of all encumbrances.

Compensation for vulnerable households including ethnic minorities, female headed-

households, and families with disabled or elderly will be carried out with respect for their

cultural values and specific needs. Appropriate assistance must be provided to help them

improve their socio-economic status.

Harmonization in resettlement policies between GoV and ADB

In general, the Land Law 2003 and Decree No. 197/2004/ND-CP, Decree No. 17/2006/ND-CP,

Decree No. 84/2007/ND-CP and Decree No. 69/2009/ND-CP on amendment of some provisions

guiding implementation of the Land Law 2003 and Decree No. 197/2004/ND-CP, satisfy the most

principles and objectives of the ADB’s Policy on Involuntary Resettlement.

However, due to existence of some gaps between policy of Vietnam and ADB, the Government had

approved a Resettlement policy Framework for the MFF. The table below provides summary of

differences between Resettlement Policies of the Government of Vietnam and the Asian

Development Bank and the Policy proposed for the MFF.

Severely impacted APs losing productive land

Art 19, Decree 47/2014/ND-CP, Stipulates that households directly engaged in agriculture production losing 30% and more of agricultural land, are entitled to support for stabilizing livelihood.

.

The involuntary resettlement impacts of an ADB-supported project are considered significant if 200 or more persons will experience major impacts, which are defined as (i) being physically displaced from housing, or (ii) losing 10% or more of their productive assets (income generating).

Losing 10% or more of the household’s assets shall be considered as threshold.

APs without LURC Article 75, Land Law 2013, promulgating regulations on eligibility for land compensation when the State acquires land for the purposes of national defense, security, socio-economic development in the national and public interests.

Article 3, of Decree No. 47/2014/ND – CP stipulates that in case those who own land acquired for building the State structures and meet conditions on land ownership rights as stipulated in provisions of Article 76, Land Law 2014 will be eligible for compensation for remaining investment costs on land. Unless otherwise, the People’s Committees of the provinces and cities directly under the Central authority shall be responsible for considering and solving for specific case.

Art 1, 2, 3, 4 , Article 82, Land Law 2013 stipulate cases ineligible for compensation on land when the State acquires land.

Art 1, 2 and 3, Article 92, Land Law 2013 stipulate cases ineligible for compensation for on-land assets when the State acquires land.

Those APs without legal title to land will be included in consultations. Ensure that APs without titles to land or any recognizable legal rights to land are eligible for resettlement assistance and compensation for loss of non-land assets including dwellings, structures and other improvements to land such as crops, irrigation, at full replacement cost.

Safeguards cover involuntary restrictions on land use or on access to legally designated parks and protected areas. Covers temporary and partial losses.

Project affected people, without legal or recognizable legal claims to land acquired, will be equally entitled to participation in consultations and project benefit schemes where possible, and be compensated for their lost non-land assets such as dwellings and structures occupied before cut-off date. They will be entitled to resettlement assistance and other compensation and social support to assist them to improve or at least restore their pre-project living standards and income levels.

Compensation for lost land

Article 3, Art 6, Decree No. 47/2014/ND – CP: The compensation rates for land shall be determined by the PPC in accordance with the Government regulations for the type of land which has been used for at the time of land acquisition.

Art 74, Land Law 2013: The compensation must be made in the form of allocating new land with the same land use purpose with the recovered land. If there is no land available for compensation, the land users shall receive compensation in money calculated according to the specific land price of the type of recovered land which is decided by the provincial-level People’s Committee at the time of the recovery decision.

Land based livelihoods restoration based upon land based strategies where possible, or cash compensation at replacement value provided loss of land does not undermine livelihoods for those with legal rights to land.. Provide adequate and appropriate replacement land. If land not available non-land based options built around opportunities for employment, self-employment should be provided in addition to cash compensation for land and non-land assets lost.

Where appropriate land-based compensation is not viable replacement cost surveys have been carried out and will be carried out by the project staff to ensure that project rates for all categories of loss will be equivalent to replacement cost at current market value, to be updated at the time of compensation and combined with other assistance and livelihood restoration measures to ensure full restoration and improvements. Provided AP has legal or recognizable claim, compensation is for full amount of land acquired.

Differences between compensation rates and market rates

Article 113, Land Law 2013, Land price frames The Government shall promulgate land price frames once every 5 years for each type of land and for each region. During the implementation of land price frames, if the popular price in the market increases 20% or more over the maximum price or reduces 20% or more below the minimum price prescribed in land price frames, the Government shall adjust land price frames accordingly.

Provide physically and economically APs with needed assistance including i) if there is relocation, secured tenure to relocation land, better housing at resettlement sites with comparable access to employment and production opportunities, integration of APs economically and socially into host communities, ii) transitional support and development assistance such as land development, credit facilities, training or employment opportunities, and, iii) civil infrastructure as required.

Physically displaced (relocated) APs are to receive relocation assistance, secured tenure to relocated land, with comparable access to production and employment opportunities, and civic infrastructure and community services as required, transitional support and development assistance such as land development, credit facilities, training or employment opportunities.

Compensation for structures

Art 89, Land Law 2013 – Compensation for House, Structures on Acquired Land.

Clause (1) – For houses and land-attached residential construction facilities of households, individuals or overseas Vietnamese which are wholly or partially dismantled upon land recovery by the State while the remaining part does not meet technical standards as prescribed by law, their owners are entitled to

Rate of compensation for acquired housing, land and other assets will be calculated at full replacement costs, based upon: i) fair market value, ii) transaction costs, iii) interest accrued, iv) transitional and restoration costs, v) other applicable payments.

compensation equivalent to the value of new houses and construction facilities with equivalent technical standards.

If the remaining part of the houses and construction facilities still meets the technical standards as prescribed by law, the compensation must be made based on the actual damage.

Art 92, Land Law 2014 Cases ineligible for compensation for land-attached assets upon land recovery by the State Cases of land recovery due to termination of land use in accordance with law, voluntary return of land or risks threatening human life

Clause (1) Organizations to which land is allocated by the State without land use levy, or organizations to which land is allocated with land use levy and the land use levy is originated from the state budget, are dissolved, go bankrupt, move to another place, or have lower or no land use demand; land users which lease land with annual rental payment are dissolved, go bankrupt, move to another place, or have lower or no land use demand

Clause (2) Land-attached assets which are illegally created or created after the notice of land recovery by a competent state agency takes effect.

Clause (3) Technical infrastructure, social infrastructure and other construction facilities which are no longer in use.

Compensation for registered businesses

Article 19.4b of Decree No. 47/2014/ND-CP stipulates that economic organizations, households and individuals engaged in production and business and foreign-invested enterprises, that have to stop production and business, are entitled to support in

Grievance redress procedure in accordance with the current law

The grievance redress procedure is based on the Law on Denunciation No 02/2011/QH13 including 4

following steps:

Step 1: AH sends/forwards directly his/her complaint (written or verbal) to the commune level. These

complaint will be discussed in one informal meeting between AH and Communal PC. The Communal PC

is obligated to redress such complaint within 15 days to 45 days since the complaint is logged.

Step 2: If the two parties cannot reach to an agreement or no solution is drawn, or the communal PC fails

to respond, AH can forward his/her complaint to the district level. Within a month, AH may prepare a

formal written complaint and supporting documents/evidences and send to the district CARB. The district

CARB will give out the final decision from 30 to 70 days since the AH submit the complaint

Step 3: If AH does not satisfied with the decision from district CARB or in the absence of any response,

AH can appeal to the Provincial Peoples Committee. PPC will review and issue a decision on the appeal

within 30-45 days from the day received.

Step 4: After 30 days, If AH does not satisfied with the decision of PPC or in the absence of any response

within the stipulated time, AH may submit his/her case to the district court.
