Subject:-Award of Annual Rate Contract for the supply of Chemicals/ Glassware (s)/ Plastic-ware (s)/ Filter Paper (s)/ Liquid Handling System etc. and for outsourcing of services i.e. Oligo/ Probe synthesis, Cloning, Sequencing, Genotyping, Microarray, Antibody production and others during the financial year 2015-16-regarding.

-----------------Dear Sir,

With reference to your tender opened on 27-6-2015 on the subject cited above, the Director, CIRC, Meerut has been pleased to award the Annual Rate Contract for the supply of Chemicals/ Glassware(s)/ Plastic-ware(s)/ Filter Paper(s)/ Liquid Handling System etc. and for outsourcing of services i.e. Oligo/Probe synthesis, Cloning, Sequencing, Genotyping, Microarray, Antibody production and others (as mentioned in the attached list) during the financial year 2015-16 with the following terms and conditions:-

1. The supply of material & billing will be made by the firm directly or through their authorized dealer.2. There will be a discount as given in the attached list on the price list mentioned in the catalogue. The

Sales tax/VAT and other Govt. levies will be paid extra as applicable. The Institute will not issue C/D form. Road permit and Excise Duty and Custom Duty exemption certificate will be provided by this Institute, if required. The ICAR-CIRC is a Research Institutes under the control of ICAR, New Delhi (Ministry of Agriculture, Govt. of India) is exempted from Excise and Customs Duties on Research Consumables, vide Notification No.10/97-CE dated 01.03.1997 (as amended by 16/07-CE) and Notification No. 51/96-Customs respectively.

3. Small equipment, apparatus, Gel electrophoresis apparatus, single channel and multi-channel micropipettes upto cost of Rs. 15000/- (Rupees fifteen thousand only) is covered under Annual Rate contract.

4. That the freight, insurance charges, if any will not be paid by the purchaser. Similarly shortage, pilferage in transit will be sole responsibility of the supplier and the same will be sole responsibility of the supplier within 15 days on receipt of goods by the purchaser to make good the loss caused on this account.

5. That the delivery/supply will be made on F.O.R. basis to CIRC, Store, Meerut.6. The items manufactured by one firm and marketed by the other firm will not be covered under this

Annual Rate contract, even if these are mentioned/shown in the catalogue of the rate contracted firm.7. In case of perishable store, the rejected one should be replaced free of cost by the firm to the Institute.

The packing of the goods should be as is required to prevent the material from damage of deterioration during transit to their final destination.

8. That the material should be supplied in one lot as the piecemeal/short supply will not be accepted.

9. The supply of material will have to be completed within 30 days from the date of issue of Purchase order or as mentioned in Purchase Order strictly in conformity of specification and grade. In case of any delay in executing the contract, the supplier/firm shall promptly inform the Institute in writing the fact of delay & duration of supply well before the expiry of delivery period. The material supplied after the due date will be at their own risk and failure to supply/short supply the ordered goods within

stipulated period may cause for forfeiture of the security deposits. Moreover, if the firm fails to deliver the goods within the stipulated period for reasons other than circumstances beyond suppliers control and the Institute extends the delivery period, the Institute will also deduct from the contract price, as liquidated damages at the rate of 0.5% per week subject to a maximum of 10%. Once the maximum is reached, the Institute may consider termination of the P.O. if the same has not been terminated already. However in certain case & genuine situation extension may be granted if the competent authority is satisfied and the request is received in the office within the stipulated period of supply.

10. No revision in rate on higher side will be accepted during the Annual Rate Contract period i.e. financial year 2015-16. The price list already submitted / received in the office will be treated as final.11. The dispute arising between firm/manufacturer and the Institute relating to any matter with the contract

& the parties fails to resolves the dispute/difference by mutual discussion, the same will be referred to the Secretary, ICAR, Krishi Bhavan, New Delhi for which sole arbitration and decision thereof will be binding upon both the parties i.e. manufacturer/supplier and purchaser.

12. Supply should be made in full against the order and shortage will be procured on the risk and cost of the supplier.

13. Other than chemicals the cost of the material of each item of Glassware(s)/ Plastic-ware(s) /Filter Paper(s)/ Liquid Handling System etc. and for outsourcing of services i.e. Oligo/ Probe synthesis, Cloning, Sequencing, Genotyping, Microarray, Antibody production and others excluding discount may not exceed to Rs.15,000/-(Rupees Fifteen thousand only).

14. The small instrument/equipment listed in the price catalogue of the firm upto the total cost of Rs. 15000/- (Rupees Fifteen thousand only) (inclusive of rebate and taxes, if any) will be purchased with the approval of the Competent Authority only subject to approved in projects/plan-EFC ect.

15. A copy of this letter may be returned to this office, duly signed in token of acceptance of the rate contract for our record as an agreement by return of Speed post/Registered post immediately, along with acceptance of Annual Rate Contract. The firm should also furnish a certificate to effect that they are not giving more discount to any other organization over and above accepted by the Institute and that the firm is only applicable throughout India. If, it is found that the firm has offered more discount to other Deptt./Organization, the recovery as deemed fit will be made from the firm as well as further action will be taken as per rules. The name of your authorized dealer, if any, may also be intimated.

16. Sufficient copies of Price lists may be sent to all the Incharges of the Institutes to enable them to process procurement of these items required by them.

17. Any dispute related to the present Annual Rate Contract, if any arises shall be subject to Meerut jurisdiction.

18. The material to be supplied should be from the latest batch of production with the maximum life period.

19. All other terms and conditions of the standard biding document of purchaser will remain unchanged. 20. The Director, CIRC, Meerut reserves the right to cancel the Annual Rate Contract at any time without

assigning any reason.
