As the winter season comes to a close, and our snow birds head north, we wish you a wonderful, safe, and healthy summer! Please be assured that we will still be available remotely to conduct all required Association business. The purpose of this mailing is to consider a request from a unit owner to make a material change to a common element (an additional parking pad/driveway extension). In the past, unit owners were asked to gather and submit 2/3 rds of the voting members’ written signatures, along with a drawing or photo depicting the change, to the Board of Directors for final approval. In doing our due diligence, we reviewed our governing documents but could not find any reference to this approval process. We then reached out to our attorney for his legal opinion. He could not find any authority in our governing documents for members to act by written agreement; therefore, it is his opinion that absent that authority, two-thirds (2/3 rds ) membership approval must be obtained at a duly-noticed membership meeting which is the purpose of this communication. Absent any formal process or guidelines for unit owners to follow when submitting requests to make alterations or improvements to a unit that are to be maintained by the Association, i.e. windows, doors, etc. or to make material alterations and improvements of common elements, the Board appointed an Architectural Review Committee (ARC) as its advisor to assist in reviewing these types of requests. The ARC will insure that these requests do not impact neighboring unit owners nor our underlying infrastructure, i.e. Irrigation system, drainage, power, water, etc. The ARC was tasked with establishing a process and guidelines for architectural changes to insure that all requests are handled in a consistent manner that is fair to all unit owners. The following request is the first to be reviewed and approved by the ARC and the Board, requiring a member vote at a duly noticed Special Member Meeting. MEMBER REQUEST Attached please find the relevant documents in support of a request from Grainger Goodman and Darlene Pappas at Unit #20/749 Vivienda North Court to pour a driveway pad/extension. The Unit Owner has met all of the ARC requirements. Unit 749 Driveway pad Explanation There is no encroachment on unit boundary, no impact to any utility, drainage, water meter, water line, sewer line, electric line, and no impact to neighbor unit. 2 sprinkler heads to be moved, I talked to Jeff of Prestigious Thursday April 26th. and he has agreed to move the sprinkler heads to the other side of the pad, this includes wrapping the supply pipe around the pad for maintance, to be done when driveway pad work is started. Please see diagram sheet for a visual. There is no impact to water meter or water line. I have been to the Sarasota water department and administration, they have said no impact to meter or water line and no need to move anything. Connect driveway pad to existing driveway at unit 749, #20, Concrete to be 4” thick and hold up 4000PSI. The pad will use 6x6 carbon fiber mesh and rebar. Rebar will be used to connect the pad to the current driveway. Project cost $1200.00 Masonary work to be done bu Tibor masonary whom has install pads in this association, Tibor Toth 1171 Graham Rd.
