I, ROBERT GOTT, Director (Marine Resources), acting under Rule 9 of the Fisheries (Abalone) Rules 2009, and delegated authority under Section 20(1) of the Living Marine Resources Management Act 1995, hereby determine that the dates of the closed season for the commercial abalone fishery for the taking of blacklip abalone (Haliotis rubra) for commercial purposes from State waters off the east coast of Tasmania are as follows:–

from 1 January 2011 to 31 March 2011 inclusive;

where State waters off the east coast of Tasmania is defined to mean: State waters off the east coast of Tasmania bounded in the north by the line of latitude 40º 59' 42" South at Eddystone

Point and bounded in the west by the line of longitude 146º 52' 15" East at Whale Head.

Public notice—Making of the Fisheries (Processing and Handling) Rules 2010

I, ROBERT GOTT, Director (Marine Resources) of the Department of Primary Industries, Parks, Water and Environment (DPIPWE) in accordance with section 33 of the Living Marine Resources Management Act 1995 and pursuant to the delegated authority under section 20(1) of that Act, hereby notify that—

1. the Fisheries Processing and Handling Rules 2001, that regulate the handling and processing of the quota managed abalone, rock lobster and giant crab fisheries, expire on 31 December 2010.

2. replacement rules to regulate the handling and processing of the quota managed abalone, rock lobster and giant crab fisheries are to be made; and

3. the proposed rules are called the Fisheries (Processing and Handling) Rules 2010; and

4. the proposed Fisheries (Processing and Handling) Rules 2010 will take effect on 01 January 2011.

Fisheries (Biosecurity) Order (No. 4) 2010

I MAKE the following order under section 270 of the Living Marine Resources Management Act 1995 issuing directions aimed at preventing the introduction or spread in State waters of a harmful disease.

1. Short title

This order may be cited as the Fisheries (Biosecurity) Order (No. 4) 2010.

2. Specification

This order is made in respect of the disease Abalone Viral Ganglioneuritis and is aimed at preventing the introduction or spread of that disease in State waters.

3. Commencement

This order takes effect on the day it is published in the Gazette.

4. Directions issued

That the holder of a marine farming licence authorised to farm abalone, and where that activity is undertaken above the high water mark, must –

(a) by no later than 1 March 2011, develop and furnish to the Secretary a plan (“Farmed Abalone Escape Prevention Plan”) detailing measures for preventing the escape of abalone from the premises used for abalone farming under the authority of the marine farming licence; and

(b) obtain the Secretary’s approval to that Farmed Abalone Escape Prevention Plan, if necessary revising it as often and expeditiously as the Secretary may reasonably require for the purposes of conferring that approval;

(c) by no later than 1 July 2011, furnish the Secretary with such guarantees and evidence as he or she, by notice to the licensee, may reasonably require to demonstrate that a Farmed Abalone Escape Prevention Plan approved by the Secretary under 4(b) above has been implemented.

5. Interpretation

(1) In this order –

“abalone” means fish of the genus Haliotis;

“introduction” includes re-introduction.

(2) Expressions in this order have the same meaning as in the Living Marine Resources Management Act 1995.

INFORMATION

This order seeks to prevent the introduction or spread of the disease abalone viral ganglioneuritis.

A Farmed Abalone Escape Prevention Plan should be farm-specific and describe infrastructure, operating practices and monitoring as part of the routine management of the marine farm to which it relates.

Specifically, such a plan might include measures for and relating to the following:

• the inspection of, and removal of abalone from, races, pipes, channels, sumps, ponds or any other water holding or transmission infrastructure between fish holding tanks and the marine farm outfall;

• effective physical barriers to prevent fish from escaping the marine farm into State waters;

• the maintenance of inspection logs on escape prevention measures;

• holding juvenile stock in tanks furthest from races, pipes, channels, sumps, or ponds, or any other water holding or transmission infrastructure between fish holding tanks and the marine farm outfall;

• the inspection of fish holding tanks to keep stock away from the immediate vicinity of fish holding tank outlet pipes.

Prohibition oF entry into a saFety Zone- craigow 1 (t/47P)

I, MICHAEL LEONARD, Director of Mines, Mineral Resources Tasmania, Department of Infrastructure, Energy and Resources of Tasmania by instrument of delegation dated 3rd March 2009, pursuant to section 616 of the above Act, hereby prohibit all vessels other than vessels under the registered holders of Offshore Exploration Licence T/47P, vessels operated by authorised persons who are exercising powers under Division 1 of Part 6.6 section 615(1) of the above Act from entering or remaining in the area of the safety zone without the consent in writing of the Designated Authority.

This safety zone extends to a distance of five hundred metres, measured from each point of the outer edge of the drilling vessel known as the Kan Tan IV semi-submersible mobile offshore drilling unit and the area or areas within a distance of 500 metres measured from each point of the outer edge of any anchor buoys or other equipment deployed from that drilling unit, while the vessel is engaged in operations associated with drilling of the Craigow-1 well situated at or about the point of Latitude 39º 35' 31.74" South (5 616 629 mN*), Longitude 145° 38' 34.52" East (383 472 mE*) over the period from 15 December 2010 until 15 March 2011.

*note: the above are GDA94 coordinates

Where an unauthorised vessel enters or remains in the safety zone specified in contravention of this instrument, the owner and the person in command or in charge of the vessel are each guilty of an offence against section 616 of the Act and are liable, upon conviction, to imprisonment for a term:

• not exceeding 15 years if the breach is determined as intentional;

• not exceeding 12.5 years if the breach is determined as recklessness;

• not exceeding 10 years if the breach is determined as negligence; or

• not exceeding 5 years if the breach is determined as an offence of strict liability.

(1) Proclamation under section 2 of the Dangerous Goods (Road and Rail Transport) Act 2010

This proclamation fixes 1 January 2011 as the day on which the provisions of the Dangerous Goods (Road and Rail Transport) Act 2010 commence and, as a consequence, the Dangerous Goods (Road and Rail Transport) Regulations 2010 take effect.

(2) Dangerous Goods (Road and Rail Transport) Regulations 2010

These regulations provide for the following for the purposes of transporting dangerous goods under the Dangerous Goods (Road and Rail Transport) Act 2010:

(d) the safety equipment and safety standards required for vehicles and equipment;(e) the emergency procedures;(f) exemptions and administrative determinations and approvals given, and the review of such exemptions and

administrative determinations and approvals;(g) transitional and other miscellaneous matters.

(3) Land Tax Regulations 2010These regulations –

(a) make provision in respect of –(i) amendments of assessments under the Land and Income Taxation Act 1910; and(ii) Repatriation Health Cards; and

(b) prescribe certain fees for matters under the Land Tax Act 2000; and(c) are made consequentially on the repeal of the Land Tax Regulations 2000 under section 11 of the Subordinate Legislation

Act 1992.

(4) Proclamation under section 2 of the Occupational Licensing Act 2005This proclamation fixes 15 December 2010 as the day on which the remaining provisions of the Occupational Licensing Act 2005 commence.

(5) Occupational Licensing (Electrical Work) Amendment Regulations 2010These regulations amend the Occupational Licensing (Electrical Work) Regulations 2008 by –

(a) amending which jurisdictions are reciprocating jurisdictions; and(b) clarifying when certain electrical work may be lawfully energised; and(c) adding two new classifications for electrical work; and(d) adding, removing and increasing fees payable in certain circumstances; and(e) increasing and reducing certain infringement notice penalties.

(6) Occupational Licensing (Gas-fitting Work) Regulations 2010These regulations provide, in relation to gas-fitting work and automotive gas-fitting work and for the purposes of the Occupational Licensing Act 2005, for –

(a) licensing procedures and related matters; and(b) rectification processes for defective work; and(c) infringement notice penalties, demerit points and other penalties; and(d) licensing and other fees; and(e) other miscellaneous matters.

(7) Occupational Licensing (Plumbing Work) Regulations 2010These regulations provide, in relation to plumbing work and for the purposes the Occupational Licensing Act 2005, for –

(a) licensing procedures and related matters; and(b) rectification processes for defective work; and(c) infringement notice offences, demerit points and other penalties; and(d) licensing and other fees; and(e) other miscellaneous matters.

(8) Plumbers and Gas-fitters Registration (Rescission) Regulations 2010

These regulations rescind the Plumbers and Gas-fitters Registration Regulations 2009 consequent on the commencement of the Occupational Licensing (Plumbing Work) Regulations 2010 and the Occupational Licensing (Gas-fitting Work) Regulations 2010.

(9) Passenger Transport Amendment (community Transport) Regulations 2010

These regulations amend the Passenger Transport Regulations 2000 by extending, until 1 July 2012, the period of the exemption from registration under the Passenger Transport Act 1997 for small passenger vehicles that are used for a community transport service.

(10) Taxation Administration Regulations 2010

These regulations –

(a) prescribe certain persons to whom a tax officer may disclose information relating to the administration of a taxation law; and

(b) make provision in relation to conditions of an approval given under section 49 of the Taxation Administration Act 1997; and

(c) are made consequentially on the repeal of the Taxation Administration Regulations 2000 under section 11 of the Subordinate Legislation Act 1992.

(11) Vehicle and Traffic (Driver Licensing and Vehicle Registration) Amendment (community Transport) Regulations 2010

These regulations amend the Vehicle and Traffic (Driver Licensing and Vehicle Registration) Regulations 2010 by extending, until 1 July 2012, the period of the exemption for certain drivers providing community transport services from the requirement to hold an ancillary certificate under the Vehicle and Traffic Act 1999.

(12) Victims of crime Assistance Regulations 2010

These regulations –

(a) prescribe the maximum amount of an award of compensation under the Victims of crime Assistance Act 1976 and the information to be included in an application for such an award; and

(b) are made consequentially on the repeal of the Victims of crime Assistance Regulations 2000 under section 11 of the Subordinate Legislation Act 1992.
