Post Conviction Relief Act—Voluntary Guilty Plea—Risk of Deportation—Ineffective Assistance of Counsel—Waiver.

The appellant entered a guilty plea to aggravated assault, a felony of the second degree. The appellant subsequently filed a Post Conviction Relief Act appeal, and alleged that his counsel was ineffective because counsel failed to advise the appellant that his guilty plea would definitively result in his deportation. The Court noted that counsel is required to advise a defendant that a guilty plea can result in the risk of deportation, not the cer-tainty of deportation. Additionally, the Court concluded that the appellant’s counsel was effective, in that counsel explicitly warned the appellant that there could be immigration consequences as a result of his guilty plea, and recommended that the appellant consult with an immigration law attorney. The Court further concluded that the appellant’s failure to adhere to his counsel’s advice to consult with an immigration law attorney constituted a waiver of an ineffective assistance of counsel claim.

steinberG, J., April 26, 2017. The appellant in this Post Con-viction Relief Act (hereinafter PCRA) appeal is seeking to extend Padilla v. Kentucky, 559 U.S. 356 (2010) beyond its current borders. It is alleged that guilty plea counsel, who advised the appellant to consult with immigration counsel prior to sentencing, was ineffec-tive in her representation because she failed to tell the appellant that his guilty plea would definitively result in his deportation.

The appellant, who was a lawful permanent resident, entered a guilty plea to aggravated assault, a felony of the second degree, on February 16, 2016. He was charged with stabbing the victim in both the abdomen, and “a superficial graze across [the] back.”1 The victim, Cesar Aguero, underwent two (2) surgeries, and “there was a serious potential for life-threatening injuries given where [he] was nicked and the damage to the organs that were involved.”2

A written and oral colloquy were part of the appellant’s guilty plea. The written colloquy, which the appellant acknowledged he understood, was in both Spanish and English. The appellant had a rudimentary knowledge of English, but all of the proceedings were conducted with the assistance of a court interpreter. The written colloquy included the following questions and responses:

On April 26, 2016, the appellant was sentenced to not less than twelve (12) months less one day nor more than twenty-four (24) months less one day, to be followed by a consecutive period of thirty-six (36) months’ probation. The sentencing had been originally scheduled for March 21, 2016, but guilty plea counsel requested a continuance so that the appellant could consult with immigration counsel.3

The presentence report included comments from Deporta-tion Officer Andrew Daniels of the United States Department of Homeland Security, specifically that although the appellant was “now a lawful permanent resident, he is still a citizen of the Do-minican Republic.” Agent Daniels also reported that the appellant is “deportable, and his immigration status will be reviewed after [appellant] is sentenced for his present offense.”4

On the date of sentencing, counsel outlined her efforts to make sure that appellant was fully aware of the potential immigra-tion consequences that he faced. She had provided the name of an immigration lawyer to the appellant, and also participated in ad-ditional communications with appellant’s father regarding appel-lant’s immigration status. The appellant was told by counsel that he “could be deported based upon a guilty plea to these charges.”5

This Court also read to the appellant the comments of Agent Daniels from the PSI.6 He was given the option of proceeding to sentencing or requesting the opportunity to withdraw his guilty plea and proceed to trial. The appellant voluntarily decided to proceed with his sentencing.

On October 31, 2016, PCRA counsel filed a “Motion for Post-Conviction [sic] Collateral Relief.” The motion alleges that appellant’s guilty plea made him subject to “automatic deporta-tion.”7 As a result, it is alleged that guilty plea counsel was ineffec-tive by not advising him that his deportation was assured.

A PCRA hearing was held on January 17, 2017. Counsel, Maureen Coggins, the appellant, Jhonatin Nina, his father, Santo Nina, and an expert in immigration law all testified. Following the completion of the testimony, the PCRA petition was dismissed.

A Notice of Appeal was filed on February 16, 2017. Pursuant to Pa. R.A.P. 1925(b), counsel filed a timely “Defendant’s State-ment of Matters Complained of On Appeal Pursuant to Pa. R.A.P. 1925(b).” It is alleged that “guilty plea counsel failed to advise defendant that his plea of guilty to this offense made him subject to mandatory deportation. ... ”8

DISCUSSION

The appellant asserts that he is entitled to PCRA relief, even though he essentially ignored guilty plea counsel’s advice to seek immigration counsel. Instead, he relied upon the information his father learned from speaking by phone to an immigration lawyer. He also contends that despite trial counsel’s best effort to alert him to the precariousness of his immigration status, her semantics made her representation ineffective.

In Padilla v. Kentucky, 559 U.S. 356 (2010), it was held that counsel must inform a client whether their plea carries the risk of deportation. Id. at 374. “The severity of deportation—‘the equiva-lent of banishment or exile’—underscores how critical it is for

counsel to inform [a] noncitizen client [about the] risk of deporta-tion.” Id. at 373. See also, Commonwealth v. McDermitt, 66 A.3d 810, 814 (Pa. Super. 2013) (“ ... Padilla requires counsel to inform a defendant as to [the] risk of deportation, not as to its certainty”).

It has long been held that a defendant is entitled to the ef-fective assistance of counsel during the guilty plea process, as well as at trial. Padilla, supra at 374; Hill v. Lockhart, 474 U.S. 52 (1985); Commonwealth v. Hickman, 799 A.2d 136, 141 (Pa. Super. 2002). See also, Commonwealth v. Patterson, 143 A.3d 394 (Pa. Super. 2016). “Allegations of ineffectiveness in connection with the entry of a guilty plea will serve as a basis for relief only if the ineffective-ness caused the defendant to enter an involuntary or unknowing plea. ... Where the defendant enters his plea on the advice of counsel, ‘the voluntariness of the plea depends [upon] whether counsel’s advice “was within the range of competence demanded of attorneys in criminal cases.” ’ ” Hickman, supra (internal citations omitted); see also, Commonwealth v. Escobar, 70 A.3d 838, 841 (Pa. Super. 2013); Commonwealth v. Wah, 42 A.3d 335, 338-39 (Pa. Super. 2012). It was not until the Supreme Court’s decision in Padilla, however, that it was universally held that counsel had a responsibility to inform a noncitizen client that his guilty plea car-ried the risk of deportation. The failure to do so would be consid-ered representation that fell outside the range of competence demanded of attorneys in criminal cases. Escobar, supra at 841-42; Wah, supra at 339.

The appellant would now require counsel to advise a client not of just the “risk of deportation,” but the certainty of deporta-tion. This position has been consistently rejected. See Escobar, supra at 840; McDermitt, supra. Padilla also involved counsel who told his client “not to worry” about his immigration status. Here, as in Wah, “counsel ... explicitly warned appellant that there could be immigration consequences related to his guilty plea and recom-mended that he consult with an attorney versed in immigration law.” Wah, supra at 340.

Furthermore, during the PCRA hearing, the appellant testi-fied that he did not follow counsel’s advice and speak with an im-migration lawyer. Instead, he abdicated that responsibility to his

father.9 His father then told him that “everything was going to be fine, that when I leave I was going to be given a detainer, and then I’ll have to come back to court.”10

He also testified that counsel instructed him that he would “have to speak to an attorney because she didn’t know about those type[s] of cases.”11 The appellant’s father, Santo Nina, confirmed that counsel suggested that immigration counsel become involved, and so he spoke with an attorney by telephone.12 The immigration attorney told him his son’s removal was dependent on “the gravity of the case.”13

Counsel testified at the PCRA hearing that she was alerted to the immigration issues early in her representation of the appel-lant.14 She was aware that appellant was born in the Dominican Republic, and that the seriousness of the charges would “implicate immigration.”15 As a result, even prior to the guilty plea, she recom-mended the name of an immigration lawyer who practiced in Philadelphia.16

Counsel also confirmed that she told the appellant that he needed immigration counsel because she was unfamiliar with the intricacies of immigration law.17 Due to the nature of the charge and potential length of appellant’s sentence, she knew it was a “deportable offense.”18 “It’s a question in this case of when you’re going to get deported.”19

She did not tell the appellant that “he will one hundred per-cent be deported,” but did tell him that there was a “possibility”

that he would be deported.20 She also explained to the appellant that it was a “bad sign” that immigration authorities had already visited him.21 The appellant, with that knowledge, still decided to proceed with the sentencing.

Guilty plea counsel acted within the range of professionally competent assistance when she recommended that the appellant seek the advice of immigration counsel, and alerted him to his perilous immigration status. She did not misadvise him, as counsel did in Padilla.

Finally, the appellant’s decision to essentially disregard coun-sel’s advice to meaningfully consult with immigration counsel constitutes a waiver of any ineffective assistance of counsel claims.

For all the foregoing reasons, the denial of the appellant’s PCRA petition should be affirmed.

ORDER

AND NOW, this 26th day of April, 2017, it appearing that the appellant filed a Notice of Appeal in the above-captioned mat-ter on February 16, 2017; it further appearing that the appellant filed a Concise Statement of Matters Complained of On Appeal pursuant to Pa.R.A.P. 1925(b) on March 20, 2017; it further ap-pearing that our Opinion satisfies the requirements of Pa.R.A.P. 1925(a);
