Wearegoingtohavetofightforthem. This is our place in history – this
moment,atthistime! I believe that we all can make adifference,andyoudonothavetogiveupyourentirelifetobeanactivist. Evenjustasmallact,likevolunteeringtohelpsomeyoungkidslearnaboutyourcraft,isactivism.MakingsomephonecallstoCongressorlocalpoliticianstoletthemknowthatyouopposetheSoCalledRighttoWorkefforts(norights,andnowork!),andthatyousupportthePrevailingWagerequirements,isactivism. Evenjustcorrectingsomeonewhenyouhear,“Unionworkersdon’treallyhavetoworkhard,andtheygetallthosedaysoffpaid,”isactivism.Don’tletthosekindsofthoughtsbeput intootherfolk’sminds.
Letthemknowthatyouworkyourbuttoff,anddon’tgetpaidwhenyoudon’twork. Thereisnobodytodefendus,sowemustdefendourselves. I am coming up on two years thissummerasFieldRepforLocal7,andIhavegottentoknowalotofmymembersbetter,and also gotten to know a few moremembersfromotherLocals. Iwouldjustliketosaythatithasnotalwaysbeeneasy,butithasbeenaprivilegetoserveyousofar. Thatiswhatweareherefor,toservethemembership.Imightnotalwaysbeabletosaywhatyouwanttohear,butknowthatinallofmydecisionsItrytokeepinmindwhatwillbestservethemembership.

Who is theUnion? The Ohio-Ken-tucky Adminis-trative District Council is theadministrativearmoftheInter-national Union
ofBricklayersandAlliedCraftworkers,representing19localunionsandover6,000members throughout its two-statejurisdiction. The OH-KY ADC represents itsdedicatedmembershipintheCollectiveBargaining process and provideseducationandupgradetrainingto itsapprenticesand journeymenthroughJointApprenticeshipTrainingCommitteesand partnerships with signatorycontractors. SoistheDirectoroftheOH-KYADCtheUnion? Am I, the Secretary-Treasurer,theUnion? AretheFieldRepresentativesthatdo the day-to-day representation ofthemembersintheirLocaljurisdictiontheunion? I’mgoingtoanswerthosequestionsbysayingthatthe6,000membersthatbelong to this organization are theUnion,andtheonlytrueUnion.TheonlyreasonwejoinaUnionistocombinetogether to have the strength ofnumbers.Thisstrengthgivesustheabilitytonegotiatewiththeemployersthatyouworkfortogainbetterwages,benefitsandworkingconditions. Prior to labor-friendlypoliticianstakingtheWhiteHouse in1933,thecountry had been in the GreatDepression. President Franklin D.RooseveltwasinstrumentalingettingCongresstopasstheNewDeal thatfocusedonthethreeRs:Relieffortheunemployedandpoor,Recoveryoftheeconomytonormallevels,andReformof thefinancialsystemtopreventarepeatDepression. In1935,theWagnerAct(NationalLabor Relations Act of 1935) waspassed. Itguaranteedbasicrightsofprivatesectoremployeestoorganizeintotradeunions,engageincollectivebargaining for better terms and
conditionsatwork,andtakecollectiveaction-includingtherighttostrike-ifnecessary. Uniongrowthwasboomingaftertheselabor-friendlylawswerepassed. Sowhathappened? Well,IwilltellyouthatconservativepoliticiansmademajorgainsinCongressin1938,andby1942-43,reliefprogramswere shut down. This was only thebeginningofastrategizedeffortbyanti-labor businesses and their lackeypolitical friends to halt the growthandpoweroftheeverydayworkingmanandwoman. Soherewearetoday.Anti-laborconservatives are continuing theireffortstocompletelyendthelittlepowertheworkingpeopleofthiscountryhave.Theattacktheyareusing istheveryrightthatwasgiventothepeople,nottheunions,ifyougobacktotheoriginalquestionofwhoistheUnion. YoucanseethattheWagnerActspecifically gave private sectorEMPLOYEEStherighttoorganizeintounionsformutualaidandprotection.Whatcamefirst,thechickenortheegg? IwilltellyouthatwithoutYOU,andImeanallofyou,noUnionwouldexist. SotheansweristhatwetogetheraretheUnion. Now,withallofthatbeingsaid,outofalltheconstructionthatwasdoneinthis country in the last year, unioncontractorswithunioncraftworkersonlydid13percentofthework. Soifwedonotgetpissedandbindtogether for our mutual aid andprotection, theworkwillbe lessandlesseachyearuntilwenolongerexist.
(SO CALLED) RIGHT TO WORK Sincethefoundationofthiscountry,ordinarypeoplehavecomehere formainly economic opportunity. Takea look at your own family history.How many times did your ownancestorsmove? Iwillbewillingtobeteverytimetheymoved,theydidsoforajob. Wehavealwayshad,andcontinuetohave,theRighttoWork.Amanorwomanhastherighttopicktomatoes,makesteel,workinafactory,laybrick,or set tile. We also have the righttoeitherbelongtoalabororganizationornot.
AsImentionedabove,outofevery100constructionprojectscompletedinthiscountrylastyear,only13ofthemwerecompletedbyUnionworkers. Sotherealreasonfor(SoCalled)RighttoWorkissimplytodefundtheUnion movement. You do that bysayingitisyourchoicewhethertopayduesornot. Hell, you have always had thatchoice.Youcouldhavesimplyworkedon one of the other 87 percentofprojects. Onanyoneofthoseprojects,theonly dues you would have to paywouldbefor lesspay,noonetocalltocomplainaboutincorrectpay,inferioror no benefits, and poorer, unsafeworkingconditions. Thosearetherealduesyouwouldpay,andyouwouldpaythemdirectlytothepersonwhohiredyou,whetheryouknewitornot. Sowhydoweasunionmemberspaydues? Myansweristhatwepayduesfortherighttoworkonthat13percentofjobs under a collectively bargainedagreementthatsetswages,benefitsandworkingconditions.ThisagreementisnegotiatedbythecontractorandtheUnion;bothsidessign itandhavetoupholdtheirparts. Ontheother87percentof jobs,youhavenosignedagreement,andyouareoutthereonyourown.RememberthemutualaidandprotectiongrantedbytheWarnerAct? ItdoesnotcomefromtheUnion,butfromthosewhohaveboundtogetherandformedtheUnion. Now,justbecausealawwaspassedtogiveusworkingpeopletherighttoorganizedoesnotmeanthatUnionsjustmagicallyappear.Theyevolvedfromthehardworkandfightofworkingfolkswhowere treatedascattleandnotashumans. Theywereformedbyfolksthatwereengagedandsacrificedforthemovement–peoplewhoweretiredofbeingtreatedasthoughtheydidnotmatter. Soattheendoftheday,ifwe–andImeanallofus–donotgetpissedoffandstartfightingbacktogether,wewillcertainlylosethisbattle. Ifwedonotdoitforourselves,attheveryleastlet’sdoitforourchildren. Unitedwestand,dividedwewillmostcertainlyfall.

Applicants must be 18 years or older, must present a valid state identification card, must be a high school graduate (or graduating within the current semester with a letter from high school administration verifying applicant’s current progress will result in graduation) or equivalent (General Education Diploma), and be physically fit to perform the work. All applicants must provide transcripts (record of grades) or GED (General Education Diploma) and test scores. Applicants for apprenticeship will not be considered unless transcript or GED is received within 10 business days. Failure to comply will result in automatic disqualification. The recruitment, selection, employment, and training of apprentices shall be conducted without discrimination because of race, color, religion, national origin, age, or sex. JudgingfromtheamountofUnionStatusVerificationformsthatLocal5’s
officehadtofilloutforourmembersoverthepast fewmonths, theharshwinterdefinitely took its toll on employmentopportunities. Ihopebythetimeyouarereadingthisarticlethattheweatherhaschangedforthebetter,allowingfortheworktopickup. Wearebeingtoldbyourcontractorsthattheyexpecttobebusyagainthisyear,andthedemandformanpowerwillbethere. ThemonthofAprilwillbeabusyoneattheArcelorMittalClevelandSteelPlant.TheC5furnacetopchange,BOFVesselrelineandtheNumber1Reheatfurnaceareallscheduled. Ontheoutside,theLorainHighSchoolproject,which isbeingbuiltbyFoti,stillhas at least a year of work left. TheStrongsvilleMiddleSchool,withLencykMasonry,willcontinuethroughoutthisyear,andtheLakewoodschoolswillbestartingupthisyear. HEALTH SCREENING WerecentlyheldaHealthyLifeScreeningatLocal7. Thiscombinationoftestswasdoneatnocosttomembersandspousesover40years old that are participants inOhioBricklayersH&W. Thescreeninginvolvedcheckingmultiplearteries forblockages,bloodpressure,cholesterol, and a few more health-relatedissues. IhavegottenwordfromKathleenKelly-Calceithattherehavebeenafewinstancesinwhichparticipantsinthescreeningwereabletocatchsomeprettyseriousproblemsandgettothehospitaltogetthemcorrected. We can’t be too cautious with ourhealth.Nomatterwhatotherproblemswemighthave,withoutgoodhealth,wewon’tbearoundtoexperienceanyoflife.

MAPS is a museum comprised ofmilitaryandotheraircraft,alongwithallsortsofmilitaryweaponsandequipment.Themuseumisrunbyvolunteerswhofixuptheaircraftforpresentationandalsogivetoursofthefacility. OnasnowyandcoldSaturday,eightmem-bersfromLocal7,andoneLocal6member,pairedupwithsixvocationalstudentsonthewalltogiveone-on-oneinstruction. Thestudentsbuiltthe8-inchblockwallundertheinstructionsoftheseasonedjourneymen.ItwastrulyauniqueexperienceandthestudentslistenedwellandlearnedalotfromtheexperiencedBricklayers. Thegroupofjourneymenthathelpedouthadtofightthroughasnowstormtoevengettothefacilityandspentanentiredayteachingyoungpeoplesomeofthetrade. It is always good to have severalcompaniesbiddingonprojects. Anyprojectawardedtoeitherlocalorout-of-towncontractorsmeansworkforourLocalmembership. Unfortunately,thisalsomeansgreatercompetitionfromthenon-unionsector. Weareallfamiliarwithhowmostofthesecompaniesoperate.Theycan lowbidourcontractorsbecausetheypaytheirworkerslowwagesandnobenefits,aswellassubbingtheir jobsto individual1099workers. Theseworkers,inturn,skirtthelawsthatweandourcontractorshavetoworkby.Weneedtokeepanopeneyetothesecompanies.Weneedtoleteachotherknowwhotheyareandwheretheyare. Thiswillallowustoholdthemtothesameworkstandardsthatwearerequiredtofollow.

strikethataffectedusatMarathon. ItappearsthattheUSW,andtheownerstheybargainwith,havereachedatentativesettlement.AllthatremainstobedoneisUSWlocalratification. AtourAprilUnionMeeting,wewillawardTallmadge Davishisawardpinfor40yearsofservice. OnMarch21,BACLocal40-Mansfieldwas represented by apprentices Josh Harvey andJoe CooperintheOH-KYADCBrickCompetitionattheSouthernRegionalTrainingCenterinBatavia,OH. ThiscompetitionwasheldasaqualifierfortheIUNorthCentralRegionalContest,tobeheldinChicagoonMay30. ThewinnersattheRegionalContestwilladvancetotheNationalFinalsContesttobeheldSeptember10-13inMaryland,inconjunctionwiththeIUConvention. This National ApprenticeshipCompetitionwaslastheldin2009.BACLocal40isthehomeLocalforthe2009BrickCompetitionChampion,Darren Tobolt, whoiscurrentlya journeymanemployedwithStuder-ObringerConstruction. JoeCooperandJoshHarvey,whoarebothcurrentlyemployedwithKirkBros.Masonry,weretwoofthesixapprenticesselectedfromtheRobertA.FozioNorthernOhioRegionalTrainingCentertocompeteintheBataviacontest.Crayton Lariscywasalsoselectedbutwasunabletoattend. With well over 100 apprenticesattendingtheNORTC,justbeingselectedtocompeteisquiteanaccomplishment.Weshouldallbeproudtoberepresentedbysuchfineyoungmenandcraftsmen.

asaMasonTender forJBMasonry, themanwhohelpedmegetintheapprentice-shipprogramwhenIwasasinglefatherand needed health insurance for mydaughter,andthemanwholiterallygavemeanassbeatingwhenIwasscrewingupinApprenticeship:BrotherMike “Moo” Grabill. BrotherMoopassedawayataround12:15a.m.onJan.30.Hefoughtcanceruntil the end and held out until aftermidnightbecausehedidnotwanttopassawayonhisgrandson’sbirthday,Jan.29. BrotherMoosufferedcoloncancer,received a liver transplant, and finallysufferedaggressivemelanomacancer. ButhetoldmeandothermembersatourUnionMeetingsthatoneofthethingshewasgratefulforwasthefactheknewtheUnionhadhisbackandwastheretohelphimandhisfamily.BecauseofhisUnionhealthinsurance,hehadthecareheneeded. WORK STATUSManyofourmembershavebeenfortunatetofindjobsthatwereclosedinandwereabletowork
onallbutthecoldestdays,iftheycouldgetthere.Thiswasoftenchallenging. Thereweremanytimeswehadcallformenthatwentunfilledbyourmembersdueto lackofspecifictrainingthatwasrequiredtoworkonprojects.Manyofourmembersdidtakethetimetoupgradetheirtraining,andtheywerefortunatetoworkmostofthewinter. Moreandmore,ownersandcontractorsaredemandingthebest-trainedmenandwomen to work on their projects. It’simportantthateachofusstayawareofwhatisnecessarytobethebestofthebest. ThespringoutlookforNorthwestOhiolooksprettygood. Therearetreatmentplants,collegeprojects,apowerplant,andschools,aswellasanumberofupcomingprivateprojectsonthebooksforourarea. ManyoftheseprojectswillrequirethatyouhaveanOSHAcardthatisnotoverthreeyearsold.Up-to-datedrugcardswillbeanotherrequirementonmostprojects,withonejobrequiringadrugtestevery10days. Itallseemslikeapaininthebuttwhenallyouwanttodoisgooutanddothejobyou’vedonehundredsoftimesbefore,butthosedaysareprettymuchgone. Thedaysofanuntrainedworkforceareslippingaway. Instead,theyspendmostoftheirtimetrying toget re-electedand talkaboutsubjectsthat,inreality,willdonothingtobuildthiscountry. Itseemstheyhaveagoaltolowerourliving standards to match the rest oftheworld. Theycanfindbillionsofdollarstohelpothercountries,bigbanksandWallStreet,butneglect todoanythingfor the lowlyAmericanworkerexceptdrivehimdownandsendhisjobstoothercountries.
