The Comrnittee of the Whole met this rnorning and has author-

~zed me to report the following:

MEDICAL BRANCH: PERSONNEL CHANOES, EFFECTIVE MAY 15, 1964.--Upon recommendation of the Administration, Doctor John B. Truslow, Executive Dean and Director of the Medical Branch, was given a research assignment as Professor of Adrninistrative Medicine for the period May 15-August 31, 1964, at the same salary rate he was receiving (including pay- rnents on annuity) payable from Medical Branch Unallocated 5alaries and Current Restricted Funds available for this purpose.

Doctor Truman Blocker was appointed Acting Executive Dean and Director of the Medical Branch for the period May 15 -

August 31, 1964.

HOSPITAL (150 BEDS) TO BE BUILT BY THE SEALY AND SMITH FOUNDATION: SITE SELECTION, ETC.--With reference to a proposed 150 bed hospital for private psychi- atric and medical patients t¿~e built in Galveston by The Sealy and Smith Fcundation and affiliated with The University of Texas Medical Branch, the Committee of the Whole approved the following recommendations which had been presented at the April meeting but on ~vhich no action had been taken:

i. The proposed hospital should be physically con- nected, ir architecturally, economically, and operationally £easible, to the existing University hospitals of the R. Waverly Smith Pavilion, which has the approval of The Sealy and Srnith Trustees.

Z. Architectural p~i'¿ns of the proposed hospital rnust have the approval of the Chairman of the Departrnent of Medicine, and the Chairrnan of the Departrnent of

Neurology and Psychiatry.

3. The professional staff of the hospital should be appointed by and under the control of the Iv[edical Branch and the assignment of interns, residents, and medical students should be under the direction and control of the respec:;

tire Medical Branch departments.

4. The hospital should be operated in such a manner so as not to affect adverse]y the financial operation of

the Medical Branch.

5. • ti The operation of the hospital facility should be under

an agency-type contract with The University of Texas as the operator and with the Foundation entitled to any

profits and responsible for any losses in the hospital

operation.

The University and the Foundation, in the contract, should agree on the accounting practices and pro- cedures that will govern in deterrnining the type and amount of expenses to be charged to the opera- t[on oí the hospital to assure complete conformity with existing statutory provisions and restrictions.

The University of Texas, in the contract, will agree not to change substantially the allocation of hospital beds between clinical departments without first having the concurrence of The Sealy and Smith Foundation.

Chancellor Ransom and his delegated representatives shall be authorized to continue negotiations with The Sealy and Smith Foundation for the construction and operation of the proposed 150 bed hospital, and to submit to the Boardof Regents ata subsequent meet- ing the proposed terms of a contract to be made hy the Board of Regents with the Foundation.

The Committee further recommends that there be conveyed to the Foundation such portion of the land described in Senate Bill No. 475, Chapter 257, 55th Legislature, Regular Session, 1957, as may be required for the construction oí the proposed hospi- tal, subject, to and in accordance with the provisions and limitations of Senate Bill 473. MOODY STATE SCHOOL HOSPITAL: EASEMENTS AND RIGHTS- OF-WAY FOR ROAD AND FOR FILTRATION PLANT.--The Committee of the Whole also concurred in the recomrnendation of Mr. Walker and Doctor Blccker that The University of Texas should advise the Board for Texas State Hospitals and Special Schools that the Board of Regents of The University of Tex&s has no objection to the proposed easements and right-of-way íor the road and filtration plant on the present Iv~oody State School Hospital. As the record reflects, the Board of Regents is join- ~ng with the Board íor Texas State Hospitals and Special Schools in submitting a bill for consideration of the 59th Legislature to transfer the MoodyState School from the Board for Texas State Hospitals and Special Schools to the Board of Regents of The

University of Texas.

PROPOSED PRISON HOSPITAL BY THE DEPARTMENT OF CORRECTIONS TO BE OPERATED BY THE MEDICAL BRANCH.-- The matter relating to a proposed prison hospital by the Depart-

ment of Corrections was postponed.

On November ii, 1961, following íiling of the suit, the Board of Regents

rnade the follow~ng staternent: "W~th reference to student housing, we w-sh to s=v ~hat :n v~ew of the filing of a lawsuit on th~s quest~on, we deem :~ :mproper t o cornrnent of take ¿ction ¿t this time on this que8t~on pendtng hnal dec:s~on by the Court." Th:s, together wíth the fact that

those favor~ng dorm~tory ~ntegrat~on obviously chose to leave the rnatter

to a Court of the~r select:on rather than to the Board's aesurances o~ ":ntegrat:ng w~th all deliberate speed" has been largely responsable for

the dorrn~tory situation being left as the last step in "integr¿ting with all

dehberate speed."

The var~ous steps taken slnce November~ 1961--integration of the sta- d~um, some oí the rnen's dorm~to~ies, Texas Rel¿ys, Longhorn Band,

inlerco]]eg:ate athlet~cs; scholarship awards~ and the faculty-.-, as po:ntedly stated by the Board last November: "the only exception relates

to dorm~-tory res'.'dences and this is the subject matter of litigation now

pend~ng ~n the 9-ederal Court waiting the jurisdiction of that Court

~nvoked aga:nst the Board of Regents the day before it announced ít

Under our oaths of office to up'hold the Constitution of the United States.~

our only cholce has been that of timing the 'deliberate speed'. Some feel we have heen too slow, others that we have been too fast. In this exerc~se of judgment we have concluded that the completion of Jntegra- t~on should come at the close, rather than in the early part: of a school
