Having to ask the question "what is the value of music?",especially with so much free music around, suggeststhat it is considerably less than it once was, or is cer-tainly perceived to be so. Everyone wants music for freeor at a discount these days-radio stations, advertisingagencies, magazines for their monthly CDs, online ser-vices and retailers. All of them say that they provideexposure for music. And they get away with it.

It's bad enough so many believing music should befree, but that the industry itself has been giving awayits own assets is near criminal. Last week, AIM's chiefexecutive Alison Wenham said that "we are all guilty ofcheapening the value of music, and giving away ourindustry". She pointed at an industry that has a propen-sity to accept short-term gains at the expense of its ownlong-term viability.

"Name any other industry that sells its premiumproduct at a discounted price and new products at pre-mium prices?" asked Jeremy Lascelles, divisional chiefexecutive at Chrysalis Music, at the same forum.

In the US, it is now frequent to have superstaralbums at less than $10 (euros 9) when you might endup paying $15-17 (euros 13-15) for the debut CD of anew rock act. It makes no sense. It's digging the hole inwhich the industry fell into still deeper.

Wenham suggested her members start a cultural rev-olution by simply stopping such practices. Ask for value,create value, get some respect for your assets and stickto such a policy. But one is not sure that in the currentclimate, with intense pressure on revenues, much willchange in business practices.

And meanwhile, what of the RIAA's polidy of protect-ing its interests by chasing and suing US P2P users?This will obviously be very unpopular with music lovers.It will give the further impression that the industry canonly protect itself defensively, and it isdoubtful whether it will contribute togetting people back in stores to buyrecorded music.

The RIAA claims it has tried edu-cating consumers and failed, hencethis tougher -than -ever stance. But ifthis is the only means the industryhas found to protect the value ofmusic, one might suggest there'smuch to worry about.

Indies can buck trend says Wenhamby Emmanuel Legrand

LONDON - The UK independent sec-tor has the resources to survive in thecurrent tough trading environmentbecause of its "agility, speed andentrepreneurial spirit", according toAlison Wenham, CEO of the UK'sindependent labels' body, MM.

Speaking at the organisation'sAGM in London on June 24, Wenhamtold members that "the wonderful flu-idity of the small business model isn'tunder threat" at a time when "themultinational model is not so blessed".

In AIM's annual report, Wenhamnoted: "If the independent sector con-tinues to remain as active and utterlydetermined as it has demonstrateditself to be over the past year, the sur-vival of the sector-even in the cur-rent, depressingly negative environ-ment for music-is also in no doubt."

Wenham told delegates that whatunited independent labels was "ourlong term vision for the industry".

Launched in 1999 and now claim-ing some 740 members, AIM was theresult of a split within the members ofindustry body, the BPI, which manyindie labels claimed under -represent-ed them.

Wenham said that since its incep-tion, AIM -has found a role and been anactive voice for the indies, listing thelobbying of the UK government on theforthcoming Communication Bill; thesearch for a resolution in the transat-lantic conflict between labels andmechanical societies, the UK's MCPSand US Harry Fox Agency; the partici-pation in the campaign for a lower VATrate in Europe; negotiating frameworkdeals with music online platforms, andthe ground work to establish a UKexport office in New York.

Wenham's speech followed a yearduring which AIM and the BPI hadbeen trying to resolve their differ-ences. Wenham said a tie-up with theBPI is still on the agenda, despite twoyears of talks without apparent suc-cess. "We would like to work with theBPI," Wenham told label executivesand guests, including BPI chairmanPeter Jamieson. "And we would liketo mend the wounds of division. Reso-lution and reconciliation are on theagenda."

However, Wenham put some condi-tions to such an agreement: "We doneed to see the political will demon-strated that recognises that the birthand success of AIM was no accident.We need to see a recognition of mutual-ity go further than a marriage of con-venience. It is the stated objective toget the brains in the business sittingaround at the same table."

Staff buy out French indie distributorby James Martin

PARIS - In an unprecedentedmove for the French musicindustry, France's leadingindependent distributor,Wagram Music, has beenbought by the company'smanagement and employees.

The deal, which took ninemonths to seal, was concludedfor an undisclosed sum in March, buthas only been made public recently.

Before the buyout, 89% of WagramMusic-which claims a local marketshare of 3.5%-belonged to WagramEquity Partners, with the remaining11% held by three members of the dis-tributor and label's management. Amajority stake of 51% is now con-trolled by these same managers-CEO Stephan Bourdoiseau (pictured),general manager Francis Jullien and

CFO Martin de Cham-bost-backed by 20 ofWagram Music's 100employees, with the sup-port of a bank loan. Theremaining 49% is held byDutch company Chris vanLeeuwen BV, an investorfound by Bourdoiseau.These parts form thewhole of new company

Wagram Holding, to which WagramMusic now belongs.

For Bourdoiseau, who remainsCEO of Wagram Music and becomespresident of Wagram Holding, thenew deal means that "we can do whatwe want now, as long as we're good atwhat we do. I'm convinced that theidea of employees being financiallyinvolved in the success of our artistsand catalogue is a sound one".

Bourdoiseau admits that the dis-

advantages of the deal remain to beseen, but says: "We're not into sellingmillions of records. We prefer artistswho start small and become big, likeVincent Delerm and Carla Bruni[released through Tot Ou Tard/Warn-er and Naïve respectively]. And thistype of collective structure is interest-ing in a world where so many employ-ees feel they're just another numberon a list." Bourdoiseau says 70%-75%of sales are in France, split 40%-60%between distribution and productionrespectively.

Founded in 1998, Wagram Music'srevenues were euros 56 million in2002, a euro one million increase onthe previous year, and should reacheuros 28 million for the first sixmonths of this year. Leading distrib-uted labels include Pschent, avant-garde French electronic label Cata-logue and retro-pop outfit Tricatel.

New arrivals battle for Helsinkiby Jonathan Mander

HELSINKI - The Helsinkiradio market has welcomedtwo new local radio stationsafter licences were recentlyawarded to Metromedia andSuomen Uutisradio. Both sta-tions will have a specificHelsinki focus.

Metromedia launched itsnew station, Radio Suomi -plus, in mid -June, adding toits existing Hot AC domesticrepertoire station RadioSuomipop and soft Urbanoutlet Groove FM.

Suomen Uutisradio runsFinland's only national com-mercial station, Soft AC -for-matted Radio Nova, and itsnew Helsinki station willlaunch by the end of the year.Although its format has yet to

be confirmed, Suomen Uutis-radio received the licence fora locally -focused radio sta-tion, so traffic reporting andlocal news are likely to bepriorities.

Metromedia's RadioSuomiplus has similar inten-tions, and will target over -35sin the Finnish capital. "Welike to say that [Suomiplus] isfor the person 'on the move',so we report on things thataffect movement in the city,such as local events and traf-fic," says Metromedia MDStefan Moller. To that end,the station has hired EskoRiihela, the well-known after-noon traffic news voice frompublic broadcaster YLE. Shewill produce and host trafficreports on Suomiplus.

Suomen Uutisradio will

announce details of its pro-gramming this autumn, once"the company has analysedthe development of the radiomarket after this year'schanges, according to MDPetri Manninen.

The new stations will facea tough battle for advertisers.Finland's companies current-ly spend less than euros twomillion a year on radio adver-tising in the Finnish capital-less than in smaller Finnishcities such as Turku and Tam-pere, which have fewer radiostations.

However, Moller is confi-dent that new stations willgenerate more money: "Weare targeting people whohaven't been catered to yet, soit should bring new advertis-ers to radio," he says.

Nostalgie prepares Flemish network launchby Marc Maes

BRUSSELS - Sofer, the com-pany which runs the 24 -sta-tion Nostalgie network inFrench-speaking southernBelgium (Wallony) underlicence from the NRJ Groupin France, has signed a dealthe bring the Gold networkto Flemish-speaking north-ern Belgium (Flanders).

The agreement is withBrussels -based radio consul-tancy and hardware supplierEurosound, which haspledged to set up a fully-fledged Nostalgie network inFlanders by September 2004.

Sofer MD Marc Vossensays: "Nostalgie has a strongposition in French-speakingBelgium and is still growing.Now we are ready to help tolaunch a network in Flan-ders under the Nostalgie[brand]. I think we have an

Vossen made the dealwith Eurosund co-owner LucDe Coster-the two execu-tive's working relationshipdates back to 1981 whenthey were colleagues atRadio Contact.

"As a consultant, I'vebeen assisting Marc [Vossen]in various tasks at Nostal-gie", says De Coster, "andwhen the parent companydecided to go ahead with thenetwork in Flanders, I wasgiven the assignment."

De Coster says that theFlemish Nostalgie networkwill operate independently ofthe Wallony group; the cur-rent deal includes the use ofthe brand name, plus collab-

oration in the field of promo-tion, marketing and logistics.

Nostalgie already has oneoutlet in northern Belgium,which broadcasts in Antwerpto an audience of about16,500 (a 3% reach). "Thestation, headed by PeterBenoot, is doing quite welland will become the net-work's main outlet," says DeCoster. "Our aim is to con-clude franchise deals withsome 30 [local] stations,including [high power] urbanfrequencies, and to have thenetwork completed by 2004."

Musically, the new Flem-ish network will follow Nos-talgia's well -established Goldformat, focusing on classicartists such as Bruce Spring-steen and Madonna. Aimingat a wide 25-54 age range,70% of Nostalgie Flanders'playlist will consist of musicfrom the '60s to the '80s.

ON THE BEATBBC LAUNCHES DIGITAL RADIO PROMO CAMPAIGNLONDON - UK public broadcaster the BBC launcheda five week TV campaign on June 23 highlighting thecorporation's digital radio station portfolio, whichcomprises 1Xtra (Urban), Five Live Sports Extra, 6Music (AOR), BBC 7 (comedy/drama) and the AsianNetwork. The promotion, which goes under the ban-ner Making Time For Digital Radio, will also run onradio for two weeks from June 28. The BBC has mean-while announced it is upgrading its digital radiotransmitter network from 65% to 85% of the UK's pop-ulation by the end of next year, which will bring it intoline with the coverage of commercial digital radio mul-tiplex Digital One.

SECOND GFK RADIO SURVEY PUBLISHEDLONDON - The second set of UK radio audience fig-ures to be based on electronic measurement has beenpublished by German research company GfK Media.The second instalment of the monthly numbers-com-piled through survey participants wearing GfK'sRadiocontrol electronic wristwatch-show littlechange from last month's figures (M&M, June 7), withpublic speech station BBC Radio 4 still leading theway with a weekly reach of 39%, down from lastmonth's 40%. NRJ finally moves into Zurichby Lisa Pasold

PARIS - NRJ Group, own-ers of Europe's largestradio network, has beengiven the go-ahead toincrease its share of Hitra-dio Z in Zurich.

Swiss regulator OFCOMand the federal board gaveNRJ permission to own49% of the CHR stationlast week. The remaining51% will remain in thehands of Swiss -Germancompany Goldbach Media.

An original agreementsigned in December 2002gave NRJ a 50% stake inthe station, but the dealran into regulatory prob-lems. Marc Pallain, dele-gated director of NRJ, says:"It was crucial to get offi-cial permission, but it tooklonger than expected. SinceSwitzerland is not part ofthe European Union,there's no reciprocal agree-

ment and a non -Swiss com-pany can only own 49% [ofa Swiss media operation]."

Despite the loss of theall-important percentagepoint, NRJ is delighted theagreement has now beengreen lighted. The group ispresent in more than 270cities across Europe, with300 -odd stations, and Pal -lain says Zurich has beenin its sights for some time:"We've wanted to be pre-sent in Zurich because it'san important market, andHitradio Z is in the topthree stations there. Ourgoal is always to find themost viable stations for ourEuropean expansion."

Klaus Kappeler, CEOof Goldbach Media, willalso be pleased with theclearance. Last DecemberKappeler announced thatNRJ was Goldbach's pre-ferred partner.

Media Control launches Stuttgart stationby Michael Lawton

COLOGNE - Internet radiooperator, Chart Radio, asubsidiary of Europeanchart research companyMedia Control, has startedterrestrial broadcasts inthe greater Stuttgart area.

The new station's licencerequires it to explore newforms of music radio andnew forms of financingunder real market condi-tions (M&M, May 3). Theradio station is also beingstreamed on the Internet(www. chart -radio. de/onair).

CEO Ulrike Altig saysthe station will be directedat a wide demographic, withmusic spanning rock, pop,hip hop, dance and techno:"We'll be creating technoand hip hop charts for the

first time in Germany.They'll form the basis of newprogrammes."

The station will broad-cast charts from othermusic styles, from filmmusic to heavy metal, atcertain times of day as wellas more varied program-ming in the evenings. "Wewill try to announce everytitle, and we will give lots ofinformation about themusic itself, but we won'tbe including gossip aboutthe stars," says Altig. Therewill be no news, weather orother information services.

Altig says the stationwill broadcast a large selec-tion from Media Control's17,000 -title archive. "We'llbe playing the songs whichare bought, but neverplayed on radio; we'll be

playing new artists andwe'll be looking at thecharts from the other coun-tries drawn up by [MediaControl's subsidiary] MusicControl." The Germanmusic industry's demandthat radio should play 50%new product, of which 50%should be German "will bea consideration", says Altig.

The station will takeadvertising, and will alsocarry out call -out researchon titles, while there areongoing negotiations to getsponsors for individual pro-grammes.

While BMG, Warner andUniversal jointly own theChart Radio Internet opera-tion with Media Control, con-trary to earlier reports theyare not involved directly inthe new Stuttgart station.

CDNI THE BEATGLOBAL MUSIC PUBUSHING REVENUE FALLS 4%NEW YORK - Global music publishing revenues in2001-the last year for which data from the 46 terri-tories monitored is available-fell 4%, according to the12th annual international music publishing surveyfrom the National Music Publisher's Association(NMPA). 2001's decline followed an increase of 6.75%in 2000. During 2001 performance -based income rose3.2% to nearly $3.18 billion (euros 2.76bn), althoughthis was offset by an 11.6% decline in reproduction -based revenue to $2.42bn (euros 2.lbn), fuelled by a13.1% fall in phono-mechanicals and a 7.65 dip in syn-chronisation income. NMPA president/CEO EdwardMurphy cites "poor economic conditions in some coun-tries" as contributing to the declines.

BMG RICORDI SIGNS BUONGIORNO DEALMILAN - Italy's BMG Ricordi andBuongiorno, an interactive mobileservice provider, have signed anexclusive "digital extension" dealwhich will enable subscribers tophone services Wind, Vodafone andTIM to download ringtones andother services on a payment basis.The deal will initially apply to the 13tracks on 9, the new album by ErosRamazzotti (pictured), but it willextend to other artists on the BMGRicordi roster in due course. SONY MUSIC BUYS OUT CZECH ENTERTAINMENT GROUPPRAGUE - Sony Music Entertainment Europe hasbought the remaining equity it did not own in its jointventure with Czech entertainment group Bonton foran undisclosed sum. YAHOO! LAUNCHES LAUNCH IN EUROPENEW YORK - Internet service provider Yahoo! rolledout of its music destination, Launch, June 25, in fiveEuropean territories. Yahoo! is establishing Launch inthe UK and Ireland, France, Germany, Italy andSpain as a promotional channel similar to operationsin the US. CENTURY FM PROMOTES MUSIC CHANGELONDON - The Capital Radio group's AC/talk networkCentury FM is taking a highly unusual approach topublicising its new -look music policy to advertisingclients. Century has recently switched from a malebiased, rock -based AC sound to a more female -friend-ly mainstream AC music policy with the slogan "Radioyou just have to sing along to". The TV -backed cam-paign has seen the Century FM sales team visit over50 key media buyers armed with Karaoke machines,encouraging clients to "sing along to Century". So, just who are Jack and Bob?Starting life with sensational ratings results inWinnipeg and Vancouver in Canada, it's the new for-mat for 35-44 year -olds that programmers all aroundthe world are talking about-a wide-ranging mix ofmainly '80s Gold with a rock bent combined withfresh, irreverent presentation. Sean Ross, managingeditor of M&M's sister US publication Airplay Monitor,went to meet Jack and Bob...

Five years ago, WMVX (Mix106.5) in Cleveland, US, helpedspearhead a new boom in Gold -based radio that fused '70sClassic Hits and the MTV '80s

with the presentation of an Adult Top40. Those stations achievedrespectable success, and they helpedensure that most markets wouldagain have someone playing ClassicHits in some fashion.

But nothing that happened withWMVX and its brethren could havepredicted what's taking place nowwith a series of similarly -targetedstations in Canada. Last March, theCHUM Group's CFWM in Winnipeg,Manitoba, switched from AC to aClassic Hits/Adult Top 40 hybrid for-mat branded as "99.9 Bob FM"-andwent from a 7.4% to a 14.4% share intwo ratings books.

Its success was followed by a simi-lar switch at Rogers -owned CKKS inVancouver, which became "97.9 JackFM" last December and surged from4.3% to 10.7% to become the market'snumber one FM music station inCanada's spring ratings book.

Since then, Rogers has debutednew "Jack FMs" in Calgary, Alberta,and last month on the former Top 40station CISS (Kiss 92.5) in Toronto.That move came just days after thelaunch of a second "Bob FM" onCHUM's CKKL (Kool 93.9) Ottawa-a heritage Top 40 that until veryrecently had a share in double digits,but had since been dented by a newrhythmic rival. In the cases of Ottawaand Toronto, those changes took placeamid rumours that other stations inthe market were readying similar for-mats. "[The format's] now in five ofthe top nine markets," says consul-tant Pat Bohn, president of Pat BohnAssociates, who works with theRogers stations. "By summer, it willprobably be in nine of the top ninemarkets."

The Bob 'and Jack boom has revi-talised not only the Classic Hits/AdultTop 40 hybrid, but also the "anti -radiostationality" attitude of the Bobs,Alices and other similarly named sta-tions that proliferated the US in themid-'90s-but ran their course inmany markets after the novelty woreoff. CHUM's Bob stations spoof tradi-tional station liners by playing " '80s,

'90s, and whatever." The Jack outletsare positioned as "playing what wewant".

So why has a format that became arespectable niche player in the USbecome so successful in Canada?

"Timing was everything," admitsHoward Kroeger, director of opera-tions for CHUM/Winnipeg, whohelped develop the format with

Audience Research International'sMike Dorn and former CHUM VP ofprogramming Ross Davies. "In thiscountry, the population bulge liesbetween 35 and 44, which is ourprithe demo. And around age 37 to 38,those 20 -year reunions start to hap-pen and the Police and Pretendersalbums come out."

Kroeger says the genesis of the for-mat, for him, was being at a friend's40th birthday party where ClassicRock station CITI was playinginstead of one of his stations. Theensuing discussion suggested thatthere was a hole for a younger -target-ed station that played Meat Loaf,

such a fast rise here"."The 35-44 demo was the first in

this country to grow up on FM,"CKKL programme director ChrisGordon says. "At the time, top 40 wasstill on AM [by government decree],and much of the Bob/Jack music wasbeing played on rock -based FMs thathad wider playlists due to the [gov-ernment] regulations."

It's also easier for single CanadianFM stations to cover a number of dif-ferent music franchises. WhileKroeger notes that Winnipeg has 16FM stations on the dial, 97.9 Jack FM(CKKS) programme director PatCardinal says, "We're not gettingsnipped by an '80s station, an oldiesFM, a Classic Hits station, three HotACs and a Triple -A. So there are somepretty large constituencies that canbe put together in Canada."

"There's just more opportunityhere, with a few less licences to puttogether something that is a milewide and an inch deep [musically],"Bohn adds. Cardinal calls it "theGeorge Costanza [of Seinfeld fame]format, where you do the opposite ofeverything you think you should bedoing, in terms of how the music'srotated and how we package the radiostation, and it works out beautifully."

"This whole format is about pro-gramming a potential train wreck,"Kroeger says. "You'll have Wild Thingby Tone-Loc, Hotel California by theEagles, Soak Up the Sun by SherylCrow, and Supertramp in a music

"Canada's baby boom is anywherefrom six to 10 years behind the US,which puts the guts of our baby boomin the '80s," Bohn says. While thatdoesn't mean the format wouldn'twork in the US and elsewhere,demography "does play into why it's

sweep. But the format works becauseit addresses the variety issue.Listeners get music from so manyplaces these days that their palateshave become broader."

Kroeger says that Winnipeg was "agood test market" for the format."There's a population of about715,000. If the format did well here,

there's a good chance it was going todo well in other markets." If anythingsurprised him, Kroeger says it wasthat the format turned out to havestrength among 25-34 year -olds aswell as 35-44 appeal.

More than one year after its debut,CFWM has a 10.5% share amongstlisteners over 12 and remains numbertwo in the market for the 12 -plusaudience. In doing so, it has proved tobe far more durable than its American"All -'80s" counterparts. Cardinal saysthat "looking at the performance inWinnipeg and [seeing that] it wasn'tgoing away", combined with "talkingto people who weren't in the businessabout the type of music a station likethis would play", helped spur CKKS'move. Kroeger says he knew that aBob -like format would be huge inVancouver, which has a musical her-itage of its own, but that CHUM did-n't have an appropriate home for it onone of its own stations.

The flip side of Jack and Bob's suc-cess is that it has claimed its first vic-tims-one heritage Top 40 and twoRhythmic Top 40s (in Toronto andCalgary). In that regard, it recalls theAmerican Top 40 doldrums of theearly '90s that helped give rise to suchharder -rocking Hot ACs as KHMXHouston and WPLJ in New York. "Top40 is certainly going through a downcycle," Cardinal says.

But until it rebounds, he adds,".these are big, mass -appeal radio sta-tions, and the changes that are hap-pening are creating opportunities forother stations."

Hits from the remixing bowlDance music may well notbe the dominant force thatit was, but the dancefloorhas never been a moreinteresting place-just askany remixer. Gary Smithreports.

modest fashion back in theearly 1980s. At the time, remix-ng on classic tracks like RoxyMusic's Angel Eyes or the

Clash's Radio Clash was generallyunderstood to involve removing mostof the vocals and allowing the rhythmto do the work, with little or no helpfrom other instruments. The resultwas often, quite correctly, valuedsomewhere below a B-side written bythe drummer.

Twenty years later and top -drawremixers are now regarded by A&Rpeople around the world as a combi-nation of magician and, when a pro-ject has melted down, all three emer-gency services rolled into one. A per-fect example is US producer/remix-er/DJ Tom Stephan, who-under theartist name Superchumbo-producedand wrote Irresistible (Twisted/US)which led to a flood of remix offersfrom Missy Elliot, Kylie Minogue,Basement Jaxx, X Press 2 and PetShop Boys.

Fresh sound"Generally people ask you to remix forthem because they perceive you asbeing 'current' or having a sound anda style that is new or fresh," he says."But, to be realistic about it, I get sig-nificantly more proposals when Ihave a record or a remix that isalready out and doing well."

Stephan's proven talent for gettingpeople on to the dance floor has led to

I wasso surprised that I phoned her man-agement and they confirmed it."

Stephan is currently working on anew Superchumbo album and a remixfor Warner US of the soon -to -be -released Get It Together by Seal. "This

is an interesting, mixed-up time indance music," he says. "On the onehand club audiences seem to wantclassic house music, on the other, thegrowing popularity of rock has givenremixers the opportunity to add someedge to dance tracks."

Return of rockStephen Budd, MD of Stephen BuddManagement (SBM), looks after some30 producers and remixers includingArthur Baker and Mark Picchiotti.Budd's take on the current state ofdance music is similar to Stephan's."House music is making a comebackbut I question how genuinely influen-tial it will be," he says.

"Amongst the most exciting actsthat I've seen recently, WarrenSuicide [B612/Germany] are amaz-ing. They mix a hypnotic Kraftwerk-ish approach with the punk energy ofThe Clash. Alongside that, Zero 7showed that chilled, sophisticatedelectronic music can crossover to abroad audience. I see that as anothergrowth area."

The return of rock has had severalinteresting and potentially beneficialeffects on the music of the dancefloor.Apart from highlighting the pressingneed for real songs, as opposed tolooped beats and larger than lifebasslines, it has also-as far as pro-ducers and remixers are concerned-

effectively split the dance vote. "Rockhas definitely polarised attitudes,"says producer Marco Talini of GitanaMusic. "Either you have to take a pro-duction in a very commercial or a veryunderground direction. StandardItalian commercial house music withlots of keyboards is definitely over. Atleast for now."

Talini's solution comes in the formof two current releases; M.T.J.'s EasyTo Do (Dee & Gee) which combines agrungy, stilted funk groove with askewed rhythm and a marvellous,haunting hook plus Greentage's rock -tinged Scream (Dee & Gee): "Screamis a house tune with a strong, rockmelody and a dominant guitar line,"Talini says. "I see 2003 as the year toturn off the radio, ignore the chartsand try to do something new."

Dance chartingRock -influenced dance music is unde-niably growing, and so, conversely, ispure chart music with all the dance -floor trimmings. Thanks to its stylis-tic ambiguity, the form scores hitswhile ratcheting up much -neededcredibility. "Until recently, A&R peo-ple used to tell me that my sound wastoo deep and dark for pop music, butnow that is no longer the case," saysDanish songwriter/producer CarstenKroeyer.

songwriting and production circuit forjust over a year following several soloprojects, already has an impressivetrack record with two tracks on therecent Appleton album (Polydor) andwriting credits with ex -Steps memberLisa Scott -Lee (Universal), JenniferEllison (East West) and Adahma(Jive). His most recent project waswith former Spice Girl VictoriaBeckham (Telstar).

"The track is provisionally calledCan't Get Enough Of You," Kroeyersays. "I'm delighted with the results

edge to much of today's music whichhas something to do with the returnof rock production values," Picchiottisays.

"It has definitely affected my workin the way every change in the musiclandscape does-I've always believedthat my work is influenced by the allthe music I've ever listened to. Androck is no exception."

Pushing aheadPicchiotti is currently putting the fin-ishing touches to a new Basstoy sin -

"I see 2003 as the year toturn off the radio, ignorethe charts and try to dosomething new."

Darker edgeChicago -based Mark Picchiotti, whoseremix credits include All Saints,Mariah Carey, Michael Jackson,Lighthouse Family, Enrique Iglesias,Madonna and many more, agreeswith Kroeyer about the new darknessin pop production. "There's a darker

gle called Turn It Up (Blueplate): "Ithas the flavour of previous Basstoyreleases in that it's bassline driven,"Picchiotti says.

"But I also wanted to push theenvelope. The track features banjoand harmonica and references TheGrid's Swamp Thing [Virgin] becauseit was such an important and very dif-ferent track."

Picchiotti, currently doing lessremix work due to production com-mitments, has recently been working

on tracks with Victoria Horn (Riva/Dirty Vegas' Days Go By),actress turned singerCatherine Ellis and SophieEllis-Bextor. "I was sup-posed to hook up withSophie but it hasn't hap-pened yet," he says. "Inthe meantime I've putsome backing trackstogether for her."

Alongside the Basstoytrack, Picchiotti has just com-pleted a new Absolute track calledFallen Angel featuring SuzannePalmer.

"Like previous Absolutetracks it has a lot ofgospel influences inthere but it also has arock feel," he says."There are currentlyfour major labels whowant to sign the track. Iexpect it will be out in abouttwo months when that situationis concluded."

Post -punk feelItalian producer DanieleTignino has also takenthe rock route. Tignino,who wrote four songs forthe last Simple Mindsalbum Cry (Virgin) andremixed New Gold Dream,is also one of the duo behindKlonertz's Three Girl Rhumba/Impossible (Oxyd Records). "It's actu-

To remix or not to remix? That is the questionGary Smith asks whether it isstill worth paying the moneyto bring in the remixers.

n a tough market, the issue ofchoosing whether or not to spendyet more-increasingly scarce-money on remixes has become amake or break question.It seems that each month brings

new pressures on labels, who withoutexception are finding that recoupingadvances is harder than ever. Oneobvious way to cut down the risk is tospend less on remixes.

"Alongside growing financial pres-sures we are also looking at a marketthat is particularly difficult to predict,so spending large amounts on remix-es is less of a priority," says PositivaMD Jason Ellis. "What we are tend-ing to do instead is to concentrate onsourcing quality records that areright for the market."

National exposurePositiva has recently been successfulin the UK with two records that havealso benefited from exposure in TVadvertising campaigns; Make Luv byRoom 5 and Husan by BhangraNights vs. Husan. "Make Luv was fea-tured in a [UK] Lynx campaign[known as Axe in the rest of Europe]which gave the record nationwideexposure [in the UK] throughout

remixers with a genuine `midas touch'and there are even fewer now."

"That fall in the appeal of the bigname remix has been accompanied bya general lack of creativity in the sortof crossover house music that has tra-ditionally been the chart staple ofScorpio. Our last three big hits havenot come from that genre."

Future hopesWhile Belolo points to falling compila-tion sales and a wave of good rock actscomplicating the situation, there aregrounds for optimism. "There is a newwave of young DJ/producers comingthrough such as DJ Gregory andMartin Solveg [who has worked withBob Sinclar] who have a very different,more electronic sort of sound," he says."In terms of overall strategy I believethe 'hit and run' approach is over.These days, a project needs to be basedaround an album with real songs."

Belolo believes that artists such asGreek singer Despina Vandi, signedto Scorpio for France and to Ministryof Sound in Germany, are the futureof crossover dance music. Vandi's firstsingle Gia (trans: "Hello" in Greek) isreleased in France at the beginning ofJuly with a remix by DJ Gregory.

Nanou Lamblin, VP of A&R atSony Music Europe, has a different

take on the remix equation: "To bringa record from the undergroundthrough to the charts you need theright remixes as much as ever. It'sjust as important to relate to the clubcrowd as it is to have the best possibleradio edit."

A case in point is My Love Is Alwaysby Saffron Hill featuring Ben Onono.This Tim Deluxe -produced track,released worldwide throughout June(according to territory), comes with amarkedly different radio version thanthat which was released in the UK. "Ina general sense, the trick with radioedits is to not kill the essence of atrack's underground appeal," Lamblinsays. "But [continental] Europeanradio demands a much warmer andpoppier style, so a new version wasedited by Joachim Garraud of SquareProductions in Paris. This is mainlydue to the fact that [public CHR] Radio1 in the UK is unique in the way itreflects dance culture."

Lamblin is also currently workingon remixes for Dutch featuringCrystal Waters, produced by DJScumfrog: `We won't release the trackuntil September but I've commis-sioned several remixes and the trackwill be worked through the clubs thissummer," she says. "If you believethat a record is a hit, then you have tocover all the angles."

Soma enjoys life at the sharp endTake a walk down Glasgow'sbusy Argyle Street and a fewhundred metres before reach-ing the motorway which bisectsthe city, you'll find a shop sell-

ing a selection of knives, swords andcrossbows. Hardly the cheeriest ofstores, this amateur armoury is athrowback to the city's often exagger-ated reputation of gang warfare andviolence which has taken almost twodecades to shake off.

Yet while the average pedestrian isunlikely to notice, the same buildingis also home to one of the UK's mostrespected club and electronic musiclabels which serves as a standardbearer for a city which is now morelikely to be known for its cutting -edgeindependent record companies.

Musical forceSoma was launched in 1991 by a col-lective of DJs, promoters and produc-ers, and has gone on to establish itselfas an international musical forcewhich boasts nine full-time staff. Itsreleases have been used as soundbedsfor projects ranging from a popularUK TV show featuring entertainerRolf Harris saving sick animals, to anS&M porn film called Preaching ToThe Perverted. However, to the morerefined music lover, Soma is mostlikely to be known as the label whichis home to the DJ and recording trioSlam, and which released the firstthree singles by French electronicsuperstars Daft Punk.

The latter went on to be licensedand subsequently signed by VirginFrance and have achieved main-stream fame across the globe. And inJanuary, the relationship establishedbetween the major and the indepen-dent resulted in a deal coveringEurope (excluding the UK), Africaand the Middle East. This was fol-lowed three months later with Soma

Glaswegian independent Soma isat the cutting edge of club andelectronic music in more waysthan one, reports Olaf Furniss.

Maya Massebouef first noticed theScottish label when she was an inter-national marketing manager atVirgin France imprint Delabel in themid -'90s.

"Soma was doing something greatand, without knowing what was goingto happen, I wrote to them," she recalls.

In 1996 Massebouef moved to Virgin'sfledgling Labels and is now head ofA&R for its electronic releases. Alongwith Source UK managing directorVincent Clery, she's been instrumentalin bringing Soma into the fold.

"There are not many electroniclabels which started in the early daysthat are not only still around but alsodeveloping artists," she adds.

From home boys to club kingsWhen Soma founders Nigel Hirst, Glenn Gibbons, Dave Clarke, OrdeMeikle, Stuart McMillan and Jim Muotune launched the label in 1991 itwas simply to release their own musical projects Slam and Rejuvenation.

"We were very excited by the prospect of having complete artistic control[ranging] from the music to the artwork to the way that the music was pro-moted," explains Gibbons.

Before long the label had moved from its base at Hirst's mother's houseto an office above Glasgow's seminal Sub Club. And not only did it quicklyestablish a reputation for releases by its own founders, but also for acts suchas One Dove, which launched the career of laid back club siren Dot Allison.

In 1994 Soma signed a three single deal with Daft Punk, and Clarke stillcites one of his proudest moments as when the French duo travelled toGlasgow to present the label with a gold disc.

Conversely Gibbons' high point came early on. "[The proudest moment]was when our very first release was getting great reviews, selling well andbeing played on [public UK CHR] Radio 1 by Pete Tong. We felt vindicatedthat we knew we could do it ourselves," he says.

He adds that his biggest low was when Soma's studio and office burntdown with the Sub Club three years ago, while Clarke's biggest disappoint-ment is more artist -related.

"Spending a lot of time developing and promoting Scott Grooves only toget no commitment back and no second album," he says.

Yet despite these setbacks, the two co-founders are optimistic about thefuture. Soma currently releases five albums and 12 singles a year, but thelabel also looks set to diversify into music DVDs and further develop itsonline operation.

While many of his '90s peers con-tinued to adopt a cavalier approach totheir businesses which betrayed theirpast involvement in the sometimesillegal rave scene, Brown talks ofimminent staff appraisals and a com-mitment to safeguarding the future ofboth artists and employees. "We wantour artists and employees to grow withthe company," he says.

Team spiritMoreover, this team spirit extendsfurther afield, with Soma commis-sioning music videos from local film-makers and album sleeves from stu-dents at Glasgow college of art.

Brown is convinced that his nativecity has been the lifeblood of the label."The club scene and the soul ofGlasgow has been a huge factor-it'sa very musical city," he says. "It helpsus forge an identity and it helps usfocus on what we do. In London [thereis, the danger] that you get caught upin the latest trends."

Nevertheless, he does not take aparochial view. "In London there aremore things around you. BeingScottish, you are more receptive tothe rest of Europe."

This is highlighted by Soma's long-standing popularity in countries such

as France, Spain and Germany."Soma releases are synonymous

with authenticity and consistentquality. We listen to everything thatcomes out on the label," offers MaxGuiguet, head of music at Paris -baseddance station radio Nova.

For Oli Wegener, managing direc-tor of Germany's largest music pro-motion company Public Propagandaand a co-founder of the GermanDance Awards, the label has a morepersonal significance.

"Slam's Lifetimes was a marvelloussong, it was the favourite track at mywedding and ended up on my weddingvideo!" he recounts, adding that DJ/musician Paul Van Dyk played thetrack during his set at the 2001 LoveParade's grand finale.

Crossover potentialWegener believes that had the trackreceived a bigger push by licenseeZomba Germany it could have been amassive hit, a view which serves tounderline Brown's view that the dealwith Virgin could provide the key tocrossover success.

Certainly, past releases supporthis belief. Sales of Daft Punk's DaFunk hovered around 3,000 units inthe UK, going on to reach number twoalmost two years later and chartingthroughout the world. Moreover,Mothership Reconnection by ScottGrooves featuring Parliament/Funkadelic sold an impressive200,000 in France alone.

The latter, who defected to a major(see panel), boasted a distinctly jazzyfunk sound which many might notassociate with a label known for under-ground club releases. However, it isSoma's ability to surprise that mightjust produce the desired crossover.

H -Foundation's Environments,which is due to get a US release onAstral Works in addition to comingout across Europe, owes more to GuruJazzmatazz and US3 than a ground-ing in house or techno.

And, as some of the larger labelsthat came out of the club scene areforced to tighten their belts, beingable to offer a fresh sound is likely toprovide the key to a successful future.

For the first time in the label's his-tory, Soma recently borrowed moneyfrom the bank in order to finance itsexpansion. But co-founder and headof A&R Glenn Gibbons is confidentthere is enough fresh talent to helpgrow the label.

He maintains one of his biggestchallenges is deciding which of the 50demos that get sent in every week areworthy of a deal, as recordings haveimproved significantly over the pasttwo years.

"This is partly because of the soft-ware that has come onto the marketrecently," he says. "But also the artis-tic quality is higher too."

With the extra clout afforded bythe Virgin and EMI Publishing dealsit is not likely to be long before a hostof exciting new acts could be gracingthe charts worldwide.

Dallas Superstars on drive across Europeby Jonathan Mander

Jaakko Salovaara, aka JS16 and one of Finland'shottest dance artist/producers, is no stranger tosuccess. Best known perhaps for producing/co-composing Bomfunk MC's track Freestyler, whichbecame Europe's biggest -selling single of 2000, healso produced and released Darude's singleSandstorm through his own 16 Inch Recordslabel, which became a crossover trance hit allaround the world during 2000 and 2001.

More success has now come his way with thesecond single by Dallas Superstars, Fast Driving,which has already taken the top spot in theSwedish Dance Chart. Meanwhile, Salovaara andDallas Superstars' colleague Heikki Liimatainenhave been preparing Dallas Superstars' albumFlash for release in August. "We've been doing alot of singles using different names, but we gotmost excited about Dallas Superstars, so we'reglad it's the one that also took off commercially, "Salovaara explains.

Fast Driving mixes a trance vibe with electroquirkiness-hard and direct. It also features '80sinfluenced electro-pop-style speech -vocals byKaisa Koistinen. The track features in Australianclub culture movie, One Perfect Day, togetherwith music by Paul's Van Dyk and Oakenfold.

Both Fast Driving and a previous single,Helium were released in Finland by 16 InchRecords, and the tracks were licensed toStockholm Records, which has arranged forrelease in other regions through parent companyUniversal Music. Upcoming releases include FastDriving in Germany and Helium in Australia and

the UK, where the single is released by Universallabel All Around The World in mid -July.

"The reaction has been huge in Sweden andthe UK. Big name DJs have been playing it,including Judge Jules, who had Helium seventimes in a row on his show on [public CHR sta-tion] Radio 1," says Patrik Simolin, internationalproduct manager, dance, at Stockholm Records.

In Finland Fast Driving entered the singleschart at number 11 and has been picked up on theplaylists of public CHR station YLEX, CHR sta-tion NRJ Finland, and has been one of the mostplayed songs on YLE's Swedish -language RadioX3M. It went to heavy rotation on Swedish musicTV channel ZTV, remained in the top two of theSwedish Dance Chart for nine weeks and, likeHelium, was recently picked up by dance andR&B-focused CHR station Power Hit Radio.

"Dallas Superstars suit us perfectly," saysPower Hit's head of music and programmingmanager Robert Sehlberg. "They have a greatuptempo beat and sound really fresh, unlike a lotof recent songs with strong '70s and '80s influ-ences. This is a new sound and I think that is whythe song is popular with Swedish DJs."

Beyond Dallas Superstars, Salovaara andLiimatainen collaborated as producers forDarude's second album Rush, released in Mayin Finland, where the album debuted at num-ber four.

Liimatainen also produces Modulations,which peaked in the Finnish singles charts at13 with Spirits. Salovaara, meanwhile, is dueto start working on a new Bomfunk MC's albumshortly.

Jay Kid recalls magic of MJ

It can be dangerous, covering tunesby one already dubbed the "King ofPop", but Universal MusicDenmark's Jay Kid-aka The Kid-has made an album that's a thriller.He's 13, he's got the voice and he's gotthe moves.

"The repertoire on the albumincludes some of the most popularsongs ever made," says UniversalMusic Denmark's A&R directorClaus Pedersen. "The combination ofhits from Michael Jackson done byJay Kid means we can hit a newaudience and a new generation whoprobably heard their parents playingthe songs."

The Kid's debut Bringing BackThe Magic! was released domesticallyon May 26 and is due for release inAsia, UK, Germany, France and otherterritories imminently. The US is stillpending, "but we're looking at theworld," Pedersen says, cryptically.

Covering such Jackson classics asI Want U Back, Stranger In Moscow,Can U Feel It, Liberian Girl and Bad,Jay Kid began his near -obsessionafter watching a concert video of hishero. Almost moonwalking before hecould crawl, dance and music lessonsrefined his talents and he managedto add a few moves of his own whileperforming for hours in front of amirror.

While Jay Kid's vocals bear anuncanny likeness to the original attimes, he puts a new spin on thematerial and while the various pro-ducers-including Nightshift,Supa'Flyas, Cutfather & Joe, Remee& the Shack-remain faithful to theolder melodies, they add a modernsparkle.

Universal Music sent an extendedBlame It On The Boogie to clubs withgreat results. "It was anonymouswith just `2003?' written on it,"Pedersen says. "It got hyped in DJchat forums and got a lot of clubplay.A few even commented on how fan-tastic it was that the original vocalswere used." A radio mix then got ontoDanish national public CHR stationDR P3's "Trend List" in April and waslater chosen as "Pick of the Week."

Universal sent out its marketingpackage to all Universal affiliates inthe first week of June. The packageincludes a promo video done byChrysalis TV producer VanessaWarwick (once of MTV fame). A five -song choreographed show rolled outin Denmark in early June and isready for export, says Pedersen.

DANCE GROOVESby Gary Smith

TWO RIGHTGiven the number of great tracksthat have already been sampled byartists over the years, it is slightlysurprising that Talk Talk haverarely, if ever, been co-opted. Don'tYou Forget by Stunk Of Punk (CyberProduction/France) features a sam-ple from It's My Life swathed ineffects, backed -up with a tastefullyapplied house groove. From the samelabel, Calinda by Rosa has alreadyrightly been hailed by dance maga-zine MixMag as a potential summerhit. The track has a latino-house feel,plenty of dreamy, dramatic dropsand an appropriately melo-dramaticvocal line/hook from Rosa. A sum-mery tune with crossover potentialthat also has what it takes to becomean Ibiza crowd-pleaser.

SOUL BOOMWhen the story of the origins of thecurrent European R&B boom iseventually told, London label DomeRecords should, by rights, featureprominently. The label has beenextremely consistent over the yearsand Colour Of My Soul byBirmingham -duo Full Flava contin-ues the tradition. The album fea-tures-as is often the case withDome-a selection of singers includ-ing Brand New Heavies vocalistCarleen Anderson on two tracks,alongside top-notch performances

from Ce Ce Peniston, RominaJohnston, Donna Gardier, BeverleiBrown and Alison Limerick. Thepresence of so many excellent voicesprovides subtle variations of toneacross material, which in turn istightly arranged, highly polishedand quietly effective. Another splen-did effort with several stand -outs,including Round And Round, NatureBoy and the title track.

NO CABBAGESi Begg has been making inspiredmusic for the last five years undervarious pseudonyms includingCabbage Boy and Si Futures.Director's Cut, his first album underhis own name, sees Begg going deepinto his hip hop/electro roots withvocal contributions from DJ Rush,Miss MC, Jamie Ball and Jinadu.

Opening track Body is a missionstatement, combining a furious elec-tro groove supporting an inspired DJRush laying down the dancefloor law.Grind is an old skool funk-fest com-plete with Hammond organ andFender Rhodes, while England is asweeping, inspirational tune thatuses snippets of William Blake'spoetry set to a whistful, insistentbacking. VIP sees Begg again in full -on electro mode on a song that aimsfor the celebrity jugular.

Begg has rightly been recognisedas one of the edgiest, brightest tal-ents around. Director's Cut will donothing to change that view.

It's a change -around at the top this week asBelgian -based Italian Vito Lucente, under hisJunior Jack alias, moves up three places to num-ber one with E Samba (Noisetraxx). Its climb tothe top is based on strong debuts in Sweden,Norway and in France. E Samba is Lucente'sfourth European Dance Traxx number one; onlyGermany's Sash! has hit the top more times(five). One of those number ones was Make Luv(Noisetraxx)-under his Room 5 moniker-which is also still in the top five, although itdrops one place to number three this week.

The change ends Italian Benny Benassi's runat the top and sees his Satisfaction (D:Vision)slipping down to number two.

Meanwhile, two tracks enter the top 10 ofthe chart for the very first time this week.Veteran German dance act Scooter climb fivenotches to number seven with The Night(Sheffield Tunes). The Hamburg -based group'strack is already strong in their homelandGermany, as well as in Austria, Poland andScandinavia, and it has just debuted on thedance sales chart in Ireland.

This week's biggest overall gainer, as well asthis week's highest climber, is Moloko's ForeverMore (Echo), which is up 56 notches to nine.Chart debuts in Germany, Denmark andNorway are the impetus behind its rise.

Sean Paul's Get Busy (Atlantic) is anotherbig climber this week, rocketing from 30 tonumber 12. Dancefloor popularity in Germanyand Scandinavia is accompanied by a rankingon the UK's 12 -inch singles sales chart. Oneplace behind it, Rank 1 are trying to live up totheir name, as their Breathing (Airwave 2003)(ID&T) climbs from number 31 to 13.

Elsewhere Dannii Minogue's double A -sidedDon't Wanna Lose This Feeling/Begin To SpinMe Round (London) jumps to number 29, upfrom last week's 62.

Bob Sinclar's Kiss My Eyes I Tango! (Yellow)is a new entry to the top 40 at number 27, whilethe biggest sales gain this week belongs to iiO'sAt The End (Made), which moves up to number42, partly thanks to a high debut on the UK's12 -inch singles sales chart.

The top of the European Radio Top 50 looksthe same as last week, with Madonna, CraigDavid and Justin Timberlake still occupyingthe top three places. At number four thisweek, up three places, is Jennifer Lopez withher new single I'm Glad (Epic).

Although Russian station Radio Maximumdefines itself as having a rock -oriented CHRformat and is therefore not playing the track,programme director Alexey Glazatov appreci-ates Lopez's mainstream appeal. "It's not ascatchy as her previous hits," he says. "But Ithink it's perfect for pop stations. It will bevery good for this summer."

Radio Maximum has a 4% share of thecountry's radio market and has 30 stationsacross Russia, but the playlist is created cen-trally in Moscow.

One track which the station says is massivewith its listeners just now, and in general, onRussian radio, is Evanescence's Bring Me ToLife (Wind-Up/Epic), which moves up threeplaces this week to number nine. "It's onpower rotation and it's the most requestedtrack at the moment, so for us it's the bigsound of the year," says Glazatov. "It soundslike a song you've heard before, which is good.There has been a very positive reaction fromour audience. A good reaction from ouryounger listeners was always predictable, butthere's also been a great response from the 28-30 age range. It's very melodic, which alwaysworks well on Russian stations."

A little further down the chart we findPink at number 15 with her new single fea-turing William Orbit, Feel Good Time(Arista), which is on the soundtrack ofCharlies Angels 2. Glazatov says Pink is acore artist for Maximum. "We see her as apop -rock artist," he says. "We aren't playingthe new track yet though-no-one is playingit here-but the movie's not out yet, so thatmight change. But for me, it's not a straight-forward song. It's not easy to sing along to,unlike Just Like A Pill or Don't Let Them GetMe." Glazatov says that they are still listen-ing to the track at playlist meetings, sofuture playlisting is not out of the question.

Avril Lavigne makes a big jump this weekwith Losing Grip (Arista), which moves upfrom 40 to number 19. "We've played all thesingles [to date]," says Glazatov. "She has avery energetic, street feel. She combines ayoung approach with a professional, brightsound. Her last single I'm With You is one ofthe best tracks of the year so far."

Robbie Williams (pic-tured) is this week's high-est new entry, asSomething Beautiful(Chrysalis) flies in atnumber 22. "We playRobbie-that reflects ourpop side," says Glazatov."We try to get as much`star image' for the stationas possible and Robbie has

that. But Something Beautiful doesn't suit usas much as the other singles from the album."

Meanwhile, Eminem's Business(Interscope) is up 11 places at number 35 thisweek, and Simply Red provide us with thechart's second highest new entry with Fake(SimplyRed), in at number 36.

Moore appealed to the 20 EU com-missioners-who will eventuallydecide on the proposal-to ensurethat music would be covered in therecommendations. Sheadded that the musicsector would be heavi-ly lobbying EU financeministers-who willhave the final word onthe VAT proposals-later on this year. Anychanges to the direc-tive will have to beendorsed unanimouslyby all 15 EU financeministers-although,in 1997, EU cultureministers unanimouslycut in the rate.

France, which initially took thelead in the fight for lower VAT,intends to pressure the EC and Euro-pean Union member states to achievea lower VAT rate on recorded music.The plea was renewed by Frenchminister of culture Jean -Jacques Ail-lagon on June 21-Music Day inFrance. "I am very disappointed bythe attitude of the European Com-mission," said Aillagon. "Europewould honour itself by taking such ameasure."

Aillagon added that he was "con-vinced that we will succeed in lower-ing the rate". He made these com-ments as representatives from theFrench recording industry and musicretailers signed an agreement inwhich they committed to pass on thelowering of VAT onto consumer prices.

However, industry executives inFrance now fear the momentum onVAT might have been lost. "There'sobviously a lack of political supportfrom EU members for this issue,"says Herve Rony, director general oflabels' body SNEP. In a statement,SNEP describes the EC's position as

France is aggres-sively pushing forministers to addressthe issue but many

governments have so far been reluc-tant to commit to a rate cut. FrenchPrime Minister Jean-Pierre Raffarinwrote to the Italian Prime MinisterSilvio Berlusconi earlier this monthasking him to make reduced VAT forsound recordings a priority duringItaly's six-month presidency of theEU, from July until December.

"I think it is essential that youngpeople in France and Europe canhave easy access to music, in reason-able conditions," Raffarin said. "A cutin VAT would also be an efficient wayto improve the competitiveness of acultural industry that is very impor-tant for France, Italy and Europe asa whole, at a time when the recordmarket is being gravely affected bythe growth of piracy and counterfeit-ing."

Raffarin pointed out that evenamending the directive would merelymean adding recorded music to thelist of products where a reduced VATrate could apply: it would then be upto each EU government to decidewhether to change their individualrates.

RIAA to sueThe RIAA says that to gather evi-

dence against P2P users it believesare involved in illegal downloadingand subsequent sharing it will usesoftware that scans public directoriesthat are available to any user of aP2P network. When the softwarefinds a user who is offering to distrib-ute copyrighted music files it down-loads some of the infringing files,along with the date and time itaccessed the files.

The RIAA says it can also identifythe Internet Service Provider (ISP)which hosts the userand, if necessary, willsubpoena the ISP toprovide details of userswhose accounts arebeing used to file -sharecopyrighted music, suchas their name andaddress.

The RIAA adds thatrecent court decisionshave affirmed the ille-gality of making avail-able downloaded music works, and cit-ed the Grokster case which saw usersof the system found guilty of copyrightinfringement.

Legal action will now be takenagainst those who persist in dissemi-nating copyrighted music to others,the RIAA's Sherman said. "Once webegin our evidence -gathering process,any individual computer user who con-tinues to offer music illegally to mil-lions of others will run the very realrisk of facing legal action in the form ofcivil lawsuits that will cost violatorsthousands of dollars and potentiallysubject them to criminal prosecution."

The RIAA's action has the backingof a number of US artists, includingRichard Carpenter, Missy Elliot andSheryl Crow.

In Europe, the global record indus-try association, the IFPI, noted thatthe number of infringing music fileson P2P services at any one time hasdoubled to one billion since June2002. Jay Berman, IFPI chairman/

music services avail-able; 18 months agothere were none".

Sharman Networks,which is behind theKaZaA software, said ina statement: "It is unfor-tunate that the RIAAhas chosen to declarewar on its customers byengaging in protractedand expensive litigation."

Allen Dixon (pic-tured), the IFPI's generalcounsel/executive director, tells M&M:"In the US the RIAA isn't worriedabout a consumer backlash. They'vetried education, they've sent notices touniversities and companies. This busi-ness is losing hundreds of jobs due topeople not buying music legitimately."Even critics of consumer -targetingstrategies "were asking themselveswhat other options do we have?"

However, some analysts believethe RIAA is merely trying to put the"frighteners" on consumers. "Theyknow it won't solve the problem,"says Rebecca Ulph, senior analyst atForrester Research Europe, "but itmight scare a few people. It is a com-munication to consumers that theindustry is taking this issue serious-ly. But only a tiny number will betargeted as it won't be feasible to goafter everyone."

Evans set to lose millions after defeatby Jon Heasman

LONDON - Former Virgin Radioowner and presenter Chris Evans haslost his long -running court battlewith the UK rock station's currentowners, SMG.

The High Court in London threwout Evans' claim that he was owed£8.6m (euros 12.5m) worth of sharesby SMG following his dismissal in2001 as the station's breakfast showpresenter. Justice Lightmandescribed Evans as a "petulant primadonna" and accused him of "sulkingand walking away from situationswhere he considers himself thwart-ed".

The judge said Evans was notentitled to the shares because he hadbreached his contract with Virgin bytwice going on drunken binges andfailing to turn up turning up to pre-sent his show. He ordered Evans to

pay costs and damages to be agreedwith SMG at a later date, but whichare believed to be around the £4mmark (euros 5.8m).

Evans' case effectively rested onhis claim that sickness had prevent-ed him from presenting his air -shifts, but after examining the evi-dence of medical witnesses, thejudge ruled that the DJ's state ofhealth in June 2001 offered no sup-port to his claim that he was wrong-fully dismissed.

The judge added that the failure ofEvans and Virgin Radio to resolvethe matter through mediation hadled to "mammoth litigation and a 20 -day trial at a horrendous cost ".

Following the announcement ofthe court's verdict, Evans' solicitorreleased the following statement: "Allwill come out right at last, have wesuch faith in the goodness of provi-dence."

Initially, press reports suggested that Applewould start to roll out its service in Europe inSeptember of this year...

Italy's music industry rumour mill has it thatClaudio Cecchetto could be appointed artisticdirector for the next edition of the troubledSanremo Festival. Cecchetto is most famous forfounding Radio Deejay and Radio Capital, buthis CV includes work as a talent scout (hediscovered the group 883), and he currently runsRTL 102.5 Hit Radio's video channel. Last yearhe also directed and presented a talent show onterrestrial TV, Destinazione Sanremo, whichhad disappointing ratings. Cecchetto would replacecurrent director, Pippo Baudo. Although it ispurely a rumour at this stage, Cecchetto has let itbe known that he would accept the Sanremo job,were it to be offered to him.

Following AIM CEO Alison Wenham'scomments regarding talks between herorganisation and UK industry body, the BPI (seestory, page 2), BPI executive chairman PeterJamieson does not plan to use BPI's AGM on July2 "as a negotiation tool", although "he may makereference to it", according to a source.

Finally, efforts by Dutch 3FM station managerFlorent Luycks to rejuvenate the public CHR arecausing unrest. Star presenters Rob Stenders(mornings) and Ruud de Wild (afternoon drive)are believed to be talking to Yorin FM. Earlier,early evening host Isabelle announced she willleave this week, while veteran midday host HenkWestbroek's contract was not renewed.
