MESSAGE FROM THE CHAIR

I am looking forward to the upcoming year as anopportunity to serve the Board as its Chair. As

both a licensed professional engineer and surveyor, Ifeel fortunate to have a broad perspective of theregulatory issues that face both professions. This isthe beginning of my sixth year on the Board, and Iam continually amazed at the wide range andcomplexity of the issues that come before the Board.

As a delegate at the NCEES annual meetingheld in St. Louis, Missouri in August, I participatedin several days of national discussions regardingmany of the same issues we face locally - issuessuch as licensure mobility, enforcement, computer-based testing, national examination development,and proposed changes to the laws and rules.

Notably, during the upcoming year, becauseOklahoma’s law was amended in the 2011-2012legislative session, extensive rule changes will beconsidered in 2012 and 2013 to support thesechanges. The statutory revisions are available on theBoard’s website and were effective August 24,2012. The legislative process seems to be a tediousand continuous process at the Board, but a verynecessary one. Changes in technology and theprofessions in general require that regulations belooked at regularly to ensure that they are stillrelevant and doing what they are intended to do –which is to safeguard life, health and property, and

to promote the public welfare. They are not writtento protect the professions of engineering and survey-ing, but they are also not intended to impede theprofessions needlessly. Sometimes that distinctionis a fine line and the Board works diligently to findthat proper balance.

Also during the next year, national changesare being made to the NCEES examinations withregard to Software Engineering and computer basedtesting. These changes have been worked on byspecific committees within NCEES, on which manyof our Oklahoma board members and staff play animportant role. Oklahoma continues to provideleadership and expertise to NCEES at the southernzone and national levels, which is important not onlyfor the Oklahoma board itself, but for the profes-sionals it licenses and the citizens of the state ofOklahoma.

I see this year as Chair as an opportunity forme to continue to learn and grow personally andprofessionally from my involvement with the Boardand NCEES, and to use my experience from thepast five years as a Board Member to lead theBoard and staff in a productive and decisive direc-tion. If you have input, comments or suggestionsyou can submit those at any time to the Board officeor to me directly.

2012 NCEES ENGINEERING AWARD

Oklahoma State University’s Schoolof Civil and Environmental

Engineering’s entry, Roadway andWater Feature Design at the BotanicGarden, was selected as one of fivewinners to receive a $7,500 awardfrom the 2012 NCEES EngineeringAward. Florida Atlantic University’sDepartment of Civil, Environmental, andGeomatics Engineering was the$25,000 grand prize winner for itssubmission. Each year, the NCEES EngineeringAward invites EAC/ABET-accreditedprograms from all engineering disci-

This has been a very rewarding projectin many different ways. The Civil Engineer-ing students were extremely creative andgenerated a lot of great ideas that will helpshape the further development of our envi-ronmental road system at the Botanic Gar-den. I think the project really challenged thestudents to think outside the box. Dr.Veenstra did a great job involving industryprofessionals in the project. The profession-als challenged the students and were able tohighlight many real world issues andpractices....I have been involved in manyinterdisciplinary projects, but this is one ofthe most enjoyable and rewarding. The winners are selectedby a jury of NCEES members and representativesfrom academic institutions and professional engi-neering organizations. “We’re excited to see suchinnovative approaches to teaching students aboutprofessional practice,” said NCEES President DaleJans, P.E. “Emphasizing the importance of techni-cal competency and ethical practice is critical toeducating the next general of professional engi-neers; we hope this award will inspire othercolleges to introduce similar collaborations.” OSU’s winning entry involved professors,students, and engineering consultants. The project,as described by Dr. John Veenstra, involved thestudents designing a roadway inside the OSUBotanic Garden that led from the south entranceinto the garden and eventually terminated at aparking lot. One of the unique challenges with theroad location was that it was inside a wetland. TheBotanic Garden has a general mission of environ-mental sustainability. As such, the roadway thestudents were tasked with designing was to incor-porate various types of environmentally friendlymaterials.

McVey named into Academy of Electrical Engineering by theUniversity of Arkansas

Board Member William “Bill” A. McVey, Jr., PE, was inducted intothe University of Arkansas Academy of Electrical Engineering, at

their annual banquet held on April 20, 2012. Mr. McVey was a 1971graduate of the University of Arkansas, which had a graduating class of25 students. Today the university has over 200 undergraduate studentsmajoring in electrical engineering and over 70 graduate electrical engi-neering students each year.

Mr. McVey began his career at Oklahoma Gas and Electriccompany from 1971 – 1979. During that time he was also an eveningprofessor at several Oklahoma universities. From 1979 – 1984, he wasthe Chief Electrical Engineer for Frankfurt-Short-Bruza. Since 1984,Mr. McVey has been with PSA Consulting Engineers, Inc. in OklahomaCity. He has served as President since 1993.

Appointed to the Board in 2002 by Governor Frank Keating, Mr. McVey is serving his second six-year term and continues to be active in state and national issues regarding engineering and surveying licensure.

Oklahoma Emeritus Board Member andcurrent Director of Enforcement, Bruce Pitts,

PLS, was named the recipient of the David PageDistinguished Service Award by the OklahomaSociety of Land Surveyors at its March, 2012annual convention. The award is presentedannually to a person who exemplifies service to theSociety and to the profession of land surveying.

Bruce A. Pitts, PLS, is a licensed landsurveyor in Oklahoma and in 1976 began practicingland surveying and land subdivision design with em-phasis on land title surveys and boundary analysisand boundary dispute resolution. He received his B.S.degree in Engineering Technology from OklahomaState University. He was on the land surveyingfaculty of OSU-OKC for over 30 years. Mr. Pitts isa past president of the Oklahoma Society of LandSurveyors, and an Associate Member of theOklahoma Land Title Association. He was also therecipient of the 2000 NCEES Distinguished ServiceAward.

April 2014 is the last date to take the PS and/or OLS if admitted under Long Established Prac-tice - LEP. This requirement allows applicants toapply with 9 years of qualifying, progressiveexperience approved by the Board.If the applicant has not met all of the require-ments for licensure by July 2014 and wishes tocontinue the path to licensure, they will be requiredto reapply with proof of meeting the educationalrequirements established by the Board, along withqualifying experience.

Even if you have qualified for the exams byLEP, you are encouraged to start taking landsurveying classes now. Much of the surveyingexams are based on knowledge obtained in collegelevel surveying class work. Taking college classesin the Core Curriculum will improve an applicant’schance of success on the examinations andimprove the chance of success in their surveyingpractice. Further, a LEP applicant who does notcomplete all of the examinations prior to the April2014 exam administration will be that much closerto qualifying for licensure by an education pathway.

An important function of the National Councilof Examiners for Engineers and Surveyors(NCEES) is to assist its member boards in theirstatutory responsibility of administering theirrespective laws pertaining to the regulation of theengineering and surveying professions. Memberboards are the 69 separate licensing entitiesthroughout the United Sates, Guam, the MarianaIslands and Puerto Rico. The mission of all mem-ber boards is basically the same - to safeguard thelife, health, property, and to promote the publicwelfare of the citizens they serve by administeringthe respective laws efficiently, fairly, and judi-ciously. Regulation of these professions consists oftwo important functions:

1. Licensure to ensure that professionalengineer and surveyor applicants arequalified to practice their profession in theirrespective states

2. Enforcement to ensure that licensees areperforming their professional services inconformity with the intent and purpose ofthe law and related rules of professionalconduct and to protect the public from theunlicensed practitioner

One way NCEES serves its member boards isto present a comprehensive law enforcementprogram at its annual meeting held each year inAugust. At the NCEES annual meeting just con-cluded, a full day and a half was dedicated to LawEnforcement activities. The Law EnforcementForum was held one afternoon, followed by theLaw Enforcement Program which was an all daytraining and educational event the following day.

The Law Enforcement Forum was aroundtable discussion of issues chosen by attend-ees and spearheaded by a panel of enforcementofficials which this year included Mark Caruthers,

one of our own Board Investigators. The inter-change of ideas between over 75 enforcementofficials, attorneys and board members from allacross the nation provided each of us with newperspectives on issues that affect us all. Some ofthe current and relevant topics discussed were:

The definition of responsible charge (directsupervisory control)

What exactly is “public health, safety andwelfare?”

Recent legal actions that impact regulatoryagencies

Exam Collusion (cheating) investigations Use of Social Media as evidence during

Investigations Board initiated complaints, such as those

coming from continuing education audits,placing false information on applications, orinvestigating projects that were bid orcommenced prior to licensure

Exemption from state licensure for Federalprojects (supremacy law)

Expanded use of the NCEES EnforcementExchange (the nation wide data basewhere violations in each state are posted)

Sharing information on how other states handlethese topics helps all of us find consensus on thebest practices for effective investigations. As aresult of attending this Forum, some board mem-bers and staff present learn about the NCEES

Enforcement Exchange for the first time andbegin the process of implementing this vitalprogram in their state.

The all-day Law Enforcement Program isalways an informative and educational sessionwhich includes a broad range of topics such ascurrent legal issues, topics which cover the basicsof performing investigations and training topicsfor new investigators like Engineering 101. Thisyear, I presented a training session entitled TheInvestigative Process where I shared how weconduct investigations in Oklahoma. Trainingopportunities for engineering and land surveyingboard investigators are rare, especially one likethis that is taught by individuals currently in thepractice.

These sessions are conducted annuallyby the NCEES Committee on Law Enforcementwhose members study important disciplinaryissues, and make recommendations to NCEESthat will achieve more effective and uniformenforcement and for greater interstate coordina-tion of enforcement actions. Robert Manchester,the Board’s prosecuting attorney, is currently amember of that committee.

NCEES is actively involved in providingresources to equip licensing boards with the toolsnecessary to have effective enforcement pro-grams. By participating and taking advantage ofthe NCEES programs, the Oklahoma Board willstay at the forefront of the best enforcementpractices and be better equipped to fulfill ourmission of protecting the public by advancingprofessionalism, ethics, and compliance with thelaws and rules that govern the practices inOklahoma.

PS Exam - closed-book in April 2013The NCEES Principles and Practice of Surveying(PS) exam will become a closed-book exam inApril 2013. At that time, examinees will useNCEES-supplied references during the exam andwill no longer be allowed to bring other referencematerial into the exam room. The exam is becom-ing an closed-book exam for exam security pur-poses and to facilitate the transition to a computerbased examination in the future.

FE/FS to be administered using CBTbeginning in January 2014Both the Fundamentals of Engineering (FE) andFundamentals of Surveying (FS) examinations willbe offered for the last time in its paper-and-pencilformat in October 2013. Beginning in January2014 these examinations will be administered usingcomputer based testing. The transition to computerbased examinations will allow greater schedulingflexibility for examinees, more uniformity in testingconditions and enhanced security for exam content.

Software Engineering PE ExamAvailable beginning April 2013The new PE examination in software engineeringwill be administered beginning April 2013. Theexam will be administered once a year each April.The exam specifications are available online atncees.org/exams. IEEE is planning to publish studymaterials for the exam later this year.

EXPIRATION/REVOCATION - Licenses may berevoked by the Board for non-payment of renewal fees.Licensees will be notified of revocation by mail.Typically this notification is mailed 10 days followingexpiration.RENEWALS - Each license issued by the Board expireson the last day of the month in which renewal fees aredue, and becomes invalid on that date unless paid. Onenotice of the renewal is sent by first class mail to theaddress of record in the board files. This in effectprovides notice two months prior to revocation.REINSTATEMENT - Former licensees whosecertificates have expired and were revoked for failure topay renewal fees and desire to reinstate shall makeapplication for reinstatement within 180 days afterexpiration and pay the prescribed renewal fee andpenalty. After 180 days, a new application will berequired, which shall be considered specifically by theBoard, both from the standpoint of competency and ofcharacter.

By law, the Board cannot renew a professional license if the licensee is in non-compliance with theOklahoma Tax Commission. At times it is a lengthy process to get into compliance, so pleasemake sure you allow yourself ample time prior to your renewal date to complete the process.

Practicing engineering or land surveying with an expired license, even if it is expired due to non-compliance with the tax commission, is a violation of state law and will be prosecuted by thisBoard.

Effective August 24, 2012, O.S. Title 59, 475.15 was amended to include the following lan-guage, “A professional engineer, land surveyor or firm shall retain a hard copy or elec-tronic copy of all technical submissions produced for a minimum of ten (10) years follow-ing the date of preparation.”
