As a central panel ALJ, I hear a wide variety of cases on topics including bid protests, employment discrimination, automobile dealership establishment, Medicaid overpayment, teacher discipline, adoptions, professional licensure revocation, rule challenges, tax challenges, and involuntary mental health commitment. I became active in NAALJ while assisting Past-President June McKinney in planning the 40th Anniversary Conference in Memphis in 2014. I soon realized the education and networking opportunities offered by NAALJ are invaluable, particularly for new ALJs and hearing officers! My focus as President this year is to increase the value of our organization to its members. Part of this comes from continuing the work of Past-President Peter Loomis in moving forward with developing a new strategic plan. President-Elect Elizabeth Figueroa is heading the Strategic Planning Committee and is actively seeking grant money for a consultant to aid NAALJ in this process. Following the leadership of Past-President Selina Malherbe, the Board will continue to formalize in writing what were previously unwritten traditions with regard to how the Board functions, how the Foundation operates, and how awards and scholarships are made available. Not only will this make the role of the committees and Board members better delineated for the future, it will provide greater transparency to the membership regarding how decisions are made for NAALJ. A Message from the President

Dear fellow NAALJ members, It is my pleasure to introduce myself as your new NAALJ President. I have served as an ALJ for the Florida Division of Administrative Hearings for a little over five years. Prior to that time I practiced labor and employment law for 24 years in private practice in New Orleans and Tampa, Florida. I also served as an adjunct professor at Stetson College of Law for 10 years. As a central panel ALJ, I hear a wide variety of cases on topics including bid protests, employment discrimination, automobile dealership establishment, Medicaid overpayment, teacher discipline, adoptions, professional licensure revocation,

rule challenges, tax challenges, and involuntary mental health commitment. I became active in NAALJ while assisting Past-President June McKinney in planning the 40th Anniversary Conference in Memphis in 2014. I soon realized the education and networking opportunities offered by NAALJ are invaluable, particularly for new ALJs and hearing officers! My focus as President this year is to increase the value of our organization to its members. Part of this comes from continuing the work of Past-President Peter Loomis in moving forward with developing a new strategic plan. President-Elect Elizabeth Figueroa is heading the Strategic Planning Committee and is actively seeking grant money for a consultant to aid NAALJ in this process. We are mindfully trying to balance privacy considerations with the need for our members to connect outside of annual meetings. I also plan to work with sister organizations to increase communications to advance the mutual interests of our members. Exciting things are planned for NAALJ in 2019. Our mid-year webinar is set for May 17, 2019, in conjunction with the National Judicial College. Please mark your calendar now to take advantage of this free continuing education session. The focus of this year's conference is the independence of the administrative law judiciary. If you have suggestions for topics or speakers, please contact Commissioner Clopton. Due to budgetary and scheduling considerations, we were unable to secure suitable conference space in the heart of downtown. However, the hotel is a 10-minute walk from public transportation that will take attendees into the city. Also, we are arranging transportation for our group outings. San Mateo itself has a quaint shopping and dining area close to the hotel and beautiful outdoor areas to explore. 2018 Victor J. Rosskopf Award

Rosskopf Presentation Remarks By Hon. Peter J. Loomis

Tonight, I have the great honor and privilege of presenting the Rosskopf Achievement Award, named in honor of Vic Rosskopf, a former NAALJ Board member and Treasurer who died long before he should have. It was first awarded in 2000, posthumously, to Vic, and accepted by his wife in Ashville at our annual conference. I was actually in Ashville that night eighteen years ago, and I can tell you that Vic’s wife was extraordinarily moved by the way NAALJ chose to remember Vic. The Rosskopf award honors judges who embody the highest qualities of judicial professionalism and ethics, and who have made significant contributions to the field of administrative adjudication. The Rosskopf committee consists of past recipients of the award, and this year’s committee included, until his death, past NAALJ president Larry Craddock, who we are thinking of tonight. Julian Mann is the committee chair and the other members are Steve Wise and me. Cathy Bennett is a truly deserving recipient of this year’s Rosskopf award. The announcement of the award was sent out to NAALJ members by email once Cathy was selected by the Committee as this year’s honoree, and as I expect most of you saw and read it, I will not repeat it. Let me tell you, though, some of what led us to this decision. Cathy was an ALJ with the NYS Tax Appeals Tribunal and retired after close to thirty years of service this past July. Cathy has given of herself to NAALJ in so many ways: as president; as co-chair of two highly successful conferences in New York City, where it is nigh unto impossible to put together a profitable conference, as Cathy did twice; as co-chair of the important NAALJ sponsorship committee, whose revenue has helped make conferences such as this more affordable for attendees; and as a longtime supporter of the NALJ Foundation.

Volume 30, Issue 1 | March 2019 | Page 11 In New York, Cathy is a past president of the NY affiliate and was an active member of the state bar association’s committee on attorneys in public service, where she was an important voice in developing our model code of conduct for state administrative law judges. She has also been a presenter at several state bar CLE programs dealing with appearing before state administrative tribunals. Cathy’s enthusiasm for her profession is self-evident and we believe she is a most fitting recipient of this year’s award. Many of you may know that Cathy has been a fixture at our annual conferences dating back more than a dozen years, and of course, when we most want her to be here to present her with this award, she is on a long-planned trip to Turkey and Greece with her boyfriend, Gene. Anne Murphy, Cathy’s good friend, will accept the Rosskopf award tonight on Cathy’s behalf. Cathy has prepared some remarks which Anne will deliver.

ROSSKOPF ACCEPTANCE SPEECH of CATHERINE BENNETT

Good evening. I regret that I am unable to accept this award tonight in person. A long-planned trip (and over 5000 miles) unfortunately stood in my way. In my absence, I requested that my long-time friend and colleague, Anne Murphy, kindly accept it on my behalf. I would like to sincerely thank the NAALJ Rosskopf Committee for this distinguished honor and choosing me to stand among a group of professionals whom I certainly hold in very high esteem. The number of years and manner in which I dedicated my professional life to administrative adjudication was not by chance, but largely by design. The New York State Division of Tax Appeals, where I spent 29 years adjudicating disputes, was created in 1987. Not long after its creation, I was on a mission to take advantage of an opportunity to practice in the field of taxation in a position where I could truly make a difference. Although the decisions rendered by me as an ALJ were not in and of themselves precedent setting, when confirmed on appeal (and even sometimes when they were not confirmed), my conclusions and the reasons for such determinations made a difference. In addition, one of the key factors attributed to my agency that made the outcomes so relevant, was the independence we were given to write decisions in accordance with the law without any revenue or policy pressure from the agency. That is the holy grail of public service as an ALJ. I was able to call them like I saw them and make final decisions. I was in a position to make a difference, and I did. But that’s not where my professional life ended. When Marc Zylberberg (another NY member) walked into my office one day about 20 years ago to share information about NAALJ membership and its benefits, my life would be forever changed. There not only stood another opportunity for me to serve and make a difference, but it offered me rewarding opportunities to travel to conferences in cities I may have never visited, meet professionals I may have never met, be exposed to diverse topics and a means to analyze them, and probably most importantly, the opportunity to make the friendships I have with many of you. I may be designated as the “winner” of this award this evening, but the result of my rich journey of public service, endeavors affecting administrative adjudication, and my service to NAALJ and NYSALJA, is that we are all winners. Thank you again for this honored moment and enriching my career with this distinguished award!

NAALJ Past President Jim Murray Retires

from the Maryland Office of Administrative Hearings

Jim Murray, one of the original ALJs of the Maryland OAH retires from the OAH (again!) this month. He originally came to the OAH from the MD Department of Personnel, where he was a hearing officer. Before that, he was the Chief Hearing Officer for the MD Division of Correction. Judge Murray began with the OAH on January 1, 1990 and served as the OAH’s Deputy Director of Operations and Director of Operations from 1992 to 2001. He first retired from State Service in June 2011, after thirty-three years of service, to take the position of Deputy Director of the National Appeal Division of the USDA. Having had prior federal service, in February 2016, Jim retired from the USDA and returned to the OAH as an ALJ.

Jim has been a member of NAALJ since 1996 and is a frequent attendee and occasional presenter at NAALJ conferences. In 1996 he and others, most notably Mike Nolan, formed the first Maryland NAALJ affiliate, the Maryland Association of Administrative Adjudicators (MAAA). In 1999, Jim was the president of the Maryland affiliate. In 2004, the DC OAH began operations. MAAA was disbanded and Jim, Mike Nolan, Tyrone Butler, and Neal Alexander, among others, started the MD/DC Association of Administrative Law Judges (MDDCAAJ). Jim served as president of the MDDCAAJ from October 2007 through June 2009. His tenure was extended because he had to fill in due to the untimely death of Judge Alexander. In 2009, Jim presided over the splitting up of the MDDCAAJ. By then, the DC OAH was thriving and felt it could sustain its own affiliate. That same year, Maryland formed a new affiliate, the Maryland Association of Administrative Law Judiciary. Jim was the first President.

Judge Murray was also active in NAALJ on the national level. He was elected to the NAALJ board for 2009-2011 and was President in 2013. He co-chaired NAALJ conferences for 2004, 2007, 2013 and 2012 and the 2015 mid-year. Judge Murray also chaired the NAALJ Audit Committee for 2016-17 and was Secretary for 2017-2018.

According to Judge Murray, this retirement is his final one. He does not intend to “unretire” again. Nevertheless, Jim says he will continue to be involved with administrative law in some capacity and will remain active in MAALJ and NAALJ.

The Iowa Association of Administrative Law Judges (IAALJ) is hosting a CLE on Monday, April 22, 2019. The CLE will have speakers covering decision writing, recent administrative law decisions, a look at the Iowa Court of Appeals and other judicial perspectives from the Iowa Supreme Court. It will be held at the Iowa State Bar Association from 8:00 a.m. to 4:30 p.m. Please save the date!

Over the past several years, NC OAH has consistently increased the use of technology in the courtroom. The first upgrade was the installation of a teleconferencing/recording system that made it possible to conduct entire hearings on the record, allowing multiple parties to remotely participate. This equipment was installed in one courtroom that was dedicated to Medicaid recipient appeals. These Medicaid hearings often required remote participation by multiple parties and witnesses under a statutorily mandated expedited time limit and under relaxed procedural rules.

In the winter of 2019, this technology was significantly expanded to include all OAH courtrooms which are now upfitted with teleconference, videoconference and skype capabilities that allow for greatly enhanced remote participation. Additional upgrades allow content presentation through document cameras, DVDs, laptops in addition to the enhanced wall-mounted monitors in the courtroom. This content is viewable from the counsel tables, the witness stand and the judge’s bench. Each station is equipped with tabletop monitors. One feature of this technology allows witnesses to illustrate testimony while annotating documents, simultaneously capturing these annotations on the tabletop screens. All of the screens are controlled by the presiding judge.

Combining this new courtroom technology with the existing e-filing system that was installed two years previously, has dramatically improved efficiency with case filings and presentation of evidence along with enhanced remote participation. Ultimately, these technological advances have significantly improved the contested case hearings’ services provided to the citizens of North Carolina. Hon.
