The next Local 142 Executive Board (LEB) meeting is scheduled to start at 9:00 am on March 16, 2012,in Honolulu at the ILWU building on 451 Atkinson Drive. ILWU members are welcome to attend as observers.
Legislative Priorities of 2012 This year, seven priority issues will guide the work of the ILWU during the 2012 Legislative Session. Some of our priorities have not changed from previous years. Issues like worker retention, supporting senior programs and protecting workers’ compensation still hold significance to the betterment of our lives. Hawaii is proud of all things “local”, but as one of the most oil dependent states, we have given up more of our independence. No more. We are a free people and we must declare our independence from imported oil, high prices, and the minority outside influences that try to tell us what is good for our islands. Electric rates in Hawaii are the highest in the nation. Seventy-five percent of our electricity comes from petroleum products. Last year, we sent $7 billion of our money outside the state to pay for oil. Our top 2012 legislative priority is to support legislation that promotes local renewable energy resources and a grid that will connect all of us creating true Local Power. 1. Renewableenergyresources.
Supportlegislationfordevelopmentofrenewableenergyresourcessuchaswind,geothermal,solar,biofuels,biomass,oceanthermalenergyconversioetc.andtheinfrastructureneededtosustainastatewidepowergrid.
2. Workerretention.Supportlegislationtoprotectjobsandemploymentwhencompaniesarepurchased,ownershipormanagementchanges,aleaseistransferred,orassetsaresoldand/ortransferredandthebusinessoperationscontinueinasimilarmannerasunderthepreviousownerormanagement.
3. Workers’Compensation.a. Maintaintheexisting
“presumptionclause”intheWorkers’Compensationlaw.
b. RequiremutualagreementoftheclaimantandtheinsurerforselectionofaphysiciantoperformanIndependentMedicalExamination(IME).EstablishpanelsofmedicalproviderstoassistclaimantsintheselectionofanIMEphysician.ProvidethataratingshallnotbeperformedatthesametimeastheIME.
c. ProvidethatinjuredworkersreceiveTemporaryTotalDisability(TTD)paymentsandmedicaltreatmentwhiletheirclaimsare
underinvestigationorappeal.Ifcompensabilityislaterdenied,theclaimantwillnotbeheldliableforreimbursement of benefits earlier paid.Providefortimelypaymentswhenaclaimismade.
d. Providethat,ifaninjuredworkerisinitiallydeniedcompensabilitythenawardedcompensabilityonappeal,thecostoftheappealwill
bepaidbytheinsurer.e. Addresstheproblemofphysicians
decliningtoacceptinjuredworkersaspatientsbecauseofthe“paperwork”and/orthemedicalfeescheduleundertheWorkers’Compensationlaw.
4. Harbordevelopment.StrongsupportfordevelopmentofharborsthroughouttheStateofHawaii,basedonprioritiesestablishedbytheHHUGstudy.Priorityshouldbegiventothedevelopmentandmaintenanceoffacilitiestosustainthegrowthofmanifestedcargooperationswithoutcompromisingsafeworkingconditionsforworkers.
5. Seniorprograms.Strongsupportforprogramstoaddresstheneedsofthegrowingpopulationofseniorsandthedisabled.SuchprogramsincludeKupunaCare,caregiversupport,protectionofthevulnerableelderly,resourcesforcaregiversandcarerecipients,etc.
6. TransientAccommodationTax(TAT).OpposetheState“taking”thecounties’shareoftheTAT.
7. Railtransit. Reaffirm support for therailtransitprojectonOahubysupporting,ifnecessary,retentionofthe.5%generalexcisetax(GET)assessedonlyintheCity&CountyofHonolulubeyondthe12/31/2022sunset.OpposetheState“taking”or“redirecting”therailtax.

First,IwouldliketothankDonnaDomingo,ourvicepresident,andallwhowillworkwithher.Totakeovertheoffice and complete the unexpiredtermwillpresentchallenges,but I am confident in Donnaandthesupportshehasalreadystartedtoreceive.ShewillmakeILWUhistoryasthe first woman serving as president andwearefortunatetohavesuchastronganddedicatedleadersteppingupandcontinuingtomodernizethisunion.
In the last five years, we have faced
historiceconomic,socialandpoliticalchallenges,anddisappointments.Thepublichaslosttrustingovernment,banksandcorporations.Inprotesttothegrowingeconomicinequality,wehaveseentheOccupyWallStreetmovementtakeovercitiesanduniversities.
Wehaveseenstudentspepper-sprayedbycollegecampuspolice,ourveteransbeatenandshotintheheadwithteargascanisters,ourWashingtonLongshorebrothersandsistersarrestedforprotectingwhatwaspromised.

toparticipateinthepoliticalprocessinmanyways,includingbecomingknowledgeableabouttheissuesthataffectworkers,registeringtovote,andvolunteeringforcandidates.

TheHawaiiMedicalCenter’sbankruptcyforcedtheclosureofitsEwaandLilihahospitalsonJanuary4,ofthisyear.Grievanceswerefiled on 21-day notice, WARN Act andPTOpaymentforourmembers.Theunitwillmoveforwardwiththedisbursementoftheunitfund.Itisunfortunate,notonlyforourmemberstolosetheirjobs,butforthecommunitytoloseitshospitals.Statesenatorswanttoknowhowmedical
serviceshavebeenaffectedwiththeseclosures.TheywillbemeetingwithrepresentativesfromtheHawaiiHealthSystemsCorporation,thestateDepartmentofHealth,QueensMedicalCenter, Hawaii Pacific Health, Kaiser, HMSAandHonolulu’sEmergencyMedicalServicesDepartment.Thismeeting will help lawmakers figure out whatdirectionthestatewillneedtoheadinregardstohealthcareissues.
