Mr. Jack introduced Ms. Kim Farrar, the new VDOT Director of Programming and Investment Management for the Hampton Roads District. Chairman Drumwright suggested that Item 11, Indian River Road/Kempsville Road Non-Traditional Intersection Improvements, be moved up to just after Item 7, in appreciation for Virginia Beach staff agreeing last month to defer this item to this month. Mr. Gey Moved to approve the Chair’s suggestion; seconded by Mr. Sorey. The Motion Carried. Summary Minutes Chairman Drumwright indicated the TTAC Summary Minutes of September 1, 2010 were included in the October TTAC Agenda. He asked for any corrections or amendments to the minutes. Ms. Whitney Moved to approve the minutes as written; seconded by Mr. King. The Motion Carried. FY 2009-2012 Transportation Improvement Program Revision: Request to Reallocate CMAQ Funds - Norfolk Mr. Brown explained the request to transfer Congestion Mitigation and Air Quality (CMAQ) Improvement Program funds from the Norfolk Automated Traffic Management System (ATMS) Phase III project (UPC# 79114) to the Norfolk Light Rail Transit (LRT) project (UPC# T1822). Mr. Brown noted that in order to obligate the funds, the City would need to conduct a competitive procurement process to select a contractor for the work or establish an agreement with a VDOT approved Indefinite Quantity (IDQ) contractor. has a contracting mechanism in place that would allow the funds to be obligated and put to work more quickly. For that reason, the City has requested the following fund transfers from the Norfolk ATMS Phase III project (UPC# 79114) to the Norfolk LRT project (UPC# T1822): • $2,425,000 in FY 2010 CMAQ funds • $300,000 in FY 2009 CMAQ funds Mr. Brown Moved to approve of the CMAQ fund transfer and the associated TIP Amendment; seconded by Mr. Pullen. The Motion Carried.

FY2009-2012 Transportation Improvement Program Revision: Request to Reallocate RSTP Funds - Chesapeake Mr. Sorey explained the request to transfer Regional Surface Transportation Program (RSTP) funds from two current RSTP projects – Mount Pleasant Road Widening (UPC# 84359) and Southeastern Parkway Corridor Preservation (UPC# 64058) – to the U.S. Route 17/Dominion Boulevard project (UPC# 56187), noting that the Mount Pleasant Road project currently has a $10 million fund deficit and that the Southeastern Parkway project has had RSTP funds tied up for some time, but has no record of decision and so cannot proceed. Referring to updated figures from VDOT, Mr. Sorey stated that the amount of funds to be transferred will be less than what was identified in the letter attached to the agenda. The revised amounts to be transferred are as follows:

• UPC# 84359 – Transfer $14,085,255 RSTP, including match, to UPC # 56187 • UPC# 64058 – Transfer $998,734 RSTP, including match, to UPC# 56187 Mr. Sorey Moved to approve the RSTP fun transfer and the associated TIP Amendment; seconded by Mr. Slaughter. The Motion Carried.

FY2009-2012 Transportation Improvement Program Amendment: Virginia Beach Mr. Pullen explained the request to revise the cost estimate for the Princess Anne Road/Kempsville Road Intersection Improvement project (UPC# 51866), noting that the total project cost has increased from $75,524,000 to $89,640,000 due to unforeseen acquisition costs. Mr. Pullen further noted that the City has appropriated the increase of approximately $14 million in local funds and that advertisement of the project is anticipated in late October 2010. Mr. Schnaufer Moved to approve the TIP Amendment; seconded by Mr. Hartman. The Motion Carried. Attachment 4

Indian River Road/Kempsville Road Non-Traditional Intersection Improvements Mr. Gey began his presentation by noting that the Indian River Road/Kempsville Road intersection is the most congested intersection in the City of Virginia Beach, having a higher daily traffic volume than the Hampton Roads Bridge-Tunnel. He continued by noting that the high traffic volumes and land use in the area presents significant challenges with regard to improving traffic conditions at the intersection. Mr. Gey stated that the City had considered a wide range of options for improving traffic conditions at the intersection. Of the traditional approaches considered, adding a through lane in each direction would cost $37 million and not provide significant improvement in congestion. Constructing an urban interchange at the site would cost $60 million and, while it would provide significant improvement to congestion, in addition to the prohibitive cost, such a facility would have a high negative impact on surrounding business. Mr. Gey then turned the presentation over to Mr. Lowman, who briefed the TTAC on the non-traditional options considered for improving the intersection. Mr. Lowman stated that the City, along with its consultant, considered more than twelve non-traditional options. Following an initial review, the list of options was reduced to seven. Following an in-depth evaluation of the seven options, the City has focused on a concept that includes Median U-Turns (MU) on Indian River Road and Displaced Left-Turns (DL) on Kempsville Road at an approximate cost of $10 million. Mr. Lowman then showed a computer simulation of the MU/DL concept in operation. The TTAC took no action on this item. VDOT 2010 Performance and Financial Audit Mr. Jack stated that the full audit document is accessible online and recommended that TTAC members review the document. He noted that the Governor gave the Secretary of Transportation and the VDOT Commissioner 45 days (from September 23, 2010) to develop a full action plan to address the audit findings. Mr. Jack suggested that comments from the TTAC be sent through HRTPO staff or to the Commissioner directly. Ms. Ravanbakht stated that the HRTPO staff has already begun discussions with VDOT staff on the audit and noted the recommended action for this agenda item, which called for the TTAC to recommend that the HRTPO offer its assistance to the State in its efforts to develop a spending plan. Ms. Ravanbakht noted that the recommendation from the TTAC would be formalized in a HRTPO Board resolution, a draft of which will be included in the October Board agenda packet. Mr. Keifer suggested that the recommendation from the TTAC be amended to state that it is recommended “that the HRTPO offer its assistance to the State in its efforts to develop a spending plan and streamline project review procedures.” Mr. Keifer Moved to approve the recommended action, with the suggested amendment; seconded by Mr. Brown.

During discussion following the motion, Mr. Raliski asked whether the TTAC would have an opportunity to comment on the Commissioner’s plan and Mr. King asked whether VDOT would provide the TTAC with updates during the 45-day period. Ms. Ravanbakht stated that HRTPO staff has requested an update from VDOT at the November TTAC meeting, but has not, as of yet, received a response from VDOT on that request. Following the discussion, the vote was taken and The Motion Carried, with VDOT representatives abstaining from the vote. 2034 LRTP Project Prioritization: Schedule Ms. Ravanbakht noted that this item was primarily a status report to advise the TTAC of the Board’s action at their September 15, 2010 meeting. Ms. Ravanbakht stated that the Board approved the TTAC recommendation to take a couple of months to make needed adjustments to the prioritization tool and to provide the advisory committees with an opportunity to comment on the changes. She noted that the Board also requested that a single, final score be provided for each project at the end of the prioritization process. Mr. Schnaufer noted the importance of TTAC members advising their Board members on this issue so they will have a thorough understanding of the process when they attend the Board meeting. Mr. Schnaufer made particular note of fact that the prioritization tool is just one aspect of the final prioritization of projects. The TTAC took no action on this item. 2034 LRTP Project Prioritization Outreach Strategy Ms. Miller briefed the TTAC on public outreach strategies that will be implemented over the course of the next two months in coordination with the 2034 LRTP Project Prioritization Process. Ms. Miller highlighted the following strategies:

• School Outreach Program – Building on the school outreach pilot project conducted by the HRTPO staff in cooperation with a Virginia Beach elementary school last year, the HRTPO staff will expand the program to include 2 schools – one in Virginia Beach and one in Hampton. HRTPO staff will spend two full days at each school facilitating this education campaign to engage students and their parents in the planning process. This strategy will entail engaging 5th grade classes at each school to construct Box Cities. Parents and faculty will be invited to an evening meeting to see the results of their students work on the Box Cities, as well as to be engaged by HRTPO staff on Prioritization and the LRTP. • College Outreach Program – HRTPO staff will work with students from Old Dominion University and Hampton University that are working on transportation-related class projects. The class projects will be presented to a group at HRTPO, which will provide feedback to the students.

• Community Conversations – HRTPO staff will hold special informational meetings with five groups: Military Wives on the Peninsula, the Chesapeake Task Force on Aging, Mount Pleasant Baptist Church in Norfolk, Historic Triangle Senior Center in Williamsburg, and the Mexican-American Club of Hampton Roads. • Media Outreach – Press releases will be prepared and disseminated throughout the public involvement phase of the LRTP and Prioritization. In addition to mainstream media, special efforts will be made to engage news outlets geared toward minority communities. • Email and Mail Campaign – The HRTPO’s contact lists, which include more than 6,000 addressees, will be enhanced and utilized to disseminate information and gain feedback on the LRTP and Prioritization. Surveys and informational mailings will be used. Ms. Miller continued by summarizing other means of outreach to be used, including the HRTPO website and blogs, HRTPO advisory committees and associated subcommittees, and posting of materials at public libraries. She emphasized that additional outreach measures will be implemented to engage traditionally underserved communities, noting that Visiting Nurses, Meals on Wheels, para transit agencies, and other like agencies will be asked to disseminate information about Prioritization and the LRTP to their clients. Ms. Ravanbakht stated that the next portion of the presentation would be on the visualization aspect of the outreach plan and turned the presentation over to Mr. Pérez. Mr. Pérez demonstrated a web application built on the Google Earth platform that allowed users to obtain information on LRTP projects by clicking on project identifiers overlaid on a map of the Hampton Roads region. Following the presentation, the TTAC was asked to review the outreach strategies and the visualization application and provide comments to HRTPO staff by October 20, 2010. The TTAC took no action on this item.

Regional Performance Measures Mr. Case noted the Virginia legislation that refers to regional performance measures and includes a deadline of July 1, 2011 to have the measures in place. He pointed out that the legislation does not provide specific measures, but provides categories for which measures are desired. He also noted that the State has engaged a consultant to assist MPOs in developing a report template that can be used for reporting consistency. Directing the committee’s attention to an attachment that included draft performance measures, Mr. Case stated that TTAC assistance will be needed for setting targets for each of the performance measures. Mr. Case stated that the current schedule calls for final approval of the performance measures and targets by the TTAC and HRTPO Board in January 2011. Attachment 4

Following some discussion, Mr. Rucker suggested that some type of performance measures related to financial aspects of a project be included. Ms. Ravanbakht recommended that the subcommittee to be formed for this task review public comments received on this topic and that financial measures be included in the performance measures. Ms. Whitney Moved to approve the draft performance measures, to include some financial-related measure; seconded by Mr. Cannady. The Motion Carried, with Mr. Slaughter voting no. Correspondence of Interest Ms. Ravanbakht noted a handout that contained a letter from VDOT Commissioner Whirley to General Assembly Delegate Oder in response to the delegate’s letter. Public Comments Chairman Drumwright noted the public comments included in the agenda packet, as well as a handout that included one additional public comment for the TTAC. For Your Information Mr. Raliski expressed particular interest in Item 15C, Review of Unobligated CMAQ/RSTP Funds: Status Report. Ms. Farrar assured the TTAC that this is a very high priority item for VDOT and that the current plan calls for coordination meetings with the localities to begin near the end of October. Mr. Keifer asked when this process will be completed. Ms. Ravanbakht asked the VDOT representatives whether the process would be completed by December 2010, to which VDOT staff replied in the affirmative. Ms. Ravanbakht noted Item 15E, Citizen Transportation Advisory Committee: Status Report, stating that the CTAC had formalized its recommendations on two issues in the form of resolutions that will be presented to the Board at its October meeting. Ms. Ravanbakht noted Item 15F, Draft HRTPO 2011 Legislative Agenda, stating that a list of legislative priorities assembled by the Legislative Ad-Hoc Committee will be considered by the Board at its October meeting. Old/New Business Mr. Pullen expressed a concern regarding CMAQ and RSTP projects, stating that the process in place is pushing the limits. He noted that up to now the TTAC has generally agreed to move money within localities from one CMAQ or RSTP project to another, but some of the transfer requests have been extreme in terms of the amount of money requested to be transferred. Mr. Pullen also stated that the TTAC will have to determine what will be done with any funds found to be available following the completion of work on the review of unobligated CMAQ/RSTP funds. He suggested that the TTS will probably need to convene to discuss these issues.

AGENDA ITEM #5: 2030 LONG-RANGE TRANSPORTATION PLAN AMENDMENT – ROUTE 460: VDOT

SUBJECT: Request by VDOT to amend the 2030 LRTP to include construction improvements to the Route 460 corridor. BACKGROUND: Attached is a request from VDOT Commissioner Gregory Whirley to amend the Hampton Roads 2030 Long-Range Transportation Plan (LRTP) to include construction improvements to the Route 460 corridor. The Route 460 project is currently included in the 2030 LRTP as a Preliminary Engineering (PE) Only project. According to the Commissioner’s letter, the construction of a new Route 460 is a top priority for the Governor and improvements to the corridor are critical to the continued growth and success of the Port of Virginia as well as economic growth of the Commonwealth. An improved Route 460 will also provide a critical evacuation route for the Hampton Roads region in times of emergency. The Commonwealth has received and is currently evaluating proposals from three private consortiums to build this facility as a public private partnership. VDOT has been working with the Federal Highway Administration to develop financial documentation to demonstrate that the construction of a new location Route 460 is viable and can be included in the Hampton Roads 2030 LRTP. The three private sector proposals will be published on VDOT’s website for HRTPO review and comment. It should be noted that this LRTP amendment will require a coinciding air quality conformity analysis. The public review and comment period for this 2030 LRTP amendment request began on October 27, 2010 and runs through November 10, 2010. AGENDA ITEM #6: REVIEW OF TIP REVISION PROCEDURES SUBJECT: Review and clarification of the TIP Revision Procedures that were approved by the TTAC during its July 7, 2010 meeting. BACKGROUND: Localities and transit agencies regularly submit requests to the HRTPO to revise project information in the Transportation Improvement Program (TIP) or to transfer Congestion Mitigation and Air Quality (CMAQ) Improvement Program or Regional Surface Transportation Program (RSTP) funds from one project to another. In the past, there have been several instances in which the amounts of available funds to be transferred as specified in the locality or transit agency request letter did not match the funding information maintained by the VDOT Programming Division. The usual cause for such a discrepancy has been that the locality or transit agency did not have the latest expenditure figures for the affected projects. To help resolve this problem, HRTPO staff, in coordination with staff from VDOT and DRPT, developed a set of procedures for revising the Hampton Roads TIP. The Procedures include five steps and associated timeframes to help ensure appropriate coordination between localities or transit agencies, VDOT, DRPT, and the HRTPO. HRTPO staff has produced a calendar (attached) that shows the dates for the three most critical steps in the Procedures:

• Deadline for locality/transit agency to submit proposed TIP revision to HRTPO and VDOT or DRPT for initial review • Deadline for VDOT/DRPT to respond to locality/transit agency • Deadline for locality/transit agency to submit final TIP Amendment request letter to HRTPO The Procedures and calendar can be found on the TIP page of the HRTPO website at: http://www.hrtpo.org/TPO_TIP09_12.asp. AGENDA ITEM #7: REVIEW OF UNOBLIGATED CMAQ/RSTP FUNDS: STATUS REPORT SUBJECT: Strategy and schedule for addressing the reconciliation of projects in Categories A and C so that surplus funding can be released for reallocation. BACKGROUND: In response to a request by the TTAC during its meeting on April 7, 2010, VDOT conducted a review of Hampton Roads highway projects funded with Congestion Mitigation and Air Quality (CMAQ) Improvement Program and Regional Surface Transportation Improvement Program (RSTP) funds. VDOT completed its review on June 22, 2010, identifying more than $70 million in CMAQ and RSTP funds (including match) that may be available for reallocation to projects in need of funding. For the VDOT review, CMAQ and RSTP projects were organized into the following four categories: Category Description Estimate of Funds That May Be Available for Reallocation A Projects that appear to be completed and funded with only CMAQ and/or RSTP funds $11.0 million B Projects that appear to be underway and funded with only CMAQ and/or RSTP funds $30.3 million C Projects that appear to be completed and funded with CMAQ and/or RSTP funds, plus other funds $3.7 million D Projects that appear to be underway and funded with CMAQ and/or RSTP funds, plus other funds $28.5 million Total $73.5 million An initial assessment by HRTPO staff of the VDOT review of unobligated CMAQ and RSTP funds found that, contrary to providing a final accounting of funds available to be reallocated, the VDOT review provides a good first step in the reconciliation of unobligated funds. A complete reconciliation of the allocations, obligations, and expenditures associated with CMAQ and RSTP projects will be required in order to determine the funds that are actually available to be reallocated. As recommended by the TTAC, the reconciliation of projects in Categories A and C will be handled first. The process will require meeting with each locality to systematically review each project included in the VDOT review to determine the specific steps necessary to financially close the project so that surplus funding can be released. For the reconciliation meetings, localities should be prepared to:

• Confirm that all project work is complete and that a C-5 Form has been submitted to VDOT • Confirm that final invoicing has been submitted to VDOT • Confirm that final payment has been received • Identify any discrepancies they are aware of regarding project expenditures and project allocations (with supporting documentation)

AGENDA ITEM #8: TRANSIT VISION PLAN PHASE II: STATUS REPORT SUBJECT: The Virginia Department of Rail and Public Transportation (DRPT) will provide an update on Phase II of the Transit Vision Plan. BACKGROUND: The Virginia Department of Rail and Public Transportation (DRPT) is managing the development of Phase II of a Transit Vision Plan (TVP) for Hampton Roads. The goal of the TVP is to lay out a robust transit network which can provide substantial mobility by means other than the automobile. The information and recommendations from the TVP will support the development of a fiscally constrained 2034 Long-Range Transportation Plan for the region. Draft recommendations for the Hampton Roads Regional Transit Vision Plan have been developed. AGENDA ITEM #9: 2009 SOCIOECONOMIC DATA BY TRANSPORTATION ANALYSIS ZONE: FINAL REPORT

SUBJECT: HRTPO staff has completed an identification of 2009 residential and employment data by transportation analysis zone. BACKGROUND: The region’s travel demand model will undergo a model validation over the course of the next year. The most recent validation was for the year 2000 and federal air quality conformity regulations state that a validation of the model must be made “for a base year which is not more than 10 years prior to the date of the conformity determination.” Validation refers to the model’s ability to replicate travel in the region. The model validation effort is being headed by the VDOT modeling staff in Richmond in coordination with HRTPO staff. To assist in this effort, HRTPO staff used the Geographic Information System (GIS) to determine the location of residential and employment data with respect to transportation analysis zones (TAZs) in the region. TAZs are relatively small areas used in the travel demand model; there are approximately 1,100 TAZs in the region (urban and rural). Determining the location of residential and employment data by TAZ is a very labor-intensive effort that spanned the past year. Some of the data sources included the Virginia Employment Commission, ESRI Business Analyst, Census data, U.S. Bureau of Economic Analysis (BEA), and the HRPDC Data Book. The draft report was reviewed by TTAC this past July and comments have been incorporated. The final report is enclosed. AGENDA ITEM #10: HRTPO ADVISORY COMMITTEES: STATUS REPORT SUBJECT: Update on activities of HRTPO Advisory Committees. BACKGROUND: As prescribed in the TTAC Bylaws, Article 9, Section 1, the “HRTPO Deputy Executive Director will ensure that the TTAC is kept apprised of relevant issues being considered, discussed, or addressed by all advisory committees of the HRTPO Board.” A. Citizen Transportation Advisory Committee (CTAC) The HRTPO Citizen Transportation Advisory Committee (CTAC) has held five meetings since March 2010. Over the course of its meetings, the CTAC has received presentations on transportation funding, the Congestion Management Process, project prioritization, HRTPO efforts associated with high-speed and intercity passenger rail service, and transportation congestion and mobility issues of the military in Hampton Roads. During its most recent meeting on September 9, 2010, the CTAC organized its recommendations to the HRTPO Board in the form of two CTAC resolutions (attached) regarding: 1. Transportation Funding and Mobility Issues - The CTAC resolution endorses:

• An increase in the statewide fuel tax and indexing such tax to inflation in the future to provide a necessary increase in transportation funding throughout Virginia, and • Aggressive consideration of new dedicated sources of funding for transportation including, but not limited to, Regional Gas Tax, Tolls, and Region-Based Taxes and/or User Fees. This resolution also requests that the HRTPO publicize the resolution on its website and transmit the resolution to the elected officials of the cities and counties of Hampton Roads as well as to the Hampton Roads General Assembly delegation. 2. Briefings On Military Issues – The CTAC resolution recommends: • The HRTPO Board schedule an annual briefing from a representative of the Navy, and • A representative of the military brief the Commonwealth Transportation Board at least once every year. Both of the above resolutions were approved by the HRTPO Board during its meeting on October 20, 2010. A copy of the funding resolution has been distributed to elected officials of

Legislative Ad-hoc Committee In preparation for the 2011 General Assembly session, the HRTPO Board tasked the HRTPO Legislative Ad-hoc Committee with developing a set of legislative priorities to aid in the development of the HRTPO 2011 Legislative Agenda. At its September 23, 2010 meeting, the Legislative Ad-hoc Committee prepared its legislative recommendations, which were presented to the HRTPO Board as a draft resolution during the October 20, 2010 HRTPO Board meeting. The Board made two modifications to the draft resolution prior to approving the final version (attached). A copy of the legislative agenda resolution has been distributed to elected officials of the cities and counties of Hampton Roads as well as to the Hampton Roads General Assembly delegation. Attachment 10-B C. Freight Transportation Advisory Committee (FTAC) The HRTPO Freight Transportation Advisory Committee (FTAC) has met three times since March 2010. Over the course of its meetings, the FTAC has received briefings on a number of topics, including the HRTPO Project Prioritization Tool. In the attached FTAC Statement on

HRTPO Prioritization Tool, the FTAC provides several recommendations regarding the prioritization tool and process. The attachment will also be included in the HRTPO Board agenda for November 2010. HAMPTON ROADS TRANSPORTATION PLANNING ORGANIZATION BOARD RESOLUTION 2010-09

A RESOLUTION OF THE HAMPTON ROADS TRANSPORTATION PLANNING ORGANIZATION ENDORSING THE HRTPO 2011 LEGISLATIVE AGENDA. WHEREAS, the Hampton Roads Transportation Planning Organization (HRTPO), designated by the Governor of the Commonwealth of Virginia in accordance with Section 134, Title 23, United States Code (23 USC 134) and applicable federal and state regulations, is the policy body responsible for the urban transportation planning and programming process of the Hampton Roads metropolitan planning area; WHEREAS, the Hampton Roads metropolitan planning area includes the cities of Chesapeake, Hampton, Newport News, Norfolk, Poquoson, Portsmouth, Suffolk, Virginia Beach, and Williamsburg; the counties of Isle of Wight, James City, and York; and a portion of Gloucester County; WHEREAS, the HRTPO Board is comprised primarily of local elected officials and General Assembly members, representatives from the regional transit authorities as well as from state agencies such as the Virginia Department of Transportation, Department of Rail and Public Transportation, Virginia Port Authority and Virginia Department of Aviation, and federal agencies such as the Federal Highway Administration, Federal Transit Administration, and Federal Aviation Administration; WHEREAS, the HRTPO Legislative Ad-hoc Committee developed a list of legislative priorities to aid in the preparation of the HRTPO Legislative Agenda for the 2011 General Assembly session; WHEREAS, the HRTPO has compiled the following legislative priorities to form the HRTPO 2011 Legislative Agenda for the purpose of conveying the information to the General Assembly for its review, consideration and approval for the 2011 General Assembly session:

• The HRTPO supports legislation that requires sufficient funds to be provided to fully fund the Highway and Maintenance Operating Fund. • The HRTPO supports the rescission of paragraphs 5a and 5b from Item 436 in the 2010-2012 Virginia Biennial Budget regarding the obligation and expenditure time limit provisions on projects receiving funding through the Regional Surface Transportation Program (RSTP). In lieu of rescission, the HRTPO supports the removal of the 12-month time limit on the federal obligation of the project’s allocation and supports the extension of expenditure of RSTP funds to 60-months to coincide with the local five-year Capital Improvement Programs. • The HRTPO supports legislation that allocates the necessary state funding to facilitate in the completion of the Midtown Tunnel and Martin Luther King Freeway (MLK) Extension project (UPC # 95149), which includes a new two-lane tunnel and upgrading existing two-lane in the Midtown Tunnel; extension of the MLK Freeway to I-264; and safety improvements in the Downtown Tunnel. • The HRTPO supports the codification of metropolitan planning organizations (MPOs) in the Code of Virginia to align with the federal regulations on transportation as they pertain to the role, responsibilities and products of MPOs in the transportation planning and programming processes. As I mentioned to you at the TTAC meeting on October 6th, there are many commercial interests in Hampton Roads that use our many interstates, highways, primary and secondary roads, and their concerns must be addressed in our 2034 Long Range Transportation Plan. Trucks bring the goods to Hampton Roads stores and businesses, businesses pay taxes that fund the highways, and the interstate system was founded to support the movement of goods and services throughout the country. This region is home to distribution centers, and from these centers flow the goods that you and I buy at our local stores such as Walmart and Target. These are the interests that are unrepresented at TTAC, yet they depend on the roads for their survival, and we as citizens depend on them for our economy. I realize that a Freight Transportation Advisory Committee has recently been established, but it has yet to mature and find a voice. Please take steps to assure that the commercial segment of our region is heard now in your outreach program.

AGENDA ITEM #13: FOR YOUR INFORMATION A. HRTPO DELEGATION ADDRESSES THE CTB A delegation from the HRTPO addressed the Commonwealth Transportation Board (CTB) during its meeting on October 20, 2010. HAMPTON ROADS SELECTED FOR FEDERAL PILOT PROJECT The Federal Highway Administration (FHWA) is developing a conceptual Risk Assessment Model that would be used to help decision makers identify transportation assets that are most exposed to threats from climate change and/or are associated with the most serious potential consequences of climate change threats. The conceptual model consists of three primary components:

• Develop an inventory of transportation assets • Gather climate information • Assess the risk to assets and the transportation system as a whole from projected climate change On October 8, 2010, FHWA announced the five locations selected for piloting the conceptual model. In addition to Hampton Roads, the pilot program will include the San Francisco Bay Area, Coastal and Central New Jersey, the State of Washington, and Oahu, Hawaii. C. ARRA TRANSPORTATION AND INFRASTRUCTURE REPORTING Congressman James L. Oberstar, Transportation and Infrastructure (T&I) Committee Chairman, pledged the Committee will closely oversee the implementation of transportation and infrastructure provisions of the American Reinvestment and Recovery Act (ARRA) to ensure the funds provided are invested quickly, efficiently, and in harmony with the job-creating purposes of this Act. TIGER II PROJECTS ANNOUNCED In an October 20, 2010 news release (attached), the U.S. Department of Transportation announced the 42 capital construction projects and 33 planning projects that were selected for funding under the Transportation Investment Generating Economic Recovery (TIGER) II program. The 70 projects selected to share nearly $600 million were selected out of nearly 1,000 proposals with a total cost of over $19 billion. In Virginia, the only recipient of TIGER II funding was a planning project in Richmond for Hull Street Corridor Revitalization. The study will support prior efforts by the City of Richmond that identified the Hull Street corridor as an underserved and disadvantaged area. The project, with a total cost of $613, 169, received a TIGER II grant of $100,000. HRTPO STAFF COMMENTS ON PROPOSED PPTA MANUAL AND GUIDELINES The Commonwealth of Virginia has developed a draft Public-Private Transportation Act (PPTA) Implementation Manual and Guidelines, which provides guidance for project development and implementation processes for both solicited and unsolicited PPTA projects. The document was released on September 28, 2010 for a 30-day pubic review and comment period. HRTPO staff has reviewed the draft document and provided the attached comments. Attachment 13-E

F. FHWA POLICY ON PERMISSIBLE PROJECT RELATED ACTIVITIES DURING THE NEPA

PROCESS The Federal Highway Administration (FHWA) has issued a new directive (attached) that clarifies the policy regarding the permissible project-related activities that may be advanced prior to the conclusion of the National Environmental Policy Act (NEPA) process. TRANSPORTATION ENHANCEMENT PROGRAM The Transportation Enhancement Program was first included in federal transportation legislation in the Intermodal Surface Transportation Efficiency Act (ISTEA) of 1991, and has been part of subsequent legislation including the current Safe, Accountable, Flexible, Efficient Transportation Equity Act: A Legacy for Users (SAFETEA-LU), which was enacted in 2005.

Secretary LaHood Announces More Than 70 Innovative Transportation Projects Competitively Funded Under TIGER IIRequests Top $19 Billion for $600 Million Program

Forty-two capital construction projects and 33 planning projects in 40 states will share nearly $600 million from the U.S. Department ofTransportation’s popular TIGER II program for major infrastructure projects ranging from highways and bridges to transit, rail and ports,Secretary Ray LaHood announced today.

Transportation Investment Generating Economic Recovery (TIGER) II received nearly 1,000 construction grant applications for more than$19 billion from all 50 states, U.S. territories and the District of Columbia.

The tremendous demand for TIGER II project dollars follows a similar demand for TIGER I project dollars. On February 17, 2009, theDepartment announced 51 grant awards from nearly 1,500 applications for TIGER I grants nationwide. The TIGER I requests were foralmost $60 billion worth of projects, 40 times the $1.5 billion available under that program. TIGER I dollars were made available under theAmerican Recovery and Reinvestment Act of 2009.

“These are innovative, 21st century projects that will change the U.S. transportation landscape by strengthening the economy and creatingjobs, reducing gridlock and providing safe, affordable and environmentally sustainable transportation choices,” said Secretary LaHood. “Many of these projects could not have been funded without this program.”

Roughly 29 percent of TIGER II money goes for road projects, 26 percent for transit, 20 percent for rail projects, 16 percent for ports, fourpercent for bicycle and pedestrian projects and five percent for planning projects. An example of projects funded is $47.6 million to the City of Atlanta to construct a new streetcar line connecting many of the mostimportant downtown residential, cultural, educational and historic centers, demonstrating the Department’s commitment to improvingquality of life in major metropolitan areas.

TIGER II also provided $20 million to the New Hampshire Department of Transportation to replace the deteriorating Memorial Bridge thatconnects Portsmouth, NH, with Kittery, ME. The bridge is at the end of its service life and has a bridge sufficiency rating of six out of 100. Safety concerns recently required a maximum three-ton weight restriction on the bridge, causing all truck traffic to be detoured. The projectdemonstrates the Department’s commitment to bringing the nation’s aging road and highway infrastructure to a state of good repair.

In addition, TIGER II funds are being used to support a $546 million TIFIA (Transportation Infrastructure Finance and Innovation Act) loanfor the Los Angeles County Metropolitan Transportation Authority to build the Crenshaw/LAX Light Rail Line, a key piece of MayorAntonio Villaraigosa’s 30/10 initiative to construct 12 major transit projects in 10 years rather than 30, exemplifying the Department’scommitment to bold, regional transportation projects that create jobs in the short term while reinvesting in long term economiccompetitiveness and livability.

Under TIGER II, more than $140 million is reserved for projects in rural areas.

As a competitive program, TIGER II is able to fund the best projects from around the country. Using merit-based evaluation criteria allowsthe Department of Transportation to address some of the nation’s most critical challenges like sustainability and economic competitiveness.

This marks the first time that the U.S. Departments of Transportation and Housing and Urban Development (HUD) have joined together inawarding grants for localized planning activities that ultimately lead to projects that integrate transportation, housing and urbandevelopment. Almost 700 applicants sought up to $35 million in TIGER II planning grants and up to $40 million in HUD SustainableCommunity Challenge Grants. HUD’s funds can be used for localized planning efforts, such as development around a transit stop and zoneor building code updates and improvements. The two Departments, along with assistance from the Environmental Protection Agency andthe U.S. Department of Agriculture, participated in the evaluation of the planning grant applications.

To ensure the important investments made by the Recovery Act continue, President Obama recently announced a comprehensiveinfrastructure investment plan that would be front-loaded with $50 billion to expand and renew America’s roads, railways and runways. To

The projects chosendemonstrate their ability to contribute to the long-term economic competitiveness of the nation, improve the condition of existingtransportation facilities and systems, increase energy efficiency and reducing greenhouse gas emissions, improve the safety of U.S.transportation facilities and/or enhance the quality of living and working environments of communities through increased transportationchoices and connections. The Department also gave priority to projects that are expected to create and preserve jobs quickly and stimulaterapid increases in economic activity.

About the Hampton Roads Transportation Planning Organization The Hampton Roads Transportation Planning Organization (HRTPO) is the Metropolitan Planning Organization (MPO) for the Hampton Roads area. • The PPTA manual should incorporate Federal regulations regarding the transportation planning and programming process, including interaction with metropolitan planning organizations (MPO). • Language regarding the Transportation Planning Process should be included in the manual. For example, the US DOT Manual for Using Public-Private Partnerships on

Highway Projects1 states: “In metropolitan areas, the project must be reflected in the financial plan that accompanies the Metropolitan Planning Organization’s (MPO) long‐range transportation plan and Transportation Improvement Program (TIP). In addition, the project must be included in the approved Statewide Transportation Improvement Program (STIP).” • A section should be dedicated to Interagency and Intergovernmental Involvement. Language should specify the roles and participation of local governing authorities and MPO’s during the PPTA process. • The manual should specify that VDOT must coordinate with and seek advice, input and participation of local governing authorities and MPOs of any solicited/unsolicited proposed PPTA project that falls within their respective jurisdiction. • The panel/committee that is responsible for making the recommendation of selecting a PPTA proposal should include membership from the participating local governing authority and respective MPO. At minimum, the panel/committee should

seek a recommendation from the local governing authority and MPO before making the final recommendation.

Section Specific Comments Section 3.1 Project Identification – Solicited Projects The MPO Long‐Range Transportation Plan should be included in the table on "Guidance: Potential Sources of Solicited Candidate PPTA Projects." Section 6.4 Project Procurement – Value-for-Money (“VfM”) – Part II This section states “The VfM methodology is publicly available to on the Department of Transportation’s website at http://www.virginiadot.org/business/ppta‐process.asp.” However, the methodology information at the described link cannot be found. Also, the word “to” should be omitted from the stated sentence. Appendix E Example PPTA Candidate Project Form The "MPO Long‐Range Transportation Plan" should be added to the choices among the "Applicable Commonwealth Transportation Plan" check boxes (see related comment above regarding Section 3.1).
