Caregiver’s Corner – Protect Senior Citizens From Financial Abuse by Kansas Attorney General Derek Schmidt

As we get older, we all may need some help from others. We mightneed help getting around town or with household chores. Often, seniors also ask for help with their finances from a trusted friend orloved one. Unfortunately, those who are placed in that position of trustcan sometimes take advantage of that role for their own financial benefit.

During fiscal year 2013, the Abuse, Neglect and Exploitation Unit ofthe Attorney General’s Office received 342 substantiated reports ofadult abuse. Of those, nearly 60 percent were cases of financial abuse, most often involving seniors. And, we know there are many morecases that go unreported.

In the past, the penalties for taking financial advantage of a seniordid not fit the crime. If cases were able to be prosecuted at all, thepunishment was usually very small. That is about to change.

This past spring, Kansas legislators created a new crime of “mistreatment of an elder person.” This new law, which takes effectJuly 1, makes it clear that financial abuse of senior citizens is a seriouscrime. It also explicitly states that violations of the Power of AttorneyAct or Kansas Uniform Trust Code are possible means of committingfinancial exploitation of a dependent adult or an elder person.

While this new law will help us prosecute those who financiallyabuse Kansas seniors, there are also some steps seniors can take toavoid becoming victims.

First, placing someone in a position of power over your finances –in either a power of attorney or a trust – is a very important decisionand should not be taken lightly. These documents can give anotherperson a wide range of authority over your finances. You shouldalways consult with a competent attorney before entering into theseagreements to be sure that the document accomplishes what youintend – and no more.

Second, the person you select to help manage your financesshould be someone you fully trust. He or she should also be compe-tent at managing financial matters, so pay attention to how he or shemanages his or her own money. You should also select someone whohas enough time to handle your financial matters in a timely andresponsible manner. The person will have access to your most person-al information, so he or she should also be willing to respect your confi-dentiality in these matters.

Third, remember, if you suspect an attorney-in-fact or trustee mightbe mismanaging funds, it’s okay to ask for help. Having an independ-ent third party, like an accountant, review your finances will help keepeveryone accountable.

As Kansans, we know it’s important that we watch out for oneanother. If you suspect a senior citizen is being taken advantage of,please report it to your local authorities or call our Medicaid Fraud andAbuse hotline at (866) 551-6328

What’s Happening to Grandpa?Book ReviewBy Maria Shriver & Illustrated by Sandra Speidel

Helping a young child understand Alzheimer’s disease can be a difficulttask. With insight derived from her own father’s struggles with Alzheimer’sdisease, Maria Shriver has done an excellent job creating a book thatencourages young readers to be aware, accept, and offers dialogue amongfamily and friends who are suffering with Alzheimer’s disease. “What’s happening to grandpa?, is a sensitively written book, that shows how children can be of help when dealing with a family member who hasAlzheimer’s disease or another form of memory loss by getting involved. The main character Kate has always adored her grandpa’s storytelling, butlately he has been repeating the same stories over and over again. One day, he even forgets Kate’s name. Her mother’s patient explanations open Kate’s eyes to what so many of the elderly must confront: Alzheimer’sdisease and other forms of memory loss. Determined to support her grandfather, Kate explores ways to helphim and herself by creating a photo album of their times together. The photo album helps to make memoriesthat will remain in their hearts forever.

This is a perfect book for any child that has a loved one that is dealing with Alzheimer’s disease or anoth-er form of memory loss. The book brings to life how precious and important our elders are in our lives. As inthe author’s other books, important points are highlighted in a larger font, and Sandra Speidel’s paintings cre-ate a very special feeling to go with the text.

For more information on reserving a copy of “What’s happening to grandpa?” by Maria Shriver, please callJenna Smith at 316-267-7333 or email [email protected].
