Greetings and welcome everyone to a brand new year. It is now 2018 and it gives me great pleasure to introduce the new Board to everyone. It is a new beginning, thus starts a new chapter for the Board of Architects Malaysia. First and foremost I would like to express my utmost appreciation to the past President Ar. Dato’ Sri Dr. Amer Hamzah Mohd Yunus for managing the Board to its current state. It is not an easy feat but I believe he has done a very commendable job taking LAM to where it is now.
The Board is here to regulate the architectural practice, as well as to look into the interest of the general public. We are constantly monitoring the activities in the market and we will direct our efforts to further strengthen the prevailing guidelines and regulation to ensure that the interest of our stakeholders are well in order.
On the education front, I am pleased to inform that the validation exercise undertaken by MAPS formerly known as MAPSM has bear fruit. We now have 17 foreign universities validated by the Board. We anticipate more will follow suit in the near future. This is a positive indication that the Board is moving in a right direction.
On the registration front, LAM will continue to encourage and increase the number of qualified members in the industry. The registration of Architectural Technologist and Inspector of Works will commence within the first quarter of 2018. To this end we have witness many successful achievements by our members through the LAM President Medal Award 2017. It is an achievement which is truly inspiring, an achievement which can only be garnered by being a professional architect. We encourage more individuals of this calibre to step forward and shine. This is a very rewarding profession. As a final note, I welcome again everyone to 2018, let’s make architecture exciting!

The advent of this new 2018 double issue of the re-vamped WARTA LAM marks a new start for the official publication of Lembaga Arkitek Malaysia (LAM). In current times, when the profession faces many new challenges, there is a need to compile information on LAM affairs and activities to members so that the functions of LAM as the profession’s regulatory body can be effectively circulated and disseminated.
It is my hope that the new WARTA LAM shall be one of the important tasks to be handled by LAM’s Public Relations Committee, of which I am currently the Chairman. As an important professional body whose board members are appointed by the Government, LAM must be seen as accessible and transparent in regulating the administration of all professions under its jurisdiction, which are covered under the Act. Members will then be regularly informed of the new policies and be aware of the many functions and activities of the various LAM committees. The new WARTA LAM aims to be the official medium in facilitating this primary objective and we will be introducing more programs for the year ahead.

The 87th Meeting of the ASEAN Coordinating Committee Meeting on Services (CCS) was held in Kuala Lumpur from 15 to 20 May 2017. Once again Malaysia play host to this prestigious event held at the Berjaya Times Square Hotel. It was a very lengthy event with several meetings held deliberating on various issues concerning the development of the architectural fraternity among others in the ASEAN region.
In the context of the ASEAN Architectural Council (AAC), the current statistics on the register members were highlighted. In addition, the meeting also tabled strategies to further promote the mobility of architects amongst the member states. Other matters highlighted were the AAC Quick Survey on the architectural practice and the field of specialization. In other matters, The ASEAN Architect Education Committee (AAEC) also highlighted the progress on the education front whereby the proposal on a feasibility study was deliberated at length to establish the Architecture Accreditation system in ASEAN.
In conclusion, it was a very fruitful event. The Board of Architects Malaysia held a dinner event with a note of appreciation to all participating representatives from the member states for a very productive session.

A workshop was organized by the Architectural Society of China from 14 to 20 January 2017. This was an international event gathering young architects from across the world to participate in a collaboration of architectural expertise to establish a strong network, and a chance to experience the different cultures in the practice. There were participation from 7 countries which include Malaysia, Canada, Mongolia, Singapore, Korea and China Macau. A total of 43 young architects participated in this event.
It was a very productive event as participants were exposed to real live projects including briefings, site visits, project discussions and design as well as a mentoring session. Participants were able to engage in the process and established solutions based on existing practices gather from various industries and nations.
The program was a success and the participant were eager to be involved in more activities of the same in the near future. They look forward to next event which hopefully will be held in the following year.

LAM PRESIDENT MEDAL AWARD 2017
The LAM President Medal Award was recently held on the 28 November 2017 at the Royal Chulan Kuala Lumpur. The President Medal Award was given to two recipients namely Ar. Dato’ Hj. Hajeedar Hj. Abdul Majid and Ar. Datuk Tan Pei Ing. The award was given in recognition of their contributions to the industry, their participation and involvement in the development of the current laws and guidelines, their contributions in the international field, involvements in charities and non-governmental organizations as well as leadership and commitment towards the betterment of the industry as whole.
The event also celebrated the Architectural Education Award which was given to Prof Emeritus Ezrin Arbi, the Special Architectural Education Award given to the late Ar. Saari Omar and the LAM Long Service Award which was given to Puan Esah Abdullah, the former Executive Secretary of The Board of Architects Malaysia. It was a splash of colourful celebrations for various recognition honouring their contributions in the Architectural Industry. There was a cultural performance and citations for the respective recipients highlighting on their past and present achievement in hopes of inspiring the new and younger breed of architects to step up and enhance the standards of architectural practice in Malaysia.
The event was graced by the Honourable Minister of Works Dato’ Sri Hj. Fadilah Bin Hj. Yusof and the Chief Secretary Minister of Works, Dato’ Sri Zohari Hj. Akob. LAM congratulates all the recipients of the awards and hopes that the next event will be as memorable as the present LAM President Medal Award.

The Board of Architects (LAM) in collaboration with the Malaysian Institute of Architects (PAM) had organized a dialogue session with its members on 11 June 2017. The Dialogue session was held at the Club House of Persatuan Alumni Universiti Malaya. It was a huge turnout with members from all across Malaysia participating in the dialogue.
Several key issues were address and highlighted to the members. Issues pertaining to the progress of the architectural education validation exercise, the LAM Part 3 structured course, the practice of scale of minimum fees and the LAM stakeholder fee management were brief to the members.
It was a very insightful day for the members as they need to keep themselves updated with the current trends, regulations and changes in the architectural industry. The dialogue ended with a lunch session for the members and a note of appreciation for their participation in the dialogue.

LAM ARCHITECTURAL AND INTERIOR DESIGN MANUAL WORKSHOPSince its official launch in 2015, the Council of Architecture Accreditation Malaysia (MAPS) has continuously monitored the manual’s implementation in line with the current developments in the industry as a whole. Further analysis and research has been done over the years to strengthen the guideline and policies to ensure a more practical and in depth understanding of the manual usage for the various institutions in the market. To this date another workshop was held between the 22-24 September 2017 to further study the various facets of the manual which needs to be updated in tandem with the current changes in the architectural industry.
LAM had recently organized a soft launch of the Interior Design Manual in conjunction with the LAM President Medal Event which was held on 28 November 2017. A series of workshop and meeting was organised to compile and draft the details for the Manual. Many professional in the field of interior design were present to deliberate and formalised the guideline to its current state. The final draft of the manual is anticipated to be ready for distribution by June 2018.

This General Circular is issued to inform all registered members on the requirements and responsibilities of the principal submitting person (PSP) or submitting person (SP) under by-law 258 (1) of the Uniform Building By-laws 1984.
1. WHEN A REPORT MUST BE SUBMITTED UNDER BY- LAW 258(1)
Section (1) of by-law 258 stipulates:
In the event of any failure to any building or part of the building, whether in the course of construction or after completion, the principal submitting person or submitting person shall within one week of the occurrence of such failure or such further period as may be specified by the local authority within whose jurisdiction such building is situated:
(aa) report such failure; (bb) explain the cause of failure; and (cc) if such failure occurred during the construction of such building, state the remedial action taken.
"Failure to building" is a very broad term and may cover even minor defects from non-structural cracks and poor workmanship. The PSP is only required to submit a report to the local authority where there is failure that affects "safety and health" aspects of the building. It should not cover the following types of building failure:
a) Defects that are due to poor workmanship that could be remedied by the Contractor b) Defective materials that could be addressed by the Contractor c) Failures during the construction process for which the Contractor has contractual obligations which do not affect
safety and health d) Minor failures for which the Contractor is answerable to respective licensing and approving authorities or utility
providers which do not affect safety and health
2. HOW THE REPORT IS TO BE SUBMITTED UNDER BY-LAW 258(2)
Reports submitted should be comprehensive and cover all requirements listed under section (1) of by-law 258:
(a) Report such failure with plans and photographs of the failure (b) Explain the cause of failure; and (c) If such failure occurred during the construction of such building, state the remedial action taken.
3. REPORT REQUIRED UNDER UBBL BY-LAW 258 (3)
Where the local authority has reason to believe that a failure to any building or part of a building has occurred which failure has not been reported to such local authority it shall serve a notice on the qualified person who-
(a) submitted the plans, drawings or calculations for such building; (b) supervised the setting out of such building; (c) certified that the setting out was carried out in accordance with the approved site plan, (d) supervised the construction of such building; (e) certified that proper supervision of such building was carried out;
requiring him within one week of such service to-
(aa) state whether such failure occurred. (bb) explain why he failed to report such failure; (cc) if such failure occurred during the construction of such building, state the remedial action taken.
The PSP should submit a comprehensive building failure report as required under by-law 258(3) with supporting relevant documents from the respective registered supporting professionals.

UNIFORM BUILDING BY-LAWS 1984 :BY LAW 258 - FAILURE OF BUILDINGS
GENERAL CIRCULAR NO.4/2017P18
This General Circular is issued to advise all Architects in their role as a principal submitting person (PSP), under the present regulations to certify the drawings prepared by a Licensed Land Surveyor for the purpose of filing of schedule of parcels.
1. In accordance with the Strata Management Act 2013 (Act 757) the certification requirements are stipulated in the following section
Schedule of parcels to be filed with the Commissioner before sale of any parcel.
Section 6(3) :A schedule of parcels filed under subsection (1) or an amended schedule of parcels filed under subsection (2) shall:- (d) contain a certificate by the developer's architect or engineer that the buildings or land parcels to be constructed in
accordance with the approved plans and specifications and any amendments to the plans and specifications under the Street, Drainage and Building Act 1974 [Act 133] and any by-laws made under that Act, prepared by the developer's architect or engineer, are capable of being subdivided under the provisions of the Strata Title Act 1985;
Note: This section requires the schedule of parcels to be certified by the developer's Architect before it can be filed with the Commissioner.
2. Certification requirements under this Act are additional statutory obligations that Architects are required to comply. An Architect appointed as a principal submitting person (PSP) is to certify and make necessary declarations under the Act, and shall not unnecessarily refuse to comply with these requirements.
3. The new certification requirements implemented through this Act imposes additional work on Architects, for which the Architect is entitled to charge additional fees for the works done accordingly.
4. Architects shall charge additional fees for these certification services at a rate of RM500.00 per parcel for each certification filed to the Commissioner.
Other than certifying the drawings on the schedule of parcels prepared by the Licensed Land Surveyor, the role of the certifying Architect is to issue the latest approved Building Plans to the Licensed Land Surveyor.
In view that the Licensed Land Surveyor shall take full responsibility for the accuracy of the information, the certifying Architect is to obtain a letter from the Licensed Land Surveyor confirming that the Licensed Land Surveyor is fully responsible and liable for the accuracy of the information before the Architect certifies on the said documents.

ARCHITECT'S ADDITIONAL SCOPE OF SERVICES FOR CERTIFICATION UNDER THESTRATA MANAGEMENT ACT 2013 (ACT 757) FOR STRATIFIED DEVELOPMENT
GENERAL CIRCULAR NO.5/2017 P19
The Board of Architects Malaysia (Lembaga Arkitek Malaysia) would like to inform that with effect from February 2015, the provisions of the Architects’ Act, 1967 (Act 117) new amendments governing the legislation of Interior Designers have come into force.
Under Part VA of Act 117 entitled ‘Special Provisions Relating to Interior Designers’, all Interior Designers (Section 27A) and Interior Design Consultancy Practices (Section 27E) must be registered with the Board of Architects Malaysia in order to provide Interior Design services and in order to be entitled to recover any professional fees thereof.
Section 27E: Interior Design Consultancy Practice provides, inter alia, that an Interior Designer, unless registered with the Board of Architects Malaysia as a sole proprietorship, a partnership or a body corporate and has been issued a certificate of registration, shall not:a) be entitled to provide interior design consultancy services for interior works as listed and described in Section 27E.b) be entitled to recover in any court any fee, charge, remuneration or other form of consideration for interior design services
rendered.
Interior Design practitioners are advised to take note of and heed the above provisions of the Law.
