WASECA COUNTY BOARD OF COMMISSIONERS — DECEMBER 7, 2017

The Waseca County Board of Commissioners met in regular session and tax

meeting on Tuesday, December 7, 2017, in the boardroom, 300 North State Street,

Waseca, Minnesota. Members present were Chair Dan Kuhns, Doug Christopherson,

Brian Harguth, Blair Nelson and Richard Androli.

Also present at the meeting were: Jessica Beyer, Administrator; Tammy Spooner,

Auditor-Treasurer; Russ Guse, Ditch Inspector; Chris Howard, H & H Excavating;

Nathan Richman, Highway Engineer; Brenda Miller, County Attorney; Jonathan Schiro,

Court Services Director; Brad Milbrath, Sheriff; Kim Foels, Waseca Chamber President;

and Dana Melius, News Reporter.

Chair Kuhns called the Ditch Authority to order at 5:00 p.m. Roll call was taken

and the Pledge of Allegiance was recited.

Russ Guse, Ditch Inspector, presented ditch repairs for viewing/recording the

following ditches by camera:

CD #16 (Section 33 Freedom Twp.) in the amount of $598.25.

JD #51 (Section 20 Vivian), in the amount of $874.50.

CD #47 (Section City of New Richland) in the amount of $1,163.80

Nelson moved and Christopherson seconded to approve the expenses with the

correction of section number on CD #16. Motion carried unanimously.

Russ Guse, Ditch Inspector, then requested approval of a repair to CD #8 in

Section 28 of Byron Township in the estimated amount of $13,136.00. Christopherson

moved and Androli seconded to approve the repair. Motion carried unanimously.

Russ, requested approval of a repair to CD #29 in section 10 of Alton Township

in the estimated amount of $10,836.00. Christopherson moved and Nelson seconded to

approve the repair. Motion carried unanimously.

He also requested a repair to CD #3 to clear trees, brush, and sediment to the

entire system in the estimated amount of $125,000.00. H & H Excavating is willing to do

the project at an hourly rate due to the size of the project is difficult to estimate the entire

ditch. Russ was unable to find another contractor to submit a bid. Androli moved and

Christopherson seconded to approve the repair be done at an hourly rate not to exceed a

total cost of $125,000.00. Motion carried unanimously.

There was no more business to come before the Ditch Authority. Androli moved

and Harguth seconded to adjourn the Ditch Authority at 5:13 p.m. Motion carried

unanimously.

Chair Kuhns called the regular session to order at 5:14 p.m.

Agenda strike 7a Harguth moved and Androli seconded to approve the Agenda

with the removal item 7b Auditor-Treasurer-PACE Special Assessments. Motion carried

unanimously.

Androli moved and Christopherson seconded to approve the minutes from the

Regular Commissioner Meeting of November 7, 2017 and the Special Meeting of

November 20, 2017. Motion carried unanimously.

Androli moved and Harguth seconded to approve the Consent Agenda as

presented. Motion carried unanimously.

Kim Foels, Waseca Chamber President, presented information and statistics from

the Intelligence Components on the Chamber website. This information is useful

information for residents and businesses. Ms. Foels requested the county partner with

them again in the amount of $500.00 annually. Nelson moved and Harguth seconded to

approve the partnership in the amount of $500.00 to be paid out of the Economic

Development Fund. Motion carried unanimously.

Tammy Spooner, Auditor-Treasurer, presented proposed Ditch Assessments for

2018. Androli moved Christopherson seconded to approve placing the following Ditch

Assessments on the 2018 tax rolls. Motion carried unanimously.

Jonathan Schiro, Court Services Director, presented a proposed 2018 Fee

Schedule for probation services. The fee have been reviewed and agreed to by Judge

Hanks. Nelson moved and Harguth seconded to approve the new fee schedule. Motion

carried unanimously.

Brenda Miller, County Attorney, presented a memo requesting that Waseca

County commence litigation against opioid manufacturers and distributors. Miller

indicated there would be no out of pocket expense to the county. If there is a settlement

to Waseca County, the attorney would take out their expenses and percentage. Staff

recommends joining with Steele County and using Lockridge, Grindal & Nauen to

represent us in the litigation. Nelson moved and Christopherson seconded to commence

litigation and join with Steele County using Lockridge, Grindal & Nauen. Motion carried

unanimously.

Jessica Beyer, Administrator, requested approval of the Human Resources

Agenda. Christopherson moved and Harguth seconded to approve the Human Resources

Agenda as presented. Motion carried unanimously.

David Malakowsky, Feedlot Officer effective 12-26-17 at $21.03 per hour.

Chair Kuhns recessed the meeting at 5:50 p.m.

The meeting was called back to order at 6:30 p.m. for the 2018 Waseca County

Budget and Levy Hearing. The Pledge of Allegiance was recited.

Chair Kuhns opened the meeting for public comment. The following residents provided

Chair Kuhns left the meeting at 7:45 p.m.

Vice Chair Nelson closed the Public Comment Period at 7:55 p.m.

Discussion was held regarding the proposed levy and cuts that were made to the

budget at a prior work session.

Harguth moved and Androli seconded to adopt Resolution #2017-42 to set the

2018 levy. Motion carried 4-0 (Kuhns was absent).

Resolution # 2017-42 2018 Waseca County Levy

WHEREAS, the Waseca County Board of Commissioners annually reviews the types and levels of service Waseca County must provide along with associated costs; and

WHEREAS, the Waseca County Board of Commissioners is annually challenged with the task of balancing needs and desires of those serviced and the ability to pay for these services; and

WHEREAS, the Waseca County Board of Commissioners is committed to maintaining reliable and consistent property tax levels; and

WHEREAS, Minnesota Statutes §275.07 requires that the final property tax levy for the coming year be certified to the County Auditor/Treasurer by December 29, 2017; and

WHEREAS, the Board intends to commit the property tax levy funds for the following purposes:

General Fund $8,437,165.00 Building Fund $200,000.00 Public Works Fund $3,759,241.00 Human Services Fund $2,609,415.00 Debt Services $298,638.00

NOW, THEREFORE, BE IT RESOLVED by the Waseca County Board of Commissioners in and for the County of Waseca, Minnesota, does hereby adopt a final tax levy of $15,304,459.00, reflecting a 5.24% increase to be certified to the Waseca County Auditor/Treasurer.

Christopherson moved and Androli seconded to adopt Resolution #2017-43 to set

the budget for 2018. Motion carried 4-0 (Kuhns was absent).

Resolution # 2017-43 2018 Waseca County Budget

WHEREAS, Minnesota Statutes 375A.06 provides that the County Administrator shall prepare and submit to the County Board a proposed annual budget including detailed estimates of revenues and expenditures and enforce the provisions of the budget when adopted by the County Board; and

WHEREAS, budget documents have been prepared and the County Board has met in regular sessions for the purpose of adopting a proposed budget for fiscal year 2018; and

WHEREAS, the County Board has come to the conclusion that the budget so prepared is adequate and meets Minnesota Statute provisions;

NOW, THEREFORE, BE IT RESOLVED by the Waseca County Board of Commissioners in and for the County of Waseca, Minnesota, does hereby adopt a budget of $26,366,162.00 to be certified to the County Auditor/Treasurer. A copy of the budget summary statement is attached to this resolution.

Having no further county board business, Androli moved and Harguth seconded

the motion to adjourn the meeting. Motion carried 4-0 (Kuhns was absent) and the

meeting adjourned at 8:07 p.m.

Subject: Ordinance Number 82 ____________________________

In 2005, the Janesville Sportsman's Club approached the County to incorporate an ordinance on Lake Elysian to regulate vehicles on the lake when the aeration system was in operation. The reason for this ordinance was to help with insurance costs and liability for the Janesville Sportsman's Club. Since this request, the Minnesota Darkhouse Association has taken over the aeration system. The association received a letter from the DNR stating that the aeration system had no effect one way or the other on Lake Elysian. The Darkhouse Association had substantial costs in running the aeration system along with the maintenance of the equipment. Due to these factors, effective in 2017, the Dark Horse Association has ceased using the aeration system on Lake Elysian. With no aeration system being used on Lake Elysian, I request that the Waseca County Board repeal Ordinance Number 82 which regulates the use of Motor Vehicles on Lake Elysian.

Agreement

Background:

As you are aware, the Water Resource Specialist is still vacant at this present time with the

Human Resources Department is currently recruiting for the position. Chris Hughes has

been assisting with the administration of the Wetlands Conservation Act (WCA) as a

“Contractor” under the attached Service Agreement, however, the agreement period and

thus, the contract, will expire on December 31, 2017. Waseca County does not currently

have an employee with the qualifications to administer the wetland program, thus the

Planning and Zoning Department is requesting an extension to the service agreement with

Hughes. In the event that Hughes is no longer willing to provide his services, staff requests

the allowance by the Board to contact other consultants. Please note that, in this instance,

we will request approval from the County Administrator to approve the use of any outside

consultants used to assist with administering the WCA until we hire a full-time Water

Resource Specialist.

The service agreement with Hughes is appended to this report. This service agreement

would mirror what would be offered to any other potential consultants. Hughes has been

compensated $45 per hour to assist Waseca with the WCA administration. It is estimated

that he will work up to ten hours per week for Waseca County once all is said and done.

This would place the weekly cost for this service at approximately $450 and the cost to year

end at approximately $7,200 ($450 per week x 16 weeks). The County will have additional

costs for our staff that will be partially reimbursed by the Natural Resources Block Grant

(NRBG). The costs of the WCA administration will also be offset to some degree by fees

that may be charged for services rendered by the department.

Budget/financial consideration:

Approximately $450.00 per week until a Water Resource Specialist is hired to a full-time

position.

Legal Consideration:

NONE – County Attorney, Brenda Miller, has already reviewed the Service Agreement when

initially approved.

Extension of Wetland Conservation Act Administration Contract Agreement

Service Agreement

Waseca County, 307 N. State St., Waseca, Minnesota, 56093, hereafter referred to as the “County,” and Christopher Hughes , _________________________________, Mankato, Minnesota, 56001, hereafter referred to as the “Contractor,” enter into this Agreement for the period from September 1, 2017, until December 31, 2017.

WITNESSETH

WHEREAS, the Contractor is qualified to provide administrative services regarding the implementation of the Minnesota Wetland Conservation Act of 1991 (WCA) and Water Planning duties; and WHEREAS, the County wishes to purchase services for administrative oversight of the WCA and assist with water planning activities in Waseca County from the Contractor; NOW, THEREFORE, in consideration of the mutual understandings and agreements set forth, the County and Contractor agree as follows: 1. CONTRACTOR’S DUTIES

a. In accordance with the Scope of the WCA (MN Rule 8420.0105), the County agrees to purchase and the Contractor agrees to furnish the WCA Administration Services outlined in Attachment A and to assist with water planning duties as assigned.

b. The Contractor shall, in writing within sixty (60) days, notify the County

whenever it is unable to, or going to be unable to, provide the required quality or quantity of services. Upon such notification, the County and the Contractor shall determine whether such inability will require modification or cancellation of the contract.

2. COST AND DELIVERY OF PURCHASED SERVICES

a. Services provided will be billed by the Contractor to the County at the rate of $45.00 per hour plus the reasonable expenses such as mileage reimbursement for the use of Contractors personal vehicle.

3. PAYMENT FOR PURCHASED SERVICES

a. Certification of expenditures: The Contractor must, within fifteen working days following the last day of each calendar month, submit a standard invoice for services provided.

b. Payment: The County must, within 30 days of the date of receipt of the Invoice,

make payment to the Contractor. 5. CONDITIONS OF THE PARTIES’ OBLIGATIONS

a. This agreement may be canceled by either party at any time, with or without

cause, upon sixty (60) days’ notice, in writing, delivered by mail or in person.

b. Before the termination date of this agreement, the County and Contractor may evaluate the agreement to determine each party’s interest in renewal of the agreement.

c. Any alterations, variations, modifications, or waivers of provisions of this

agreement must be valid only when they have been reduced to writing, duly signed, and attached to the original of this agreement.

d. No claim for services furnished by the Contractor not specifically provided in the

agreement will be allowed by the County, nor must the Contractor do any work or furnish any material not covered by the agreement, unless this is approved in writing by the County.

6. SUBCONTRACTING

The Contractor agrees not to enter into subcontracts for any of the work contemplated under this contract without written approval of the County.

16. ENTIRE AGREEMENT

It is understood and agreed that the entire contract of the parties is contained herein and this contract supersedes all oral agreements and negotiations between the parties relating to the subject matter thereof.

ATTACHMENT A - SERVICES This Agreement is for Christopher Hughes (the Contractor) to provide services for implementation of the Minnesota Wetland Conservation Act (WCA) to Waseca County (County). This generally includes administrative oversight and technical assistance. The Contractor will provide approximately ten hours of WCA services per week. This may vary depending on need and time availability. Additional or increased services should be requested in writing. Below is a list of services to be provided by the Contractor and the corresponding responsibilities of Waseca County: Administration

Contractor Responsibilities: Provide oversight and guidance for WCA implementation. Troubleshoot and assist with resolving contentious WCA administrative issues.

Waseca County Responsibilities: Assist with administrative duties as necessary.

Public Interaction

Contractor Responsibilities: Provide comments and recommendations on project proposals to County staff. Attend meetings with landowners and staff if necessary and requested.

Waseca County Responsibilities: Coordinate communication of recommendations with applicants and other clientele.

Meet with the public as necessary. Wetland Applications

Contractor Responsibilities: Determine completeness of applications.

Notice and seek comment on completed applications. Incorporate received comments. Perform site visits as necessary. Sign, issue, and distribute all notices of applications and notices of decision.

Waseca County Responsibilities: Attend site visits and advise landowner and clientele contacts as necessary.

Field Work

Contractor Responsibilities: Utilize off-site resources (historic aerial photographs, National Wetland

Inventory, Soils, LiDAR, etc.) prior to conducting field visits. Provide technical assistance to clientele and County staff on wetland delineation

and wetland functional assessment. Perform field work in a timely manner, within the growing season. Document and communicate field findings (written and mapped) to County staff and Technical Evaluation Panel members.

Waseca County Responsibilities: Provide guidance and means for Contractor to use off-site resources.

File all application and inquiry documents according to the corresponding Parcel Identification Number (PID) file (physical and electronic). File all Technical Evaluation Panel meeting documents.

Waseca County Responsibilities: Provide guidance on PID file system. Provide guidance on Technical Evaluation Panel file system. Technical Evaluation Panel (TEP)

Contractor Responsibilities: Coordinate and participate in monthly TEP meetings as necessary. Create and distribute agendas and supporting documents to all TEP members. Prepare necessary materials for members to facilitate informed discussion. Document meeting discussions. Prepare and distribute written Findings of Fact (FoF) for each TEP meeting.

Waseca County Responsibilities: Assist with meeting logistics (location, technology).

Provide guidance on agenda and FoF template. Violations and Enforcement

Contractor Responsibilities: Coordinate enforcement efforts with landowner, potential violator, County and

agency staff. Document field reviews (pictures; soils, vegetation and hydrology analysis). Assist Soil and Water Conservation District staff with the creation of Restoration Orders as necessary.

Waseca County Responsibilities: Assist with coordination of enforcement efforts.

Also, to refund an application fee or overpayment and to purchase miscellaneous supplies for the jail as authorized by the jail administrator.

Resolution Establishing 2018 Annual Salaries for Waseca County Elected Offices

WHEREAS, the County Board of Commissioners has the duty and responsibility, by law, to establish by resolution the minimum and annual salaries to be paid to its elected officials; and

WHEREAS, the County Board of Commissioners has considered the position responsibilities and duties, as well as, the elected officials individual’s experience, qualifications and performance;

NOW, THEREFORE, BE IT RESOLVED that effective January 1, 2018, the annual salaries of elected officials shall be as follows:
