federal RCRA law to manure Would treat manure as solid waste subject to RCRA

regulations on disposal

RCRA exempts manure when applied as fertilizer

Court said defendants applied beyond agronomic rates

and improperly stored manure – allowing it to leak into

Precedent setting decision with broad
