ABOUT THIS APPLICATION FORM

This form is for the purpose of making an application for a Waste Water Discharge Licence under the Waste Water Discharge (Authorisation) Regulations, 2007 (S.I. No. 684 of 2007) or for the review of an existing Waste Water Discharge licence. The Application Form must be completed in accordance with the instructions and guidance provided in the Waste Water Discharge Licensing Application Guidance Note. The Guidance Note gives an overview of Waste Water Licensing, outlines the licence application process (including the number of copies required) and specifies the information to be submitted as part of the application. The Guidance Note and application form are available to download from the Licensing page of the EPA’s website at www.epa.ie. A valid application for a Waste Water Discharge Licence must contain the information prescribed in the Waste Water Discharge (Authorisation) Regulations, 2007 (S.I. No. 684 of 2007). Regulation 16 of the Regulations sets out the statutory requirements for information to accompany a licence application. The application form is designed in such a way as to set out these questions in a structured manner and not necessarily in the order presented in the Regulations. In order to ensure a legally valid application in respect of Regulation 16 requirements, please complete the Regulation 16 Checklist provided in Annex 2.

PROCEDURES

The procedure for making and processing of applications for waste water discharge licences, and for the processing of reviews of such licences, appear in the Waste Water Discharge (Authorisation) Regulations, 2007 (S.I. No. 684 of 2007) and is summarised below. The application fees that shall accompany an application are listed in the Third Schedule to the Regulations. Prior to submitting an application the applicant must publish in a newspaper circulating in the area, and erect at the point nearest to the waste water treatment plant concerned or, if no such plant exists, at a location nearest the primary discharge point, a notice of intention to apply. An applicant, not being the local authority in whose functional area the relevant waste water discharge, or discharges, to which the relevant application relates, takes place or is to take place, must also notify the relevant Local Authority, in writing, of their intention to apply. An application for a licence must be submitted on the appropriate form (available from the Agency) with the correct fee, and should contain relevant supporting documentation as attachments. The application should be based on responses to the form and include supporting written text and the appropriate use of tables and drawings. Where point source emissions occur, a system of unique reference numbers should be used to denote each discharge point. These should be simple, logical, and traceable throughout the application. The application form is divided into a number of sections of related information. The purpose of these divisions is to facilitate both the applicant and the Agency in the provision of the information and its assessment. Please adhere to the format as set out in the application form and clearly number each section and associated attachment, if applicable, accordingly. Attachments should be clearly numbered, titled and paginated and must contain the required information as set out in the application form. Additional attachments may be included to supply any further information supporting the application. Any references made should be supported by a bibliography. All questions should be answered. Where information is requested in the application form, which is not relevant to the particular application, the words “not applicable” should be clearly written on the form. The abbreviation “N/A” should not be used. Additional information may need to be submitted beyond that which is explicitly requested on this form. Any references made should be supported by a bibliography. The Agency may request further information if it considers that its provision is material to the assessment of the application. Advice should be sought from the Agency where there is doubt about the type of information required or the level of detail. Information supplied in this application, including supporting documentation will be put on public display and be open to inspection by any person. Applicants should be aware that a contravention of the conditions of a waste water discharge licence is an offence under the Waste Water Discharge (Authorisation) Regulations, 2007.

The provision of information in an application for a waste water discharge licence which is false or misleading is an offence under Regulation 35 of the Waste Water Discharge (Authorisation) Regulations, 2007 (S.I. No. 684 of 2007). Note: Drawings. The following guidelines are included to assist applicants: • All drawings submitted should be titled and dated. • All drawings should have a unique reference number and should be signed by a

clearly identifiable person. • All drawings should indicate a scale and the direction of north. • All drawings should, generally, be to a scale of between 1:20 to 1:500,

depending upon the degree of detail needed to be shown and the size of the facility. Drawings delineating the boundary can be to a smaller scale of between 1:1000 to 1:10560, but must clearly and accurately present the required level of detail. Drawings showing the waste water treatment plant location, if such a plant exists, can be to a scale of between 1:50 000 to 1:126 720. All drawings should, however, be A3 or less and of an appropriate scale such that they are clearly legible. Provide legends on all drawings and maps as appropriate.

• In exceptional circumstances, where A3 is considered inadequate, a larger size may be requested by the Agency.

It should be noted that it will not be possible to process or determine the application until the required documents have been provided in sufficient detail and to a satisfactory standard.

SECTION A: NON-TECHNICAL SUMMARY Lismore town is situated on the southern banks of the Blackwater River. It was planned and built during the nineteenth century and is now one of Ireland’s ‘Heritage Towns’. It has a population of approximately 1,650 people. The picturesque Lismore Bridge crosses the River Blackwater and provides access to the town from the north. The town generally ‘fans out’ to the south, east and west from the bridge and Lismore Castle lies on the riverbank to the west of the bridge. Description of the Wastewater Treatment Works Prior to 1986, wastewater from the town was discharged untreated directly to the Blackwater River. In 1976, a Preliminary report was prepared to provide a sewerage scheme for the town of Lismore. In 1986, a new wastewater treatment plant and associated collection system were constructed to collect and treat wastewater from the town prior to discharge to the river. This plant is located on the riverbanks to the east of Lismore Bridge and is still in operation today. The sewage treatment plant for Lismore is an Oxidation Ditch type biological treatment plant. The design final effluent standards are 20mg/l BOD5 and 30mg/l Suspended Solids. The main elements of the plant are:

• Inlet Chamber with overflow weir • Aeration Tank • Settling Tank with Sludge Return • Outlet Chamber with flow measurement weir • Picket Fence Thickener • Sludge Dewatering Press

The current capacity of the WWTP has been calculated to be 1,800 p.e. It should be noted that the capacity of the plant is limited by the amount of stormwater being collected in the network prior to the WWTP. The recorded population of the town in the 2006 Census was 1,240 persons. However, a house count was carried out in 2005 to determine the existing population of Lismore and the total count was 608 houses of which 49 were still under construction. Assuming 95% of the 608 houses are now occupied and assuming a house occupancy of 2.64 persons per house in accordance with the average urban house occupancy in Co. Waterford in the 2002 Census report, the estimated residential population of the town is 1,525. Lismore also has a large school-going population that contributes to the load on the WWTP. There are three schools in the town that have a total of 1,091 students. A further 50 persons can be assumed for teachers and other admin staff in the schools. Assuming that each person contributes approximately ⅓ p.e. (based on the 20mg/l per person recommended in the EPA Wastewater Treatment Manual for Treatment Systems for Small Communities, Business, Leisure Centres and Hotels), this gives a total of 380p.e. However, it is estimated that half of these people have been accounted for already as they are resident within the town. Thus, the contribution of the schools to the WWTP load is 190 p.e.

Lismore is also an attraction to tourists and the town contains a number of B&B’s and Hotels. During the tourist season the average total number of rooms occupied in these premises is 46. Assuming an average occupancy of 2 persons per room, this amounts to a contribution of 92 p.e. to the load of the WWTP. There is currently no industrial load in Lismore which contributes to the sewerage scheme. The total estimated current loading to the treatment plant is therefore 1,807 p.e. This is just above the calculated capacity of the treatment plant, and allied to the current construction of some 150 houses in the town, Waterford County Council have recently submitted a proposal for funding to the Department of Environment, Heritage and Local Government for an upgrade of the WWTP. A design for the upgrade has been completed and the Part 8 Planning Process has been completed. The proposed upgrade works comprise

• Construction of a 170m³ storm tank at a new site 75m south west of the WWTP site.

• Provision of a package inlet screening works at the new storm tank site. • Associated siteworks at the new storm tank and inlet works site. • Construction of new sewers to connect to the WWTP. • Refurbishment of the existing aeration and settling tanks. • Associated Mechanical & Electrical and Telemetry works.

The above works will increase the capacity of the WWTP to 2,914 p.e. based on the settlement tank capacity, which is the limiting factor. Following screening and grit and grease removal, the inlet chamber will allow 2,010m³/day (3 DWF) from the sewage network to go forward to the secondary treatment plant. Flows in excess of 3 DWF will be spilled to the new 170m³ storm tank. This tank has sufficient capacity for 2 hours retention if the flow to the inlet works reach 6DWF. Once the flow through the treatment plant drops below 3DWF, flow from the storm tank is pumped back to the inlet chamber where it is returned to secondary treatment process Secondary treatment is achieved by an oxidation ditch type extended aeration tank and aeration is provided by surface vertical cone type aerators. From this tank, the flow passes to a settling tank which settles out the solids from the treated effluent. The effluent flows under a baffle plate and over a v-notch weir into a collection channel and onto the outlet chamber prior to discharge to the River Blackwater. The sludge is drawn from the bottom of the settlement tank and, using the sludge pump, is either returned to the aeration tank or wasted to the sludge dewatering system. This dewatering system comprises a picket fence thickener, sludge transfer pumps, poly dosing system and a belt press dewatering machine. All sludge produced at the treatment plant will be dewatered to produce a sludge cake with a solids content of 12% to 15%. This will then be transferred to the Dungarvan Wastewater Treatment Plant for drying to 95% or greater dry solids content. Sources of Emissions from the Wastewater Treatment Works The collection system in Lismore is a combined system that culminates in a 525mm sewer which enters a stormwater overflow chamber at the western end

of the WWTP site. Pipe diameters within the network vary from 150mm up to 525mm. There is only a single stormwater overflow chamber on the network. The overflow is controlled in the chamber by a 200mm diameter throttle pipe restricting continuation flow to the treatment plant. During a storm, the 200mm pipe surcharges and a portion of the flow is diverted over a weir within the chamber and discharges to the River Blackwater via a 600mm overflow pipe. The top of the weir is 180mm above the invert of the 200mm pipe. (Refer to the drawings and photographs in Attachment No. B5. The nature and quantities of foreseeable emissions from the wastewater works into the receiving aqueous environment as well as identification of significant effects of the emissions on the environment The final effluent standards that are designed to be achieved by the Lismore Wastewater Treatment Works are as follows: B.O.D. 20mg/l S.S. 30mg/l The quantity of foreseeable emissions from the wastewater works is 2,010m³/day, which is 3DWF, and is the design capacity of the treatment works. The outfall from the Lismore WWTP discharges to the River Blackwater and it is concluded from the aforementioned report that discharging at the minimum standard set out in the Urban Wastewater Treatment Regulations, 2001 would be sufficient to comply with the water quality objectives of the Blackwater at Lismore. The aforementioned report is contained in Attachment B.6. The proposed technology and other techniques for preventing or, where this is not possible, reducing emissions from the waste water works As described earlier, there is a proposal with the Department of the Environment, heritage and Local Government for an upgrading of the WWTP in Lismore. If this is approved, the construction of the upgrade works will reduce the emissions from the wastewater works. An upgrade of the entire sewerage system to include network and treatment is also proposed for Lismore and is included in the Department of the Environment, Heritage and Local Government Water Service Investment Programme 2007-2009. This is due to enter the planning stage during the lifetime of the programme. The aforementioned proposed works form part of the upgrade and a preliminary report on the remainder is awaited. Furthermore, while the sewerage system in Lismore is primarily a combined system, in recent years, separate storm and foul systems have been installed in newly constructed developments. The Waterford County Development Plan 2005-2011 and the Lismore Local Area Plan 2007-2013 state that all proposals for housing estate development or for the development of a large number of houses are required to submit proposals for a Sustainable Urban Drainage System (SUDS). Both Plans also state that the Council will insist that all new developments within Lismore are connected to the public sewerage system where one exists.

Further measures planned to comply with the general principle of the basic obligations of the operator, i.e. that no significant pollution is required A further review of the existing WWTP will be undertaken when the upgrade works are complete and the population equivalent of the agglomeration begins to approach the new design capacity of the WWTP (2,914 p.e.). If an increase over and above the design capacity is considered to be required at that time, then a new WWTP site will need to be acquired as the existing site has very little room for expansion of secondary treatment. Measures planned to Monitor Emissions into the Environment As a minimum, monitoring of the treated effluent will comply with that outlined in the Fifth Schedule of the Urban Wastewater Treatment Regulations, 2001. The monitoring will be carried out by Waterford County Council’s own laboratory staff. Any increased and/or expanded monitoring required as a result of this Licence Application will be implemented.

In 2005, 2 significant planning applications were applied for and have been granted and are either still under construction or are awaiting construction to commence. These developments will add a further 150 houses or 396 to the existing 1,807 p.e. within the agglomeration at present as calculated for Section B.9(i). There have been no further applications since 2005 and, in the current climate, it is unlikely that any significant developments will be undertaken in Ardmore in the next few years. Thus the total p.e. capacity that will be required once these developments are completed and occupied is 2,203. In the calculation of the p.e. of the agglomeration an allowance for a further 297 p.e. has been included to cover any major residential developments within the period of this licence.

Although some lands are zoned commercial within the agglomeration, there have been no recent applications for such development and there are none expected. Thus there are no new non-domestic activities contributing to the projected p.e. The existing wastewater treatment plant capacity is 1,800 p.e. and, as we are aware that the domestic effluent load from the housing developments currently under construction will need to be accommodated within the Lismore WWTP, we have requested funding from the DEHLG for interim works to increase the capacity to 2,914 p.e. as soon as possible. These works will need to be commissioned prior to accepting flows from any further completed developments. It should be noted that 61 of the houses under construction will have an interim treatment plant associated with them and this will remain in operation until our upgrade is complete. B.9 (iii) FEES

B.10 Capital Investment Programme

Waterford County Council’s Assessment of Needs report published in 2007 stated that significant works would be required to upgrade the capacity for sewerage treatment in Lismore for a design horizon of 2034. The ultimate requirement was for 4,500 p.e. by 2034. This report was submitted to the Department of Environment, Heritage and Local Government for consideration and the Water Services Investment Programme for 2007-2009 has an allocation for these upgrade works included. The budget figure is €5,215,000 and the scheme is approved to enter the planning stage. A Preliminary Report is being prepared and it is expected that this will be submitted to the DEHLG in 2009. However, as it is our experience that such upgrade works can take a number of years to come to construction, it has been decided that an application for funding under the Serviced Land Initiative for advance interim works should be submitted to the DEHLG and we are currently awaiting approval from the DEHLG for such works. We believe that it will be possible to have these interim works in operation by the end of 2010. The interim works comprise primarily the construction of a 170m³ stormwater holding tank and the installation of inlet screening and grit traps as well as an upgrade of the control system. The interim works are estimated to cost €1,150,000 and the DEHLG would fund 40% of this under the Serviced Land Initiative, if approved. Attachment B.10 should contain the most recent development programme, including a copy of any approved funding for the project and a timeframe for the completion of the necessary works to take place. SECTION C: INFRASTRUCTURE & OPERATION Advice on completing this section is provided in the accompanying Guidance Note.

C.1 Operational Information Requirements The existing treatment plant is located on Castle grounds on the banks of the Blackwater River. It is a well screened location with tall trees surrounding the site. The site is limited in available space with little room for large-scale expansion. It is bounded on south west and east side by a steep rock face and on the north side by the Blackwater River. It is located at a low point in the town which facilitates gravity collection of wastewater to the treatment plant. The plant was originally designed in 1985 and is comprised of the following treatment units:

• Inlet Works – The inlet works consists of a stormwater overflow

chamber, an inlet chamber and comminutor (de-commissioned).

• Aeration Tank – Oxidation Ditch type extended aeration tank with surface vertical cone type aerators.

• Settling Tank – There is one settling tank which settles out the solids

from the treated effluent. The effluent flows under a baffle plate and over a v-notch weir into a collection channel and to the river.

• Sludge Dewatering – The dewatering system consists of a Picket Fence

Thickner, sludge transfer pumps, poly dosing system and a belt press dewatering machine.

• Sludge Pumping Station – Sludge pumps draw sludge from the bottom of

the settling tank and pump it to either the Picket Fence Thickner or back to the aeration tanks.

A schematic layout of the existing WWTP is shown in attachment C1. The existing treatment plant in Lismore was designed in 1985 with a design horizon up to 2005. Much of the mechanical and electrical plant is now in need of replacement. Also the capacity of the plant needs to be reviewed to cater for a design horizon up to 2031. The existing Treatment Plant was designed for the following parameters. • BOD Load 186 Kgs/day

• Max hydraulic load at 6 DWF 114 m3/hr These figures were obtained from the 1985 “Specification for Mechanical Plant for Lismore Sewerage Scheme” prepared by M.C. O Sullivan & Co. Ltd. (now RPS-MCOS Ltd). Based on 60 gr/c/day BOD concentration the aeration capacity of the plant is 3,100 pe.

The design per capita dry weather flow for this population based on a plant design DWF of 19 m3/hr = (19m3/hr x24) / 3,100pe = 147 l/c/day. This is low compared with the generally accepted value of 230 l/c/day. This gives an actual design capacity of 1,982 p.e. A recent review of the operation of the plant shows a capacity of the order of 1,800 p.e. with settlement capacity being the limiting factor. All mechanical equipment, except that of the dewatering plant is controlled from the main control panel in the control house. Hours run meters are shown for the mechanical equipment. Continuous chart recorders are included which tabulate data on dissolved oxygen levels in the aeration tank and on the outlet from the plant. However, as much of the equipment is now over 20 years old and not all functioning fully, an upgrade of the entire control system is warranted and this has been included in the scope of works for the advanced interim upgrade as described in Section B10. The control panel will now be upgraded using a PLC and proper controls and monitoring installed for control of the plant. The electrics at the plant will also be upgraded in line with current design practice. The upgrade of the treatment system has been identified and included in the DEHLG’s Water Services Investment Programme 2007-2009 to enter the planning phase. Waterford County Council have also submitted a proposal to the DEHLG for advance interim works to be funded under the Serviced Land Initiative. These advance works will increase the capacity of the WWTP to 2,914 p.e. C.1.1 Storm Water Overflows One of the main criteria to assess the significance of a stormwater overflow to freshwater is contained within the ‘Procedures and Criteria in relation to Stormwater Overflows’ published by the DEHLG in 1995. Table 1 in Appendix 1 states that if the dilution is > 8:1 (foul DWF @ 95%-ile flow) and there is no interaction with other discharges, then the storm overflow is of low significance. In this case, there are no upstream discharges and the downstream discharge is treated effluent, therefore there is no interaction with any significant discharge. The dilution is 1380:1 with a 95%-ile flow of 10.7m³/sec in the river and a foul DWF of 0.00775m³/sec (670m³/day). Thus the stormwater overflow here is low significance. Where the dilution factor available at the 95 percentile flow in the receiving stream is greater than 8 times the DWF at the point of discharge of the spill, the minimum recommended overflow setting is Formula A of UK Technical Committee on Storm Overflows and Disposal of Storm Sewage Final Report in 1970. This formula is as follows: Q = DWF + 1360P + 2E Q = flow retained in the sewer system (l/d). DWF = dry weather flow (including any infiltration) to the overflow (l/d). P = population served by the upstream network. E = average industrial effluent flow (l/d). This has been used to set the overflow weir for the stormwater overflow.

As part of the planned upgrade of the entire sewerage scheme identified in the Waterford County Council ‘Assessment of Needs’ and included in the DEHLG’s Water Services Investment Programme 2007-2009, a full review of the design of the Storm Water Overflow will be undertaken and any necessary upgrade works will be put in place. It should be also noted that the location of the SWO chamber is approximately 10 metres above the normal river level in an area that is not within the floodplain. As a result, backwatering of the SWO is not an issue in Lismore. C.1.2 Pumping Stations There are no pumping stations associated with this agglomeration and its associated sewerage network. Within the treatment plant, the only pumping station is that associated with the sludge pumping chamber. The sludge pumping chamber is adjacent to the settlement tank and aeration tank. It contains 2 separate sumps, a sludge recycle sump and sludge waste sump. One pump is available for sludge return. One submersible sludge pump was installed for excess sludge wastage. There is a risk that if the pump fails that the settlement tank will build up with sludge and this will then overflow to the river. However, to ensure that this risk is mitigated, a set of spare pumps is kept in Dungarvan and can be installed in a very short period of time. Duty and standby pumps have not proven successful in that when the duty pump has broken down, invariably the standby pump has also encountered difficulties within a very short period of time as the cause of the problem for the duty pump tends to remain within the system. There is an emergency overflow from the decommissioned comminutor station to the inlet chamber for the aeration tank should flows forward from the aeration tank not be possible for maintenance reasons. This connects to the existing treated effluent discharge outfall just below the sludge outlet chamber. There is no laboratory associated with this activity. Attachment C.1 should contain supporting documentation with regard to the plant and process capacity, systems, storm water overflows, emergency overflows, etc., including flow diagrams of each with any relevant additional information. SECTION D: DISCHARGES TO THE AQUATIC ENVIRONMENT

The primary discharge point is designated SW1 and is located at 204885E, 098748N at the bank of the River Blackwater. Its source is the Lismore WWTP which treats the waste water from the agglomeration of Lismore, whose collection system is a combined network. As there is very little commercial activity in Lismore, the effluent being treated is largely of a domestic nature. The Dry Weather Flow through the works is 670m³/day (7.75l/s) with a maximum discharge of 2010m³/day (3DWF). The discharge through the outfall is continuous for 24 hours and 365 days per year. The storm overflow discharge is designated SW2 and is located at 204855E, 098755N at the bank of the River Blackwater and is just upstream of the primary discharge point. Its source is the combined sewer network in Lismore. The overflow manhole operates such that all flows in excess of 3DWF will overflow to the river i.e. all flows in excess of 2,010m³/day (23.25l/s). The normal flow will be 0m³/day as it is designed to only overflow in storm circumstances. The Dry Weather Flow through the works will be 0m³ by definition of dry weather. The discharge through the outfall will only occur once flows to the WWTP exceed 23.25l/s. All maximum flows are based on a 1-year storm of 1 hour duration.

SECTION E: MONITORING

E.1 Waste Water Discharge Frequency and Quantities – Existing & Proposed

The estimated quantity of waste water likely to be emitted in relation to all primary and secondary discharge points applied for is to be included in Table E.1(i) via the following web based link: http://78.137.160.73/epa_wwd_licensing/. It is also included as Attachment E1. However, at the time of preparing this licence application, the results of the discharge sampling were not available. The results will be forwarded to the Agency when available.There is only a Primary Discharge Point for Lismore agglomeration. The estimated quantity of waste water to be emitted is 244,550m³/annum.

The estimated quantity of waste water likely to be emitted in relation to all storm water overflows within the agglomeration applied for is to be included in Table E.1(ii) via the following web based link: http://78.137.160.73/epa_wwd_licensing/. However, at the time of preparing this licence application, the results of the discharge sampling were not available. The results will be forwarded to the Agency when available. There is only one Storm Water Overflow Point for Lismore Agglomeration. The estimated quantity of waste water to be emitted is 0m³/annum. The sampling at these points is not continuous nor is it composite. It is grab samples only. In the process of preparing the design of the full upgrade of the sewerage scheme plans and timescales for the provision of composite sampling and continuous flow meters will be considered and included.

E.2. Monitoring and Sampling Points

In general, the discharge from the Lismore WWTP is sampled 4 times a year and this is in accordance with the Urban Wastewater Treatment Regulations, 2001 for similar sized and located works. It should be noted that the capacity of the Lismore WWTP (1,800 p.e.) is below the threshold of the aforementioned regulations, so our monitoring programme is in line with that for a WWTP of 2,000 – 9,000 p.e. capacity. The parameters monitored are also in accordance with the aforementioned regulations with a number of additional parameters not specified for a WWTP of this size. Details of all parameters monitored is included in Appendix E.2. The sampling is currently carried out at the outlet chamber adjacent to the settling tank and thus safe access is provided. Sampling at the upstream and downstream points are achieved by walking along the river bank to the points in question and taking a grab sample. Attachment E2 gives further information on the analytical and quality control procedures carried out in order to ensure accurate and reliable monitoring. It is proposed to continue to monitor at the same frequency as required under the Urban Wastewater Treatment Regulations, 2001 and for the same parameters. A copy of the monitoring programme is included in Attachment E2. Details of any accreditation and certification of analysis has been included as part of Attachment E2.

E.4 Sampling Data

Regulation 16(1)(h) of the Waste Water Discharge (Authorisation) Regulations 2007 requires all applicants in the case of an existing waste water treatment plant to specify the sampling data pertaining to the discharge based on the samples taken in the 12 months preceding the making of the application. There were 4 No. samples taken in the last 12 months. The sampling data is included as an Excel spreadsheet in Attachment E4. Regulation 16(1)(l) of the regulations requires applicants to give details of compliance with any applicable monitoring requirements and treatment standards. For a treatment plant of 2,000 – 9,999 p.e. this is 25mg/l for B.O.D., 125mg/l for C.O.D. and 35mg/l for Suspended Solids. Levels of compliance are overall 75% with a single failure for Suspended Solids on 25th October 2007. Both other parameters are 100% compliant. Again, it should be noted that the capacity of the Lismore WWTP is below the 2,000 p.e. threshold for the Urban Waste Water Treatment Regulations, 2001. Attachment E.4 should contain any supporting information.

SECTION F: EXISTING ENVIRONMENT & IMPACT OF THE DISCHARGE(S)

This assessment was carried out on the impact of the discharges to the River Blackwater from the Lismore Agglomeration. In accordance with the guidelines for the application form, the assessment will be in relation to 1 upstream (aSW1u) and 1 downstream (aSW1d) of the primary discharge point. A further upstream monitoring point was assessed upstream of the stormwater overflow point (aSW2u) also to ensure that the influences of the stormwater overflow on aSW1u were noted. A consultant’s report on the upgrade of the Lismore WWTP includes a section on receiving water flow and background quality along with assimilative capacity calculations. The report concludes that discharging at the minimum standard set out under the Urban Waste Water Directive would be sufficient to comply with the water quality objectives of the Blackwater River at Lismore. A copy of the relevant sections of this report are included in Attachment F.1

F.1. Assessment of Impact on Receiving Surface or Ground Water

The proposed emissions from the Lismore Agglomeration are of a nature that should not impact on the environmental media other than those into which the emissions are to be made. There are no perceived risks associated with groundwaters and the impact on the air quality in terms of odour and aerosols is low. There have been no complaints of odour received from the plant and it is remote from any dwelling. Details of all monitoring of the receiving water have been supplied via the following web based link: http://78.137.160.73/epa_wwd_licensing/. Tables F.1(i)(a) & (b) are to be completed for the primary discharge point. However, at the time of preparing this licence application, the results of the discharge sampling were not available. The results will be forwarded to the Agency when available. Surface water monitoring locations upstream and downstream of the discharge point will be screened for those substances listed in Tables F.1(i)(a) & (b). Monitoring of surface water was carried out at three points, two upstream from the discharge location and one downstream.

There are no secondary discharge points associated with the agglomeration. There are no ground emissions from the waste water treatment plant associated with the Lismore agglomeration and, therefore, no surface water bodies and water wells that may be at risk as a result of the ground discharge. In relation to the Phosphorous Regulations, the last report in 2006 stated that the River Blackwater within County Waterford was satisfactory (copy of the report is in Attachment G2). Also, in the River Water Quality Report for Co. Waterford 2007 (prepared by EPA Laboratory, Kilkenny), it is stated that the 4 sampling stations have generally satisfactory quality and has a Q4 rating just upstream and downstream of the discharge points. A copy of the relevant sections of this report are included in Appendix F1. Under the Water Framework Directive, the River Blackwater in the vicinity of the Lismore Agglomeration is Moderate in terms of Ecological Quality and the Overall Risk Result for the whole river is 1a, ‘at significant risk’. than monitoring associated with the Water Framework Directives and the Phosphorous Regulations. Under the various EU Council Directives, the River Blackwater is Nutrient Sensitive, is one of the designated Salmonid Waters and sections of the River are designated Special Areas of Conservation (SAC), Special Protection Areas (SPA) and a proposed Natural Heritage Areas (pNHA). Having reviewed the results of monitoring for the plant, emissions of main polluting substances (as defined in the Dangerous Substances Regulations S.I. No. 12 of 2001) to water are unlikely to impair the environment. There are no water abstraction points downstream of the Lismore agglomeration. Owing to the fact that a waste water treatment plant treats the domestic effluent from Lismore agglomeration and the dilution factor associated with the River Blackwater, it is considered that emissions from the agglomeration or any plant, methods, processes, operating procedures or other factors which affect such emissions are not likely to have a significant effect on any of the following:–

a site (until the adoption, in respect of the site, of a decision by the European Commission under Article 21 of Council Directive 92/43/EEC for the purposes of the third paragraph of Article 4(2) of that Directive) —

notified for the purposes of Regulation 4 of the Natural Habitats Regulations, subject to any amendments made to it by virtue of Regulation 5 of those Regulations,

details of which have been transmitted to the Commission in accordance with Regulation 5(4) of the Natural Habitats Regulations, or

added by virtue of Regulation 6 of the Natural Habitats Regulations to the list transmitted to the Commission in accordance with Regulation 5(4) of those Regulations,

a site adopted by the European Commission as a site of Community importance for the purposes of Article 4(2) of Council Directive 92/43/EEC1 in accordance with the procedures laid down in Article 21 of that Directive,

a special area of conservation within the meaning of the Natural Habitats Regulations, or
