Introduction The Natural Resources Access Regulator (NRAR) is an independent regulator established under

the Natural Resources Access Regulator Act 2017. NRAR is responsible for compliance and

enforcement measures for natural resources management legislation, which currently includes the

Water Management Act 2000 and the Water Act 1912 and associated regulations.

NRAR’s legislative objectives are to:

• ensure effective, efficient, transparent and accountable compliance and enforcement measures for the natural resources management legislation

• maintain public confidence in the enforcement of the natural resources management legislation.

To do this, we will:

• ensure compliance with the Water Act 1912 and the Water Management Act 2000

• promote best-practice management and regulation of surface water and groundwater

• take a risk-based and outcome-focused approach to regulation

• guide decision-making and action by our people, through the adoption of a graduated and proportionate response to non-compliance

• ensure decisions on enforcement action are transparent to the community.

Purpose of this document The Waterfront land tool (PDF version) has been developed to help applicants to determine what is

waterfront land under the controlled activity provisions of the Water Management Act 2000. This

tool has been developed:

• as an interim tool prior to development of a web-based tool

• to be used as a field guide for applicants and consultants to support field-based investigations and assessments.

Rationale This tool identifies waterfront land based on consideration of three key factors:

• the presence of defined bed and banks

• evidence of flow and geomorphic features (whether water is present or not)

• the presence of aquatic/riparian vegetation.

The tool steps through a series of questions to ensure that the right information is assessed to

determine the presence or absence of these features and whether the combination of features is

indicative of waterfront land.

Definition of waterfront land ‘Waterfront land’ means the bed of any river, lake or estuary, and the land within 40 metres of the

river banks, lake shore or estuary mean high-water mark.

How to use this tool The Waterfront land tool (PDF version) is made up of five parts:

• Disclaimer—refer to the disclaimer for the proper use of this tool

• Desktop—this requires the use of a computer and an internet connection

• Site assessment—this requires a site inspection of the property

• Results—based on the answers to questions at desktop and site assessment

• Appendices—supporting documents to help answer questions in the tool.

Supporting evidence: you must keep all information used to answer the questions —including

maps, photos and observations—as a record of your decision making. Required information is

listed in Supporting Evidence. NRAR may request copies of the Waterfront land tool and

supporting documents from landholders where works are carried out without a controlled activity

approval under the Water Management Act 2000.

licences or water supply work and/or water use approvals.

This is not an approval to undertake work on waterfront land and you will still need to obtain

relevant approvals as required under the Water Management Act 2000 (WM Act).

The use of this tool does not remove the obligation to obtain approval under any other relevant

legislation.
