This cheesecake is not only very simple to make it is also the ‘bestest in the

world’, according to many friends and family that have tried it.

Ingredients:Mix the following well by hand• 2 cartons low fat cream cheese

• ¾ cup of sugar

• 2 eggs

• ½ cup of cream

• 1 tbs flour

• Juice of ½ a lemon

• ½ tsp vanilla

The BaseCrumble 1 packet of tennis biscuits* and mix with 125 grams of melted butter

Press the base into a pie dish, add the cheese mixture, bake at 180 degrees for approximately 45 minutes.

Cool and enjoy!*you’ll find tennis biscuits in the South African section in the Supermarket.

Lately we have been seeing many clients hitting

their milestone year – the magic 65. This is the year where they can access their Kiwisaver, receive National Super, travel on SuperGold card and even enjoy a cuppa - compliments of McDonalds. While clients are busy planning how to spend their “windfall”, it is also the year where they are one step closer to the inevitable reality of needing residential care.

While it is reassuring to know that our country has a social net for the underprivileged, it is also disheartening to hear some clients deliberating their double jeopardy experience – paying high taxes when they were young and yet not getting any residential care subsidies when they grow old (as promised). The irony in all this, is that they fail the means and income testing because they choose to save and invest for the future – theirs and their family’s future.

Putting aside the polarising topic whether the

State should look after you till death do us part, I was reminded recently of the official stance from the Ministry of Social Development. And I quote: “…where appropriate [applicants] should use the resources available to them before seeking financial assistance under this Act…” [s1A Social Security Act]

So this prompted many clients including some of their advisors to resort to setting up trusts or

other mechanisms to reduce their personal wealth (i.e. “financial resources”) with the hope that they would qualify for some sort of subsidy.

There are many genuine reasons why you should have a family trust (e.g assets protection) However, our firm generally does not recommend clients setting up trusts solely for residential care purpose because rules and case precedents change all the time. Worst of all, the Ministry could view such act as “deprivation of property and income”. [s9B Social Security Act]

So it is fitting for us to revisit the current application process for residential care

subsidies and see how having trusts may affect some of the steps involved. Note: you will not qualify for any residential care subsidy until you have passed all of the following steps.

Step 1 Self Financial Review

• Satisfy yourself that you do not have the financial resources to pay for your own care

Step 2 Needs Assessment

• A needs assessor will determine whether long term residential care is required

Step 3 Means Assessment – assets

• This is where WINZ determines whether you and your spouse’s combined assets value (e.g. cash; shares; rental property) would exceed the threshold.

But what about the loans you made to the family trust? These are assets too, particularly when your gifting program is incomplete or was only completed recently.

On the subject of gifting, did you know that WINZ sees gifting differently to lawyers and accountants? In fact, rather than recognising the usual $27,000 per individual per year (the annual gift duty threshold up until September 2011) WINZ will only recognise $30,000

(previously $25,000) over five years preceding the subsidy application instead of $135,000 (being 5 years x $27,000/year).

Such “count back” alone will increase your personal assets value by $105,000.

Step 4 Means Assessment - Income

This is where WINZ considers whether income (e.g. interest, rental income, dividends) in addition to the National Super has exceeded the allowable threshold.

Though not defined in legislation or regulations, anecdotal evidence albeit isolated cases suggest that the Ministry could consider both income and capital distributions (if paid regularly) from trusts as income. This is a clear departure from the common accounting and legal practices.

As you can see, you cannot simply set up a trust, sit back and expect the State to handover the money that you believe you’re entitled to.

It is a pertinent reminder for everyone to regularly review your trust affairs with your lawyers and accountants to ensure your objectives are met and you do not count the chickens before they are hatched…as witnessed by our recent Cup challenge.

Trusts and Residential Care Subsidies

Perfect tenants for your rental property? Maybe,

maybe not. Usually things are as they seem, but sometimes, they are not. One way that you can protect yourself is to consider a shorter term fixed tenancy. This is basically a trial for 3 months, this will give you an opportunity to confirm they are paying their rent on time and taking good care of the property. If you are happy at the end of this period, the tenancy reverts to a normal tenancy where you can either renew for a longer term fixed tenancy or revert to a periodic tenancy, this is where the tenancy provides them with three weeks (21 days) notice to terminate the tenancy, landlord six weeks (60 days), unless moving family member in then 45 days.

Some of the reasons to do this would be if they are first time renters, they are foreigner where access to referees can be difficult, or you just don’t get the right ‘gut’ feeling. The objective is to have happy tenants and a happy

landlord. When you use the trial it is easier for both parties to have an amicable parting of the ways.

There are several ways to check whether a tenant will be a good one. There are credit checks you can have done, tribunal orders to be checked, facebook can sometimes provide unexpected information, character references from associates; but past landlords are invaluable particularly the one before the current landlord. As the

current landlord could be a landlord who actually wants their tenant to move on. By and large though you will get an honest report from previous landlords. The last thing you want to hear is they are running a brothel from the property. References provided still need to be considered closely as who would give a contact name for someone who would give them a bad reference?

This is a time consuming task, but definitely a necessary part of the rental process to ensure you mitigate the possibility of a troublesome tenant. Good property managers will take care of all these details for you, so you can rest easy with your investment.
