การขออยตอในราชอาณาจกร VISA EXTENSION

1.กรณมเหตจำาเปนทางธรกจ เชน จะตองอยปฏบตงานในบรษท หรอ หางหนสวนเปนตน

หลกเกณฑการพจารณา

1. คนตางดาวตองไดรบการตรวจลงตรา ประเภทคนอยชวคราว2. คนตางดาวตองมเงนไดตามตารางเงนไดแนบทายคำาสงน (ผนวก ก)3. ตองเปนธรกจซงมทนจดทะเบยนทชำาระ

แลวไมตำากวา 2 ลานบาท4. ธรกจนนตองยนงบการเงน ณ วนสนงวด

สองปบญชทผานมา ทไดรบการตรวจรบรองความถกตองจากผสอบบญชรบอนญาตหรอผสอบบญชภาษอากรแลวแตกรณเพอแสดงวาธรกจมความมนคงเชอถอได มการประกอบการจรงและมความตอเนอง โดยพจารณาจากแนวทางพจารณาสถานภาพธรกจวามการประกอบการจรงและมความ ตอเนองแนบทายคำาสงน (ผนวก ข)

5. ธรกจนนมความจำาเปนจะตองวาจางคนตางดาวทำางาน

6. ธรกจนนตองมอตราสวนระหวางจำานวนคนตางดาวกบพนกงานคนไทยประจำา ในอตราสวนคนตางดาว 1 คนตอพนกงานคนไทยประจำา 4 คน

7. ธรกจประเภทดงตอไปน ใหไดรบการยกเวนหลกเกณฑตามขอ (3) (4) และ (5)และใหไดรบการผอนผนในเรองอตราสวนคนไทยตามหลกเกณฑขอ (๖) โดยใหมพนกงานคนไทยในอตราสวนคนตางดาว ๑ คน ตอพนกงานคนไทยประจำา ๑ คน(ก) ธรกจการคาระหวางประเทศ(สำานกงานผแทน)(ข) สำานกงานภมภาค(ค) บรษทขามชาต (สำานกงานสาขา)

1. แบบคำาขอ ตม.7 รปถาย ขนาด 4 x 6 ซม จำานวน 1 รป และ คาธรรมเนยม 1,900.- บาท (คน

ตางดาวตองมายนคำารองดวยตนเอง)2. สำาเนาหนงสอเดนทางของผยนคำาขอ (หนาทมรปถาย, วซา, ตราเดนทางเขาครงสดทาย, บตร

9. สำาเนาแบบยนรายการภาษเงนไดบคคลธรรมดา (ภ.ง.ด.91) ของคนตางดาวผยนคำาขอ ปลาสด พรอมใบเสรจรบเงน (ถาม)

10.สำาเนาแบบรายการแสดงการสงเงนสมทบตามทไดยนไวตอสำานกงานประกนสงคม ( สปส.1-10) 3 เดอนลาสด พรอมใบเสรจรบเงน

11.สำาเนาแบบแสดงรายการเสยภาษมลคาเพม (ภ.พ.30 หรอ ภ.พ.36) ของปงบการเงนลาสด 3 เดอนลาสด พรอมใบเสรจรบเงน

13.แผนทแสดงสถานททำางานของผยนคำาขอ (ประทบตราบรษทและกรรมการผมอำานาจลงนาม )14. เอกสารหรอหลกฐานอน ตามทคณะกรรมการตดตามการปฎบตราชการของพนกงานเจาหนาท

ตรวจคนเขาเมองของ สตม. กำาหนด (แบบ สตม.2)15. รปถายสถานประกอบการ (ประทบตราบรษทและกรรมการผมอำานาจลงนามทกแผน)

- ภายนอก ใหปรากฏรปถายสภาพตวอาคาร, เลขทตง และปายชอสถานประกอบการ - ภายใน ใหปรากฏภาพพนกงานคนไทยและคนตางดาวขณะปฏบตงานอย

16. ใหนำาหลกฐานเอกสารตวจรงตามขอ 5, 6, 7, 8, 9 และ 10 มาแสดงดวย17.กรณมครอบครวตดตามมาอยดวย ใหแสดงหลกฐานครอบครว ไดแก ทะเบยนสมรส ใบเกด

บตร หากออกโดยรฐบาลในตางประเทศ ใหผานการรบรองจากสถานทตของประเทศนนๆ

1.In the case of business necessity, for example, the applicant must stayto carry out work for a company or partnership

Criteria for Consideration

(1) The alien must have been granted a non-immigrant visa (NON-IM).(2) The alien must earn an income per the attached Table of Income (Annex A).(3) The business must have a paid-up registered capital of no less than Baht 2 million.(4) Said business must have submitted its financial statements as at the end of its fiscal year for thepast two accounting years which have duly been audited and certified by a certified publicaccountant or a tax auditor, to prove that the business is sufficiently secure with actual andcontinuous operation, according to the guidelines for consideration of business status concerning theactual and continuous operation attached hereto (Annex B).(5) Said business needs to hire aliens.(6) Said business must have a ratio of one alien employee per four permanent Thai employees.(7) The following businesses shall be exempted from the Criteria (3), (4), and (5), and the ratio ofThai employees specified under Criteria (6), shall be reduced to one alien employee per onepermanent Thai employee:(a) International trade business (representative office)(b) Regional office(c) Overseas company (branch office)

Documents to be submitted

1. Application form TM.7, photograph 4x6 cm., application fee is 1,900 (Application must be made in person)

2. Copy of applicant’s passport (copy of passport with your photo, last arrival stamp, Re-entry Permit stamp, Departure card (TM.6) and last extend visa)

3. Certificate of employment prepared in accordance with the form prescribed by

the Immigration Bureau (Sor.Tor.Mor.1)- A table showing the numbers of all foreigners employed by the company, also their salary on monthly and annually basis, and their total salary, is additionally required.

4. Copy of work permit5. Proof of corporate registration e.g. certificate of incorporation of company or

partnership certified by the Registrar with validity for 6 months6. Copy of list of shareholders certified by the Registrar with validity for 6 months7. A copy of latest balance sheet and income statement, together with corporate

income tax return (Por.Ngor.Dor.50) and receipt.Copy of Sor.Bor.Chor.3 they must be certified by the Revenue Dept. or by The Department of Business Development.

8. Copy of 3 latest monthly withholding tax return (Por.Pro.1) showing the name of employees and the alien applicant, together with receipt.

9. Copy of latest personal income tax return of the applicant (Por.Pro.91), together with receipt (or an explanatory letter)

10.Copy of 3 latest monthly social security contributions return filed with the Social Security Office (Form Sor.Por.Sor. 1-10)

11.Copy of 3 latest monthly value add tax return (Por.Pro.30 or Por.Por.36) together with receipt.

12.Proof of the need of the business to employ the alien e.g. no Thai candidate has applied after advertising such a position

13.Location map of the place of work14.Other supporting documents required by the competent authority (Sor.Tor.Mor.2)15.Photographs showing the location of the business

a. Exterior photographs showing the address and the sign of company name b. Interior photographs showing the employee while working

16.Original documents of Nos. 5,6,7,8,9 and 10 must be provided.17. In case the applicant are accompanied by the family member, proof of family

relationship e.g. marriage certificate, birth certificate of their children must be provided. If these documents were issued by a foreign government, they must be certified by such foreign embassy.

Remark: Documents required for permission of temporary stay no. 8- 11 must be certified true copy by authorized officer of government unit concerned

ของพนกงานเจาหนาทตรวจคนเขาเมอง ของ สำานกงานตรวจคนเขาเมองกำาหนด(กรณเปนบคคลสญชาตศรลงกา อนเดย ปากสถาน บงคลาเทศ อหราน เนปาล โตโก ไนจเรยและยกนดา จะไดรบใหอยในราขอาณาจกรไดไมเกน 7 วน)

4.In the case of tourism purposes:


The alien:(1) Must have been granted a tourist visa (TOURIST).(2) Must not be of a nationality or type prescribed by the committee monitoring officialproceedings of officers of the Immigration Bureau.( In case of the following natinalites ,extension of stay permit will not be longer than 7 days ; Sri Lanka ,India,Pakistan,Bangladesh,Iran,Nepal,Togo,Nigeria,Uganda )

1. คนตางดาวตองไดรบการตรวจลงตรา ประเภทคนอยชวคราว2. เดนทางเขามาในราชอาณาจกรกอนวนท 1 ตลาคม 2549 และไดรบ

อนญาตใหอยในราชอาณาจกรเพอการลงทนไมนอยกวา 3 ลานบาทตอเนองตลอดมา

3. มหลกฐานการโอนเงนเขาสประเทศไทย จำานวนไมนอยกวา 3 ลานบาท4. มหลกฐานการลงทนโดยการซอหองชดใน อาคารชดจากหนวยงาน หรอ

สวนราชการท เกยวของในราคาซอไมนอยกวา 3 ลานบาทหรอ5. มหลกฐานการลงทนโดยการฝากเงน ประจำากบธนาคารทจดทะเบยนใน

ประเทศไทย ซงมผถอหนเปนคนสญชาตไทยเกนกวารอยละ 50 ไมนอย

กวา 3 ลานบาท หรอ6. มหลกฐานการลงทนโดยการซอพนธบตร ของทางราชการหรอของ

กรณเพอการลงทนไมนอยกวา 10 ลานบาท1. คนตางดาวตองไดรบการตรวจลงตรา ประเภทคนอยชวคราว2. มหลกฐานการโอนเงนเขาสประเทศไทย จำานวนไมนอยกวา 10 ลานบาท3. มหลกฐานการลงทนโดยการซอหรอเชา ระยะเวลาไมนอยกวา 3 ป หองชด

ในอาคารชด จากหนวยงาน หรอสวนราชการทเกยวของใน ราคาซอหรอเชาไมนอยกวา 10 ลานบาท หรอ

4. มหลกฐานการลงทนโดยการฝากเงนประจำา กบธนาคารทจดทะเบยนในประเทศไทยซงม ผถอหนเปนคนสญชาตไทยเกนกวารอยละ 50 ไมนอยกวา 10 ลานบาท หรอ

5. มหลกฐานการลงทนโดยการซอพนธบตร ของทางราชการหรอของรฐวสาหกจไมนอย กวา 10 ลานบาท หรอ

6.สำาเนาพนธบตร (เฉพาะกรณลงทนซอ พนธบตรของทางราชการหรอรฐวสาหกจ)

5.In the case of investment:


A. Investment of no less than Baht 3 million:The alien:(1) Must have been granted a non-immigrant visa (NON-IM);(2) Must have entered the Kingdom before October 1, 2006 and must have been consecutivelypermitted to stay in the Kingdom for an investment of no less than Baht 3 million;(3) Must have evidence of transferring funds into Thailand of no less than Baht 3 million;(4) Must have evidence of investing in the purchase of a condominium unit for no less than Baht 3million issued by a relevant agency or by the government; or(5) Must have evidence of investing in the form of a fixed deposit of no less than Baht 3 million

with a bank which is registered in Thailand and has Thai nationals holding more than 50 percent ofits shares; or(6) Must have evidence of investing in the purchase of government or state enterprise bonds of noless than Baht 3 million; or(7) Must have evidence of making an investment as set out in Criteria (4), (5), or (6) with a totalvalue of no less than Baht 3 million.

B. Investment of no less than Baht 10 million:The alien:(1) Must have been granted a non-immigrant visa (NON-IM).(2) Must have evidence of transferring funds into Thailand of no less than Baht 10 million.(3) Must have evidence of investing in the purchase or rental of a condominium unit for a period ofno less than 3 years issued by a relevant agency or government, at a purchase or rental price of noless than Baht 10 million; or(4) Must have evidence of investing in the form of a fixed deposit of no less than Baht 10 millionwith a bank which is registered in Thailand and has Thai nationals holding more than 50 percent ofits shares; or(5) Must have evidence of investing in the purchase of government or state enterprise bonds of noless than Baht 10 million; or(6) Must have evidence of making an investment as set out in Criteria (3), (4), or (5) with a totalvalue of not less than Baht 10 million.

Copies of bond certificates (only in the case of investment in a purchase of government or stateenterprise bonds)

B. Investment of no less than Baht 10 million:1. Application form2. Copy of applicant’s passport3. Copy of evidence showing a transfer of funds from a foreign country to a bank in Thailand4. Copy of a condominium purchase agreement and a copy of the ownership registration of saidcondominium issued by the government or relevant agency (in the case of purchase of acondominium) or a copy of a long-term lease agreement; or5. Funds deposit certificate issued by a bank and a copy of evidence of the funds deposit (only inthe case of investment in funds deposit); or6. Copies of bond certificates (only in the case of investment in a purchase of government or stateenterprise bonds)

1. แบบคำาขอ ตม.72. สำาเนาหนงสอเดนทางของผยนคำาขอ3. สำาเนาใบอนญาตทำางาน4. หนงสอรบรองและรองขอใหอยตอจาก สถานศกษานน โดยระบตำาแหนง อตรา เงนเดอน และ

ระยะเวลาการจาง5. สำาเนาใบประกอบวชาชพคร หรอสำาเนา หนงสอรบรองสทธจากครสภา หรอสำาเนา หนงสอผอน

6.In the case of a teacher, professor, or expert in a government educational institution:


The alien:(1) Must have been granted a non-immigrant visa (NON-IM).(2) Must have been confirmed and requested by the particular educational institution.

specifying the applicant’s title, monthly salary rate, and term of employment5. Copy of a teaching license or a certificate of license issued by the Teacher’s Council of Thailandor a copy of a letter of waiver issued by the Teacher’s Council of Thailand or a copy of anacknowledgment of waiver request issued by the Teacher’s Council of Thailand (except for teachers,instructors, or experts of higher education)

7.กรณเปนคร หรออาจารยหรอ ผเชยวชาญหรอบคลากรทางการศกษาในสถานศกษาของเอกชน


1. คนตางดาวตองไดรบการตรวจลงตรา ประเภทคนอยชวคราว2. สถานศกษานนไดรบอนญาตใหประกอบ กจการจากสวนราชการทเกยวของ3. ไดรบการรบรองและรองขอจากสถานศกษานน4. กรณบคลากรทางการศกษา ตองมคณวฒหรอประสบการณตรงกบหนาทปฏบตและมจำานวน

ไมเกนรอยละ 10 ของจำานวนครหรออาจารยของสถานศกษานน


กรณโรงเรยนในระบบ ไดแก โรงเรยน สามญศกษา English Program โรงเรยน อาชวศกษาทใชหลกสตรกระทรวงศกษาธการ และโรงเรยนนานาชาต

11.In the case of being a family member of an alien who has been permitted a temporary stay in the Kingdomfor study in an educational institution according to Clauses 2.8 or 2.9 hereof (applicable only to parents,spouse, children, adopted children, or spouse’s children):

(1) The alien must have been granted a non-immigrant visa (NON-IM).(2) The alien must have proof of relationship.(3) In the case of spouse, the relationship must be de jure and de facto; or(4) In the case of children, adopted children, or spouse’s children, said children, adopted children,

or spouse’s children must not be married, must live with the alien as part of the family, and must notbe over 20 years of age; or(5) In the case of parents, the father or mother must maintain an average annual income of no lessthan Baht 40,000 per month throughout the year or must have deposited funds of no less than Baht400,000 to cover expenses for one year.For other necessary cases, the Commissioner or Deputy Commissioner of Immigration Bureauis granted the authority to make decisions regarding approval on a case-by-case basis.(6) In the case of marriage to a Thai woman, the alien husband must earn an average annual incomeof no less than Baht 40,000 per month or must have no less than Baht 400,000 in a bank account inThailand for the past two months to cover expenses for one year.

20.In the case of being a family member of an alien permitted a temporary stay in the Kingdom underClauses 2.1, 2.2, 2.3, 2.5, 2.6, 2.7, 2.10, 2.12, 2.13, 2.14, 2.15, 2.16, 2.17, 2.21, 2.22, 2.26, or 2.29 hereof or Section 34(7) (applicable only to parents, spouse, children, adopted children, or spouse’s children):

21.In the case of necessity where the alien must stay to perform duties in a public charitable organization, aforeign private company, a foundation, an association, a foreign chamber of commerce, the ThaiChamber of Commerce, or the Federation of Thai Industries:


The alien:(1) Must have been granted a non-immigrant visa (NON-IM).(2) Must have been confirmed and requested by the authorized person or the person holding thehighest position in the organization, and/or(3) Must have been confirmed and requested by the head of a government agency equivalent to orhigher than the departmental level or by the head of a state enterprise or by the head of anothergovernment agency relating to the organization.

ในบญชตลอดระยะเวลายอนหลง 3 เดอน ไมนอยกวา 800, 000 บาท เฉพาะในปแรกใหแสดงบญชเงนฝากโดยมเงนจำานวนดงกลาวฝากอยในบญชมาแลวไมนอยกวา 60 วน หรอ

5. มเงนไดในรอบป และมเงนฝากธนาคาร คำานวณรวมกนไดไมนอยกวา 800,000 บาทนบถงวนยนคำาขอ

6. คนตางดาว ซงเดนทางเขามาในราชอาณาจกรกอนวนท 21 ตลาคม 2541และไดรบอนญาตใหอยในราชอาณาจกร เพอใชชวตในบนปลายตอเนองตลอดมา

22.In the case of retirement:


The alien:(1) Must have been granted a non-immigrant visa (NON-IM).(2) Must be 50 years of age or over.(3) Must have evidence of having income of no less than Baht 65,000 per month; or(4) On the filing date, the applicant must have account deposited (saving / fixed account) in a bank in Thailand of no less thanBaht 800,000 for the past three months. For the first year only, the applicant must have proof of adeposit account in which said amount of funds has been maintained for no less than 60 days prior tothe filing date; or(5) Must have an annual earning and funds deposited with a bank totaling no less than Baht800,000 as of the filing date.(6) An alien who entered the Kingdom before October 21, 1998 and has been

consecutivelypermitted to stay in the Kingdom for retirement shall be subject to the following criteria:

(a) Must be 60 years of age or over and have an annual fixed income with funds maintained ina bank account for the past three months of no less than Baht 200,000 or have a monthly income ofno less than Baht 20,000.

(b) If less than 60 years of age but not less than 55 years of age, must have an annual fixedincome with funds maintained in a bank account for the past three months of no less than Baht500,000 or have a monthly income of no less than Baht 50,000.

5. ผดแลผปวย กรณทเปนบดา มารดา คสมรส บตรหรอบตรบญธรรม ใหแนบเอกสารแสดงความสมพนธในครอบครว เชน สำาเนาทะเบยนบาน สำาเนาบตรประจำาตวประชาชน สำาเนาทะเบยนสมรส สำาเนาสตบตร สำาเนาใบรบรองบตร หรอหนงสอรบรองความสมพนธจากผรบการรกษาพยาบาลในกรณทไมไดจดทะเบยนสมรส สำาหรบบคคลอนนอกเหนอจากบดา มารดา คสมรส บตร หรอบตรบญธรรมใหแนบสญญาจาง หรอหนงสอรบรองจากผเขารบการรกษาพยาบาล โดยทงสองกรณตองแนบเอกสารแสดงรายชอผดแลแลผปวย ซงผรบการรกษาพยาบาลลงลายมอชอรบรองเอกสารทงน เอกสารดงกลาวขางตน ตองรบรองโดยสถานทตหรอหนวยงานราชการของประเทศในกลมประเทศสมาชกคณะมนตรความรวมมอรฐอาวอาหรบ (GCC : Gulf Cooperation Council) (ตามแบบฟอรมเอกสารหนงสอรบรองความเปนญาตและผตดตามของผรบบรการรกษาพยาบาล - Affidavit of Support) โดยแปลเปนภาษาไทยหรอภาษาองกฤษ

25.In the case of receiving medical treatment, attending rehabilitation, or taking care of a patient:


(1) Must have been confirmed and requested by a physician of the hospital providing said treatmentwith full explanation about the illness, period of treatment, and the physician’s opinion that theillness is an impediment to travel.

(2) In the case of taking care of a patient, the applicant must have been confirmed and requested bya physician of the hospital providing the examination and treatment or by an embassy or consulate.

(3) In the case of caretakers who are not the parents, spouse, children, adopted children, or spouse’schildren, permission shall be granted for no more than one person.

27.In the case of performing duties or missions for a government agency, state enterprise, other governmentagency or embassy or consulate or international organization:


(1) Must have been confirmed and requested by a government agency of the departmental level orequivalent; the head of a state enterprise; the head of another government agency; or a police officerof a level equivalent to or higher than the divisional level; or by a military officer of a command unitunder the Ministry of Defense, Royal Thai Armed Forces Headquarters, Royal Thai Army, RoyalThai Navy, or Royal Thai Air Force who is a Major General, Rear Admiral, Air Vice Marshal, orofficer of a higher ranking; or by an international organization.

(2) In the case of necessity on a case-by-case basis, to stay more than 90 days, the application mustbe forwarded to the Commissioner of the Immigration Bureau or Deputy Commissioner of theImmigration Bureau for consideration.

31.In the case of a person in charge of conveyance and crew of conveyancewho entered through a port, station, or locality in the Kingdom, and has not departed from the Kingdom:
