Article 2.- Scope of ApplicationThe present Andean Technical Regulation is applicable to clothing new destined for the consumer or user, whose sub-games are classified according to the NANDINA, are listed in Annex No. 1 to this Regulation.

Clothing that is referred to in this Regulation Andean Technician are as defined in paragraph 3.3.

With the exception of the scope of this Technical Regulation Andino, clothing made by commissioned to measure the customer and the menaje de casa, diplomatic allowances, relief shipments, donations, advertising material, samples of no commercial value, personal effects or luggage of travellers, items of correspondence, postal parcels and urgent shipments, as garments that do not correspond to its object and purposes.

The present Technical Regulation is applicable to the andean natural persons or legal entities that manufacture, import or marketed within the Andean subregion the products that are part of this Regulation.

Purchasing specifications, by governmental bodies have the power to follow the prescriptions of the present Technical Regulation Andino, according to its domestic legislation.

Article 3 .- DefinitionsFor the purpose of application and interpretation of this Andean Technical Regulation must take into account the following definitions:3.1 Adorno: Ornament in a clothing that does not alter the characteristics of the same.

3.2 MERCHANT or distributor: natural or legal person who regularly sells or supplies, wholesale or retail, goods intended finally to consumers, even when it is not developed in establishments open to the public.

3.18 Pen: Permanent, that cannot be erased.

Article 4 .- minimum information to containThe labels of the clothing should include at least the following information:A.   Composition of the materials that make up the product. b. Aftercare Instructions and conservation.C.    Identification of the manufacturer or importer.D.   Country of origin.E.   Size or dimensions, as applicable.

The information provided for in subparagraphs c and e of this article may be recorded on a label is not permanent. The use of non-permanent labels will be conditioned to ensure the presentation of the information required in all stages of the marketing chain up to the acquisition of the preparation on the part of the consumer or end user.

The information referred to in subparagraphs a, b, and d of this article must be entered in the permanent labels.Article 5.- General ConditionsThe information required in the previous article must meet the following general requirements:

5.1 should be drafted in simple terms, with the purpose of the consumer or user to have knowledge about the actual characteristics of the product.5.2 may be in one or more labels.5.3 Must be indelible.5.4 Must be legible to the naked eye, be placed in a visible place of the product, or in an accessible place.5.5  Must be expressed in spanish language, without prejudice to the fact that the information can be submitted in addition in other languages.5.6 The dimensions must be expressed using the International System of Units of measure (YES), without prejudice to the additional employment in other systems of units of measure.5.7 In the case of the Carvings, must be expressed in alphabetic or numeric forms or both,Admitting their expressions of everyday use.5.8 Additional information or special that allows the consumer or user decide the purchase of product, should not conceal or misrepresent the minimum information required.5.9 If the label is affixed must have properties and technical characteristicsThat to be removed from the products covered by this Technical RegulationAndino, lead to their destruction and cannot be re-used.5.10 The labels will not be able to overcome on any other label to hide any information of the product originally manufactured.

Subchapter IOn the Description, COMPOSITION AND DECLARATION OF THE MATERIALS OF THE CLOTHING INDUSTRY

Article 6 .- Designation of the materials.  The materials that compose the clothing should be recorded on the label with the generic names or the other denominations of synthetic textile fibers, artificial or natural, which will be used preferably the terms contained in the tables in Annex 3.

In the denomination of any material that does not correspond to the definition of "leather" or "skin", it should not be use that name to main title, or root (example: "synthetic leather leather", "recovered", "ecological leather" among others) or as an adjective, or their representative symbols.

For the case of garments made with leather, it is not necessary to specify the kind of animal which comes. If, however, the label appears the name of the animal, such

Information will be under the responsibility of the manufacturer or importer of clothing, subject to the laws or regulations in consumer's defense of the Member Countries.

The closure panel components or adjustments, ornaments, similar items, as well as those indicated in Annex 2 of this Regulation Andean Technician are not part of the percentage content specified in this article.Article 7.- Statement of the composition of materials.For the declaration of the composition of materials of clothing should take into account the following considerations:7.1 The percentage of participation of the materials in clothing must be declared in descending order, in accordance with the following options:

7.1.1.- In relation to the total mass of the product; or7.1.2.- By distinct parts with percentage content of the materials of each party. In this case you must take into account the following considerations:(A)   The clothing industry has two or more distinct parts;(B) shall   not be taken into account the linings; andC)    You can omit the declaration of the distinct parts that constitute less than30% of the total mass of the product.

7.2 All material that composes the clothing in a percentage equal to or greater than 5 % of theThe product must be declared. The materials present in a smaller percentage to 5 % or as a whole is less than 15% of the total mass, can be declared as: "others", "Other Material", "Other Materials", "other fiber" or "other fibers".

The materials that provide special features or functional to the product must be reported showing its generic name, even when they are below the5% of the total mass of the 7.3 In the case of clothing containing coated fabrics, its coatings areShould Declare using the phrases "covered" or "covered with", according to the generic name or a name of the polymer that composes it. The composition of the tissueCoated must be declared in accordance with article 6; example 60% polyester, 40% Cotton, coated with polyurethane.

7.4 When the clothing industry has lining, its composition shall be declared on the same label orIn additional, explicitly stating that it is the composition corresponding, as set out in paragraph 8.4.Article 8 .- tolerances on the content of materials.The tolerances of the content of the materials that make up the clothing should have the following considerations:

8.1 The confections processors in its entirety by textile fibers or leather or skin tanned, should be labeled as "100%", "pure" or "ALL" if it is composed of the same material. It supports a tolerance of 2 % by mass of other textile fibers provided that it will not be added as a matter of routine but on grounds of technical,  functional or decorative, being inevitable in good manufacturing practices. This tolerance shall be increased to 5 % for textile products carding process.

For the garments composed only by fabrics coated, the declaration of the "100%", "pure" or "all", applied when this tissue is composed of a layer of textile material covered with a polymer film, in which the declaration of the textile fiber and their tolerances only apply to the textile material, indicating whether or not the coating; example 100% cotton, coated with polyurethane.8.2 In the garments composed of two or more textile materials supported a tolerance of +/- 3% in mass of the contents of the textile fiber for each material bySeparate.

8.3 For the garments that have lining, it is not mandatory to declare its composition when its percentage stake in the clothing industry does not exceed 5% of the total massThe product or the 15 % of the total surface of the same.

Subchapter IICare and Preservation Instructions

Article 9 .- The care and preservation instructions must be included through legends, standardized symbols, or both, in accordance with the ISO 3758:2012 "Textiles. Labelling code of conservation through symbols".

Subchapter IIIIdentification OF THE MANUFACTURER OR IMPORTER

Article 10.- On the basis of the provisions of Article 4°of this Technical Regulation Andino, the label must indicate the name of the natural person or company) of the manufacturer or importer as appropriate, including the tax identification number or other records to be payable in the country of destination for marketing these products.

The inclusion of trademarks and logos does not substitute for the identification of the manufacturer or importer is required by this article. In the case of include trademarks as additional information, these shall be in accordance with the provisions of Decision 486 "Common Regime of Intellectual Property Rights", Title VI "Brand Names" Chapter I "Requirements for the Registration of Marks".Chapter IIIAdditional CONDITIONS OF LABELLING

Article 11.- When the garments are produced in the so-called "joint", composed of two or more clothing, even if they maintain the same composition of materials, the label will have to go on each one of them. When the composition differs in each article of clothing you must declare the composition of materials separately, identifying each of them.

When the garments are marketed as "pairs", made of the same material and design, as for example: pairs of socks, gloves or mittens, the label must be in at least one of the garments that make up the pair.

Article 12.-  When the clothing, due to its nature, delicacy or size,Adherirles directly the label, it adversely affecting them in their use, aesthetics, or cause loss of value, or those that are marketed in packaging that does not allow them to view their contents, shall carry stuck in their packaging the label with the information required in the present Technical Regulation Andino. As examples, mention is made of cases such as: sets for newborns, disposable clothing, apparel reversible, sets of household linen, pantyhose, stockings nylon or soirées, among others.

Article 13.- When a complement of clothing is part of a clothing, both in the scope of the present Andean Technical Regulation, such as a pair of trousers that has a seat belt, it shall submit two (2) tags separately, unless they are made of the same material.

Chapter IVConformity assessment procedure.

Article 14.- The conformity assessment procedureFor the purposes of this Andean technical regulation does not apply a conformity assessment procedure. However, the information contained on the label, as required in article4, it will be assumed as the explicit declaration of the manufacturer, importer, marketer or distributor of such products, as appropriate, and as such, credited to the appropriate authority, consumers and other stakeholders, the conditions by which

The consumer or user chooses the product and at the same time, this information will serve as a test for civil and commercial effects.

Chapter VSUPERVISION AND CONTROLArticle 15.- The monitoring regime applicableThe fulfilment of the obligations covered by this Andean technical regulation shall be subject to the monitoring regime and control provided for by the country of destination for the supervision of their technical regulations, provided that their application to ensure equitable treatment between domestic and imported products.

In order to comply with this Andean Technical Regulation of products imported into a Member Country will verify that the label contains the information required in articles 4 and 5, according to the internal procedures of the Authority of Control and Surveillance of the Member Country of destination.

Without prejudice to the foregoing, in the domestic and imported products, the information on the label must be demonstrated before the authority of control and surveillance of member country, when required, according to the internal procedure of the authority of control and surveillance of each country.Article 16.- Penalties applicableBreaches of this Regulation will be sanctioned by Technical Andino national authorities in accordance with their internal rules.

Chapter VISupplementary provisions, TRANSITIONAL AND FINAL PROVISIONS

Article 17 - NotificationThe present Andean technical regulation shall be notified to the Andean Community Member Countries in accordance with the conditions laid down in Andean Decisions 827 and 615, and according to the Agreement on Technical Barriers to Trade in the World Trade Organization (WTO).

The Andean Community Member Countries that have free trade treaties or trade agreements with third countries may notify the present Andean Technical Regulation within the framework of the provisions of such treaties or agreements.

Article 18.- Entry into ForceIn accordance with  Section 2.12 of the Agreement  on Technical Barriers to Trade and the Decision 827 of the Andean Community, this Decision shall enter into force eighteen (18) months after the date of its publication in the Official Gazette of the Cartagena Agreement.

Article 19.- Review and updateThis Regulation shall be reviewed Technical Andino at least once every five (5) years, with the aim to update it or decide to rescind, or when the conditions that gave origin to change or disappear.Article 20.- RepealFrom the date of publication of this Decision deroguense the provisions that are contrary.
