Report Highlights:On Thursday, October 26, 2017, Japan’s Ministry of Health, Labor and Welfare (MHLW) announced revisions to Japan’s Maximum Residue Levels (MRLs) for the following pesticides, veterinary drugs, and feed additives: Aminocyclopyrachlor, Etofenprox, Captan, Fenbuconazole, Propiconazole, Josamycin, Spectinomycin, and Prednisolone. MHLW also proposes to establish the maximum limit for Deoxynivalenol (DON) in foods. Furthermore, MHLW proposes to designate Propiconazole as a new food additive. The Embassy comment period for these proposals is open until Thursday, November 09, 2017. MHLW will notify these revisions and amendments to the World Trade Organization, which will provide another opportunity for interested parties to comment on these proposed changes.

The Ministry of Health, Labour and Welfare (MHLW) will amend the existing standards and specifications for food as shown in this document. Please provide comments in writing by Thursday, November 9, 2017. After the given date, comments should be directed to the enquiry point in accordance with the WTO/SPS Agreement.
With regard to agenda item 1, 2, 3, 4 and 5, the SPS notification will be made for the setting or revision of the MRL for the agricultural and veterinary chemicals except for Aminocyclopyrachlor and Prednisolone for which regulations will not be strengthened by this amendment.
If you wish to request Japan to adopt the same limits as your country’s MRLs, you are requested to submit data supporting your country’s MRLs, such as risk assessment and residue data.

Item 1. Establishment of the Maximum Residue Limits for Agricultural and Veterinary Chemicals in Foods
The Food Sanitation Act authorizes the Ministry of Health, Labour and Welfare (MHLW) to establish residue standards (maximum residue limits, “MRLs”) for pesticides, feed additives, and veterinary drugs (hereafter referred to as “agricultural and veterinary chemicals”) that may remain in foods. Any food for which standards are established pursuant to the provisions in Article 11, Paragraph 1 of the act is not permitted to be marketed in Japan unless it complies with the established standards.
On May 29, 2006, Japan introduced the Positive List System1 for agricultural and veterinary chemicals in food. All foods distributed in the Japanese marketplace are subject to regulation of the system.
The MHLW is going to modify or newly set MRLs in some commodities for the following substances:
Pesticides: Aminocyclopyrachlor, Etofenprox, Captan,
Fenbuconazole, Propiconazole
Veterinary drugs: Josamycin, Spectinomycin, Prednisolone

Summary
Aminocyclopyrachlor (pesticide: herbicide): Not permitted for use in Japan. The MHLW is going to establish MRLs in some commodities in response to a request for setting import tolerances based on the Guideline for Establishment and Revision of Maximum Residue Limits for Agricultural Chemicals Used outside Japan (Shokuan No. 0205001, 5 February 2004). This action will not strengthen the current regulation for any commodities.
Etofenprox (pesticide: insecticide): Permitted for use in Japan. The MHLW is going to establish MRLs in some commodities in response to a request for setting MRLs by the Ministry of Agriculture, Forestry and Fisheries (MAFF) with the intention to expand its use pattern.
Captan (pesticide: fungicide): Permitted for use in Japan. The MHLW is going to establish MRLs in some commodities in response to a request for setting MRLs by the MAFF with the intention to expand its use pattern. The MHLW is also going to modify MRLs in some commodities that were provisionally set at the introduction of the Positive List System.
Fenbuconazole (pesticide: fungicide): Permitted for use in Japan. The MHLW is going to establish MRLs in some commodities in response to a request for setting MRLs by the MAFF with the intention to expand its use pattern.
Propiconazole (pesticide: fungicide): Permitted for use in Japan. The MHLW is going to modify the existing MRLs for animal products in response to a request by the MAFF.
Josamycin (veterinary drug: antibiotic): Not permitted for use in Japan. The MHLW is going to withdraw MRLs in some commodities that were provisionally set at the introduction of the Positive List System.
Spectinomycin (veterinary drug: antibiotic): Not permitted for use in Japan. The MHLW is going to modify MRLs in some commodities that were provisionally set at the introduction of the Positive List System.
Prednisolone (veterinary drug: synthetic adrenocortical hormone): Permitted for use in Japan. The MHLW is going to modify MRLs in some commodities that were provisionally set at the introduction of the Positive List System. This action will not strengthen the current regulation for any commodities.

Item 2. The removal of Azadirachtin from the list of substances having no potential to cause damage to human health (exempt substance list).
Azadirachtin is obtained by extraction of neem (Azadirachtin indica) seeds or seed oil, which is considered to have an insecticidal effect. Azadirachtin has never been used as pesticide in Japan.
Azadirachtin is currently designated by Minister of Health, Labour and Welfare as the substance having no potential to cause damage to human health, which is also referred to as “exempt substance,” according to the Paragraph 3, Article 11, Food sanitation Act. Those substances are exempted from the Japan’s positive list system.
The Food Safety Commission of Japan conducted its risk assessment in response to the request from the Ministry of Health, Labour and Welfare (MHLW) on August, 2013, and concluded that azadirachtin is not considered to have no potential to cause damage to human health from its residue in foods. The reasons are there is insufficient data on its toxicology, residue in foods and dietary exposure and the European Food Safety Authority has set its Acceptable Daily Intake (ADI) and Acute Reference Dose (ARfD).
The MHLW has decided to remove the substance from the exempt substance list on the basis of the risk assessment by the Food Safety Commission, which means that the residue of azadirachtin in foods is going to be regulated under the positive list system. The distribution of any foods which contain agricultural chemicals at amounts exceeding a level of 0.01 ppm in the Japanese marketplace is prohibited unless specific maximum residue limits have been set.
Item 3. Establishment of the Maximum Limit for Deoxynivalenol (DON) in Foods.
Background From the viewpoint of public health, the Minister of Health, Labour and Welfare is authorized to establish specifications and standards for food or additives to be served for the purpose of marketing by hearing the opinions of the Pharmaceutical Affairs and Food Sanitation Council. (Food Sanitation Act Article 11 Paragraph 1)
Based on the conclusion of discussion conducted by the Committee on Standards for Food* on September 22, 2017, the Ministry of Health, Labour and Welfare of Japan (MHLW) has decided to establish a maximum limit (ML) for Deoxynivalenol (DON) in wheat at 1.0 mg/kg.
* The Committee of the Standards for Food is one of the advisory bodies of the Food Sanitation Council that is established under the Pharmaceutical Affairs and Food Sanitation Council.
Outline of revision Deoxynivalenol (DON) is a trichothecene mycotoxin produced in cereals (especially wheat, maize and barely) by mainly G. zeae, F. graminearum andF. culmorum. It is known to cause acute toxicity characterized by emesis and disorders of the lymphoid tissue and digestive tract and chronic toxicity characterized by symptoms including weight loss.
In May 2002 the MHLW established a provisional standard limit of 1.1 mg/kg for wheat because a high concentration of DON (2.2 mg/kg) was detected in wheat distributed in the Japanese market. In July 2015 theCodex Alimentarius Commission set maximum levels for DON in wheat, maize, and barley. (CODEX STAN 193-1995)Wheat is a secondary staple food in Japan and most of wheat consumed in Japan is imported. In light of past food poisoning cases associated with DON, Japan will establish the ML for DON in wheat to prevent a public
health risk. The ML has been derived applying the Codex ALARA principle1, based on the actual situation of contamination of imported wheat and exposure assessment for Japanese consumers.

Concept of setting MLs
・ Codex Alimentarius Commission separately set the maximum levels for DON in cereals (wheat, maize, and barley) in three categories: cereal grains for further processing, flour, and cereal-based foods for infants and young children. In Japan, however, it is difficult to process wheat to reduce possible contamination by DON. In addition, it is not easy to separately regulate wheat-based foods for infants and children.
・ Exposure assessment conducted by the Ministry of Agriculture, Forestryand Fisheries of Japan has found that if a maximum limit (ML) of 1.0 mg/kg is applied to wheat, the 95th percentile of the orally ingested DON by pre-school children would be the same level as the tolerable daily intake (TDI) for DON set by the Food Safety Commission of Japan, a risk assessment body, in the Cabinet Office. This means the application of the ML of 1.0 mg/kg will ensure food safety.
・ Codex Alimentarius Commission sets maximum levels as low as reasonablyachievable based on actual contamination studies, considering so that the violation rate can be 2–3%. According to the study carried out by the MHLW, an ML of 1.0 mg/kg will result in a violation rate of about 2%.

Item 4. Revision of the Standards and Specifications for Foods and Food Additives under the Food Sanitation Act
Background Any food or food additive for which compositional specifications or standards are established based on Article 11, Paragraph 1 of the Food Sanitation Act of Japan and stipulated in the Ministry of Health, Labour and Welfare Notification (Ministry of Health and Welfare Notification No. 370, 1959) shall not be used or marketed unless it meets the standards or specifications.
Non-alcoholic beverages are classified into four categories: 1) mineral waters (non-alcoholic beverages consisting only of water), 2) frozen fruit beverages, 3) fruit juices for ingredients, and 4) beverages other than those listed in 1) through 3). Compositional specifications and standards are established for individual categories.
In December 2014 Japan revised the existing specifications and standards for consistency with Japan’s water quality standards and international standards. This time the Japan will revise the specifications and standards for the items that were not covered by the revision of December 2014 based on the assessment report from the risk assessment body, the Food Safety Commission of Japan, a risk assessment body, in the Cabinet Office.

Item 5. Designation of Food Additive
The government of Japan will designate Propiconazole as a
food additive. Summary The Food Sanitation Act, in Article 10, prohibits the use and sale of food additives the Minister of Health, Labour and Welfare (hereinafter referred as “the Minister”) does not designate. In addition, when specifications or standards for food additives are established based on Article 11 of the act and stipulated in the Ministry of Health, Labour and Welfare Notification (Ministry of Health and Welfare Notification No. 370, 1959), those additives shall not be used or sold unless they meet the standards or specifications.
In response to a request from the Minister, the Committee on Food Additives of the Food Sanitation Council that is established under the Pharmaceutical Affairs and Food Sanitation Council has discussed whether it is adequate to designate Propiconazole [CAS: 60207-90-1]※ as a food additive.
The committee has concluded that based on Article 10 of the act, the Minister should designate Propiconazole as a food additive unlikely to harm human health and establish specifications and standards for this additive based on Article 11 of the act. See Attachments 5-1.
Note: Propiconazole is a triazole fungicide. It has a fungicidal effect by inhibiting membrane ergosterol biosynthesis in filamentous fungi. It is applied overseas, such as in Europe and the United States, to crops, including citrus fruits, as a fungicide in the pre-harvest period or as an antimolding agent in the post-harvest period. In Japan, this substance is registered in 1990 as a fungicide in the pre-harvest period and used for commodities including wheats and barley. Propiconazole, however, has not been designated as a food additive.

Standards for use (draft)
Propiconazole is permitted for use on apricot, cherry, citrus fruits (excluding unshū oranges), nectarine, peach, and Japanese plum. It shall not remain more than 0.008 g/kg in citrus fruits (excluding unshū oranges), 0.004 g/kg in apricot, cherry, nectarine, and peach, and 0.0006 g/kg in Japanese plum.

Specific Gravity d : 1.288–1.290.Purity
Lead Not more than 2 g/g as Pb (2.0 g, Method 1, Control Solution: Lead Standard Solution 4.0 mL, Flame Method). After the sample is charred, ignite it at 450°C in an electric furnace.
AssayTest Solution and Standard Solution Weigh accurately about 50
mg each of Propiconazole and propiconazole for assay, add 20 mL of the internal standard solution to each, add acetone to dissolve the mixture, and then make each of the solutions up to exactly 100 mL with acetone.
Internal Standard Solution Dissolve 75 mg of fludioxonil for assay in acetone to make exactly 50 mL.
Procedure Analyze 1- L portions of the test solution and the standard solution by gas chromatography using the operating conditions given below. Determine the peak area ratios of propiconazole to fludioxonil for the test solution and the standard solution, and express as Q T and Q S , respectively. Calculate the amount of propiconazole by the formula:

Operating ConditionsDetector: Hydrogen flame-ionization detector.Column: A fused silica tube (0.25 mm internal diameter and 30 m
length) coated with a 0.25- m thick layer of dimethylpolysiloxan for gas chromatography.
Column temperature: Inject at 200ºC, then raise the temperature at a rate of 5ºC/minute to 280ºC.
Detector temperature: A constant temperature of about 300ºC. Injection port temperature: A constant temperature of about 250ºC. Carrier gas: Helium.Flow rate: Adjust the retention time of propiconazole to 10–15 minutes. Injection method: Split.
Split ratio: 1:10.
Reagents and Test Solutions (TS)
Propiconazole for assay C15H17Cl2N3O2 [ 60207-90-1 ] A colorless to yellow semi-gelatinous substance or a transparent viscous liquid.
Content Not less than 97.0% of propiconazole (C15H17Cl2N3O2).Identification Measure the absorption spectrum of propiconazole
for assay as directed in the Liquid Film Method under Infrared Spectrophotometry. It exhibits absorptions at about 2960 cm-1, 2870 cm-1, 1587 cm-1, 1506 cm-1, and 1466 cm-1, 1273 cm-1, 1138 cm-1, and 1028 cm-1. Use optical plates made from sodium chloride.
Specific gravity d : 1.288–1.290.Assay Weigh accurately about 40 mg of propiconazole for assay and about 4 mg
of 1,4-BTMSB-d4, and dissolve them together in 4 mL of deuterated acetone. Transfer the resulting solution to an NMR tube of 5 mm in external diameter, stopper tightly, and measure 1HNMR spectra using an NMR spectrometer at a proton resonance frequency of 400 MHz or more. Assuming the signal of 1,4-BTMSB-d4 .00 ppm, determine the signal area intensity (A) (corresponding to 1 hydrogen) at around 7.05–7.13 ppm. Assuming the signal area intensity of 1,4-BTMSB-d4 as 18.00, when the conversion value of A and the purity of 1,4-BTMSB-d4 are designated as I and P(%), respectively, determine the content of propiconazole by the following formula.
