CASE STUDY
Tuna Boat Incident – Work Experience Student
Andrew, a Year 11 student, had an interest in aquaculture and arranged to do his work experience with a tuna farm to see how the fishing industry operated.
On his first day, Andrew was doing jobs like untangling and mending nets. Later in the day he helped clean one of the vessels and do other general tasks.
On the second day, it was arranged that Andrew would be picked up at 4.00pm and would go out on a vessel to the tuna farms. However, due to a mix up with telephone calls, Andrew missed the pick up time. Arrangements were made to take Andrew out to the vessel on another boat.
When Andrew got to the vessel he was told by the skipper to “keep out of the way” and watch what was being done.
When they got to the tuna farm, Andrew and a deckhand shovelled feed into the tuna nets, then Andrew untied the vessel and it travelled to the next farm.
Again they shovelled feed into the nets, the deckhand was about to ask Andrew to untie the vessel but Andrew had already started to do so. The boat moved in the sea swell and he caught his fingers in the rope, injuring them.
Andrew suffered a fracture and de-gloving* injury to his right index finger and laceration to his left index finger.
The owners of the tuna vessel were prosecuted in the Industrial Court for, among other charges, failing to:

Andrew was deemed an employee under the safety laws because he was performing work gratuitously for an employer.
The skipper failed to ensure that Andrew was provided with a full induction when he started work experience.
Andrew was not provided with an induction when he boarded the vessel. The skipper did not ensure Andrew was properly supervised while on the vessel and
failed to provide adequate information, instruction, training and supervision.
A de-gloving injury is when the skin is taken off – like when a glove is taken off the hand.

Employers and recruitment agencies have been accused of subjecting women to blatant discrimination in job interviews.
The Federal Sex Discrimination Commissioner, Ms Susan Halliday, says women face job questions which men are not asked to answer. And she says asking the questions breaches the federal Sex Discrimination Act.
Ms Halliday said one woman in her mid-30s was asked if she was married. “When she said no, the interviewer said back, What’s wrong with you?”, she said. “Another woman who refused to answer a question about how many children she had was told by a recruitment agency, ‘with an attitude like that, you won’t get the job anyway’.
Ms Halliday said in one case an interviewer knew that the woman being interviewed was a lesbian and asked: “What does your same sex partner do?” Another case brought before her involved a young woman who wore an engagement ring during an internal company interview.
The woman failed to get the job after revealing that she planned to get married within the next 18 months and start a family.
“You can guarantee the male applicants going for the same jobs on all accounts were not asked any of these questions,” Ms Halliday said.
Ms Halliday hit out at employers and recruitment agencies, which asked women marital and family questions. She said discrimination against women during interviews was worse than in job advertisements. Some women were still being asked to sleep with employers or agency interviewers if they wanted a job, she said. “Discriminatory recruitment practices prevail,” Ms Halliday said. “However, they are more covert, with questions often framed in a way to hide the discriminatory intent.” She said people do not have to reveal their marital status, but women who decline to do so are often accused of withholding information. “Women are asked abut the age of their kids and their ability to raise and handle them while working, “ MsHalliday said. “Asking about family responsibilities is not the way to determine the number of hours a job applicant can actually work of the types of shift they can do.”
Ms Halliday says some employers just look for white Anglo-Saxon men in job applications and throw the rest in the bin. “They can do that but it is a strategy that lacks incredible business acumen and common sense,” she said. Other employers ask for a phot ‘to try and differentiate on the base of gender, age and race.”
Ms Halliday said that while business and recruitment agencies needed to make short lists, I was best for them to start with a broad and diverse pool of applicants and narrow the list down based on criteria related to the job in question.
