How to apply: The entire application process consists of two parts: 1. online survey and 2. application form in Word format. Both parts and all sections of the application form need to be completed and received by the Secretariat before the expiration of the deadline. First part: Online survey (http://ohchr-survey.unog.ch/index.php/695691?lang=en) is used to collect information for statistical purposes such as personal data (i.e. name, gender, nationality), contact details, mandate applying for and, if appropriate, nominating entity. Second part: Application form in Word can be downloaded from http://www.ohchr.org/EN/HRBodies/SP/Pages/HRC33.aspx by clicking on the mandate. It should be fully completed and saved in Word format and then submitted as an attachment by email. Information provided in this form includes a motivation letter of maximum 600 words. The application form should be completed in English only. It will be used as received to prepare the public list of candidates who applied for each vacancy and will also be posted as received on the OHCHR public website. Once fully completed (including Section VII), the application form in Word should be submitted to [email protected] (by email). A maximum of up to three reference letters (optional) can be attached in Word or pdf format to the email prior to the expiration of the deadline. No additional documents, such as CVs, resumes, or supplementary reference letters beyond the first three received will be accepted. I am a Queen's Counsel and a member of the Bar of England & Wales (1992). I have also been admitted to the Bar in Pakistan (2008), Cambodia (2008) and Kosovo (2011). I have acquired expertise in International Human Rights law in over 20 years of practice in this field. I have experience in investigating cases involving human rights violations such as torture, inhuman and degrading treatment. I have published extensively and taught in the field of international law and human rights. I was awarded academic degrees in law from King's College, University of London, the Inns of Court School of Law and Lincoln’s Inn. I have been awarded two honorary doctorates in law in 2012 from FAMA University, Pristina and 2013 from the European University of Tirana, Albania in recognition of my work in human rights and international law. In 1998, I was awarded a Diploma after completing the Advanced Course on the International Protection of Human Rights at Abo Akademi school of law, Finland. English is my mother tongue, and I also read Arabic and French. I have been an advocate in court proceedings where the main language of record was French or English or Arabic. I am familiar with the necessities and practicalities of communicating effectively through interpreters in court, during press conferences and investigations. I am experienced in public speaking gained through court based advocacy and media work.

For more than 20 years I have specialised in international human rights law in all of the United Nations Tribunals, hybrid courts and at the ICC. This experience has required an understanding of the ICCPR, CAT, ECHR and the other international conventions and norms. I am familiar with the work of the Special Rapporteur for torture and other stakeholders such the APT and CTI and the role they play in seeking to prevent torture and in promoting the universal ratification of the CAT and OPCAT. I have published extensively in the field of human rights, including in the prohibition of torture and inhuman and degrading treatment. I was the first member of the English Bar appointed by the Office of the Prosecutor of the United Nations ICTY. I was part of the prosecution trial team in the "Celebici case" in 1997. That case involved investigating and prosecuting accused persons who operated a detention facility where torture and inhuman and degrading conditions existed. I have also been a prosecution lawyer in the the UN-ICTR from 1998-2000. In addition, I have defended cases at the ICTY (2003-2007), and in the EULEX courts in Kosovo (2011-2016) where torture was specifically alleged. I represented the largest group of victims in Trial Number One at the Extraordinary Chambers of the Courts of Cambodia relating to the infamous S-21 detention centre where a central allegation was endemic practice of torture.

3. ESTABLISHED COMPETENCE (200 words)Nationally, regionally or internationally recognized competence related to human rights. (Please explain how such competence was acquired.)

At the International level, I have been engaged as lead counsel in all the various international and hybrid tribunals including the SPSC, SCSL, ICTR, ICTY, STL, ECCC, EULEX courts and the ICC and have investigated torture cases in various continents of the world. I have lectured in human rights internationally, including at the Universities of Florence, Padowa, Tsinghua (China), at the 2015 Global Human Rights Summit in Tokyo and at PHILJA, Phillipines in 2015. I have been a Senior Research Fellow at King's College London between 1999-2002 and a visiting lecturer in law at Utrecht University between 2010-2013. I am a member of the international advisory board at the WSD Handa Centre for Human Rights and International Justice at Stanford University and a Founding Director of the Peace and Justice Initiative.

At the national level, I was appointed a Human Rights Tutor at the National Police Training Centre at Bramshill, UK, prior to the entry into force of the 1998 Human Rights Act. In this capacity, I trained the police on the ambit and purpose of the Human Rights Act in order to ensure compliance with its provisions. Special regard was had to the prohibition of torture and inhuman and degrading treatment.

I am aware of the requirement that at least three months a year be dedicated to mandate related work. As a Queen's Counsel and member of the Bar, I am self employed and need no external authorisation in order to dedicate the required time to the work of the mandate. I am in a position to devote this time and will enthusiastically do so. I am independent by training and experience. As a practitioner specialising in international law, I have worked, investigated and advised in Asia, the Middle East, Far East, and North, West and East Africa, as well as in Europe. I have qualified lawyers and researchers in the Hague and London and elsewhere who work under my direction. Country visits, investigations, examination of issues, and time critical drafting of reports are all familiar to me. In addition, I have directly engaged with various Heads of State, cabinet officials, senior members of the judiciary in many continents of the world. Within the UN system, I have also productively engaged with various SRSG's, such as the late, Sergio Viera de Mello of Brazil whilst he was SRSG in Timor Leste. Similarly, I have a track record of positive engagement with various USG/ASG level UN officials, as well with senior officials in Regional organisations such as the African Union. I am flexible in my work practices and ready and available to commit myself to the mandate if appointed.

III. MOTIVATION LETTER (600 word limit)

This mandate is of critical importance. I combine a thorough academic understanding of CAT, OPCAT and the HRC mechanisms with practical experience gained in investigating and evaluating allegations of torture. I have investigated cases involving allegations of torture and inhuman and degrading treatment in Timor Leste, Libya, Sierra Leone, Liberia, Cambodia, Kenya, Kosova and Bosnia-Herzegovina. I believe that I have a distinct advantage in that I have prosecuted, defended and represented the victims in international cases where torture was the criminal conduct alleged. I have actively investigated such cases in Europe, Asia and Africa. Having acted for all sides in cases where torture is alleged, not only helps demonstrate my independence and ability to be impartial, but I believe that it can lend additional credibility to my role as Special Rapporteur. I have trained police officers in the United Kingdom on provisions of human rights law and know how important the processes that govern the first hours in police custody are to the prevention of torture and abuse. The mandate holder must be cognisant of his or her role and be prepared to work within the terms of the mandate. Seeking to expand that mandate is for the HRC and not for the incumbent. In this regard, it is also pertinent to note that States, NGO's, Regional organisations (including mandate holders of regional or other international organisations - like the Torture Prevention Advisor of the OSCE) all have a role to play in seeking to prevent torture. Understanding how these stakeholders can cooperate and work harmoniously with each other is important.

In interactions with states, it will be obvious that apart from compliance with provisions of Conventional and Customary law, the prohibition of torture also gives rise to universal criminal jurisdiction. This reality should not be lost on States and other actors. At the same time, the mandate holder must seek to engage states in constructive dialogue with a view to voluntary compliance with CAT and customary norms prohibiting torture in all circumstances. The fact that I have acted for the Prosecution, Defence and Victims in different torture case may underline my impartiality. This varied experience can be used to help foster an environment of cooperation - rather than adversarial opposition. The mandate holder should not retreat to "naming and shaming" as his or her first port of call, but seek to leave the mandate stronger at the end of his or her term. It will be stronger when structures are voluntarily put in place by states that help eradicate torture and inhuman and degrading treatment and punishment. States should be able to trust the mandate holder and be encouraged to invite the mandate holder to conduct fact finding missions - knowing that no political baggage will infect the work of the mandate holder. Trust and confidence is of fundamental importance and must be fostered. At the same time, it is imperative that the mandate holder is able to speak truth to power and make every effort to root out torture within the paramenters of the mandate. The ability to review cases and sieve out spurious allegations and focus on properly grounded ones is also key and requires forensic skills and an ability to objectively evaluate a complaint. I possess these skills as demonstrated by my work on torture cases from the investigative and legal perspectives.

I am a British national, but also of Asian heritage. I have been educated in Europe, but lived in Africa and Asia. I have worked internationally and closely interacted with men,

women and children from all cultures, religions, nationalities and from all walks of life. My ability to relate to them, and to appreciate and respect the richness that diversity brings, may also be of utility to the work of this mandate. Regardless of that, the prohibition of torture is a basic norm that UNITES humanity and all peoples regardless of gender, race, religion, colour, creed or social group. It is a high calling indeed.

I was one of two lawyers advising the Prosecutor of the ICTR based in the Hague. I worked in the appeals section of the Prosecution and also in the Legal advisory section. In this capacity I worked on many leading cases including on the Akayesu appeal as well as the Kayishema & Ruzindana, Serushago and Kambanda appeals. These cases involved allegations of genocide, crimes against humanity

(2) International Criminal Tribunal for Former Yugoslavia (ICTY)

I was a Prosecution Legal Officer working with the senior trial attorney on the Delalic et al case. This case involved allegations of widespread torture in the Celebici detention centre in Konjic in Bosnia. I participated in indictment reviews in several major cases.
