PUBLIC WORKS CONTRACTS STATUS REPORT #2

1. STAFF RECOMMENDATIONS It is recommended that:

i) The Public Works Committee receives Report #PW-06-2009, Public Works

Contracts Status Report #2, for information.

2. PURPOSE

The purpose of this Report is to inform the Committee of the status of Public Works Contracts.

3. BACKGROUND

Shaded rows in the attached summary indicate completed contracts. Contracts related to Community Forest Operations and Facilities Projects, managed by the Public Works Department, will be included in the Contract Status Reports.

4. DISCUSSION

Appendix “A” includes a summary of all ongoing contracts and proposed tenders for 2009. Eight (8) tenders will be called and closed in February, 2009: two (2) road maintenance tenders, four (4) road construction project tenders and two (2) bridge rehabilitation project tenders. A map of the proposed 2009 road and bridge capital projects is attached at Appendix “B”. The Public Works department has recently assumed management responsibility for the construction of ambulance base facilities in Lanark and Almonte. The progress of these projects is now included in the monthly Contract Status Report.

5. ANALYSIS AND OPTIONS The table below summarizes the status of the contracts/tenders/projects being managed by the Public Works Department.

6. FINANCIAL IMPLICATIONS

The February tender results will be presented at the March Meeting of the Public Works Committee and will be included in the budget deliberations.

7. LOCAL MUNICIPAL IMPACT

Consultation with local municipal Public Works Staff, for 2009 County Projects, is ongoing. Joint projects that have been initiated by local municipalities and County initiated Projects, which will include significant input from their local municipal staffs, include:

• McNeely Avenue Phase 3 Preliminary Design (Town of Carleton Place) • Network Analysis and Transportation Master Plan (All local municipalities,

including Town of Smiths Falls) • County Road 9 and Bellamy Mills Road Intersection Improvements (Town of

Mississippi Mills)

8. CONCLUSIONS Tender preparation for 2009 is proceeding as planned and winter preparations are ongoing.

WEED INSPECTOR’S 2008 REPORT AND APPOINTMENT OF THE COUNTY WEED

INSPECTOR FOR 2009 1. STAFF RECOMMENDATIONS

It is recommended that: i) County Council accepts the 2008 Annual Weed Report for information. ii) County Council authorize the payment of an honorarium of $500 to Mr. Tom

Guindon for his services as County Weed Inspector in 2008. iii) A by-law appointing Mr. Tom Guindon as the County Weed Inspector for 2009

is presented at the January, 2009, Meeting of County Council.

2. PURPOSE

The purpose of this Report is to inform the Committee of the activities of the County Weed Inspector.

3. BACKGROUND

Under Section (1) of the Weed Control Act, RSO 1990, Chapter W.5, Councils of every County District Municipality and Regional Municipality shall by-law appoint one or more persons as an Area Weed Inspector. Mr. Tom Guindon, the Almonte Patrol Operations Supervisor, has performed the County Weed Inspector duties for a number of years in an efficient and capable manner.

4. DISCUSSION

The attached Annual Report summarizes the activities of the County Weed Inspector during 2008.

5. ANALYSIS

None.

The Weed Inspector’s annual honorarium of $500 is included in the Public Works Department Budget.

10. PURPOSE

The purpose of this Report is to seek Council approval to schedule Public Information Centres (PIC) for five (5) future road and bridge rehabilitation projects and the Transportation Master Plan.

11. BACKGROUND Public consultation is a critical part of the planning process for road and bridge improvement projects and the Transportation Master Plan Project. Public Information Centres (PICs) are held to seek public input on alternative rehabilitation strategies and to ensure that issues and concerns are considered before projects enter the final design and tendering stages. The date and the location of the event are coordinated with the local municipality.

12. DISCUSSION

The proposed road and bridge project PICs have been coordinated with the local municipalities and subject to Council approval, have been scheduled on the dates indicated in the table below. The proposed Transportation Master Plan PIC dates and locations have been coordinated with the Technical Advisory Group. A map of the project locations is at Appendix “A”.

16. CONCLUSIONS

The early scheduling of PICs enables the Public Works Department to schedule and to prioritize the necessary pre-engineering work that is needed prior to public consultation. A Report on the results of each PIC will be presented to Council.

PROPOSED EXTENSION OF CONTRACT #PW-10-2007 SUPPLY AND APPLY WATER BASED TRAFFIC PAINT

FOR PAVEMENT MARKINGS 1. STAFF RECOMMENDATIONS

It is recommended that: i) County Council extends Contract PW-10-2007, Supply and Apply Water Based

Traffic Paint for Pavement Markings, with Trillium Pavement Marking, for one year (1), with a five percent (5%) price increase.

ii) The Clerk sends Report PW-10-2009 to all local municipal Clerks, for information.

2. PURPOSE

The purpose of this Report is to recommend a one year (1) extension to a Contract with Trillium Pavement Marking.

3. BACKGROUND

At their March 28th, 2007, Meeting, Council awarded a one year pavement marking contract to the lowest bidder, Trillium Pavement Marking (TPM) for $140,979.41. If the Contractor agreed to maintain their 2007 prices, the contract provided for a one year extension. TPM subsequently agreed to an extension under these conditions and on February 21st, 2008, the Director granted TPM a one year extension to the contract. On January 12th, 2009, TPM advised the Director that they would be agreeable to a two year extension to their Contract with a seven percent (7%) price increase in 2009 and an eight percent (8%) increase in 2010. After negotiations with TPM, the proposed price increases were reduced to five percent (5%) for 2009 and 2010. Article 26.1.7 of County By-law 2007-57, Policy for Procurement of Goods and Services states, that a Contract may be extended, if “it will result in significant savings to the County”.

4. DISCUSSION

The 2007 and 2008 County Contracts with TPM were completed satisfactorily. In 2008, a number of car paint damage claims were submitted to TPM by local residents. TPM was slow to react to some of these claims and as a result some County Staff time was required to manage the complaints.

5. ANALYSIS AND OPTIONS Three (3) options are open: Option 1. Reject TPM offer to extend contract and call for tenders. Option 2. Accept TPM offer to extend contract for two years. Option 3. Accept TPM offer to extend contract for one year. Given the volatility of fuel prices and higher paint prices during the past three years, a five percent (5%) increase to the contract in 2009 is reasonable. TPM has committed to implement a public relations program to manage and to reduce the number of car paint damage claims. However, it would be prudent to monitor the success of this program before agreeing to a second one year extension of the contract. Therefore, the Director recommends a one year extension to the TPM contract, with an optional second one year extension, to be negotiated after successful performance of the 2009 Contract. (Option 3). The Purchasing Officer concurs with the Director’s recommendation.

6. FINANCIAL IMPACT

The proposed 2009 Public Works Budget for pavement marking is based on the proposed one-year extension of the TPM contract.

7. LOCAL MUNICIPAL IMPACT

Some local municipalities have TPM complete their pavement marking requirements at the County price.

8. CONCLUSIONS

Extending the TPM Pavement Marking Contract for one year (1) with a five percent (5%) increase is recommended.

TOWNSHIP OF DALHOUSIE, TOWNSHIP OF LANARK HIGHLANDS 1. STAFF RECOMMENDATIONS It is recommended that:

i) Lanark County Council declare the portion of the former County Road 12, in

Lots 9 and 10, Concession 11, in the Geographic Township of Dalhousie, Municipality of Lanark Highlands Township, as surplus to County needs and that staff be authorized to commence the process to stop-up, close and sell the subject lands.

ii) The value of consideration for the surplus lands be set at one dollar ($1.00). iii) A Public Hearing regarding the subject road closing be held at the Lanark

County Council Chambers on March 4th, 2009. iv) The Director of Public Works provides a report and recommendations to the

Public Works Committee as soon as practicable after the Public Hearing. v) The Clerk sends this Report to the Lanark Highlands Township Clerk, for

information. 2. PURPOSE

The purpose of this Report is to propose that a portion of the former County Road 12 (McDonalds Corners Road), in Lots 9 and 10, Concession 11, Geographic Township of Dalhousie, within the Municipality of Lanark Highlands, be declared surplus, stopped-up, closed and sold to the abutting property owner, Ruby Carol McKinnon.

3. BACKGROUND

In the 1950’s, the County acquired property to facilitate the realignment of County Road 12. When the realignment occurred, the portion of the former county road, that is the subject of this Report, was not stopped-up and closed. Ruby McKinnon, the current owner of the parcel, through which the former County Road 12 meanders, is attempting to simplify her title before conveying the parcel to the abutting property owner Gina Ellis.

4. DISCUSSION

A sketch of the Old and New County Road 12 and the parcel to be severed is attached at Appendix “A”.

5. ANALYSIS AND OPTIONS

Since the portion of the former County Road 12, as shown on the sketch, is not needed, it should be stopped up, closed and sold. Pursuant to Section 34 of the Municipal Act, S.O. 2001, Chapter 25, and amendments thereto, a municipality has the power to close a highway by carrying out the prescribed procedures. County of Lanark By-Law 2007-68 “Being a By-Law to Authorize the Adoption of the Public Notice Policy for the Corporation of the County of Lanark” requires that, where notice of intention to pass a by-law or notice of a public meeting is required to be given, the notice shall be published in a local paper and on the County of Lanark Website a minimum of fourteen (14) days prior to the passing of the By-Law. A Public Hearing, to hear any claims from landowners who object to the proposed road closing, is also required.

6. FINANCIAL IMPACT

Since the road closing process should have been completed when County Road 12 was realigned, the Director proposes that the County should pay for County legal costs and the costs to survey the former road to identify it as a separate part, on the R-Plan, that will be developed as part of the McKinnon conveyance. The $2,500 estimated survey costs are included in the proposed 2009 Public Works Budget.

7. LOCAL MUNICIPAL IMPACT

None.

8. CONCLUSIONS

Taking the necessary steps to stop-up, close and dispose of the portion of the former County Road 12, in Lots 9 and 10, Concession 11, in the Geographic Township of Dalhousie, Municipality of Lanark Highlands Township, is recommended.

The purpose of this Report is to inform Council of the progress of Contract #PW-13-2008.

3. BACKGROUND

The Minutes of the Seventh Meeting of the Technical Advisory Group are attached at Appendix “A”. The Consultant’s monthly Project Status Report is attached at Appendix “B”.

4. DISCUSSION

Representatives from five (5) local municipalities attended the seventh Meeting. Participants included the Chief Administrative Officers from two (2) local municipalities and three (3) Road Superintendents. There were no participants from the Town of Smiths Falls, Drummond/North Elmsley Township, Beckwith Township or Lanark Highlands Township. The Agenda included a review of the proposed transportation strategies to address the problems and opportunities that were identified in the needs analysis, as well as a discussion regarding the next round of public consultation. Future Technical Advisory Group Meetings will be held at the County Public Works Building at 9:00 am on February 17th and March 10th, 2009.
