What's new plus Professional Negligence issues for Quantity Surveyors

Trevor Drury, Managing Director of Estia Consulting writes:

"The RICS has produced a suite of documents called the New Rules of Measurement (NRM). These are to be found inthree volumes:

NRM1 - for the quantification of building works for the purpose of preparing cost estimates and cost plans.NRM2 - guidance on the detailed measurement and description of building works for the purpose of obtaining a tenderprice.NRM3 - guidance for cost planning and cost estimating for maintenance works

The subject of this article is NRM2, which replaces the Standard Method of Measurement published by the RICS in 1922with the latest edition, SMM7, having been published 25 years ago in 1988. The first edition of NRM2 became operativefrom 1 January 2013."

He continues: "The RICS is of the view that a member, conforming to the practices recommended in the guidance noteshould have at least a partial defence to any allegation of professional negligence if they have followed those practices.However; the RICS backtracks slightly in stating that "members have the responsibility of deciding when it is appropriate tofollow the guidance". Not particularly helpful you may think? Standard Preliminaries 6th Edition - September 2013 - now available in MOR

The Association of South African Quantity Surveyors (ASAQS) has compiled the ASAQS Preliminaries in the interests ofstandardisation of documentation and good practice in the building industry. The document generally covers all aspects ofpreliminaries for most types of projects and should consequently simplify the tendering for and the administration ofbuilding agreements and produce economic advantages to all concerned. Users should note that the Preliminaries havebeen specifically formulated for use with the 2013 edition of the JBCCTM agreements (PBA and NSSA Edition 6.0, MWAEdition 5.0)

The wait is over – from Monday 07 October 2013 you may order the 6.0 Edition Principal Building Agreement and ContractData and Nominated/Selected Subcontract Agreement and Contract Data and the 5.0 Edition of the Minor WorksAgreement and Contract Data.

Contract Data: There is only one booklet for use with each of the new editions.Forms: Will be posted on the Free Form Printing page www.jbcc.co.za. Pricing: Will remain unchanged until the end of December 2013. Contract Data will however no longer be free onwww.jbcc.co.za.Please Note: The Principal Building Agreement 2005 Edition 4.1 is still in use for State work as the CIDB and the JBCCare in discussions re a new document – please continue to order same until advised otherwise.

Netspot : The quality of the future PrQS

The e-letter by Steve Lyons on the quality of the future PrQS and our subsequent article on the matter sparked a livelydebate in the Quantity Surveyors South Africa group on LinkedIn.

Just yesterday I was e-mailed excerpts from Bills of Quantities of items which were impossible to price as they were notmeasured in accordance with the standard system. Our leading article at the top of this page on the New Rules ofMeasurement, published at the beginning of this year by the RICS, makes it clear that members following the guidancenotes in the New Rules of Measurement should have ..."at least a partial defence to any allegation of professionalnegligence if they have followed those practices."

The debate on LinkedIn was kicked off by Mluleki Mbambo who said that: " Coming from an academic background, andhaving seen a news posting on the ASAQS website adding a view to the debate, I am inclined to agree with Prof. Cattell.Quantity Surveying has (and must evolve) beyond taking off and measuring. Although important, these skills asdemonstrated above, are vocational and can be learnt on the job by an average candidate. Tertiary institutions cannotspend 4 years "teaching" someone how to do a job."

Professor Dave Root is also very keen to get a couple of QS’s to sit on an examination panel on the 14th and 15thNovember to help examine/watch presentations of the students on their simulated projects. The Registrar of theSACQSP has confirmed that time spent assisting Prof. Root on the examination panel can be claimed as CPD(Category 2) hours!

What is the IDoW?

It is work reserved to be done by only persons registered with any of the six Built Environment Professional Councils(BEPCs).

Once the IDoW has been finalised, the legislation governing the BE professional councils (BEPCs) envisages registrationwith the relevant professional council to be mandatory in order to practice as a professional in a particular builtenvironment profession.

After a process of consultation with stakeholders within their professions; five of the six built environment ProfessionalCouncils (excluding the Engineering Council of South Africa, (ECSA)); submitted IDoW to the CBE for finalisation.
