THE WEST VALLEY CITY COUNCIL MET IN STUDY SESSION ON TUESDAY, FEBRUARY 12, 2019, AT 4:32 P.M. AT WEST VALLEY CITY HALL, MULTIPURPOSE ROOM, 3600 CONSTITUTION BOULEVARD, WEST VALLEY CITY, UTAH. THE MEETING WAS CALLED TO ORDER AND CONDUCTED BY MAYOR BIGELOW.

REVIEW AGENDA FOR REGULAR CITY COUNCIL MEETING OF FEBRUARY 12, 2019Upon inquiry by Mayor Bigelow, members of the Council had no further questions or concerns regarding items listed on the Agenda for the Regular City Council Meeting scheduled later this night.

AWARDS, CEREMONIES, AND PROCLAMATIONS SCHEDULED FOR FEBRUARY 19, 2019 A. PRESENTATION OF ENGLISH LANGUAGE AWARDS TO STUDENTS

FROM GRANITE PEAKS LEARNING CENTERMayor Bigelow stated that awards and congratulations will be granted to students who have taken a course at Granite Peaks Learning Center and earned an achievement in learning the English language.

Councilmember Buhler asked if this is something learning centers are still interested in participating in. Nichole Camac, City Recorder, replied that there has been difficulty in the past with turnover in directors. She stated that the new director seems enthusiastic in continuing the program and the recognition of students will hopefully be more common moving forward. Mayor Bigelow stated that this program shouldn’t be forced and if schools don’t want to participate in the future, this is something the City doesn’t need to continue. Councilmember Buhler agreed but added this program is valuable and if there is interest, he’d like to see it continue.

PUBLIC HEARINGS SCHEDULED FOR FEBRUARY 19, 2019B. ACCEPT PUBLIC INPUT REGARDING APPLICATION ZT-1-2019,

FILED BY ALPINE STORAGE LAKE WORTH, LLC, REQUESTING A ZONE TEXT CHANGE TO ALLOW UP TO THREE ON-SITE CARETAKER'S DWELLINGS FOR SELF-STORAGE FACILITIESMayor Bigelow informed a public hearing had been advertised for the Regular Council Meeting scheduled February 19, 2019, in order for the City Council to hear and consider public comments regarding application ZT-1-2019, filed by Alpine Storage Lake Worth, LLC, requesting a Zone Text Change to allow up to three on-site caretaker's dwellings for self-storage facilities.

Proposed Ordinance 19-06 related to the proposal to be considered by the City Council subsequent to the public hearing, was discussed as follows:

ACTION: ORDINANCE NO. 19-06, AMEND SECTIONS 7-1-103 AND 7-7-122 OF THE WEST VALLEY CITY MUNICIPAL CODE TO AMEND REGULATIONS GOVERNING CERTAIN CARETAKER DWELLINGSSteve Pastorik, CED, discussed proposed Ordinance 19-06 that would amend Sections 7-1-103 and 7-7-122 of the West Valley City Municipal Code to amend regulations governing certain caretaker dwellings.

Written documentation previously provided to the City Council included information as follows:

Alpine Storage Lake Worth, LLC is requesting a zone text change to allow up to three on-site caretaker’s dwellings for self-storage facilities. Currently City Code only allows one caretaker’s dwelling, which is defined as “a Dwelling Unit for the caretaker of an otherwise nonresidential Building that is completely contained within the nonresidential Building.”

Included with this issue paper is a letter from Roman Frazier with Alpine Storage that provides an explanation for this request. In summary, the applicant contents that having three on-site managers insures better customer service, improves facility management and improves site security.

The Planning Commission recommended approval with two additional changes. The first change was to tie the number of allowed caretaker’s dwellings to the size of the self-storage facility. The second change was to modify the definition of caretaker’s dwellings to prevent them from being rented out.

Councilmember Buhler stated that he was unaware that this was something the City currently allowed. Councilmember Lang asked if the King Arthur Storage Units on 3500 South have a caretaker on site. Staff replied yes. Mayor Bigelow asked for clarification on specific language in the proposed code change. Councilmember Buhler asked what housing standards would be applied. Steve replied there are no standards and indicated that the units are part of the building. Mayor Bigelow clarified that friends or family can live with the caretaker. He stated that he would like the Code to state that “an employee” must be live in the unit. Councilmember Buhler agreed and added that language should also specify that the employee be required to have duties on site. Mayor Bigelow asked if this change could extend to a restaurant or other business. Steve replied that that the

proposed ordinance only applies to self-storage units as proposed by the applicant. Mayor Bigelow and the Council debated other uses that could ask for an increase for caretaker units in the future. Councilmember Nordfelt asked if there is a reason the City chose the specific square footage for the three caretaker units. Steve replied the number is based on the amount of space caretakers are required to take care of. Mayor Bigelow stated he feels having more restrictions on who lives in the units is more important than how many units are allowed. Councilmember Buhler asked if there are safety concerns. Steve replied none that he is aware of. Councilmember Christensen asked how the Kmart building on 5600 West will be structured and Steve replied that storage units will be located on the ground floor while a second story addition will be added for caretaker units. Councilmember Buhler asked how property taxes are impacted. Steve replied they are taxed as a business since units are on a single parcel. Councilmember Lang asked if there is a minimum size property or building in the current code that allows caretaker units. Steve replied that any business can have one.

The City Council will consider Ordinance 19-06 at the Regular Council Meeting scheduled February 19, 2019 at 6:30 P.M.

RESOLUTION 19-16: AWARD A CONTRACT TO ACME CONSTRUCTION FOR THE EXTENSION OF A BOX CULVERTRuss Willardson, Public Works Director, presented proposed Resolution 19-16 that would award a Contract to Acme Construction for the extension of a box culvert.

Written documentation previously provided to the City Council included information as follows:

Bids were opened for the project on February 5, 2019. A total of three (3) bids were received. The lowest responsible bidder was ACME Construction, in the amount of $150,930.00.

The Public Works Department is preparing to reconstruct and widen Beagley Lane as part of the 2540 South extension project. To construct the new road configuration at 7200 West, it is necessary to extend the existing box culvert on the east side of the road approximately 26 feet. The Riter Canal shuts down for two weeks in March, during which the extension of the culvert may occur while the water is not running. This contractor will install the box culvert sections previously purchased by the City from Oldcastle Precast.

Mayor Bigelow asked if $20,000 is a common amount for a contingency. Russ replied this

is an unusual project and the City wanted to ensure every possibility was covered.

The City Council will consider Resolution 19-16 at the Regular Council Meeting scheduled February 19, 2019 at 6:30 P.M.

RESOLUTION 19-17: AUTHORIZE THE CITY TO PURCHASE FOUR MOTORCYCLES FOR THE POLICE DEPARTMENTColleen Jacobs, Police Chief, presented proposed Resolution 19-17 that would authorize the City to purchase four motorcycles for the Police Department.

Written documentation previously provided to the City Council included information as follows:

The City would like to purchase four (4) fully equipped police motorcycles. All four Motorcycles will be used in the traffic division of the Police Department. The Police Department would like to purchase Harley Davidson FLHTP to keep the motors squad as uniform as possible and this purchase would allow them to match the existing bikes in their motorcycle fleet. All the motor officers that are currently in the squad have been trained and certified on Harley Davidson police motorcycles. Please see attachments for the two quotes and the four motorcycles being replaced. The price indicated below is a competitive price and the product meets the City’s needs.

4- Harley Davidson FLHTP- $23,076.60 (per vehicle)= Total: $92,306.40

Councilmember Buhler asked if officers are issued both a car and a bike. Colleen replied yes. She indicated bikes are kept in the City and do not go home with officers. Colleen explained the age and use of existing bikes. Mayor Bigelow clarified that bikes are not used in inclement weather. Colleen replied no. Councilmember Huynh asked if Harley is a good brand. Colleen replied yes and added that it is also more affordable. Councilmember Christensen asked why motorcycles are not part of the small fleet. Colleen replied that they traditionally haven’t been used as often and are only now being implemented as part of traffic patrol again. Wayne added that since they aren’t used as often they don’t need to be replaced as frequently. He indicated that the City looks at different methods of purchasing motorcycles when the need arises. Councilmember Fitisemanu asked what type of transport the parking enforcement unit uses. Colleen replied Ford Escapes.

IMPLEMENTATION OF A PUBLIC PORTAL ON THE CITY'S WEBSITEPaul Isaac, Assistant City Manager, and Ken Cushing, IT, presented proposed Resolution 19-18 that would award a Contract to Timmons Group, Inc. for implementation of a Public Portal on the City's Website.

Written documentation previously provided to the City Council included information as follows:

West Valley City uses Cityworks to manage all aspects of permit management and requires a public facing portal to interface with residents, contractors and business owners. The Timmons Group will implement a public facing portal for permitting to interface with the City’s current software Cityworks. In addition, The Timmons Groups shall implement a public service request/complaint management system, Citysourced, which also interfaces with Cityworks. All business licensing will be implemented in Cityworks as well.

The City has been using Cityworks to manage Building permits, Planning and Zoning permits, and Public Works permits for more than ten years. The City needs the ability for the public and contractors to apply for and manage all aspects of permits online. In addition, all service requests are received through CivicPlus and emailed to appropriate departments. The City needs the ability to manage the receipt and management of service requests through a more streamlined portal and these requests need to be automatically imported into Cityworks. Finally, the City needs Business Licensing to be in the same system for managing all aspects of permitting, code enforcement and service requests.

Mayor Bigelow asked how this will impact the workload of employees and how it will benefit citizens. Ken replied that currently contractors are required to come in and their plans are hand passed through the entire City. This software will allow a contractor to submit everything online (including payment) without having to step foot in City Hall and Departments can then process everything digitally which is a lot quicker and efficient. Mayor Bigelow asked how much maintenance is. Ken replied $42,000 per year. Mayor Bigelow asked how employees benefit from the software. Ken replied the software is compatible with software that is already used internally so it will speed up the process for everyone. He added that residents will also be able to submit complaints on the portal and employees will be able to process and respond to those more quickly. Councilmember Christensen provided an example of an addition to his home that would have been a lot quicker with this program. Councilmember Buhler asked if employees will need to be laid off since this software will alleviate so much work. Ken replied no and indicated that this will simply help employees be more efficient and will allow them to take on other tasks. Mayor Bigelow clarified that the software will reduce the amount of time to accomplish

tasks. Ken replied yes. Councilmember Lang asked why dog and cat licensing is not available with this proposal. Ken replied that the software needed for the Animal Shelter is different but this is a goal of staff to incorporate into the program in the future. Councilmember Buhler indicated that he is unsure if this software is necessary since the needs of the public are already being accomplished by the method in place today. Councilmember Lang indicated that this will provide a higher level of customer service, provide an easier method of working with the City, and provide an online tool for residents since many people rely on that. Wayne agreed and added that this may seem like incremental progress but changes like this affect the big picture moving forward. The Council discussed how much has changed over the last 40 years and how different things will be in the next 40 years. The Mayor and Council discussed improvements and drawbacks that could result from this change.

Councilmember Buhler stated that he would like to allow two story homes. Councilmembers Nordfelt and Lang agreed. Mayor Bigelow requested a side by side comparison of the modified standards being proposed. Councilmember Huynh requested a variety of porches be allowed. Steve replied another option would be to allow a covered entry. Councilmember Nordfelt requested a map of existing zones. Councilmember Buhler asked if the overlay zone would prevent zone changes to the RE zone. Steve replied it would not prevent anyone from requesting the zone change. Councilmember Lang asked if there is anything that prevents someone from building a large, fancier home. Steve replied no. Councilmember Fitisemanu asked if this proposal contemplates closing entries on Redwood Road. Steve replied this would be outside of the Ordinance but would be something the City could do as an improvement.

B. LEGISLATIVE UPDATE Nicole Cottle, Assistant City Manager, provide an update on events occurring at the State Legislature. She discussed bills regarding Medicaid, land use, transportation funding, public safety, animal shelters, code citations, sales tax, and affordable housing.

C. COUNCIL CALENDAR Mayor Bigelow referenced a Memorandum previously received from the City Manager that outlined upcoming meetings and events.

Councilmember Huynh asked why the Police Awards Banquet is being held at the Rice Eccles Stadium. Chief Jacobs replied City venues were not available at the time and a partnership with the University of Utah provided the facility for free. She added that the venue will accommodate the amount of people needed.

COUNCIL REPORTSCOUNCILMEMBER BUHLER- SHAKESPEARE FESTIVALCouncilmember Buhler stated that the Shakespeare Festival was a great event, was well attended, and he is looking forward to future programs. He indicated that he got a voicemail from a resident who was appreciative of shoveling efforts in the neighborhood and questioned what could be done for recognition. The Mayor suggested providing the address to staff so that a letter of commendation could be sent out.

COUNCILMEMBER CHRISTENSEN- GRANGER HIGH ART EXHIBITS, SHAKESPEARE FESTIVALCouncilmember Christensen indicated that there are art exhibits from Granger High students on display at the Utah Cultural Celebration Center. He stated he met with some of the students and was impressed with them. Councilmember Christensen stated he also enjoyed the Shakespeare Festival and added that he is concerned about how the previous tenant left the Harman Hall. He indicated that he feels they should be made aware that the space was left in disrepair.

COUNCILMEMBER FITISEMANU- HEALTHY WEST VALLEYCouncilmember Fitisemanu stated that Healthy West Valley is sponsoring an art contest involving all West Valley City schools. He stated that the contest urges students to design a logo that goes along with the initiatives of the program.

COUNCILMEMBER LANG- PARKING TICKETSCouncilmember Lang indicated that she has received and email and a phone call from residents who have received tickets for parking violations requesting warnings first before tickets. She also stated that the Council may see an increase in parking on landscaping areas or additional concrete in front yards to avoid street parking. Mayor Bigelow stated that people are typically aware of parking violations, they just haven’t been ticketed before.

ISSUE:

We are requesting approval of a Purchase Agreement between the City and America First Credit Union (AFCU) for the branch property located at 2788 West 3650 South (Fairbourne Station).

SYNOPSIS:

The City would like to purchase the AFCU site as part of the overall Fairbourne Station Master plan. The site will be for used as additional parking for City Hall. AFCU has already relocated to a new location on 3500 South with the intentions of this sale. .

BACKGROUND:

The Fairbourne Station has planned on the relocation of AFCU to accommodate more parking for City Hall.

RECOMMENDATION:

The WVC RDA Administrator recommends the City approve the purchase agreement.

RESOLUTION NO.

A RESOLUTION APPROVING A REAL ESTATE PURCHASE AND SALE AGREEMENT WITH AMERICA FIRST CREDIT UNION, TO PURCHASE PROPERTY LOCATED AT 2788 WEST 3650 SOUTH IN WEST VALLEY CITY.

WHEREAS, West Valley City (herein the “City”) desires to purchase property for public use from America First Credit Union (herein the “Seller”); and

WHEREAS, Seller desires to sell the property located at 2788 West 3650 South (herein the “Property”) to the City at fair market value, and then lease the property from the City for a short period of time; and

WHEREAS, an agreement has been prepared for execution by and between the City and Seller, a copy of which is attached hereto and entitled “Real Estate Purchase and Sale Agreement” (herein the “Agreement”), which sets forth the rights, duties, and obligations of each of the parties thereto for the sale and lease of the Property; and

WHEREAS, the City Council of the West Valley City does hereby determine that it is in the best interests of the health, safety, and welfare of the citizens of West Valley City to approve the Real Estate Purchase and Sale Agreement;

NOW, THEREFORE, BE IT RESOLVED by the City Council of the West Valley City as follows:

1. That the Agreement, including the lease, for the property located at 2788 West 3650 South is hereby approved, subject to approval of the final form of the Agreement by the City Manager and City Attorney’s Office.

2. That the Mayor is hereby authorized to accept the Deed to the property located at 2788 West 3650 South and the City Manager is authorized to execute any documents necessary to complete the purchase and lease on behalf of the City.

3. That the West Valley City Recorder is hereby authorized to record the Deed in the Office of the Salt Lake County Recorder.

ISSUE:

Amend the West Valley City Code to create a hobby permit that will allow residents to exceed the legally allowed number of dogs and cats per address.

SYNOPSIS:

If approved this ordinance change would create a special permit, titled a “Hobby Permit”, that would allow citizens to exceed the number of legally allowed pets so long as they met the following criteria:

a. The owner completes the application and pays all associated fees;

b. All household pets, in excess of four (4), fit the definition of a Dog or a Cat.

c. All Dogs and Cats at the address are rendered sterile;

d. All Dogs and Cats at the address are microchipped.

e. Adequate areas for confinement and shelter are provided;

f. The owners have not been found in violation of this Title or Utah State Code Title

76 Chapter 9 Part 3 within the past twelve (12) months.

BACKGROUND:

Currently, West Valley City Code 23-3-107 allows each address to have two (2) dogs and (2) cats. This ordinance would amend that provision by creating an exception to West Valley City Code 23-3-107, and create a new ordinance under West Valley City Code 23-3-108 that would establish the criteria for that issuing of the hobby permit.

7 AN ORDINANCE AMENDING SECTION 23-3-107(1) AND

8 CREATING 23-3-108 OF THE WEST VALLEY CITY

9 MUNICIPAL CODE TO CREATE A PERMIT THAT WILL

10 ALLOW RESIDENTS TO HAVE MORE THAN TWO DOGS

11 OR TWO CATS AT A SINGLE ADDRESS.

13 WHEREAS, Title 23 of the West Valley City Municipal Code regulated animals in West

14 Valley City.

15 WHEREAS, the City Council of West Valley City, Utah recognizes the important role

16 dogs and cats have in the lives of the citizenry and the community.

17 WHEREAS, the City Council of West Valley City, Utah does hereby determine that it is

18 in the best interests of the health, safety, and welfare of the citizens of West Valley City to amend

19 Section 23-3-107 of the West Valley City Municipal Code;

20 WHEREAS, the City Council of West Valley City, Utah does hereby determine that it is

21 in the best interests of the health, safety, and welfare of the citizens of West Valley City to create

22 Section 23-3-108 of the West Valley City Municipal Code;

23 NOW, THEREFORE, BE IT ORDAINED by the City Council of West Valley City,

24 Utah as follows:

25 Section 1. Repealer. Any provision of the West Valley City Municipal Code found to be

26 in conflict with this Ordinance is hereby repealed.

27 Section 2. Amendment. Section 23-3-107(1)(5) is hereby amended as follows:

28 23-3-107(1)(5). HOUSEHOLD PETS.

30 1) Unless otherwise provided under this Title, household Pets shall be limited to no more

31 than four animals per address, including no more than two cats, no more than two dogs,

37 1) The Animal Control Division may issue a permit to owners of Dogs and Cats to keep

38 more than four (4) Dogs and Cats; including more than two Dogs (2) or two (2) Cats in a

39 residential area provided:

40 a. The owner completes the application and pays all associated fees;

41 b. All household pets, in excess of four (4), fit the definition of a Dog or a Cat.

42 c. All Dogs and Cats at the address at the address are rendered sterile;

43 d. All Dogs and Cats at the address are microchipped.

44 e. Adequate areas for confinement and shelter are provided;

45 f. The owners have not been found in violation of this Title or Utah State Code Title

46 76 Chapter 9 Part 3 within the past twelve (12) months.

47 2) The Hobby Permit may be immediately revoked if the owners are found to be in violation

48 of this Title or Utah State Code Title 76 Chapter 9 Part 3.

49 Section 3. Severability. If any provision of this Ordinance is declared to be invalid by

50 a court of competent jurisdiction, the remainder shall not be affected thereby.

51 Section 4. Effective Date. This Ordinance shall take effect immediately upon posting

52 in the manner required by law.
