C.S.O. 2924/16. WHEREAS by " The Ports and Harbours Act, 1917," it is provided that the Governor may proclaim any place bounded as set out in the proclamation to be a port or harbour for the purposes of Ordinances 18 Victoria, No. 15 (The Shipping and Pilotage Consoli-dation Ordinance 1855), and 37 Victoria, No. 14: Now therefore I, the said Governor, acting with the advice of the Executive Council, do hereby proclaim and de-clare the area set out in the Schedule hereto to be a port for the purposes aforesaid, and that such port shall bear the name of the Port of Perth.

The Schedule. All the waters of the Swan and Canning Rivers ex-

- tending from the Fremantle Railway Bridge upstream to the Perth Causev,my and the Canning Bridge, to the High Water Mark on the shores of the said rivers.

WHEREAS by " The Metropolitan Water Supply, Sew-erage, and Drainage Act, 1909," it is provided that, subject to the provisions of the Act, the Minister of Water Supply, Sewerage, and Drainage shall, with the approval of the Governor, have power to construct and extend water works : Now, therefore, His Excellency the Governor, with the advice of the Executive Council, hereby approves of the construction by the Minister of Water Supply, Sewerage, and Drainage of the following works under the said Act:—

A pipe line from Walter's Brook to the new Power Station.

Contract No, 224.

Description and location of Proposed Works.

A 12in. Monier pipe line, with manholes and all ap-paratus connected therewith, starting within the right-of-way between Packenham and Gardiner Streets, Perth, and proceeding in a Southerly direction, as indicated in blue on Plan W.S., S., and D.D., 2969.

This Order in Council shall take effect from the 1st day of June, 1917.

At the Executive Council Chamber,' at Perth, this 23rd day of May, 1917.

W.S. 330/17. WHEREAS by " The Water Boards Act, 1904," it is provided that before undertaking the construction of water works, the Minister shall submit plans, descrip-tions, books of reference and estimates of the proposed works to the Governor for approval; and that if -they are approved, the Governor may forthwith, by Order in Council, empower the Minister to undertake the con-struction of proposed works: Now, therefore, His Ex-cellency the Governor, with the advice of the Execu-tive Council, hereby approves of the plans, descrip-tions, books of reference and estimates marked W.S., S., and D.D., W.A., No. 2693, for the construction of water works within the Bridgetown Water Area, which were duly submitted for approval, and hereby empowers the Minister of Water Supply, Sewerage, and Drainage to undertake the construction of the said works.

Abolition of present Wards and Redivision into Five Wards.

WHEREAS by virtue of the power conferred by the provision of "The Roads Act, 1911," the Governor may, by Order in Council, abolish Wards, re-divide any district into Wards, and define the boundaries of and assign names to the same and determine the number of Members for each Ward: And whereas it is desir-able to abolish the present Wards of the Denmark Road District and to re-divide it into five Wards with the boundaries and the names hereinafter appearing, and also to determine the number of Members to represent each Ward: Now, therefore, His Excellency the Gov-ernor

doth hereby abolish the present Wards of the Denmark Road District and re-divide the district into five Wards -with the names and the boundaries as described and set forth in the Schedule hereunder, and (loth also determine that the number of Members for the said District shall be seven, with the number allotted to represent each Ward as set forth in the said Schedule hereunder:-

West Ward. Bounded on the North by part of the North boundary

WHEREAS a Local Health Authority may make By-laws under the provisions of "The Health Act, 1911-15," and may alter, repeal, or amend any By-laws so made: Now, therefore, the Claremont Road Board, being a Local Health Authority under the provisions of the said Act, does hereby repeal the By-law made by the Board on the 14th September, 1916, and published in the Government Gazette on the 20th October, 1916, and hi lieu thereof doth hereby make the following:—

(1.) The premises of any person who hereafter com-mences to keep cows for the purpose of carrying on the trade of a dairyman shall comply with the following conditions:—

The milking shed and milk room_ shall not be less than 11/, chains from any public road, street, or stable, nor less than one chain from any house, privy, or poultry yard.

(2.) 'He preceding By-law shall apply on and after the 1st day of January, 1919, in respect of all pre-mises whereon cows are now kept for the purpose of carrying on the trade of a dairyman, and every person now carrying on the trade of a dairyman as aforesaid shall after such date comply with such By-law.

IT is hereby notified, for general information, that the areas scheduled hereunder will be available for selection under "The Land Act, 1898," and its amendments, on and after the dates set out in said schedule.

Applications must be lodged at the Local Land Office for the district in which the land is situated, and should be lodged on or before tue date specified.

All applications lodged before such date will be treated as having been received on that day, and if there are more applicants than one for any lot the application to be granted will be determined by the Land Board. Should any lands remain unselected such will continue available until applied for or otherwise dealt with.

If a Land Board sitting becomes necessary, notice will be given in the Government Gazette and at least one newspaper advising the applicants for the blocks of the date, time, and place of the meeting of the Board, to deal with the matter; but it shall not be obligatory on the Department to give any other notice.

HIS Excellency the Governor in Executive Council has been pleased to approve, under "The Land Act," and amending Acts, of the Regulations for the Sale, of Town and Suburban Lands, as set out hereunder.

L. & 1072/17. REGULATION UNDER "THE LAND ACT, 1898,"

FOR THE SALE OF TOWN AND SUBURBAN LANDS.

Town and Suburban Lands, except Suburban Lands set apart for cultivation, shall be sold subject to the conditions of sale set forth in the schedule hereto, and the purchase money or premium shall be payable in the instalments therein stated.

Should the applicant not be the purchaser his deposit will be refunded in due course.

5. The purchaser shall, immediately upon the fall of the hammer, pay to the Minister for Lands or his agent a deposit at the rate of 10 per cent. upon the total amount of the purchase money, unless he has already paid a sufficient deposit on application, and any such deposit shall be considered as payment of the pur-chase money so far as the same will extend. Should the purchaser fail to pay the deposit as required, the pur-chase shall be void, and the lot shall be offered again immediately for sale.

6. The balance of purchase money shall be paid to the Minister for Lands or his agent within twelve months from the day of sale, by four equal quarterly instalments on the first days of January, April, July, and October, the first instalment being payable on the first day of the quarter next following the date of sale, the Crown Grant fees being payable with the last in-stalment of the purchase money. Provided that nothing shall prevent the balance of the purchase money and fees being paid at an earlier date should the purchaser so desire, but no Crown Grant of any Suburban Lot shall issue until the Minister is satisfied that the pre-scribed fencing has been effected.

7. In default of payment of any one of the several insalments of purchase money within thirty days after the dates mentioned; or if, in the case of Subur-ban Lots, the required fencing is not completed within two years from the date of sale, the land shall be absolutely forfeited, together with all purchase money and fees that may have been paid.

8. On payment of the final instalment of the pur-chase money, provided that in the case of Suburban Lots the condition of fencing has been complied with and maintained, a Crown Grant shall be issued on ap-plication and payment of the prescribed fee of Thirty shillings.

9. The purchaser will have the option of taking, in lieu of a grant of the fee simple, a lease under the Regulations gazetted the 23rd day of August, 1912, at the scheduled capital value nearest the upset price, for the term of 99 years, at a ground rent of 4 per centum on the capital value, and a premium equal to the amount of his bid in excess of the upset price, in which case the following conditions shall apply in place of para-graphs 5, 6, 7, and 8, viz.: -

(a) Every purchaser shall, at the fall of the ham- mer, pay to the auctioneer a lease fee of five shillings and a sum equal to the in-stalment of rent of lease purchased, payable in advance; pursuant to Section 136 of the said Act, unless the purchaser shall as an applicant have previously paid the same pursuant to Clause 4 of the said Regula-tions.

(b) The purchaser shall also pay, on the fall of the hammer, the sum of ten shillings or 10 per centum of the premium, whichever shall be the greater, and shall pay the balance (if any) of the premium within thirty days thereafter. In default of such payment the purchase shall be void, the deposit forfeited, and the lease may be put up again and re-sold.

10. Immediately after the sale the purchaser shall declare to whom or in whose name he requires the Crown Grant or Lease to issue, and the name, address, and occupation of such person shall thereupon be in-serted in the form of application to purchase or lease.

11. If any lot is improved, the value of the im-provements (unless the purchaser is the owner of the improvements) will be payable by the purchaser to the Minister for Lands or his agent, in addition to the pur-chase money or premium, forthwith after the Sale, or at such time and by such instalments (if any) as the Minister may determine.

12. Each Suburban Lot shall be fenced on the sur-'veyed boundaries, within two years from the date of sale, with a fence of the description prescribed by the said Act: Provided that the Minister for Lands may, if he think fit, dispense with the division fences be-tween two or more adjoining lots purchased by one person; or may, if he thinks fit, accept other substan-tial improvements in lieu of fencing.

Bonus for Production of Graphite.

Department of Mines, Perth, 30th May, 1917.

It is hereby notified, for public information, that in order to aid the development of mining for Graphite in the State of Western Australia, a Bonus will be paid by the Government on marketable graphite mined and prepared for market within the State, on the follow-ing. conditions, viz.: —

(1.) The graphite shall be "flake" graphite, and shall be, in the opinion of the Government officer ap-pointed by the Minister to supervise all payments of bonuses under his notice, of good marketable quality.

(2.) The producer shall notify the Department of Mines when he forwards any parcel of the mineral on which a bonus is to be claimed, and shall give oppor-tunity and authority for an officer of the Department to inspect the same before it is delivered finally to any manufacturer or consumer of graphite within the State, or is exported from the State, and shall give particu-lars of how it is intended to dispose of the parcel. He shall render an account for the bonus payable on each parcel on Treasury account forms together with account sales showing all particulars and details of the actual sale of each parcel, and a statutory declaration that all information given is true and correct, and that the graphite is the produce of his mine within the State of Western Australia.

(3.) The bonus- shall be at the rate of five per cent. of the net proceeds at the mine of sale of each parcel as paid to the producer directly or indirectly by the manufacturer or consumer within the State or the pur-chaser outside the State.

(4.) For the purposes of these conditions, the com-pany or person immediately controlling the working of the mine from which the graphite is raised shall be deemed to be the producer, and any bonus payable shall be paid to him or to his authorised agent. No bonus shall be payable to any intermediate sellers between the producer and the final buyers. The supervising officer may require, and shall be supplied with full information as to any intermediate sales, and his decision as to what is the sale price on which the bonus is payable shall he final.

(5.) The amount of bonus payable in any year to any one producer shall not exceed £500.

(G.) The bonuses shall be payable on ore sold after the date of this notice for which accounts are received up to but not later than 30th June, 1919.

(7.) The supervising officer if not satisfied with the information regarding the sale of any parcel may re-quire further information to Pb supplied under statutory declaration, and no bonus shall be payable unless and until he is fully satisfied that all transactions are gen-uine business deals.

ROADS ACT AMENDMENT AND CONTINUATION ACT, 1915.

WHEREAS by Order in Council dated the 30th day of July, 1912, and published in the Government Gazette of the 2nd day of August, 1912, page 3031, portion of the Bayswater Road District was transferred to the Perth Road District, and it is desirable that !the pro-visions of Section 2 of " The Roads Act Amendment and Continuation Act, 1915," should apply: Now therefore I, the undersigned, Minister for Works, hereby declare that the provisions of Section 2 of "The Roads Act Amendment and Continuation Act, 1915," shall apply on the transfer of the above territory from the Bayswater Road District to the Perth Road Dis-trict, so far as any such matters as are dealt with by the said section remain unadjusted or unsettled and the same are adjusted or Fettled by Order in Council.

Gosnells District Road Board.

Modification of terms of Section 288, Subsection 5. P.W. 6808/16.

UNDER and by virtue of the powers conferred on me by Section 288 (7) of "The Roads Act, 1911.," I do hereby modify the terms of Section 288 (5) and direct that all moneys of the Gosnells District Road Board shall be paid into such bank and in such manner as the Board shall from time to time direct for that purpose, at least once every fortnight. Provided always, that no sum exceeding £10 shall be held in the hands of any Member or any Officer, Servant, or Clerk of the Board, but the funds shall, after exceeding that amount, be banked forthwith.

NOTICE is hereby given that it is the intention of the Registrar to proceed on the 10th day of July, 1917, to cancel the registration of the Metropolitan Gardeners and Nursery Employees' Union of Workers, under the above-named Act, unless cause be shown to the contrary in the meantime.

The grounds of such proposed cancellation are stated to be as follows:—" Decrease of membership owing to the Arbitration Court Award only covering a section of the members of the Union; also a number of mem-bers having gone to the Front, the income from the remaining members is not sufficient to continue."

HIS Excellency the Governor in Executive Council has

been pleased to approve of the following amended Regu-

lations for Continuation Classes under the Education

Department.

CONTINUATION CLASSES REGULATIONS.

1. (a) Instruction in these classes will be given

to male and female students between the ages of 14

and 18 years, who are not attending Day Schools.

(b) Day School scholars over 14 years of age in the

VII. or VIII. Class may attend the Commercial Course

in Shorthand and Bookkeeping, or the Domestic Course

in Millinery and Dress-cutting, provided that no facili-

ties for the teaching of these subjects are afforded in

the State school during the day-time.

(c) Children under 14 who have obtained exemption

from attendance at Day Schools are eligible for instruc-

tion.

CONDITIONS OF INSTRUCTION.

2. (a) Each class term will consist of eleven lessons

of two hours each.

(b) Students must take English and either one or

two of the subjects in the course for which they enter.

(c) English will, as a rule, be a compulsory subject

in any of the groups that may be taken.

(d) Students will be required to be present at 75

per cent. of the lessons in each class of the courses they

attend. More than three absences in one term in any

subject, unless a valid excuse can be given, will dis-

qualify a student from further attendance in that sub-

ject, and also in the other subjects of Isis course.

Absences may be excused if a written note from the

student's parent or guardian is presented to the Head

Teacher or Secretary, and if, in the opinion of the Head

Teacher or Secretary, the excuse given is a reasonable

one.

(e) Each student will be expected to confine his sub-

jects to one of the following groups:—Preliminary.

Commercial, industrial, Domestic, Science; provided that

the Director of Education shall have power to allow a

relaxation of this rule where special circumstances have

to be considered.

SCALE OF REMUNERATION.

3. The remuneration of the instructor will, as a rule,

be 12s. Gd. per lesson of two hours for each class in

which he average attendance of students is at least

equal to the number set down as the minimum average

attendance for the class, and will lie calculated propor-

tionately if the averuge attendance of students falls

below this number.

At the end of the yssar an adjustment will be made

whereby the excess of students during one term will be

allowed to make up for any deficiency in another term.

The remuneration for Headmasters shall be as fol-

lows:—

50 to 100 pupils—f1 per week for 36 weeks.

101 to 150 pupils—V. 5s. per week for 36 weeks.

151 to 200 pupils—fl 17s. Gd, per Weak for 36

weeks.

201 to 300 pupils—f2 Os. Gd. per week for 36

weeks.

301 to 400 pupils—E2 1.0s. per week for 36 weeks.

Where the enrolment exceeds 400, the salary of the

Headmaster shall be determined by the Minister.

The remuneration of Secretaries shall be calculated on

the following basis: —

(a) In the centres with an enrolment up to 25 indivi-

dual students-7s. 6d. per week for 36 weeks

per annum.

(b) In centres with an enrolment from 26 to 50 in-

dividual students-10s. per week for 36 weeks

per annum.

The remuneration of cleaners shall be in accordance

with the following scale:—

Up to 5 classes-5s. per week.

Up to 10 classes-6s, per week,

11 to 15 classes-7s. Gd. per week.

16 to 20 classes-10s. per week.

21 to 25 classes-1.2s. Gd. per week.

Over 23 classes-15s. per week.

E M I NATIONS.

4. Annual examinations will be held on the work

of each class, and a record of each student's success will

be kept by the Headmaster or Secretary.

COURSES OF INSTRUCTION.

5. The various courses of instruction shall be those

outlined in the Department 's syllabus for each year. In-

struction should not be given to a higher standard than

is prescribed in the courses as outlined, without per-

I u isstion having first been obtained from the Depart-

ment.

CONDUCT OF CLASSES.

G. (a) Students must, as a rule, confine their work

to one of the courses specified, but permission may be

granted by the Department, on application, to vary the

courses according to local requirements.

(b) Students will be required to select two or three

subjects from any course. Permission may be granted,

on application to time Department, to vary this rule.

(c) Students who have not reached a standard of

education equal to that prescribed for Class VI. in the

State Schools should take the Preliminary Course in

their mfirst year.

(0) Students who have reached a standard equal to

that of Class VI. in the State Schools will be eligible

to attend the first year's classes in any course. Those

who have reacted a standard equal to Class VII. or

VIII. in the State Schools will lie eligible to attend the

second year clue-es in any course.

(e) Students who complete ally full course and pass

the examination - et by the Department thereon, may re-

ceive a certificate entitling them to further instruction

in certain courses at the Technical School.

(f) No class that does not reach the nlittlin11111 num-

ber specified by the syllabus may be commenced with-

out permission of the Department.

(g) Each Headmaster and Secretary will be required

to keep the following books and registers:—

(a) Teacher 's Time-book,

(1)) Attendance Registers.

(c) Free Entry Book.

(d) Postage Stamp Book.

(e) Admission Cards.

(f) Record of Absentee Notices and Ex-

planations of Absence.

(h) In small centres where no Technical Schools are

established, students over 18 years of age may be ad-mitted to vacancies in any Continuation School Class.

Permission mint in each ease be first obtained from the

Department.

(i) In small centres where no Technical Schools are

Course uud mmertificate at the annual examination

may be poi mitted to continue their attendance, and re-

ceive, further instruction of a more advanced nature.

(j) A student may be suspended by the Headmaster

for misconduct or unsatisfactory behaviour. The cir-

cumstances must be reported to the Department for de-

cision as to the permanent exclusion or re-admission of the student.

of the Technical School:—

"Students who have satisfactorily passed a tech-

nical subject in their continuation course may be

admitted for further instruction in that subject at

the Technical School, provided that they attend

also at the Continuation School until they complete

the remaining subjects of their course.

"Those who obtain passes in English and a tech-

ideal subject, one of them with credit, will be ex-

empt from further attendance at Continuation

Classes."

NOTICE is hereby given that the Board of the Road District of West Guildford propose to borrow the sum of Five hundred pounds (£500), to be expended in the extension of the Electric Lighting Scheme, and notice is also hereby given that plans and specifications and an estimate of the works and undertakings, and a statement showing the proposed expenditure of the money to be borrowed, have been prepared and are HOW open for inspection at the Office of the Board, West Guildford, for one month from the date of publi-cation hereof.

The above amount is proposed to be raised by the sale of debentures bearing interest at the rate of Five pounds (£5) per centum per annum, such interest to be payable half-yearly on the last day of July and January in each year, at the Office of the said Board, the said debentures to be repayable twenty years after the date of issue thereof; but the said Board reserves to itself the right to pay off the said debentures at any time after 10 years from the date of issue thereof.
