Electricity Industry Act 2004

Electricity Industry (Caravan Park Operators) Exemption Order 2005

Made by the Governor in Executive Council under section 8 of the Act.

1. Citation

This order is the Electricity Industry (Caravan Park Operators) Exemption Order 2005.

2. Commencement

This order comes into operation on the day on which it is published in the Gazette.

3. Terms used in this order

In this order — “caravan park” has the meaning given to that term in the

Caravan Parks and Camping Grounds Act 1995 section 5(1);

“caravan park operator” means a person who owns or operates a caravan park;

“electricity reticulation system” means any apparatus, plant or equipment in a caravan park used for, or in connection with, the transportation of electricity to a site;

“electricity services” has the meaning given to that term in clause 4;

“permanent park resident” means a person who occupies a site in a caravan park as the person’s principal place of residence;

“site” has the meaning given to that term in the Caravan Parks and Camping Grounds Act 1995 section 5(1).

4. Electricity services

(1) Electricity services are services for, or in connection with, the supply of electricity.

(2) Without limiting subclause (1), electricity services include — (a) the provision and maintenance of an electricity

reticulation system; (b) the connection of a site to an electricity reticulation

system; (c) the provision, maintenance and reading of a meter to

measure and record the quantity of electricity supplied to a site;

(d) the preparation and issue of accounts in relation to the supply of electricity to a site; and

(e) anything incidental to or associated with a matter referred to in paragraph (a), (b), (c) or (d).

5. Exemption

A caravan park operator is exempt from section 7(1), (3) and (4) of the Electricity Industry Act 2004 in relation to the supply of electricity at the caravan park subject to the conditions described in clause 6.

6. Conditions of exemption

(1) Unless subclause (2) applies, any charge imposed by the caravan park operator for electricity supplied to a site occupied by a permanent park resident must not exceed 13.94 cents per kilowatt hour.

(2) If the electricity supplied to a site occupied by a permanent park resident is generated using generating works that are owned or operated by the caravan park operator, any charge imposed by the caravan park operator for that electricity must not exceed the amount necessary for the caravan park operator to recover the costs of generation.

(3) Any fees or charges imposed by the caravan park operator for the provision of electricity services in relation to a site occupied by a permanent park resident must not, in total, exceed 25.57 cents per day.

(4) The caravan park operator must make available to each permanent park resident information that clearly sets out —

(a) the quantity of electricity supplied to the resident; and (b) the fees and charges payable by the resident — (i) for electricity supplied; and (ii) for the provision of electricity services.

(5) Information referred to in subclause (4) must be made available in a manner that is easily accessible.

(6) If information referred to in subclause (4) is not included in an account issued to a permanent park resident, the caravan park operator must inform the resident how to gain access to the information.

3. Repeal

Made by the Land Surveyors Licensing Board with the approval of the Governor in Executive Council.

1. Citation

These regulations are the Licensed Surveyors (Guidance of Surveyors) Amendment Regulations 2005.

2. The regulations amended

The amendments in these regulations are to the Licensed Surveyors (Guidance of Surveyors) Regulations 1961*.

3. Regulation 36 amended

(1) Regulation 36(1) is amended by deleting “made from a material approved by the Board.” and inserting instead —

or polypropylene. ”.

(2) Regulation 36(1a) is repealed.

(3) The Table to regulation 36 is amended as follows: (a) in paragraph (a) by deleting “another material and to

dimensions approved by the Board.” and inserting instead —

“ polypropylene, 75 mm square, at least 0.45 m long. ”; (b) in paragraph (b) by deleting “, a steel peg 75 mm square,

at least 0.6 m long or a mark made from another material and to dimensions approved by the Board.” and inserting instead —

“ or a steel peg 75 mm square, at least 0.6 m long. ”;

Under the powers conferred by the Local Government Act 1995 and the Bush Fires Act 1954 and by all other powers enabling it, the council of the City of Melville resolved on 15 March 2005 to make the following local law amendment as set out below. Delete Clause 3 and Insert— “3 All firebreaks must be cleared by the owner or occupier of land on or before

15 November in any year, and there after be maintained by the owner or occupier clear of inflammable matter up to and including 30 April in the following year.”

FD 339/01 I, Peter Rogers, the Executive Director of the Department of Fisheries, Western Australia, pursuant to Section 23 of the Pearling Act 1990 (“the Pearling Act”) have granted an application by Pearls Pty Ltd, for a pearl oyster farm lease, in respect of areas of water located near Entrance Island. Under section 33(1) of the Pearling Act a person aggrieved by my decision may apply to the State Administrative Tribunal (SAT) for a review of the decision. HERITAGE OF WESTERN AUSTRALIA ACT 1990 NOTICE OF INTENTION TO REMOVE AN ENTRY IN THE REGISTER OF HERITAGE PLACES

In accordance with the requirements of Section 54(1)(b) of the Heritage of Western Australia Act 1990, the Heritage Council gives notice that the entry in the Register on an interim basis in relation to the Place being “Mitchell’s Buildings” at No. 136-142 William Street, Perth is to be removed from the Register. The reason for the removal is that the Place is to be demolished to allow for the safe construction of underground railway platforms. The façade is to be preserved and relocated on the same site at a later date and will be registered as part of the William & Wellington Street Precinct. The Heritage Council of Western Australia has agreed to the demolition of the building and reinstatement of the façade. The entry in the Register to be removed is in relation to that parcel of land comprising Lots 3 and 7 on Diagram 5746 and being the whole of the land contained in Certificate of Title Volume 2226 Folio 39. The Heritage Council invites submissions on the proposal. Submissions must be in writing and should be forwarded to the following address not later than 5pm on 3 June 2005.

b) Buildings shall be located within a maximum 1500m2 building envelope. c) No boundary fencing is permitted. Fencing of up to a 4000m2 yard area may be permitted

by Council where fencing location, materials, height and style do not compromise a Vegetation Conservation Area, a Strategic Fire Break or the landscape amenity of the zone.

d) Buildings shall be designed and constructed of materials which allow them to blend into the landscape of the site. Council shall refuse to approve walls and roofs constructed of reflective materials such as unpainted zincalume and off-white colours. Council will be supportive of walls and roofs with green, brown or red tonings in keeping with the amenity of the area.

e) Dwelling houses shall not exceed 7.5 metres in height which is measured vertically from the natural ground level unless otherwise approved by Council.

f) Any water tanks shall be coloured an appropriate natural shade of brown or green or suitably screened with vegetation in keeping with the amenity of the area to the satisfaction of Council.

3. Vegetation Conservation & Environment a) With the exception of approved setback variations, access, service and bushfire safety

requirements, no local native vegetation shall be removed/felled/killed from within Vegetation Conservation Areas as generally shown on the Subdivision Guide Plan.

b) The keeping of stock as well as intensive agriculture shall be prohibited. c) Where, in the opinion of Council, dust nuisance, soil or land degradation is occurring or

likely to occur, Council shall require the landowner to rehabilitate or stabilise the land to Council’s satisfaction.

d) Tree and shrub planting using local native species shall be required by Council as a condition of development approval.

4. Infrastructure and Servicing a) Lots shall be connected to a reticulated potable water supply to an appropriate standard

as determined by the license holder. b) Onsite effluent disposal shall be the responsibility of the individual landowner. c) The disposal of liquid wastes shall be carried out with an effluent disposal system

approved by Council and the Health Department of WA. Systems shall be designed and located to minimise nutrient export and/or release into groundwater. Effluent disposal areas for new dwellings shall be setback a minimum of 100 metres from the closest Department of Environment, Water & Catchment Protection bore and be a minimum of 2 metres above the highest known groundwater level.

d) No more than one effluent disposal system will be permitted per lot. e) Council may request a condition at the time of subdivision requiring the construction of

Banksia Road through to the site. f) Council may request a condition at the time of subdivision requiring the construction of

battleaxe legs. g) Stormwater management shall utilise low impact water sensitive measures. h) Council may request a condition at the time of subdivision requiring the provision of

underground electrical and telecommunications connections. 5. Fire Safety

a) Council may request the Commission to impose a condition at the time of subdivision for the construction of Strategic Fire Breaks as shown on the Subdivision Guide Plan. Strategic Fire Breaks shall be constructed to a standard suitable, for all year access by heavy duty fire appliances and two wheel drive vehicles.

b) Where a Strategic Fire Break crosses individual lots, the landowner shall be responsible for ongoing maintenance.

c) A Building Protection zone not less than 20 metres wide shall be provided and maintained around all residential buildings. Landowners shall also be responsible for maintaining other cleared areas in a low fuel condition either by annual slashing or another approved method.

d) In cases where only part of the zone is developed, an interim firebreak system or strategic firebreak system shall be prepared and put in place, to the satisfaction of Council and FESA.

e) Fire hydrants shall be provided at intervals of 200 metres along subdivisional water mains.

f) The subdivider shall make arrangements to the satisfaction of Council to ensure prospective purchasers are aware of the fire management guidelines of the Fire Management Plan, Home Owners Bushfire Survival Manual and the Australian Standard 3959 “Construction of Buildings in Bushfire Prone Areas”.

6. Notification of Prospective Purchasers a) Provision shall be made to Council’s satisfaction to ensure prospective purchasers of land

within Rural Conservation Zone No. 5 are given a copy of these provisions prior to entering into an agreement to acquire any property.

b) Application for Planning Consent shall require the submission of— i) a completed “application for Planning Consent” form; ii) three copies of a Plan showing the precise location and size of all the buildings and

fencing proposed and any clearing as well as fire protection measures to be adopted; iii) three scaled elevation plans showing the elevation of the buildings proposed and the

materials and colours to be used.

This proposal was first published in the Government Gazette on 1 June 2004. The amendment is shown on Western Australian Planning Commission plan number 3.1767. The amendment, as advertised, has been presented to and approved by the Governor in accordance with the requirements of the Metropolitan Region Town Planning Scheme Act. It will now be tabled in both Houses of Parliament, where it must remain for 12 sitting days. During this time either House may, by resolution, disallow the amendment. As soon as the amendment is no longer subject to disallowance it becomes legally effective in the Metropolitan Region Scheme.
