WHAT’S NEW? Creation of Kansas Trucking Connection The Kansas Corporation Commission Motor Carriers Section, the Kansas Department of Transportation Oversize/Overweight Special Permits Section, and the Kansas Department of Revenue Motor Carrier Services Bureau are in the process of relocating all their respective staff and offices into one site at 1500 SW Arrowhead Rd., Topeka, KS. This new office is designed to progressively improve and simplify the services currently provided to our customers with the creation of a One-Stop-Service. There will be one main phone line and one main fax line at the Kansas Trucking Connection. At the current time, these departments will act independently to meet existing statutory requirements and collaboratively to meet customer needs. The Kansas Department of Revenue IFTA Bureau will not be included in this move. However, the MCSB staff will continue to provide the same IFTA assistance as they have in the past. Future developments include: creation of one carrier application form to obtain registration, IFTA, and KCC compliance; improving documentation processing by scanning and imaging systems; cross-training staff of the various duties performed by these departments so that a customer may be helped on first contact by one staff associate to obtain Oversize/Overweight Permits, IRP registration, IFTA, and KCC compliance; and offering training to increase usage of Internet processing to meet customer needs at their convenience.

TOTAL REISSUE OF ALL IRP PLATES IN 2005

During the 2005 IRP Renewal all IRP accounts will be issued new license plates for their trailers and power units. Please renew early to get your new your tags and new cab cards on and in your vehicles by the March 1, 2005 deadline.

Apportioned Registration Refunds on Sold Leased Vehicles

Effective 04/02/2004 the MCSB will process refunds on vehicles leased on to Kansas IRP accounts when the vehicle has been sold, repossessed, foreclosed by mechanic’s lien, title transferred by operation of law, or the owner is deceased and the deleted vehicle is not going to be replaced by another vehicle. The required documentation is outlined in this book under refunds. For example, a copy of the bill of sale is required to be provided with the properly completed and notarized Application for Refund of Kansas Apportioned Fleet Registration form (MCS-105) for sold vehicles that are being deleted from the account. The MCS-105 application is designed to be completed by an authorized representative of the IRP account and the Federal Tax Identification Number required and provided on the MCS-105 will be for the IRP Registrant since the refund will be sent to the IRP registrant.

credentials. Who Can Use the On-line Permit System? Any motor carrier, permit company or individual with an escrow account from Central Permit and a Motor Carrier INK subscription may purchase permits. Getting Access You need an Escrow account, a user name, and a password. • To get an escrow account, fill out the escrow form or contact Central Permit at (785) 271-3145. • To get a user name and password, fill out the Motor Carrier Subscription form and download the terms and agreement or contact

the Information Network of Kansas at 1-800-4KANSAS or (785) 296-5059. • These forms are available in this book. • There is a $50 minimum deposit to open Escrow account if you only plan to do IRP transactions. You will receive a letter

advising you to deposit funds when your Escrow account balance drops below $25. There are no other charges involved in getting your access set up.

What is the Information Network of Kansas (INK)? Is the primary Internet provider for many state agencies, you may visit them at http://www.accesskansas.org/. Some services provided by INK require a subscription, for subscription information logon to: http://www.accesskansas.org/subscribeform.html Why Would I Want To File On-line? Internet supplement processing • It is easy to do and it allows you to add vehicles, transfer vehicle fees, add jurisdictions, increase vehicle weights, and replace lost

credentials (cab cards and license plates) at your convenience. • After you have submitted the information you will be able to print off the necessary documentation to get your vehicle on the

road. • The next day (unless it is a holiday, weekend, or your entry occurred after 6 PM) your billing invoice will be available for you to

printout for submission to our office with the required documents and payment. You enter the information prompted one time and the system will create the Schedule C and Title Application forms for you to print off.

• You will continue to have 30 days to complete the process and receive your credentials. • There is no charge for replacement cab cards. INK charges a $1.00 transaction fee. The replacement license tag fee of $6.50 plus

the $1.00 INK processing fee includes the cab card and plate and is deducted immediately from your Escrow account, which allows us to promptly mail your replacement tag to you.

Payments of IRP Internet Supplements and Renewal Invoices

• The next business day after you have completed your on-line transaction you will be able to pay your invoice with an E-check. This means you provide your personal checking account routing number and the fees will be automatically drafted out of your account.

IRP Renewal Processing As of December 2002 we encouraged all of our IRP accounts to file their renewal on-line. • You do not need an Escrow account to process your renewal on-line. • You will need your IRP account number and your PIN annually assigned by MCSB off the forms we mail to you. • It is designed to allow you to return to the session and complete your processing if you get interrupted. After your renewal has

been created you can resume processing supplements on-line. When Would I Not Be Allowed To File On-line? • If your IRP account balance exceeds $100.00 due you will not be able to process renewals on-line. • If you are trying to enter a supplement for a vehicle that the purchase date exceeds 30 days. • If your IRP account was not in good standing. • If your IRP account was inactive. Letter size Cab Cards Effective August 28, 2002, Kansas began producing our cab cards printed on standard letter size 8 ½” x 11” white paper. Law enforcement and IRP was informed of this change. The 2004 renewal cab cards displayed the Kansas State Seal watermark in the background as a security enhancement. IMPORTANT INFORMATION

When you call us to verify or search information to assist you, please have your IRP Account Number and your license plate number, or vehicle identification number ready. SCHEDULE C SUPPLEMENT APPLICATION The schedule C form is used to add vehicles, transfer vehicles, and delete vehicles. Use this Checklist to know what items should be sent with SCHEDULE C Form: ADDITIONS 1. Provide the proof of ownership via: original title if assigned on the back to new purchaser OR Manufacturer Statement of Origin

OR provide a front and back copy of the clear title with the owner’s name printed on the front side of the title. 2. Provide a VIN (Vehicle Identification Number) Inspection that has been completed by the Kansas Highway Patrol or another

state’s law enforcement for an out of state title. 3. Notarization is needed if the vehicle is purchased from a notary state. (AZ,KY,LA,MT,NC,OH,OK,PA,WY) 4. All liens must be released and notarized if required by a notary state. (KS,WV,WY) 5. If the vehicle you are adding has just been purchased (it does not have a clear title), you will need to provide a Sales Tax

Exemption Number or the Sales Tax Payment, and surrender the current title. If you need to apply for exemption of Sales Tax Payment, you will also need to provide a completed Business Tax Application and a copy of the current Lease Agreement between both parties. NOTE: the name on the lease agreement, the business tax application form and the title must match exactly. In order to apply for exemption, our office must receive these forms within 30 days of the date the vehicle was purchased. Once your Business Tax Application has been processed, you will receive your Sales Tax Number.

• Leasing to a Private Carrier you will need to pay Kansas Sales Tax. • Leasing to a For Hire Carrier you will need to provide a Kansas Sales Tax number, or completed business tax application

form. • Company owned will pay sales tax if a Private Carrier. • Company owned with current For Hire Authority may use their KCC authority number or MCID Number to apply for

exemption of sales tax. 6. Provide a completed and signed title application form if adding a newly purchased vehicle with an assigned outstanding

negotiable title or adding a vehicle with an MSO (Manufacturer’s Statement of Origin form). 7. Heavy Vehicle Use Tax needs to be provided if the vehicle was purchased 60 days or more days ago. INTRODUCTION

IRP INTERNATIONAL REGISTRATION PLAN Kansas is a member of the International Registration Plan referred to as the IRP. Members of the IRP include all of the United States as well as Canadian jurisdictions. Under the IRP an owner of a Kansas based vehicle or fleet shall make application for apportioned registration only to Kansas. Kansas will provide each IRP jurisdiction information contained in the application. Vehicles registered under the IRP shall be deemed fully registered in all jurisdictions for both inter-jurisdiction or intra-jurisdiction movement. Kansas shall determine the percentage of miles operated in Kansas and each IRP jurisdiction to the total miles operated in all jurisdictions. The percentages applicable to the registration fee of each jurisdiction will be calculated and a billing notice covering registration will be issued. An optional breakdown of registration fees by vehicle is available on more than one vehicle. The enclosed original application is to be completed according to the instructions on the back of the form. If you had a fleet with Kansas apportioned registration for the previous registration year; the renewal application is a printout based on that information. If any changes have occurred they must be noted on this application.

IMPORTANT DATES

The registration year for Kansas apportioned vehicles is January 1 through December 31 each year. Kansas apportioned registration renewal applications are sent out of our office Mid December each year. Please review the renewals for accuracy and make required changes and return them to our office as soon as possible or process your renewal on-line. We process renewals by date of receipt. Please remember these dates so that if you do not receive your next renewal packet in the mail you will need to contact us. We encourage renewal payment prior to February 15. Waiting to pay fees until the expiration of the grace period, March 1 does not allow adequate time to receive new cab cards and license plates.

Quarterly payment may be an option if received and paid in our office on or before March 1. Full fees are assessed March 2. The enforcement deadline for each renewal will begin March 2 of each year. Any vehicle that has not registered, which is required to be registered prior to that date, shall be subject to a penalty of $2 for each vehicle. Vehicles in the possession of the owner on and after January 1 of a registration year are subject to registration for that year.

CREDENTIALS Kansas shall issue a cab card describing each vehicle in the owner's fleet and a license plate. The cab card shall also indicate the name of each IRP jurisdiction with which the fleet owner is apportioning the registration of a fleet. The base IRP jurisdiction shall be the only jurisdiction to issue credentials. When you receive your credentials from us, check your cab cards for correct information. Your cab card describes your vehicle, where you go and the maximum weight in each apportioned jurisdiction. If the information is not accurate you may be ticketed and fined. Keep your IRP cab card in your vehicle. A photocopy of your IRP cab card is not valid. Display your apportioned plates on: The front of tractors. The back of straight trucks The back of all trailers.

Keep the original cab cards with the vehicle assigned. E-Mail Permits Carriers who have Internet service will now have the option to receive their IRP temporary registration permits sent electronically to their e-mail service. Also, the Central Permits Section offers the option of sending the permits they issue electronically. Customers will need to provide their e-mail address and it will be their responsibility to provide updates regarding e-mail address changes.

VitalChek is a credit card servicing company that enables our office to process your credit card for a fee that is charged on your account. You may use your credit card in our office or provide us your credit card number by phone to pay your IRP bill or to order a permit from our Permit Section. You may use MasterCard, Visa, Discover, or American Express through VitalChek. VitalChek will add a processing fee on your credit card bill at the time the transaction is processed in our office. VitalChek Fee: 2.5% of the total amount billed or a minimum $7 fee, which ever is greater. E-Check Payments • IRP Supplements and Renewals that are created

on the Internet are eligible for e-check payments. The next business day after you have completed your on-line transaction you will be able to pay your invoice with an E-check. This means you provide your personal checking account routing number and the fees will be automatically drafted out of your account.

REGISTRATION INFORMATION Kansas based apportioned registration includes the following types:

REGISTRATION

To be an apportioned IRP registrant, you must have a vehicle(s) that will operate in Kansas and one or more member jurisdictions.

You may register a power or trailer fleet in Kansas if you have an established place of business in Kansas. (a) "Established Place of Business" means a physical structure owned, leased or rented by the fleet registrant. (b) The physical structure shall be designated by a street number or road location, be open during normal business hours, and have located within it:

(1) a telephone or telephones publicly listed in the name of the fleet registrant,

(2) a person or persons conducting the fleet registrant's business, and

(3) the operational records of the fleet

(unless such records can be made available in accordance with the provisions of Section 1602. of the Plan).

Your fleet must accumulate mileage in Kansas and the operational records for your vehicles must be kept or made available for audit in Kansas.

(a) "Apportionable Vehicle" means any vehicle, except recreational vehicles, vehicles displaying restricted plates, city pick up and delivery vehicles, buses used in transportation of chartered parties, and Government-owned vehicles, used or intended for use in two or more member jurisdictions that allocate or proportionally register vehicles and is used for the transportation of persons for hire or designed, used or maintained primarily for the transportation of property and:

1. Is a power unit having two axles and a

gross vehicle weight or registered gross vehicle weight in excess of 26,000 pounds or 11,793.401 kilograms; or 2. Is a power unit having three or more axles, regardless of weight; or

3. Is used in combination, when the weight of such combination exceeds 26,000 pounds or 11,793.401 kilograms gross vehicle weight.

Trucks and truck tractors, and combinations of vehicles having a gross vehicle weight of 26,000 pounds or 11,793.401 kilograms or less and buses used in transportation of chartered parties may be proportionally registered at the option of the registrant. Optional Registration

Kansas shall accept at the option of the carrier.

• Two axle commercial trucks operated intrastate in other jurisdictions in excess of 12,000 lbs.

PERMANENT TRAILER PLATES

Carriers that have a power unit fleet may register their trailers with this office. Trailers will receive a permanent registration plate and cab card. Unless trailers are deleted from the fleet at renewal, Kansas’s fees will be billed. Trailer registration can not be transferred. When a trailer is sold or deleted from the fleet the license plate and cab card must be returned to Motor Carrier Services Bureau. When a newly purchased trailer is registered via this office, then a new vehicle license plate and cab card is issued.

PERMANENT POWER PLATES

All power units, except Custom Harvesters, will be issued permanent power plates. Cab cards will be re-issued each year at renewal and if you have quarterly payments, again each quarter. Fees will be billed on all power units at the time of renewal unless you delete the vehicle and return the plates and cab cards to Motor Carrier Services Bureau. If a leased vehicle operates after January 1 fees will be assessed until credentials are returned to this office.

RENTAL VEHICLES

Rental Vehicle: Base Jurisdiction: The base jurisdiction must be met by the rental company as registrant of the fleet. Rental companies may now register vehicles in their name and long term lease them (over 30 days) provided they lease them without drivers.

FARM CUSTOM HARVESTERS

Kansas based custom harvesters can register vehicles bearing apportioned registration. This type of registration will be allowed if the following criteria are met:

• Transport farm machinery, supplies, or both to and from a farm, for custom harvesting operations on a farm.

• Transport custom harvested crops only from a harvested field to initial storage or to initial market locations.

• Transport agricultural products produced by such owner or commodities purchased by such owner for use on the farm owned or rented by the owner of such vehicle.

• The issuance of these account numbers and license plates will be distinguished by using the 800,000 series.

ONE WAY RENTAL FLEETS

The IRP provides for the allocation registrations of a one way rental fleet consisting of trucks that are rented or offered for rental without drivers on a short-term rental. These trucks have a

combined gross weight of less than 26,000 pounds.

A one-way rental fleet owner shall complete applications MCS-1A and 1B. List only the trucks that have been allocated to Kansas for registration. The trucks listed shall be a mix of trucks by combined gross weight in proportion to the Kansas mileage percentage applicable.

In conjunction with completing and filing the application, the applicant shall include a list of the total vehicles in the fleet including the combined gross weight.

All trucks of such one-way fleet so qualified will be allowed to perform both inter-jurisdictional and intra-jurisdictional movements in all jurisdictions.

HOUSEHOLD GOODS CARRIERS

Household Goods Carriers using equipment leased from Service Representatives may elect to base such equipment in the base jurisdiction of the Service Representative or that of the Carrier. If the base jurisdiction of the service repre-sentative is selected, the equipment shall be registered in the service representative's name and the household goods carrier shall be indicated as lessee. The apportionment of fees shall be according to the combined mileage records of the service representative and those of the carrier. Such records must be kept or made available in the service representative's base jurisdiction.

If the base jurisdiction of the household goods carrier is selected, the carrier shall register the equipment and the service representative shall be designated as lessor. The apportionment of fees shall be according to the mileage records of the carrier and the service representative, which must include intrastate miles, operated by those vehicles. The records must be kept or made available in the base jurisdiction of the carrier. Service representatives properly registered under this selection shall be fully registered for operations under their own authority as well as under the authority of the carrier.

BUSES

Common carriers of passengers must file and apportion unless the bus is used exclusively for charter. The bus must be marked as "Chartered" and have an itinerary. At the option of the registrant, total miles may be the sum of all actual miles in a jurisdiction or it may be a sum equal to the scheduled route miles per jurisdiction from the farthest point of origination to the farthest point of destination of the scheduled pool.

APPORTIONED REGISTRATION EXEMPTIONS

• Buses transporting chartered parties.

• Vehicles with restricted registration plates, i.e., "Local," "Farm," "6,000 mile."

• Charitable vehicles, i.e. not for profit fraternal or religious organizations or an accredited school.

• Recreational vehicles (personal pleasure).

• Drive away, Transporter or Dealers.

• Government owned vehicles.

• Missouri Bilateral Supplemental Agreement.

IFTA MILEAGE PRINTED ON RENEWAL Are the miles you report for the International Fuel Tax Agreement (IFTA) the same miles you use for your apportioned registration (International Registration Plan) (IRP)? If you did a name change with IFTA during the year you will need to submit this form.

We are able to electronically obtain the mileage filed on your Kansas IFTA returns in hopes of saving you the time of writing down this information on our renewal applications. Please read the following paragraphs to completely understand this new process: If you sign and return this form by September 30, 2005, your next apportioned registration renewal form will contain your mileage information from the IFTA returns you filed for the 3rd and 4th quarters of 2004 and the 1st and 2nd quarters of 2005. This is to match the IRP reporting period of July 1, 2004, through June 30, 2005. This mileage information will be used as actual miles traveled. Once received, you will be able to make any necessary changes to the preprinted mileage information and you will need to add any miles that are not captured on the renewal application. You can also add jurisdictions, even if you did not have actual miles during the reporting period. • Our office will assign an account number, please retain for future use and identification with our office.

• Federal Employer Identification Number or Social Security Number.

• Kansas established place of business (a physical location address is required).

• Proof of prior registration is required.

• Type of operating authority issued by the Kansas Corporation Commission. MC authority type and number.

Owner Operator Registration Requirements: 1. KCC Authority is not required. 2. Provide proof of Insurance. 3. Provide proof of HVUT payment for

vehicles registered over 54,000 lbs. 4. Provide proof of payment of personal

property tax (obtain from carrier if you were leased on, or from your local county treasurer’s office).

5. Provide your valid Kansas driver’s license with current Kansas address.

6. Provide proof of business or home address via copy of a current utility bill.

7. Agree to maintain mileage records for their vehicle and report the miles for IRP registration and IFTA (if applicable).

8. Provide actual miles if applicable when account is opened.

9. Must register in at least one other jurisdiction (multiple jurisdictions are anticipated).

RENEWAL IRP REGISTRATION

Preprinted renewal applications are mailed during December prior to the new registration year in a packet with extra forms and the MCSB Instruction Manual. You should correct and return the Schedule A and B forms. The documents you return will be processed in order of date of receipt and your Renewal Invoice will be mailed to you for payment. Your payment must be received no later than March 1 each year.

Schedule B (MCS-1B)

♦ Verify the Registrant information for accuracy. If information is missing, i.e., telephone, fax numbers, U.S.DOT number, or needs corrections please provide.

♦ Record actual miles driven during the reporting period of July 1, through June 30, of the previous registration year.

♦ Place an X in the box of each jurisdiction that you have actual miles for and want to continue apportioned registration. Record actual miles.

♦ When you don't have actual miles and you want to add the jurisdiction on your cab card, place an X in the ADD JUR column. The estimated miles will be calculated and these fees will be billed at over 100%. You will receive one bill of both actual and estimated miles.

♦ Proof of Insurance, Proof of payment of Personal Property tax and Proof of payment of Heavy Use Tax may be required. Your printed invoice will indicate if you need to satisfy any of these requirements. If you have not met any combination of these requirements by March 1 each year, your account will be Suspended until satisfied (even if the renewal invoice has been paid).

INSTRUCTIONS FOR MCS-1B Section 1 -- Mileage Schedule List the actual miles operated, include all miles traveled, in each and all jurisdictions by the motor vehicles of the fleet that are proportionally registered with Kansas during the period of July 1 through June 30 of the fiscal year immediately preceding the new registration year. E.G., the mileage-reporting period for the registration year 2003 is July 1, 2001 through June 30, 2002. Mark an "X" in the square of all IRP jurisdictions that you have actual miles AND want to continue the apportioned registration. If you do not put a"X" in the box, that jurisdiction will not be included. If you wish to add a jurisdiction (and do not have actual miles) mark an "X" in the "ADD JUR" column. Our office will enter miles based on mileagthat current fleets operate into these jurisdictions. When a new account is established, and there is not a history of mileage, estimated mileage will be used. If the account is established during the period of January 1 through April 30 actual mileage will be required on the next renewal. REGISTRATION REQUIREMENTS There are qualifications and compliance requirements that must be met in Kansas before an application for apportioned registration may be accepted or any registration issued. Some of the requirements may have already been met depending on the type of authority registered with the Kansas Corporation Commission and the Federal Highway Administration (FHWA).

An example of when “authority” may not be needed: In Kansas if you haul sand, rock and gravel you would be exempt from KCC. If you haul sand, rock and gravel across a state line, you would not be exempt from FHWA authority. It is the individual’s responsibilities to contact the state you are working in to verify if you would be exempt in that state.

OWNERSHIP

Effective 4-3-2003 Kansas’s statutes changed to allow Kansas to register a vehicle in the name of a lessor or owner-operator. An owner-operator, who meets the required criteria, may obtain Kansas registration by opening an account with our office and operate under the lessee's authority. This allows the owner-operator to purchase his own Kansas registration and receive credentials as the Registrant.

For purposes of registration in Kansas, the Owner is the person or company who has the right to control the operation of a vehicle. If the vehicle title is in a different name than the Registrant name the vehicle is considered a leased vehicle. The lessee is responsible for the operation of the vehicle and shall be considered the owner and not the owner of the legal title.

TITLE

Proof of ownership is required for each fleet vehicle. Proof of ownership may be satisfied by providing a Kansas Title, a Kansas County Receipt, a Kansas E-title, a title issued by a jurisdiction other than Kansas, a Manufacturer Statement of Origin, or a copy of the front and back sides of the title (if the back of the title has

not been assigned over to a different owner than the one on the front of the title).

Proof of prior registration must be provided whether Kansas registered or previously registered in another jurisdiction.

A lease agreement is required, if the name on the title is different from the registrant name.

If the title has been assigned to another owner, a completed Kansas Title application form shall be provided. (Refer to Application for Kansas title section).

INSURANCE

Financial security (liability insurance) as required by Kansas’s law must be maintained continuously throughout a registration year on the vehicles that constitute a fleet.

If you are NOT registered with the KCC we must have a CERTIFICATE OF INSURANCE or a copy of your current insurance card.

PROPERTY TAX

Vehicles of a fleet shall be currently assessed for property taxes or the property taxes paid for the preceding calendar year.

INTERSTATE FOR HIRE CARRIER shall be subject for the assessment by and payment of ad valorem or property taxes to the Division of Property Valuation, Kansas Department of Revenue.

PRIVATE CARRIERS or CARRIERS WHO HOLD NO KCC AUTHORITY will be subject to assessment of personal property tax by the County. The County in which the fleet vehicles have a tax base is the County where the taxes are to be paid. Private carriers and carriers who hold no KCC authority will be required to show proof of personal property tax payment each renewal registration year.

Owner-Operators will be required to show evidence of payment of personal property tax when they establish their registrant account and at each renewal registration year. If the Owner-Operator is not leased onto an Interstate For Hire Carrier the Owner-Operator shall be subject to assessment of personal property tax by their Local County Appraiser's Office. When the Owner-Operator is leased onto an Interstate For Hire Carrier, it the Owner- Operator’s responsibility to obtain a copy of the personal property tax assessed rendition form from the lessee. If the Owner-Operator cannot provide this form he shall be subject to assessment of personal property tax by the County.

Motor vehicles acquired, purchased, traded or sold after January 1 and prior to September 1 will need to show proof of personal property tax paid.

Trailers are classified as commercial and industrial machinery and equipment and as such are to be valued annually as of January 1, of each taxing year.

SALES TAX

Sales tax is required upon the purchase of a fleet vehicle, unless the carrier is exempt from sales tax. (See KCC Authority Types to determine Sales Tax Exemption).

If the purchaser of a vehicle obtains a lease from a registrant with ICCR or ICCE Authority (issued by KCC), the lessee may make application for a retailer's sales tax registration number, or business tax number to apply for sales tax exemption. When a business tax number is issued to the name printed on the sales tax application form that individual, partnership, or corporate name would be exempt from paying sales tax.

Please refer to Sales Tax Requirements section for additional procedural information.

HEAVY VEHICLE USE TAX

A registrant of any vehicle that is to be registered for a gross weight of 55,000 lbs. or more must show proof of payment of the Federal Heavy Vehicle Use Tax (HVUT) as required by the Internal Revenue Service (IRS). The proof of payment requirement is imposed by the Internal Revenue Service regulations. The Motor Carrier Services Bureau in Topeka does not have the authority to change these requirements.

Use Form 2290 to figure and pay the tax due. This form may also be used to claim suspension from the tax when the vehicles will be used on public highways 5,000 miles or less. You must show proof of payment of this tax to register your vehicle in any state. Use the Schedule 1 for this purpose.

If you do not have a Federal Identification Number you will need to complete a Form SS-4, Application for Employer Identification Number.

WHO MUST FILE? You must file Form 2290 and Schedule 1, if a taxable highway motor vehicle is registered, or required to be registered in your name at the time of it’s first taxable use or when you claim suspension. You must also file a return when the taxable gross weight of a vehicle increases over 54,000 lbs. during the tax period.

If the person liable for the tax at the time of the first taxable use paid the tax and later sold the vehicle, the new registrant does not have to pay the tax for the same tax period. However, if the former registrant did not pay the tax, the new registrant is liable for the total tax for the entire taxable period.

HUVT PROOF OF PAYMENT

NEW OR USED VEHICLE PURCHASED. If a vehicle is registered within 60 days of purchase, the "bill of sale" may be used as proof of payment in lieu of a Form 2290. If a used vehicle is being registered past the 60-day period, a copy of the previous registrants paid Schedule 1, form 2290 must be presented as proof.

Returns with payment are sent to the Internal Revenue Service, P.O. Box 105421, Atlanta, GA 30348-5421.

You can order forms, publications & automated information 24 hours a day, 7 days a week by calling 1-800-TAX-FORM (1-800-829-3676). You should receive your order within 10 days OR visit the IRS Website: http://www.irs.gov/ and type 2290 for the form number.

The IRS will return to you a stamped receipt of your Schedule 1, form 2290. The vehicle identification number must be shown on the Schedule 1.

WHEN YOU HAVE NOT RECEIVED YOUR 2290 RECEIPT: A photocopy of form 2290 that has not been validated by IRS can be accepted as proof IF you also provide a photocopy of both sides of the canceled check.

PAYMENT OF THE HVUT AT MCSB OFFICE: If your heavy vehicle use tax has not been paid you may send us your check (must be made out to the Treasury Department) along with a stamped envelope (addressed to the IRS) and the 2290 form. This will enable us to verify payment and then we can forward the payment on to the IRS for you. Your renewal application will be processed without the HVUT but plates and cab cards will not be issued until proof of payment has been established.

HOW TO MAKE CHANGES

After the Original Application has been submitted the Schedule C (MCS-66) is used to make most registration changes.

December - March 1

December through March 1 is considered the renewal season. Preprinted renewals must be requested each year if you cannot complete the renewal On-line at our Website.

If a vehicle is purchased after December 15 and before January 1 but will not be used before January 1, the vehicle may be registered at the unladen weight for December and the declared combined gross weight effective January 1.

SCHEDULE C

ADDITIONS via Schedule C

Complete the header information using the same information as listed on your original application. For the vehicle being added to your fleet for the first time, complete columns 2 through 16. If the added vehicle has a weight variance write the jurisdiction and weight desired for each jurisdiction in the header.

TRANSFERS via Schedule C

Registration fees for power units may be trans-ferred only if the deleted vehicle was disposed of by cancellation or expiration of a lease agreement, sold by the applicant, obtained non-highway title, repossessed, or foreclosed on or before the date the added vehicle was in the possession of the registrant. The registration plate and cab card must be returned to Motor Carrier Services Bureau. A Kansas transfer fee of $5 is required. Please do not send money prior to receiving a billing. Not all jurisdictions allow fee transfers. Several jurisdictions will

charge fees on transfers for other reasons, i.e., model, year, unladen weight, and type of vehicle.

Complete the header information using the same information as listed on your original application. For the vehicle being deleted from your fleet, complete columns 1 through 10 under DELETIONS and column 1 through 16 under ADDITIONS for the vehicle being added to transfer the fees.

DELETIONS via Schedule C

License plates may be made inactive by completing just the Deletions portion of the Schedule C. The permanent plate and cab card must be returned to Motor Carrier Services Bureau and you may then transfer fees when ready to add a new vehicle to your fleet. A deletion does not release the Registrant from the obligation to pay the quarterly fees.

SCHEDULE C

REQUIRED DOCUMENTATION

If a new title is to be issued, an assignment has been made on the back of the title, see Title Requirements. When the title name is correct on the face of the title the documentation to be included:

Proof of ownership (a copy of the title front and back).

A copy of the paid receipt from the IRS, Form 2290, heavy vehicle use tax. (A new or used vehicle may be registered within 60 days of purchase without the paid receipt, if you provide a copy of the bill of sale).

Sales tax receipt, sale tax number, completed business tax application, or sales tax payment must be satisfied when applicable.

Accounts in good standing may fax the documents for processing.

If all required documents are faxed and if there is no title work to be completed:

♦ MCSB can issue a 30-day temporary registration. No-Title work to be completed means that it is a clear title with the individual or carrier’s name printed on the face of it and there is no new assignment on the back of it.

♦ If a 30-day temporary registration is issued, any requested documents and the Supplement Billing Invoice payment must be received by MCSB and the registrant must receive the credentials before the 30-day temporary registration expires.

If all required documents are faxed and if there is title work to be completed:

♦ The MCSB may issue a 10-day temporary registration. Title work to be completed means the face of the title is not in the individual or carrier’s name and there is a new title assignment on the back of the title. The title that is to be completed and any other required documents must be received by MCSB before the 10-day registration expires.

♦ Receipt of these documents allows MCSB to extend the temporary registration 20 more days (maximum 30-day temporary permit).

♦ Failure to provide the required documentation before the 10-day registration expires will result in the issuance of a letter Warning of Suspension of the Fleet.

It is the Registrant’s responsibility to identify documents that are being provided by mail to complete a Schedule C that has been processed by fax in order to avoid duplicate billings on the account.

If a temporary registration is issued, all of the required documentation must be provided and the billing invoice must be paid within the grace period, or a letter of Warning of Suspension of the Fleet will be issued. Failure to satisfy the Warning of Suspension of the Fleet will result in the issuance of Suspension of the Fleet and all the vehicles on the fleet shall not operate.

A 30-day temporary registration may only be extended if the delay in issuing the credentials was the fault of the MCSB

DO NOT USE A SCHEDULE C to raise your Kansas weight.

To increase your Kansas weight identify the vehicle by your IRP account number, the VIN, give current registered weight, license plate number, and weight increase on company letterhead. Please sign and date. We will accept a fax or a faxed copy of your cab card with indicated changes. Payment of HVUT must be made if the new weight is for over 54,000 lbs. and the tax has not been previously paid on this vehicle. In addition to the cost of the weight increase there is a $1 cab card fee.

There is no registration fee refund or credit allowed decreasing a weight.

WEIGHT VARIANCES A SCHEDULE C FORM MAY BE USED

For example, if your vehicle is registered at 85,500 lbs. in Kansas the equivalent weight for Oklahoma is 86,000. You can register for 90,000 lbs. in Oklahoma by recording {OK 90,000} in one of the boxes for a weight vari-ance. See the Maximum Allowable Weight chart.

In addition to the added weight fee, a replacement fee of $1 shall be charged for the issuance of a Kansas cab card reflecting the new registered weights.

A 30-day temporary may be faxed upon request. If a temporary registration is issued, the billing invoice must be paid within the 30day grace period, or a warning of Suspension of the Fleet will be issued. Failure to satisfy the Warning of Suspension of the Fleet will result in issuance of Suspension of the Fleet and all vehicles on the fleet shall not operate.

LATEST PRICE: The actual purchase prices of the vehicle excluding trade-in and sales tax. 12. FACTORY PRICE: The manufacturer's retail price. 13. NAME OF OWNER: Enter the name as shown on the title. If vehicle is leased, show lessor. 14. DATE OF LEASE: If subject to a lease (30 days or more) show effective date, e.g. 7/31/93. 15. DECLARED COMBINED GROSS WEIGHT: truck including the driver and full fuel tanks plus weight of

trailers plus the maximum payload or cargo to be carried on the trailers. 16. SALES TAX NUMBER: Issued by the Business Tax Bureau, Kansas Department of Revenue.

Adding A Jurisdiction If a Kansas based registrant finds that there will be operation in an additional IRP jurisdiction after the initial application, or renewal application is filed, the registrant shall complete form MCS-71, Certification for an Added Jurisdiction.

The Certification for an Added Jurisdiction can be faxed to our office. A 30-day temporary registration can be faxed upon request. If a temporary registration is issued, the billing must be paid within a 30-day period or a warning of suspension of the fleet will be sent out.

The estimated miles are determined for the entire calendar year for which registration is being sought.

The registration fees are calculated on the computer and a billing notice shall be provided. Upon payment, a new Cab Card will be issued listing the new jurisdiction(s) for all vehicles on the fleet. In addition to the registration fees for each jurisdiction added, a cab card fee of $1 for each vehicle will be included in the billing notice. (FORM ON FOLLOWING PAGE)

APPLICATION FOR KANSAS TITLE The Motor Carrier Services Bureau can ONLY process titles on vehicles that have apportioned registration. Title processing cost is $10.00. There is a $2.00 title penalty fee for titles submitted for processing 31 days or more after the date of the assignment on the title. E-Titles The 2002 Kansas Legislature authorized titles with a security interest to be issued in electronic format effective January 1, 2003. Please note that the MCSB has an E-Title format that is different from the one issued by the County. Refer to the application for Kansas title section for sample. The Kansas State Seal watermark was added in 2004 to the Electronic Titles, or E-Titles.

• Only titles without lien holders will be issued a title certificate. An Electronic Title Receipt or E-Title Receipt will be issued when the title has a lien holder.

General Titling Information As of January 1, 2003 paper titles are not issued on vehicles with a lien. The title record in held electronically. A Kansas Electronic Title Receipt will be sent to the owner and this is to be kept in the place of the title. The lien holder will be sent a copy of the application to hold as proof of lien. Titles without lien will be issued a paper title and mailed to the owner, unless instructed differently.

MVE-1 All out of state vehicles are required to have an inspection of the vehicle identification number done by the Highway Patrol or their designee. The pink copy of the inspection form MVE-1, Kansas Highway Patrol Vehicle Examination Certificate, provided by the Highway Patrol, is to be submitted with the application for title. If the vehicle is temporarily out of state, working on a short term basis, and needs an inspection refer to form MC-65, VIN Verification Procedures for the State of Kansas, for instructions to have an out of state inspection done. Title Applications The application form MCS-63, Application for Title-Apportioned Registration, or MCS-720B, Kansas Manual Application for Duplicate, Secured, or Reissue Title, must be completely filled out and returned along with all the other documents necessary for obtaining a title. The name on the application must reflect the name on the assignment area of the title. If the assignment is incorrect, an affidavit of correction must be submitted to change the name on the assignment. An MCS-12, Affidavit to a Fact, may be used. If a lien is involved, lien holder consent will be required to make the name change. An MCS-128, Lien holder’s Consent to Transfer Vehicle Ownership, may be used.

Assignments of Ownership To transfer ownership on a paper title or Manufacturer’s Statement of Origin, the assignment must be completely filled out. On trucks the empty weight of the vehicle and the mileage at the time of sale is needed to process the title record. A bill of sale is required, if there is not a space on the assignment for the purchase date or sale price.

Liens Kansas’s law requires that all lien consents and all lien releases for Kansas Titles to be notarized. If a lien release is from a seller or a lien holder in Kansas, regardless of what state the title is from, the lien release must be notarized.

A notarized lien holder release for any liens shown on the face of the assigned title for the seller must be provided. Lien holder consents to transfer are required to be notarized. Forms and fees for Notice of Security Interest must be mailed to Titles and Registration, 915 SW Harrison, Topeka, KS, 66626.

Verification If the Kansas Electronic Title Receipt is lost you will need to mail a properly completed TR/DL-302 form with your check for $6.00 to obtain a verification of title.

Title Only/Special Title A Kansas resident leased to an out of state carrier when the lessor is purchasing the plates must submit the following documents to apply for a Kansas title. 1. A current copy of the lease agreement with a

carrier with ICC authority. The lease must identify the lessor and lessee and the vehicle year, make, and VIN number must be included. Provide the lessor’s ICC Number, or ST-28J Interstate Common Carrier Exemption Certificate.

2. A properly completed and signed Title Application Form ( MCS-63).

3. Payment of the $10.00 title payment fee if the application is received within 30 days of assignment date. If the application is received late and additional $2.00 penalty fee will be due. Payment should be submitted with the application in the form of a check or money order and made to the order of KDOR.

4. Proof of sales tax payment, or provide the current business tax number of the new owner, or submit a properly completed Kansas Business Tax Application (CR-16) to request exemption from sales tax. The application for a business tax number must

be received by MCSB within 30 days from the date the vehicle was purchased.

5. A properly assigned title or Manufacturer’s Statement of Origin (MSO).

Name Change Only

When the ownership of a vehicle is changing, but the vehicle will remain on the same Kansas IRP account, the following documents must be submitted before a new title can be issued. 1. A properly assigned title or manufacturer’s

statement of origin (MSO). 2. A cover sheet stating the vehicle is to remain

on the account and include the IRP account number.

3. A copy of the current cab card. 4. Payment of the $10.00 title fee if the

application is received within 30 days of assignment date. If the application is received late and additional $2.00 penalty fee will be due. Payment should be submitted with the application in the form of a check or money order and made to the order of KDOR.

5. Title application MCS-63 properly completed and signed.

6. Proof of sales tax paid or submit the business tax number of the new owner. If application needs to be made for a business tax number, complete form CR-16, Kansas Business Tax Application, and submit with the application. You will also need to provide a current copy of the lease agreement with a carrier with ICC authority. Proof of sales tax paid, or submit the business tax number of the new owner, or you may apply for exemption from sales tax by submitting a completed form CR-16, Kansas Business Tax Application (to apply for a business tax number). Enclose the CR-16 and a current lease agreement with a copy of the lessor’s ST-28J, Interstate Common Carrier Exemption Certificate. The copy of the lease agreement must identify the lessor and lessee and the vehicle year, make, and VIN number. The application for a business tax number must be received by MCSB within 30 days from the date the vehicle was purchased.

Documents may be faxed to get a temporary permit. The original documents will need to be mailed in and fees paid before the permanent credentials will be mailed. To avoid duplicate processing please indicate on the original documents that the records were faxed earlier. If a new title is not needed, refer to Registration Requirements/Title section.

Duplicate Title

In the event a paper title is lost, application can be made for a duplicate title, provided there is no lien showing, by submitting MCS-720 B and the $10.00 fee. If the lien has been satisfied, a lien release will need to be submitted with the application. No change of ownership can be made on a duplicate title application.

Secured Title Record

A secured title record is generated when a previously issued Kansas Title or Electronic Title Record is having a new lien holder entered. At present no electronic title receipt is generated on this transaction. Title application form MCS-720B must be completed and submitted with a $10.00 fee along with the previous Kansas title or Kansas Electronic Title Receipt. A notarized lien release must be provided for any previous lien(s). No change of ownership can be made on a secured title application.

Reissue Title A reissue title is a title issued free of lien. On electronic title records, the notarized lien release may be mailed or faxed to MCSB to have the title issued. There is no additional title fee, as the fee was paid when the electronic title record was generated.

On paper titles with a lien, form TR-720 B must be completed, submitted with a $10.00 fee, the paper title and the notarized lien release(s). No change of ownership can be made on a reissue title application. It is not required by statute to have a reissue title done on those vehicles with paper titles. However, it is advisable, as in the event the title and release would be lost a second release would need to be acquired from the lender. The second release can be difficult to acquire in some cases due to bank mergers.

Selling/Buying Vehicles with Electronic Title If a lien release can not be acquired prior to the sale to obtain a paper title, the seller should provide the buyer with the Kansas Electronic Lien Receipt showing the lien holder’s information. In the event that the seller does not have their Kansas Electronic Lien Receipt, a verification of title will need to be acquired by completing form TR/DL-302. The seller and buyer should complete an MCS-39a, Electronic Title Sales Agreement. The buyer may present the owner/sellers Kansas Electronic Title Receipt or verification with the completed MCS-39a along with other qualifying documents to acquire a temporary permit. The owner/seller must secure a lien release and provide a clear title to the buyer within 30 days to complete the buyer’s application for title and/or registration. An MCS-40 Power of Attorney and Odometer Disclosure for Electronic Title can be given to the buyer to allow the buyer to re-assign the title on behalf of the seller. The buyer must be an individual or business that is not a licensed dealer to use this form.

Notice of Security Interests (NOSI)

NOSI can not be processed by Motor Carrier Services Bureau. Notice of Security Interests filed by the lien holder to perfect their lien must be sent to the Titles and Registrations Bureau at 915 SW Harrison, Topeka, KS, 66626 along with the $2.50 fee.

SALES TAX REQUIREMENTS

8-153. PROOF OF PAYMENT OF SALES TAX REQUIRED. No certificate of registration or ownership of any motor vehicle or trailer shall hereafter be issued by the county treasurer of any county of this state or the division of vehicles, unless and until the applicant for such certificate shall produce evidence satisfactory to the county treasurer or division that the state sales tax, or, in the event the said motor vehicle was purchased outside this state, the tax provided for by the provisions of K.S.A. 79- 3701 to 79-3711, and acts amendatory thereto, has been paid by said applicant, or that said motor vehicle is exempt from the payment thereof: Provided, That no certificate of registration or ownership shall be issued for a vehicle, which was last titled or titled and registered in a foreign state or registered only if such foreign state has no title law, until satisfactory proof, by affidavit of the applicant has been made, that sales tax on such vehicle has been paid in a foreign state or compensating tax has been paid in Kansas, except in such instances where the applicant for registration or title shall prove by affidavit, that he or she was a bona fide resident of such foreign state at the time of the registration. (effective 5-1-55) Sales tax payment may be satisfied by providing:

• A copy of the Bill of Sale and Sales Tax Payment Receipt,

If a lease is obtained from a registrant with interstate common authority, the purchaser may provide a copy of their current Kansas Retailer’s tax registration number, a copy of the current lease agreement, and a copy of

the lessor’s ST-28J Interstate Common Carrier Exemption Certificate,

The purchaser may make application for a retailer's sales tax registration number by completing the Kansas Business Tax Application.

The purchaser may apply for a retailer’s sales tax registration number as follows:

agreement. The lease must identify the lessor and lessee and the vehicle year, make, and VIN number.

♦ The lease agreement, the vehicle title, and

the sales tax application form must have exactly the same individual, partnership or corporate name.

♦ Provide a copy of the lessor’s ST-28J

Interstate Common Carrier Exemption Certificate, or the Kansas IRP registrant’s ICC Number.

♦ The vehicle must be used in interstate

commerce. ♦ Carriers who have obtained a retailer’s sales

tax registration number are required to complete an annual filing with the Kansas Department of Revenue (KDOR) in order to maintain their sales tax exemption status. The annual filing with KDOR is due January 25 beginning the following year.

The MCSB office will accept the required documentation to process your application for sales tax exemption or we can compute and collect the sale tax owed. If the MCSB initiates the sales tax collection process, please complete the process with only our office. • If the vehicle was not purchased in Kansas,

the amount of the sales tax percentage of your county, city, and place of residence (if applicable) will be multiplied by the purchase price of the vehicle. A separate check for the amount of the sales tax is preferred and should be made out to the KS Department of Revenue.

VIN Verification Procedures for Vehicles outside The State of Kansas

REQUIREMENT OF KANSAS LAW Kansas law requires that before an application for a Kansas title and/or registration can be accepted for a vehicle or trailer that has been titled in another jurisdiction, the vehicle and the out-of-state title or ownership document must be inspected to ensure that the vehicle identification number shown on the foreign title is genuine and agrees with the identification number on the vehicle or trailer. These procedures allow out-of-state inspections in lieu of a Kansas inspection and issuance of an MVE-1 form when the owner and the vehicle or trailer is out-of-state.

WHO QUALIFIES FOR THESE PROCEDURES To qualify for using an out-of-state inspection in lieu of the MVE-1 a persons must meet one of the following reasons:

1. A Kansas resident who is on active military duty stationed out-of-state. 2. A Kansas resident who is attending an out-of-state college or school. 3. A Kansas resident who is temporarily out-of-state, i.e. working on a short-term basis. 4. Any out-of-state title application for Kansas apportioned registration that requires a VIN inspection

(MVE-1) and the vehicle is not in Kansas.

REQUIREMENTS

To comply with Kansas law, K.S.A. 8-116a, one of the following two Options must be met prior to making application for title and/or registration in the state of Kansas. Option #1 – State has VIN Verification/Inspection Program 1. In states that have a VIN verification (inspection) programs similar to Kansas, you may have your vehicle

inspected and documented on an that state’s VIN verification form, completed in its entirety. You should contact the State Patrol or the motor vehicle office in that state to determine the time of operation and location of the inspection sites.

2. The examiner should examine the out-of-state title document for authenticity. The title must be free of erasures, whiteout, or altered data.. (A faxed copy of the front and back of the title from the lien holder will be accepted.)

3. The examiner should examine and record the public vehicle identification number as it appears on the vehicle or trailer onto the out-of-state inspection form.

4. The examiner should compare the public vehicle identification number on the vehicle to the VIN number on the title document.

Option #2 – State Does Not Have VIN Verification/Inspection Program

1. In states that do not have a VIN verification program similar to Kansas, you may have the VIN verification completed in the following manner.

2. The VIN verification inspection must be performed by a law enforcement official, and recorded on that law enforcement agency’s letterhead. The following information must be provided: A) Date of Inspection B) Vehicle Identification Number C) Year and Make of Vehicle D) Odometer Mileage (If odometer discrepancy, please explain in detail) E) Owners name and complete address F) Title State and Title Number G) Signature of officer performing the inspection H) Officer's department and badge number

3. The law enforcement officer should examine the out-of-state title for authenticity. The out-of-state title must be free of erasures, whiteout, or altered data. (A faxed copy of the front and back of the title from the lien holder will be accepted.)

4. The law enforcement official must compare the public identification number on the vehicle to the VIN number on the title document. 5. Military: VIN verification inspections performed for military personnel may be conducted on a

military installation by a military police officer. Item #3 (above) must be documented on official military police letterhead or document.

POSSIBLE ADDITIONAL REQUIREMENTS

If during the VIN verification procedure, a discrepancy is determined with either the vehicle identification number or the title document further documentation may be required by the State of Kansas. In both options 1 and 2, the examiner or law enforcement officer's signature will certify that he or she has physically examined the vehicle and title described on the form or letter and the information is true and correct to the best of his or her knowledge, and verify that no stolen record was found in the Federal States vehicle files (NCIC). There will be no fee collected for the State of Kansas for out-of-state inspections documented on out-of-state forms or out-of-state letters. APPORTIONED BILLING STATEMENTS

COMPUTATION OF FEES

Fees are calculated on the gross weight or combined gross weight of the power unit. To calculate the registration fee divide the in-jurisdiction miles by the total fleet miles traveled. Take this percentage times the full fee for that jurisdiction. For example:

Total fleet miles 100,000 and Kansas’s miles 10,000 = 10%. The full year registration fee for 80,000 pounds in Kansas is $1,735.00 X’s 10% = $173.50.

This procedure is applied to each jurisdiction in which you travel. Each jurisdiction's full fees are based on different criteria.

BILLING STATEMENTS

Do not send money in with an application. Billing statements are issued after processing new and renewal applications. Credentials will not be issued until payment is received. The billing statement is a one-page document with the total amount due in the bottom right-hand portion. Some carriers request an optional billing page that identifies each vehicle with a breakdown of cost per vehicle. Do not pay from the optional billing page or send money prior to billing.

RENEWAL FEES DUE JANUARY 1 Fees due January 1 payable on or before March 1 -- Credentials are not issued until payment and the required documentation has been received. If you are paying by mail, allow 10 days for our office to receive the payment, issue the credentials and mail them to you. Enforcement begins March 2.

Billing statements are also issued for Schedule C’s. These fees are due upon receipt of billing. Delinquent payments may cause your entire fleet to be suspended until payment is received if a temporary is issued.

PENALTY FEES Any returned check for insufficient funds or stopped payment will be charged a $10 penalty and your fleet is suspended. If not paid within ten days of notification from the Motor Carrier Services Bureau, a lien will be filed. There is a title penalty of $2 when application for a title has not been made within 30 days of the date a title or Manufacturer’s Statement of Origin was assigned. Delinquent registration penalty is $2 for each vehicle that should have been registered prior to March 1 of a registration year. The total delinquent penalty fee is not to exceed $100 for each fleet application. An audit can result in a penalty fee equal to 5% of any additional fees found due and owing. Delinquent quarterly payments are assessed 10% of the original total annual dollar amount due Kansas. The privilege of paying quarterly installments is voided if any payment is delinquent. Full fees are due on or before March 1 each year unless you have been granted quarterly payments of Kansas’s fees. If payments are not received before the due date, full Kansas’s fees for the remaining quarters plus a 10% penalty is due. Once delinquent, quarterly payments will not be allowed for a two-year period.

QUARTERLY PAYMENTS A Kansas based registrant in good standing has the option to pay the annual Kansas fleet apportioned registration fee on a quarterly basis. Registrants who elect to pay registration fees on the quarterly payment basis are issued new cab cards after payment of each quarter. • The payment of the Kansas annual apportioned

registration fee on a quarterly basis applies only to the fee applicable to Kansas and only on a new account, renewal application, or supplemental application which adds vehicles before Mar 1 if payment is received.

• The amount of the Kansas annual fee shall

exceed $300. • The quarterly payment basis relates only to an

alternate method of payment of the Kansas annual fleet apportioned registration fee.

• The first quarterly payment of the Kansas annual

apportioned registration fee, including Kansas issuance fees, title fees and any supporting documents for registration plus all apportioned registration fees due other IRP jurisdictions, shall be received on or before March 1 of a registration year.

Failure to provide the foregoing requirements on or before March 1 of a registration year shall result in the applicant being required to pay the Kansas annual fleet apportioned registration fee in full, including any registration penalties. The remaining Kansas annual fleet apportioned registration quarterly payments are due and payable on or before:

Second quarter due April 1

Third quarter due July 1

Fourth quarter due October 1

It shall be unlawful to operate the fleet vehicles when payment is delinquent. If a fleet is detained because of a delinquent quarterly installment, authorization for operation cannot be allowed until proper payment has been made and clearance provided. No temporary wires are issued for a registrant who registration has expired. A billing notice is provided 20 to 30 days prior to due date. Failure of a fleet owner to receive a billing notice shall not waive or excuse the fleet owner from the payment. Nonpayment of Quarterly fees When a fleet owner is delinquent past the due date, a Notice of Lien shall be filed with the Register of Deeds of the county in which the fleet is based. A copy of the Notice of Lien shall be provided the fleet owner showing the amount due. The amount due covers the delinquent quarterly payment, any remaining quarterly payments, and a penalty in the sum of ten percent of the original Kansas total fleet annual apportioned registration fees. A stop title is filed with the Titles and Registrations Bureau and the title cannot be issued to a new owner until the lien has been satisfied. After a Register of Deeds has recorded a Notice of Lien, a Tax Warrant shall be issued to the Sheriff of that county. The Sheriff shall seize and hold all property subject to the lien and advertise and sell the property or an amount of the property to satisfy the state's lien. When a registrant is delinquent more than ten days beyond the due date of any quarterly payment, such registrant is denied the option to pay the annual Kansas apportioned registration fee in quarterly payments for the next two registration years.

REFUNDS - CREDITS - ABATEMENTS

Kansas Statutes provide for the refund of Kansas apportioned registration fees IF the vehicle has been sold, repossessed, fore-closed by mechanic's lien, title transferred by operation of law, or the owner is deceased, and the deleted Vehicle is not going to be replaced by another vehicle. If the title owner name and the Registrant account name are different, the vehicle is considered a leased vehicle. A leased vehicle may qualify for a refund when the vehicle is sold and a copy of the bill of sale is provided.

REFUNDS SHALL NOT APPLY UNDER THE FOLLOWING CONDITIONS:

• Cancellation or expiration of a lease agreement or the motor vehicle was removed from the state.

• The amount of the refund must exceed $50 for a check to be issued. When the refund amount is less than the $50 limit, credit will be applied to the carrier’s IRP account.

• If the owner is delinquent in the payment of an apportioned quarterly payment.

• If the application for refund is not accompanied by supporting information or required documents (current cab card and license plate assigned, bill of sale, etc.).

The amount of refund shall be determined utilizing the month following the receipt of the application and all supporting documents required to process a refund. Refunds of partial months are not possible. For example, if all of the following items were provided in January, the refund would be based on fees in February. Please submit the following items together in order to receive the maximum refund:

A copy of the Bill of Sale.

Return the Apportioned license plate.

Return the Cab card

Provide a properly completed, signed, and notarized refund application form. MCS-105 form.

The carrier will need to submit an properly completed and signed MCS-105 form to the MCSB in order to stop the accrual of any quarterly payments after the sale of a vehicle that cannot transfer registration, or abatement of fees. You will need to include a copy of the bill of sale and return the license tag and apportioned registration cab card.

Complete this application and return with the Cab Card(s) and the License Plate(s), copy of the bill of sale document(s) and any other supporting documents outlined in these instructions, to the address shown on the reverse side. To qualify for a refund and/or cancellation of fees the motor vehicle(s) must have been sold (this includes sold vehicles leased to your apportioned registration account), junked, repossessed, foreclosed by mechanic's lien, title transferred by operation of law or the owner is deceased. The cancellation or expiration of a lease agreement, the removal of a motor vehicle from service or from the state of Kansas is not a basis for refund. Refunds less than $50.00 will be applied as credit on the registrant’s IRP account and will be available only for the annual registration interval the refund was applied. Kansas will refund only the applicable unused registration fees paid to Kansas. You must contact each jurisdiction listed on your cab card to determine if they allow refunding of fees sent to them. The amount of refund is determined from the next Kansas fee reduction date after receipt of a completed refund application (including the Cab Card, the License Plate and any required supporting documents). The Kansas fee is multiplied by the current Kansas mileage percentage. If payment of the annual Kansas Proportional Fleet Registration fee is on a quarterly payment basis, a refund application must be filed to stop the accrual of any quarterly payment(s). The fleet owner shall pay any delinquent quarterly installment(s), including penalty, to stop the accrual of any fleet quarterly installment(s) if delinquent at the time refund application is made. A REFUND REQUEST MAY BE MADE FOR ONE OF THE FOLLOWING REASONS: SOLD The vehicle has been sold outright without trade or replacement. If a vehicle

is junked (wrecked beyond repair) or is sold to an insurance company you must provide the Motor Carrier Services Bureau with a signed notarized affidavit which indicates the selling of the vehicle, giving the name and address of the licensed salvage dealer or licensed scrap processor for the pur-pose of recycling, showing the date such vehicle was junked. KSA 8-1,136 effective July 1, 1991.

REPOSSESSED If a vehicle was repossessed and is not being replaced, a notarized

repossession affidavit stating the date of repossession, description of vehicle by year, make and identification number shall accompany the refund application.

FORECLOSED If a vehicle was foreclosed by a mechanic's lien, and is not being

replaced, provide a sworn statement (signed, dated and notarized) stating date of foreclosure, name of garage, a description of the vehicle foreclosed, by year, make and identification number, and the amount of the mechanic's lien owed.

TRANSFERRED If the ownership of a vehicle was transferred by court order, a BY LAW certified copy of the court order shall be provided. DECEASED If the owner has died and the estate is being probated, Letters of

TEMPORARY REGISTRATION ISSUED BY

MCSB When immediate operation of fleet additions is essential, two procedures are available to speed vehicle identification and operation on established Kansas apportioned accounts in good standing.

Request for temporary registration shall be either a written request signed by the registrant or an officer of such fleet or a telephone request by an authorized officer of the registrant.

If a temporary registration is issued, all required documents to complete the registration process and the billing must be paid within a 30-day grace period or a Warning of Suspension of the Fleet will be sent out.

Temporary registration for 30 days may be requested when: • The additional, or replacement

vehicle is eligible for apportioned registration.

• A completed Schedule C apportioned application is provided for processing which includes all the required supporting documentation to satisfy the registration and title requirements.

Temporary registration for 30 days may also be requested when: • A cab card and/or apportioned

license plate has been lost.

• The registrant raises the combined gross weight of a truck, truck tractor or bus.

• Addition of a new IRP jurisdiction.

• This office has erred in the issuance of apportioned registration.

When a 30-day temporary registration has been issued, our office will provide, to the requestor by fax or e-mail address, a document recording the issuance of the 30-day temporary registration.

INTERNET REGISTRATION & 30-DAY TEMPORARY

REGISTRATION RECORD

A carrier may register vehicles on-line to immediately process additions to your fleet if your Kansas IRP account is in good standing. You must first establish an escrow account with the MCSB Central Permit Section and fill out a subscription with Accesskansas/Information Network of Kansas (INK). Once your on-line account is established you may register vehicles and print off a 30-day temporary IRP registration record. To obtain application forms and then to issue permits go to http://www.truckingks.org

These forms are also included in the front of this book.

Once a vehicle is registered the payment must be made and the required documentation must be provided.

You must submit the documentation to MCSB in a timely manner to allow for any needed corrections to your invoice rebilling and allow you time to pay any additional fees owed. You must place your credentials in each unit you register on-line within the 30 days temporary registration interval.

• You can also receive a temporary IRP registration record to fax to your carrier if you need a replacement cab card. There is no MCSB charge, only a $1.00 transaction fee for INK processing. The replacement plate & cab card fee is $6.50 plus the $1.00 INK processing fee. These fees are automatically deducted from your Escrow account. A replacement cab card and/or plate will automatically be mailed to you after the temporary IRP registration record is issued and no further fees are due.

• Each temporary registration record shall be valid for 30 days from the date of issuance and shall not be renewable.

• A 30-day IRP temporary record cannot be used for correcting the identification of a vehicle. Fax or mail MCSB a copy of your title to correct Vehicle Identification number errors.

Failure to provide the necessary documentation and payment of the invoice within the 30-day temporary registration interval will result in issuance of warning letter of fleet suspension. The warning letter allows the carrier to resolve the outstanding matter within 10 days or the entire fleet is suspended and the all vehicles should cease to operated until a letter of reinstatement is provided by the MCSB office.

Expiration of 30-day Temporary Registration Record

When a temporary registration has expired and the registrant has failed to complete the registration requirements the following procedures shall apply:

• The registrant shall be notified by letter that if the registration is not completed within 10 days of that date, such registrant’s apportioned registration for the entire fleet shall be suspended.

• If the registrant has failed to complete registration within 10 days of the notice the registrant shall be suspended in Kansas and member IRP jurisdictions.

Upon completion of apportioned registration for the vehicle described in the expired temporary registration, the suspension shall be withdrawn and the registrant shall be provided with a Reinstatement Notice. The Reinstatement Notice shall be carried with the fleet vehicles pending notification to all parties (apportioned jurisdiction IRP members and enforcement).

Hunter’s Permit

The hunter's permit only allows the vehicle owner to operate his vehicle empty and only for the purpose of securing a new lease agreement under which proper registration may be obtained. To obtain a permit the applicant must complete a Kansas Temporary Hunter's Permit Application.

This permit is only valid for vehicles that were registered to a Kansas based carrier.

This application includes a release signed by the previous Kansas registrant, that the owner has surrendered all plates and cab cards. Required supporting documentation includes proof of ownership and a certificate of insurance is required. The fee is $26 and the permit is valid for 30 days.

REPLACEMENT CAB CARDS AND PLATES

If an apportioned cab card or license plate is lost, destroyed, stolen, or mutilated, a replacement may be issued upon receipt of a request.

Requests may be submitted by:

♦ Writing the Issuance Section in the Motor Carrier Services Bureau, OR

♦ Submitting your request on-line at www.truckingks.org

A carrier may process a request for the replacement of a lost apportioned cab card and or plate on-line if your Kansas IRP account is in good standing. You must first establish an escrow account with the MCSB Central Permit Section and fill out a subscription with Accesskansas/Information Network of Kansas (INK). Once your on-line account is established you process your request on-line and print off a new cab card. When a lost plate is involved the tag will be issued and mailed promptly from our office, usually the next business day. To obtain application forms and then to issue permits go to www.truckingks.org. Forms are included in the front of this book.

The request must include:

• Account Number.

• License plate number.

• Last five numbers of the identification number (VIN).

• Unit number.

• Name of authorized person making the request.

• Fax number if requesting a temporary registration.

A billing notice will be sent to the Registrant. The billing must be paid and the replacement on and/or in the vehicle within 30 days.

The charge is $3.00 per cab card or $6.50 for each new plate issued.

LEASING RULES Every apportioned fleet owner shall place with each leased vehicle an authentic copy of the lease or rental agreement or a memorandum of lease or rental and such agreement or memorandum shall contain the following:

• The complete and full names of the lessor and lessee.

• A description of the lease or rented vehicle by year, make, and identification number.

• The effective and expiration dates of the lease or rental agreement.

• The signatures of the lessee and lessor or their duly authorized agents.

• The agreement or memorandum of lease or rental shall be carried in the cab of the vehicle unless such vehicle is a trailer, and in that case, in the cab of the vehicle supplying the motive power.

If two registrants each have a fleet of vehicles with current Kansas’s registration and are conducting trailer interchange operations under federal regulations, no further registration is required in Kansas.

If an apportioned fleet registrant (based in Kansas or another IRP jurisdiction) leases or trip leases a truck or truck tractor that bears Kansas "regular" class of registration no further registration is required.

If the gross weight of a vehicle is greater than the gross weight registration, the registered owner or lessor of the vehicle shall make application for proper gross weight registration. This would be through the office of the County Treasurer in which such vehicle is based.

If an apportioned registrant (based in Kansas or another IRP jurisdiction) leases, or trip leases a truck or truck tractor that is fully registered, but is not apportioned in a jurisdiction other than Kansas, but meets the weight or axles eligibility for apportioned registration, the registrant then may purchase a 72-hour truck registration for $26, if the operation is of an interstate nature. If the operation is of an intrastate nature a 30-day truck registration may be purchased.

Household Good Carriers as applicable in ICC regulation, Section 165.2(b) (ex parte MC10) wherein the agent or service representative is the lessor and the carrier is the lessee shall file and register as dual applicants provided:

• Agent or service representative has a fleet of vehicles.

• If the agent or service representative does not operate sufficient vehicles to constitute a fleet, application for apportioned registration shall be filed solely in the name of the lessee carrier.

• The application for apportioned fleet registration shall be based upon the lessor's equipment and the total miles the lessor operates under his own authority and that of lessee

Lease shall mean a lease of 30 days or more.

If an apportioned fleet registrant, whether the registrant's fleet is based in Kansas or another jurisdiction, leases a vehicle for a period of more than 30 days and the vehicle has been apportioned in the name of another carrier, the apportioned registration shall be required in the name of the lessee carrier.

Trip Lease shall mean a short-term lease or rental of less than 30 days.

When an apportioned fleet registrant trip leases a truck or truck tractor for which the registration has been apportioned with Kansas from another apportioned registrant, whether such truck or truck tractor is based in Kansas or in a jurisdiction other than Kansas, no further registration is required, unless the truck is being operated with a combined gross weight greater than the registration of such vehicle.

When an apportioned fleet owner trip leases a motor vehicle to another fleet owner the miles operated under such trip lease shall be retained by the lessor apportioned fleet owner.

Rental equipment companies having fleets of motor vehicles for short term rentals (less than 30 days) and such motor vehicles operate interstate shall be required to secure apportioned registration provided:

• The rental equipment company maintains adequate records for completion of an apportioned application and/or audit.

• Daily rental equipment companies that do not maintain adequate records for completion of an apportioned application shall be required to fully license the motor vehicles if based in Kansas. If such vehicles are registered in a jurisdiction other than Kansas, they shall be subject to a 72-hour truck registration fee.

RECORDS FOR AN AUDIT The basis for determining the apportioned registration fee for a vehicle or fleet is by the percentage of in-jurisdiction miles to the total fleet miles operated multiplied by the registration fee(s) applicable in each apportioned jurisdiction. The in-jurisdiction miles and total fleet miles listed on an application are to be the actual miles operated by the motor vehicles of a fleet during the mileage reporting period. Such mileage records shall consist of: • The date a trip started and ended. • The origin and destination of each trip. • The route of travel (highways). • The mileage traveled in each jurisdiction for each trip. • The vehicle identification or unit number each trip. • The fleet number assigned. • The mileage accounted for shall include all loaded and

unloaded miles. • Odometer readings for each fleet motor vehicle by

monthly summary. A mileage summary by month for each motor vehicle should be maintained. This would facilitate any audit for apportioned purposes and would enable the fleet owner to have information available for any fuel audit or report. The mileage records upon which an apportioned application is based shall be subject to audit. A fleet owner who has filed an application for apportioned registration that has been accepted shall, upon demand, provide the mileage records upon which such application was based. During the normal business hours auditors may conduct an audit as to the accuracy of any computation, payments, assessments for deficiencies or allowance for credit, accuracy or availability of mileage records. If an audit is going to be conducted on the records of a registrant, Kansas shall provide the registrant with a notice by mail that an audit of their records shall be conducted in the near future. If the Kansas Registrant's records are not maintained at the business address indicated on the application, the registrant shall within two weeks of receiving notice notify the Audit Services Bureau, Division of Taxation where the records are maintained. If the mileage records are maintained in a jurisdiction other than Kansas, the registrant will be advised to make such records available at the Kansas business address. If such

records are not made available at the business address, the registrant may be assessed the costs of travel and per diem to conduct such audit. If any registrant fails to make records available to the Audit Services Bureau or fails to maintain records, from which such Registrant's true liability may be determined, the auditor may • Impose an arbitrary assessment of additional annual KS

registration fees And may direct the carrier: • To secure registration for future years in the office of the

County Treasurer. If moneys are due upon audit, the fleet owner shall have 20 days to make payment. The audit may be appealed to the Director of Vehicles for a hearing. To request a hearing, appeal in writing and list the reasons for the hearing and specific objections to the audit. If payment is not provided within 20 days of notice, the apportioned fleet registration of such registrant shall be suspended and a Notice of Lien shall be filed with the County in which the fleet is based. The Notice of Lien shall cover the vehicles of the fleet and all real or personal property of such registrant. Any sums found to be due and payable upon audit shall be subject to a penalty of five percent of such additional moneys. A Tax Warrant shall be issued to the Sheriff.

Retention of Records

Kansas statutes and the IRP require that any fleet owner whose application for apportioned registration has been accepted for a current registration year, shall preserve the records on which such application was based for three registration years (including the current registration year) and mileage reporting period or preceding year for such registration year. The fleet owner shall retain proof of apportioned registration in jurisdictions other than Kansas. Records would include the date registration was completed on a given vehicle or fleet, and the disposition of any vehicles removed from the fleet, plus copies of any canceled checks relating to apportioned registration fees. Mileage and other registration records that are required by statue and agreement to be preserved shall be retained in a place and condition that such records are dry, safe and in an orderly arrangement

AGREEMENT TO MAINTAIN RECORDSIN ACCORDANCE WITH THE

INTERNATIONAL REGISTRATION PLAN (IRP)

Under the provisions of Article XV Section 1500 of the International Registration Plan, each base jurisdiction (state)administrator may audit the supporting trip-mileage records of the registrants displaying apportion base plates fromtheir jurisdiction. To qualify for apportionment, a registrant must operate interstate and must maintain accuratemileage records of the trip movement of his apportioned vehicles.

All records in support of an application must be retained for a period of three years following the year for which theapplication is made. These records must be maintained on each individual vehicle from July 1 – June 30 for eachreporting period. A copy of the Department’s recommended Individual Vehicle Mileage Record (MCS-121) can befound in the Kansas Apportioned Registration Instruction booklet.

In recording the actual mileage of a vehicle, the carrier must record all trip movement (interstate and intrastate),including trip permit miles and loaded, empty, deadhead, and bob-tail miles. It is recommended that a monthly orquarterly recap by jurisdiction be maintained on all miles traveled. Computer printouts are acceptable if supportedby an Individual Vehicle Mileage Record. Additional records such as fuel receipts, disbursement logs, repairtickets, receiving contracts (one-way rental), vehicle titles, driver’s logs, dispatch logs or bills of lading should alsobe kept.

INDIVIDUAL VEHICLE MILEAGE RECORD (IVMR)

NOTICE TO CARRIERS

As a member of the International Registration Plan, the Base Jurisdiction is required to audit records to ascertain proper reporting and payment of fees. Operational records kept by the carrier should be for individual vehicle mileage in order to provide adequate mileage data for each apportioned vehicle. Examples of the individual vehicle mileage records (IVMR) are: Driver’s Logs (by vehicle, jurisdiction and date); Driver's Trip Sheets; Receiving Contracts (rental one-way); any other records that contain the required information. Computer printouts are acceptable if supported by IVMR. The vehicle mileage form should be completed for all the requested information. Use state maps, mileage chart, odometer readings or Household Goods mileage guide to determine number of miles operated by a vehicle on each trip. Deadhead miles from termination of previous trip to origin of next trip should be included. Mileage operated each day is to be carried on a source document that must contain: date, trip origin and destination, total trip miles, mileage by states, vehicle unit number, vehicle fleet number, vehicle license plate number. Maintain individual vehicle mileage records for the period of July 1 through June 30 of that fiscal year immediately preceding the commencement of the registration year for which proportional registration is being sought. Records should be preserved for six years following the date of application to apportion. A record should be maintained for each vehicle used in interstate operation. Vehicles operated solely within the Base Jurisdiction are not eligible for apportioned registration. The individual mileage record should be maintained at the central office of the carrier or where the apportionment records are kept. When a vehicle is transferred from one apportioned fleet to another, a new record should be prepared. The sample form is designed to show the continuous movement of the individual vehicle. Trips should be listed in chronological order. Any time lapses and unaccounted for movements must be explained in sufficient detail to satisfy the auditor that all mileage is properly recorded.

DIVISION OF PROPERTY VALUATION

The Property Valuation Division in the Department of Revenue is located in the Docking State Office Building, Topeka, KS 66612. Ad valorem 785-296-4510 or 785-296-2365 Anyone holding a haul-for-hire, common, exempt, contract, or ICC authority granted by the Kansas Corporation Commission on January 1 of any year must file a return (rendition). The purpose of the rendition is to comply with Kansas statutes which provide for assessment and taxation of over-the road motor vehicles and rolling equipment owned, operated, leased, or used by common, contract, or exempt motor carriers operating in or through Kansas. The Division of Property Valuation mails forms in February to all motor carriers holding authorities from the Kansas Corporation Commission on January 1 of the taxing year. Such mailings are made to the address of the carrier as listed with the KCC. If you do not receive forms by March 1, contact the Division of Property Valuation for assistance.

COUNTY PROPERTY VALUATION

There is a set of circumstances specified in the law that will allow the County to assess your equipment if they apply to your operation. Private carriers, Custom Harvesters and carriers that do not need authority are assessed at their County office. For purposes of required documentation for apportioned registration you must provide a paid receipt of taxes paid on vehicles assessed by your county.

The Motor Carrier Services Bureau provides each County with a listing of all vehicles that have apportioned registration and are private carriers, custom harvesters or carriers that have no authority.

KANSAS CORPORATION COMMISSION (KCC)

AUTHORITY TO DO BUSINESS IN KANSAS

Operating authority is issued through the Kansas Corporation Commission. Their offices are located at 1500 SW Arrowhead Rd., Topeka, KS 66604-4027. Telephone 785-271-3145. http://www.kcc.state.ks.us

The KCC regulates authority for the state of Kansas. All interstate regulated carriers are required to register authority and equipment as required by the Single State Insurance Registration Program of 1995.

The Motor Carrier Services Bureau strongly recommends that you contact the KCC before you establish an apportioned registration account. If you register your vehicle(s) first and are unable to obtain the necessary authorities, there is no basis for a refund of registration fees.

Every proposed entrant will file an application with the KCC and provide the required documents: (Liability and cargo insurance, financial information process agents and testimony). All KCC applicants granted intrastate common or contract carrier authority to transport the requested property, other than household goods, will be allowed to operate between all points and places in Kansas.

KCC will provide vehicle specific cards for each power unit registered with the Kansas Corporation Commission.

A single state registration receipt (RS-3 form) is issued to the Carrier for the number of trucks on the carrier’s fleet but is not vehicle specific.

The following information may help you determine your type of operation:

PRIVATE CARRIER: If you haul your own goods or for someone else, sold or to be sold and your business is not transportation for compensation. You must file proof of insurance with KCC.

COMMON CARRIER (For Hire): Receive compensation for hauling products or transporting passengers. On the basis of what you carry you may have to obtain federal hauling authority. You must file proof of insurance with the KCC.

CONTRACT CARRIER: If you wish to haul only for selected shippers, and not for the general public.

HOUSEHOLD GOODS CARRIER: Your type of operation is both For Hire carrier and Household Goods Carrier.

SALES TAX EXEMPTION

A Kansas sales tax exemption is granted to common carriers that operate as public utilities moving persons or tangible personal property for hire in interstate commerce. See K.S.A. 79-3606(f).

If a truck is leased to a fleet owner that meets the above requirements for exemption, the title owner of the vehicle may apply for a retailer’s sales tax number. This can be obtained by completing a Business Tax Application and providing a copy of the lease agreement.

KCC AUTHORITY TYPES The Kansas Corporation Commission issues cab cards to identify the granted authority. A carrier may have any combination of these authorities. KAN-C Intrastate Authority – Common Carrier. Not exempt from sales tax. ICC-R ICC- Regulated – Common Carrier Authority – Issued in Washington and registered with

KCC. Is exempt from sales tax. ICC-E ICC- Exempt – Common Carrier Authority. They haul commodities not regulated by

ICC, but are regulated by KCC. They are hauling commodities for hire between states. Is exempt from sales tax.

ICC-C Interstate Contract Carrier. Hauls only under contract. Issued in Washington and

registered with KCC. HB 2160 (2003) change made this authority a For Hire carrier. Not exempt from sales tax.

PRI-F Private Carrier based Out-of State. Carrier hauls only his own product. Not exempt from

sales tax. PRI-D Private Carrier based in Kansas. Carrier hauls only his own product. Not exempt from

sales tax.

Definitions Apportioned Jurisdiction: A jurisdiction with which the state of Kansas has a bilateral apportioned registration agreement. Apportioned Registration: A registration issued by an apportioned jurisdiction to a vehicle or fleet that is eligible for apportioned registration. The registration fees are based on the percentage of miles in such apportioned jurisdiction, to the total miles operated by the vehicle or fleet in all jurisdictions. Then the percentage is multiplied by the registration fees applicable in such apportioned jurisdiction. Base Jurisdiction: The jurisdiction where the owner of a vehicle or fleet has an established place of business, where mileage is accrued by such vehicle or fleet and operational records of such vehicle or fleet are maintained or can be made available. Base Plate: The plate issued by the base jurisdiction and shall be the only registration identification plate issued for the vehicle by a member jurisdiction. Having the word “apportioned” and the jurisdiction name on the plate shall identify base plates. Cab Card: The apportioned registration cab card issued by a jurisdiction identifying a specific vehicle and for which the registrant of the vehicle paid registration fees to the jurisdiction issuing the cab card. Carrier or Motor Carrier: A person operating motor vehicles, transporting goods or persons for hire or designed, used or maintained for the transportation of property of the owner. Chartered Operation: A bus line claiming a chartered operation shall label the bus as "Chartered," and there shall be placed with the bus an itinerary. The itinerary shall relate the name of the chartered party, the date and location the party assembled, and the point or points to which chartered party is destined, the date of return and the final destination.

Commercial Vehicle: Any motor vehicle other than a passenger vehicle and any trailer, semi-trailer or pole trailer drawn by such motor vehicle, which vehicle is designed, used and maintained for the transportation of persons or property for hire, compensation, profit, or in the furtherance of a commercial enterprise. Declared Combined Gross Weight (CGW): The empty weight of the truck, including driver and full fuel tanks, plus the maximum payload or cargo carried on the truck. Declared combined gross weight for a motor vehicle towing trailers or semi-trailers: Includes the empty weight, of such motor vehicle plus the driver and full fuel tanks, the empty weight of the trailers or semi-trailers, plus the maximum payload or cargo to be carried on the trailer or semi-trailers.

When a motor vehicle tows a mobile home, the weight of the mobile home would be considered the payload or cargo.

Declared combined gross weight for a bus: Means the empty weight of a bus including the driver and full fuel tanks, plus the maximum load in pounds of passengers, packages, and luggage. Declared combined gross weight of a wrecker: The weight of the vehicle being towed IS NOT to be taken into consideration. Established Place of Business: Means a physical structure owned, leased or rented by the fleet registrant. (b) The physical structure shall be designated by a street number or road location, be open during normal business hours, and have located within it:

(1) a telephone or telephones publicly listed in the name of the fleet registrant,

(2) a person or persons conducting the fleet registrant's business, and

(3) the operational records of the fleet

(unless such records can be made available in accordance with the provisions of Section 1602. of the Plan)

In-jurisdiction Miles: The total number of miles operated by a fleet of apportioned registered vehicles in a jurisdiction during the mileage reporting period or preceding year. In-jurisdiction miles shall include loaded and unloaded miles, interstate and intrastate miles and mileage traveled on a toll road. In-jurisdiction Percentage: The percentage of miles determined for a particular jurisdiction as a result of the ratio of in-jurisdiction miles in such jurisdiction to the total miles operated in all jurisdictions. Interstate operations: The movement of a commercial vehicle having an origin in one jurisdiction and operating into or through another jurisdiction. Interstate reciprocity: The recognition of base plate registration issued by one jurisdiction by another jurisdiction for interstate operations by virtue of an agreement or understanding between the two jurisdictions. Intrastate Operations: The transportation of persons or property from one point in a jurisdiction to another point within the same jurisdiction regardless of the highways traveled. Jurisdiction: The states of the United States, District of Columbia, the territories of the United States, the Provinces of Canada, and the states, territories and Federal District of Mexico. Lease: Means a written document vesting exclusive possession, control and responsibility for the operation of the vehicle to the lessee for a specific period of time. (a) A long-term lease is for a period of 30 days or more. (b) A short-term lease is for a period of fewer than 30 days.

Lessee: Means a person, firm or corporation, which has the legal possession and control of a vehicle owned by another under terms of a lease agreement. Lessee Carrier as Registrant: The lessee may be the registrant at the option of the lessor and the vehicle may be registered by the carrier, but in both the owner-operator's name and that of the carrier as lessee. The allocation of fees shall be according to the records of the carrier. The identification plates and cab card shall be the property of the lessee and may reflect both the owner-operator's name and that of the carrier as lessee. Lessor: Means a person, firm or corporation which, under the terms of a lease, grants the legal right of possession, control of, and responsibility for the operations of the vehicle to another person, firm or corporation. Mileage Reporting Period or Preceding Year: For the purpose of reporting miles generated by a vehicle or fleet qualified for apportioned registration the period of 12 consecutive months immediately prior to July 1 of the year immediately preceding the commencement of the registration or license year for which apportioned registration is sought. Missouri Bilateral Supplemental Agreement: The following Kansas based motor vehicles shall be exempt from apportioned registration in Kansas and Missouri: 1 Vehicles bearing "Local" class registration

restricted to interstate movement in a 25-mile radius of the village, city, municipality, or point where vehicles are based.

2 Vehicles bearing "Local" class registration operated by a common or contract carrier are restricted to a three-mile radius of the village, city, municipality, or point where vehicles are based.

3 Kansas based may operate interstate within the corporate limits and four miles beyond St. Joseph over U.S. 36 or U.S. 59.

4 May operate in interstate commerce within that part of Kansas as defined by the ICC.

The preceding exemptions from apportioned registration DO NOT allow a Kansas based motor vehicle to enter at St. Joseph, Missouri

and travel south on Missouri Highways to Kansas City, Missouri or its environs, or to enter at Kansas City, Missouri and travel north on Missouri highways to St. Joseph, Missouri. Owner: means: (1) Any person who is lawfully entitled to possession of a commercial vehicle and who has the right to control the operation of such vehicle; (2) in the event a commercial vehicle is the subject of a lease without a driver, the lessor shall be deemed the owner; (3) in the event a commercial vehicle is the subject of a lease with a driver, the lessee or the lessor shall be deemed the owner; Kansas Statutes allow Kansas to register a vehicle in the name of a lessor or owner-operator when the owner-operator meets the registrant requirements established by this office. Owner-Operator: means a person, firm or corporation leasing an apportioned motor vehicle with driver to a motor carrier. Owner Operator as Registrant The owner-operator (lessor) may be the registrant and the vehicle may be registered in the name of such owner-operator. The allocation of fees shall be according to the operational records of such owner-operator. The identification plates and cab card shall be the property of the lessor and may reflect both the owner-operator's name and that of the carrier as lessee. Pool Fleet: Means a fleet of rental company trailers and semi-trailers having a gross weight in excess of 6,000 pounds, and used solely in pool conditions, with no permanent base. Recreational Vehicle: A vehicle used for personal pleasure or travels by an individual or a family. Vehicles such as campers, house trailers, motor homes, when used exclusively for personal pleasure and travel by an individual or a family. Rental Fleet: Means vehicles which are rented or offered for rental with or without drivers, and which are designated by a rental owner as a rental fleet.

Restricted Registration: A class of registration that has time (less than a registration year) a geographic area, mileage or commodity restriction. A restricted registration may include, but not be limited to local registration, 6,000-mile registration and farm registration. Service Representative or Agent: A person who furnishes facilities and services including sales, warehousing, motorized equipment and drivers under contract or other arrangements to a registrant for the transportation of property by a household goods carrier. Short Term Lease or Trip Lease: A contract agreement or arrangement, for the use of a vehicle for a period of less than 30 consecutive days, with the immediate right of possession of the vehicle vested in the lessee. Total Fleet Miles: The mileage operated in all jurisdictions during the mileage reporting period by the motor vehicles of the fleet, which were apportioned by a person during such mileage reporting period. Total fleet miles shall include interstate and intrastate miles, loaded and unloaded miles, and all miles traveled on a toll road. All vehicles must leave the confines of Kansas during the reporting period, or when audited, they will be assessed 100% Kansas fees. Temporary Registration or Trip Permit: A registration for less than a registration year issued by a jurisdiction in place of reciprocity or the requirements of apportioned registration. Permits are valid for both inter-jurisdictional and intra-jurisdictional movement. Unladen Weight: Empty weight of truck or trailer.
