ROOM BIDDERS

1. Room bidders must register and obtain a bidding number onarrival. Proof of identity is required from clients new to us.

2. If successful in obtaining a lot please ensure you display yournumber clearly to the auctioneer and that it is your number thatis called out. If there is any doubt about the hammer price orbuyer, please draw this to the attention of the auctioneerimmediately.

3. Payment may be made by cash, bank draft, cleared cheque,debit or credit card — we accept Mastercard or Visa (a charge of2% is made on credit card transactions). There is no charge ondebit card transactions..

ABSENTEE BIDDING

1. If you are unable to attend you may bid before the sale, usingthe form provided. Enter the maximum you are prepared tooffer for each lot and the auctioneer will represent you as if youare personally attending the sale. Lots are knocked down at onestep above the next highest bid, and not necessarily at yourhighest bid. Example: your bid is €1,000 and next highest bid is€800 – the hammer price is €850.

2. LIMIT BIDDING: Absentee bidders may limit their total purchasesto a set amount by entering their limit on the bidding form. Thisis especially useful for bidders wishing to cover as many lots aspossible while setting a maximum amount to spend.

3. “OR” BIDDING: Absentee bidders who wish to bid on two ormore lots, but only wish to purchase one, may do so by entering“OR” between the bids – the lots will be bid on in catalogueorder.

4. EQUAL BIDS: In the event of equal bids being received for thesame lot the first received will be given preference. If theinstruction “break ties” is entered on the bid form the auctioneerwill increase the bid by one step in the event of equal bids beingreceived or in the event of a tie with a room bidder.

5. “BUY” BIDS: Unless otherwise instructed bids of “Buy” or “Buy atBest” shall be taken to indicate bids of up to three times thestated higher estimate in the catalogue.

6. LIVE INTERNET BIDDING AT NO EXTRA CHARGE: You may watchand/or bid live with video and audio link to the saleroom on ourwebsite www.whytes.ie at no extra charge.

7. LIVE TELEPHONE BIDDING may be arranged on request, subjectto availability and given at least 24 hours notice. This facility is onlyavailable on lots estimated at €1,000 or more, and a minimumbid may be requested.

8. INVOICING AND PAYMENT: Successful absentee bidders will besent a pro forma invoice immediately after the sale with detailsof payment methods. All invoices must be paid within 7 days ofthe date of the sale or the lot(s) may be deemed in default andany subsequent losses incurred on resale become theresponsibility of the bidder. The Auctioneers and House AgentsAct, under which we are licensed to hold public auctions, onlyallows for lots to be handed over to purchasers when paid for in full.

Collection of purchases at this sale may be effected 10am to 3pmon Tuesday 24 February from the RDS. After that date lots may becollected from our Molesworth Street premises, Monday to Friday10am to 5pm.

Purchasers must pay for and collect all lots within 7 days of thedate of sale. Note: each lot is at the buyer’s risk from the fall of thehammer. Storage charges will apply after 7 days.

Whyte & Sons Auctioneers Limited, trading as Whyte’s, exercises all reasonablecare to ensure that all descriptions are reliable and accurate, and that each itemis genuine unless the contrary is indicated. However, the descriptions are notintended to be, are not and are not to be taken to be, statements of fact orrepresentations of fact in relation to the lot. They are statements of the opinionof Whyte’s, and attention is particularly drawn to clause 5 set out below.Comments and opinions, which may be found in or on lots as labels, notes,lists, catalogue prices, or any other means of expression, do not constitute partof lot descriptions and are not to be taken as such unless they are made orspecifically verified by Whyte’s.Clause 1 (a) Each lot is put up subject to any reserve price imposed by the vendor(b) Subject to sub-clause (a) of this clause, the highest bidder for each lot shallbe the buyer thereof(c) If any dispute arises as to the highest bidder the auctioneer shall haveabsolute discretion to determine the dispute and may put up again and re-sellthe lot in respect of which the dispute arisesClause 2(a) The bidding and advances shall be regulated by and at the absolutediscretion of the auctioneer and he shall have the right to refuse any bid orbids. NOTE: Where an agent bids, even on behalf of a disclosed client, theauctioneer nevertheless has the right at his discretion to refuse any such bid.(b) The buyer of each lot shall immediately on its sale, if required by theauctioneer, give him the name and address of the buyer and pay to Whyte’s athis discretion the whole or part of the purchase money. If the buyer of any lotfails to comply with any such requirement Whyte’s may put up again and re-sell the lot; if upon such re-sale a lower price is obtained than was obtained onthe first sale the buyer in default on the first sale shall make good the differencein price and expenses of re-sale which shall become a debt due from him.(c) Where an agent purchases on behalf of an undisclosed client such agentshall be personally liable for payment of the purchase money to Whyte’s andfor safe delivery of the lot to the said client.Clause 3(a) Whyte’s reserves the rights to bid on behalf of clients including vendors, butshall not be liable for errors or omissions in executing instructions to bid.(b) Whyte’s reserves the rights, before or during a sale, to group together lotsbelonging to the same vendor, to split up and to withdraw any lot or lots atWhyte’s absolute discretion and without giving any reason in any case.(c) Whyte’s acts as agent only, and therefore shall not be liable for any defaultof the buyer or vendor.Clause 4(a) Each lot shall be at the buyer’s risk from the fall of the hammer and shall bepaid for in full before delivery and taken away at his expense within one day ofthe sale. The buyer will be responsible for all removal, storage and insurancecharges in respect of any lot which has not been collected within 7 days of thedate of sale.(b) If any buyer fails to pay in full for any lot within 7 days of the date of salesuch lot may at any time thereafter at Whyte’s discretion be put up for sale byauction again or sold privately; if upon such re-sale a lower price is obtainedthan was obtained on the first sale the buyer in default on the first sale shallmake good the difference in price and the expenses of re-sale which shallbecome debt due from him.(c) Interest at 2 per cent per month and legal costs (if any) for recovery ofmonies due shall be payable by the buyer on any overdue account.Clause 5(a) All lots are made available for inspection before each sale and each buyer,by making a bid, acknowledges that he has satisfied himself as to the physicalcondition, age and catalogue description of each lot (including but notrestricted to whether the lot is damaged or has been repaired or restored).(b) All lots are sold with all faults and imperfections and errors of descriptionand Whyte’s and its employees, servants or agents shall not be responsible forany error of description or for the condition or authenticity of any lot, save forClause 5 (c) below.Written or verbal condition reports may be supplied by Whyte’s on request but these are merely statements of opinion, and any error or omission in thesereports may not be taken as grounds for a cancellation of sale or refund of any part of the purchase price or the cost of any repairs to the lot or lotsreported on.

(c) If any lot sold at this auction is subsequently proved to be a “deliberateforgery”, Whyte’s will cancel the sale and refund to the buyer the total amountpaid by the buyer for the item, in the currency of the original sale. The onus ofproving a lot to be a “deliberate forgery” is on the buyer. For these purposes,“deliberate forgery” means a lot that in Whyte’s reasonable opinion is animitation created to deceive as to authorship, where the correct description ofsuch authorship is not reflected by the description in the catalogue (taking intoaccount any Glossary of Terms). No lot shall be considered a deliberate forgeryby reason only of any damage and/or restoration and/or modification work ofany kind (including repainting or overpainting). This guarantee does not applyif (i) either the catalogue description was in accordance with the generallyaccepted opinions of scholars and experts at the date of the sale, or thecatalogue description indicated that there was a conflict of such opinions; (ii) orthe only method of establishing at the date of the sale that the item was acounterfeit would have been by means of processes not then generallyavailable or accepted, unreasonably expensive or impractical to use; or likely tohave caused damage to the lot or likely (in Whyte’s reasonable opinion) to havecaused loss of value to the lot; or (iii) there has been no material loss in value ofthe lot from its value had it been in accordance with its description. Thisguarantee is provided for a period of seven (7) years after the date of therelevant auction, is solely for the benefit of the buyer and may not betransferred to any third party. Whyte’s has discretion to extend the guaranteefor a longer period. To be able to claim under this Guarantee, the buyer must (i)notify Whyte’s in writing within three (3) weeks of receiving any informationthat causes the buyer to question the authenticity or attribution of the item,specifying the lot number, date of the auction at which it was purchased andthe reasons why it is thought to be a deliberate forgery; and (ii) return the itemto Whyte’s in the same condition as the date of the sale to the buyer and beable to transfer good title in the item, free from the third party claims arisingafter the date of the sale. Whyte’s has discretion to waive any of the aboverequirements. Whyte’s may require the buyer to obtain at the buyer’s cost thereports of two independent and recognised experts in the field, mutuallyacceptable to Whyte’s and the buyer. Whyte’s shall not be bound by anyreports produced by the buyer, and reserves the right to seek additional expertadvice at its own expense. In the event Whyte’s decides to rescind the saleunder this Guarantee, it may refund the buyer the reasonable costs of up totwo mutually approved independent expert reports.(d) Any lot listed as a “mixed lot, collection, range, portfolio etc.” or stated tocomprise or contain a collection or range of items which are not describedshall be put up for sale not subject to rejection and shall be taken by the buyerwith all (if any) faults, lack of genuineness and errors of description andnumbers of items in the lot, and the buyer shall have no right to reject the lot;except that, notwithstanding the foregoing provisions of this sub-clause, wherebefore a sale a person intending to bid at the sale gives notice in writing to,and satisfies Whyte’s that any such lot contains any item or items not describedin the sale catalogue and that person specifically describes that item or thoseitems in that notice, then that item or those items shall, as between Whyte’sand that person, to be taken to form part of the description of the lot.Clause 6The respective rights and obligations of the parties shall be governed andinterpreted by Irish law, and the buyer hereby submits to the exclusivejurisdiction of the Irish Courts.

SPECIAL CONDITIONS (a) The buyer shall pay Whyte’s a commission at the rate of 20% (plus VATunder The Margin Scheme and which is not reclaimable). (b) Whyte’s or its employees, servants or agents may, on request organisepacking and shipping of lots purchased or may order on the buyer’s behalfthird parties to pack or ship purchases. Under no circumstances does Whyte’saccept any liability whatsoever for any loss or damage howsoever occasionedin the course of such service.(c) The buyer authorises Whyte’s to use any photographs or illustrations of anylot purchased for any or all purposes as Whyte’s may require.The placing of a bid will be taken as full agreement to all the above conditions.

Son of artist, Wycliffe Egginton, RI (1875-1951), Frank Egginton was born in Cheshire and first visitedIreland in the 1930s. He is synonymous with views in watercolour of the Irish countryside, particularlyCounty Donegal. From the early 1930s many of his works were shown at the RHA, and later, from 1952at the Victor Waddington Gallery in Dublin. In the UK his works were shown at the Fine Art Societyand Royal Institute of Painters in Water Colours, London and the Walker Art Gallery, Liverpool amongothers. The artist’s daughter and son-in-law own ‘The Gallery’, Dunfanaghy Co. Donegal since 1968.

Possibly a scene on the Atlantic Drive, Achill Island, although of this one cannot be certain. Theheavy impasto employed in the foreground and in the clouds is relatively uncommon in PaulHenry’s oeuvre, although the evenly applied paint on the rest of the painting is typical of his work.Again, characteristic of Henry, the composition was almost certainly based on sketches madeearlier. Dated to the 1940s on stylistic grounds, Landscape, Connemara is numbered 1290 in S. B.Kennedy’s ongoing cataloguing of Paul Henry’s work.

In spring 2013 May Guinness formed part of an importantand exciting exhibition at the Irish Museum of Modern Arttitled Analysing Cubism. It highlighted the strongassociation between Irish female artists, Cubism and thepromotion of Modernist Art in Ireland. The present work, StillLife, reflects Guinness’ avant-garde style and demonstratesher radical reimaging of composition, form and colour in thisgenre.

Among Guinness’ contemporaries exhibited in IMMA wereMainie Jellett, Mary Swanzy, Evie Hone and NorahMcGuinness alongside their continental counterparts PabloPicasso, George Braque, Albert Gleizes and André Lhote.

It was in the company of Hone and Jellett that Guinnesstravelled to France to study under Lhote from 1922 to 1925.May Guinness first travelled to Paris in 1910 and, at theoutbreak of World War I, she relocated there to become amilitary nurse in the French armed forces. She exhibitedregularly in Dublin throughout her career. Venues includedthe RHA, IELA and the Dublin Painters Group. A memorialretrospective was held the year after her death in 1955 atthe Dawson Gallery.

The composition and colour of the present example are immediate and striking and contrast greatlywith Swanzy’s gentle rhythmic landscapes of her earlier Cubist phase. From the 1930s and 40s herwork changed direction dramatically and she became more concerned with mood, symbolism andthe war ravaged world around her. Here the fantastic and almost grotesque characters demand theviewer’s attention be drawn into the scene. The crowd in the middle ground give a sense of intensityto the work as they surge towards a point beyond view to the left of the canvas.

Henry Jackson Jr. (1912 -1988) was an American professional boxer and a world champion(in more than one division) who fought under the name Henry Armstrong. He is regarded asone of the greatest fighters of all time by many boxing critics and fellow professionals. Hewas also known as “Homicide Hank”, hence the artist’s title. George Campbell was a boxingfan and made several paintings of boxers both in Ireland and in Spain.

Daniel O’Neill began exhibiting in Dublin from the early 1940s. He held a joint exhibition with fellowBelfast artist Gerard Dillon in 1943 at the Contemporary Painter Gallery and later with VictorWaddington in 1946. The positive response and sales of his work garnered him a contract withWaddington and allowed him to paint full time. Collaborative shows with George Campbell, NevilleJohnson and Gerard Dillon followed. The present example dates to this early phase in the artist’scareer. This self-portrait is a rare example by him and includes enigmatic religious references. Theyear after this work was painted O’Neill travelled to Paris and his subject and style developed further.

Later he taughtdrawing at a Catholic seminary in Seoul andsubsequently converted to Catholicism in 1967.Shortly after that he travelled to Switzerland tostudy art history, theology and metaphysics. Hecompleted his first stained glass window in1989, which was a turning point in his career.Kim en Joong exhibited with the Taylor Gallery,Dublin in the 1990s.

New York born Roy Lichtenstein is synonymous with the Pop Art Movement that emerged in the late 1950s in the USand challenged the tradition of fine art by employing aspects of mass culture, such as advertising and everyday culturalobjects. Lichtenstein came to prominence with his use of the cartoon characters Mickey Mouse and Donald Duck andlater his adapted comic-book panels such as Whaam! (1963, Tate Modern, London).

Still Life with Lobster is part of the ‘Six Still Lifes Series’ from the mid-1970s which explored the conventions of oldmaster still life painting. The series was co-published by Multiples, Inc. and Castelli Graphics, New York.

An accomplished figure painter in oil and watercolour, RichardStaunton Cahill was born in County Clare. Having trained at the RoyalHibernian Academy School in 1850, he exhibited there from 1851 until1900. Research shows he painted in Clare and Galway, concentrating ongenre subjects such as The Irish Peasant Boy (1853), The SpinningWheel (1879) and An Impending Eviction (1888). He exhibited from theearly 1850s at London’s Royal Academy, and when living in London, atThe Royal Society of British Artists and the New Watercolour Societyand elsewhere in English galleries. His detailed, sympathetic paintingsform useful historical sources for authentic furnishings and clothing.

Cahill’s group is gathered in an Irish cabin to listen to news read fromthe newspaper. The post famine years saw a huge increase inpublication of provincial newspapers, from 68 in 1850, to 127 by 1880.This growth went hand in hand with the establishment of Nationalschools, improved rates of literacy in English, and the expansion of therailways, facilitating inexpensive distribution. Newspaper editors wereoften highly politicised, encouraging the rise and spread of nationalismthrough the printed word. People often shared newspapers and theresulting debates had previously been depicted by other artists. InitiallyJohn Boyne’s The County Chronicle shows a paper being read aloud ina pub (1806). Then famous Scots artist David Wilkie produced TheVillage Politicians (1913), popularised through engravings (andstylistically influential here). Another lively Irish portrayal of the subjectwas by Henry MacManus (c.1810-78) whose oil Reading the Nationfeatures the weekly paper ‘The Nation’, which was overtly political. Bythe late 19th century, artists were addressing political issues morefrequently through their paintings. Subsequent to Cahill’s version ofthis subject, other artists included similar imagery to draw attention toIreland’s evolving Nationalist movement. Most notable is HowardHelmick’s Reading the News: Proclamation of the Land League (1881,National Gallery of Ireland).

This setting suggests a small farmhouse, with its flagged floor andcomparatively well-dressed, well fed, comfortable inhabitants. The menon the left are close to the open half door, which allowed light yetrestricted the movement of animals and children. The neatly madeform that they sit on, bears Cahill’s distinctive signature and date. Theyoung mother on the right sits on a stake-legged stool beside hertreadle spinning wheel, an improved type introduced for flaxproduction, used predominantly in northern counties. Her head iscovered, indicating her married status, and the boy listening attentivelyin the centre wears green, a colour symbolic of Fenianism, as wearinggreen had been outlawed by the ruling British in the late 17th century.Young boys were traditionally dressed as girls, in skirts. There werevarious reasons, including a superstition that if dressed as girls theywere less likely to be taken by the fairies, but also following similarEuropean aristocratic fashions, as well as for reasons of practicalhygiene. In the right corner is a red painted chest, upon which rests arush light holder, and a plate propped up, as was customary, for display.The significance of the prominently placed initials and the drawing onthe wall to the left is uncertain. However, 1850 was the year of TheReform Act, which increased the electorate, and helped build a newlypolitical nation. The juxtaposing of the male figures, with the older mensitting passively, the young man standing (with his green hat band),and the child centrally placed representing the future, suggests anactive stance towards a nationalist future, which by the time this waspainted in 1871, had started to become a reality.

The size and quality of the present work would suggest it may havebeen painted for exhibition. While no record has yet been found inexhibitors’ indexes for the present title, Reading the News, an exampleby the artist shown at the ‘Irish Exhibition in London’ in 1888 entitledThoughts of the Future [catalogue no.99, £10] would be an equallyfitting name for the present work. Thoughts of the Future was lent bythe artist to the London exhibition.

In 1834 the sixteen-year old John Henry Foley left his native Dublin forLondon, following in the footsteps of his elder brother Edward, alreadyestablished at the sculpture workshop of the celebrated Mr Behnes. Heenrolled in the school of the Royal Academy and quickly won astudentship for ten years with The Death of Abel. This piece andInnocence, perhaps inspired by his sister Martha, were exhibited at theRoyal Academy in 1839 to great acclaim. Foley’s talent was recognisedby the influential Art Journal. The following year Ino and Bacchus wasexhibited, to even greater acclaim.

In both subject matter and style it is a neo-classical piece. That is to say,it imitates the art of ancient Greece and Rome.

The infant Bacchus lies on his back, smiling, reaching for the bunch ofgrapes dangled above him by the bare-breasted Ino who lies, smiling,at his side and leans over him. The naturalness, charm and wit of thepiece affected all who saw it. Prince Albert, the Queen’s consort, wasenthusiastic.

Francis Egerton, Earl of Ellesmere, commissioned a marble copy for hisgallery at Bridgewater House. This poet-politician had inheritedproperty worth £90,000 a year and a fabulous collection of paintings.He was sworn to the privy councils of both Britain and Ireland. Hetranslated French and German literature - he was London’s equivalentof Macaenas, Rome’s great patron of the Arts.

Ino and Bacchus marked a turning point in the career of the twenty-two year old from Montgomery Street, Dublin, (Now Foley Street, justnorth of Talbot Street.) Son of Jesse Foley, glass-blower turned grocer,and Eliza Byrne, from Wicklow. It launched him upon a career-path thatled to the heart of Victorian society and major commissions for projectsacross the imperial globe from Galway to Calcutta.

A plaster-cast of the model can be found in the permanent collectionof the Royal Dublin Society.

Lesser known Irish female artists were celebrated in the publicationIrish Women Artists 1800-2009 Familiar But Unknown (ed. ÉimearO’Connor) in 2010 and among those highlighted was Kildare sculptorGabriel Hayes.

Although she exhibited almost annually with the RHA from 1932 to1947, was the recipient of the coveted Taylor Art Prize (1934), receivednumerous public and ecclesiastical commissions and, when Irishcurrency went decimal in 1971, designed several of the coins, littlerecognition has been awarded her since her death in 1978.

Among her major commissions are the panels for the then Departmentof Industry and Commerce, Kildare Street (1941) and the more than lifesize 14 Stations of the Cross for Galway Cathedral. In 1977 she won thegold medal for sculpture at the Oireachtas Exhibition with GráinneMhaol carved from American walnut.

This sizeable bronze is likely to have been a presentation plaque for AnTóstal (inaugurated in 1953). Irish life is celebrated in this piece arounda central figure holding a torch to symbols of the provinces. It is typicalof her style with its flat stylised rendering of figures and animals. Hayes’husband was Professor Seán P. Ó Ríordáin who became a householdname in the 1950s for his appearances on the BBC televisionprogramme ‘Animal, Vegetable or Mineral?’
