    !he counter ar#ument is that that is not $hat the s'eci"ication sa%s. !he s'ec does not tal o" dividin# the cut intohori/ontal slices.

    I acce't the "irst ar#ument. It does not clash $ith the s'eci"ication, it measures $here the side slo'e is $idened b% 4m orless. I" the 'ortion at the to' is measured, on that s'eci"ic 'lane the side slo'e $ill not be $idened b% 4m or less .

    I" the side slo'e o" the ne$ cut is stee'er than the side slo'e o" the existin# cut, the cut ma% be less than 4m at the to',and more than 4 m at the bottom.

    !he ar#ument can then be that the Contractor should be 'aid "or the 'ortion at the to', because he has the

    inconvenience o" narro$ $orin# areas. e has to mae use o" hand+held drills. As soon as the $idthincreases to more than 4m, the Contractor can brin# in a ri#, and have lo$er excavation cost. 'a%mentshould sto' at the level $here the $idth becomes more than 4m. !he is there"ore onl% 'a%able above thehori/ontal 'lane $here the $idth is 4 m or less.

    A#ain, the counter ar#ument is that the s'eci"ication does not tal about dividin# the cut in hori/ontal slices.
