An Introduction to WillsWhy make a Will?Many people find the thought of making a Willunpleasant and difficult – perhaps this explainswhy only one third of the UK population actuallyhas one. But facing up to this task now will helpavoid the much greater difficulties that yourloved ones may face if you were to die withoutone.

Your wishesMaking a Will is the only way to ensure that yourestate passes to those who you want it to, ratherthan according to the fixed statutory intestacyrules. This is essential for unmarried couples,since each partner has no legal entitlement tothe estate of the other. But for married couplestoo, reliance on the intestacy rules is unlikely toachieve a satisfactory outcome. For example, it iscommonly assumed that even without a Will awidow or widower automatically inherits theestate of his or her spouse, but in fact under theintestacy rules the provision for a spouse is morelimited. Particularly where they have children.

Protect childrenA Will can be structured to protect youngchildren by including appropriate trusts so thatthey do not receive their entitlements too soon.A well drafted Will can also help protect yourfamily against claims on divorce or bankruptcy,thus ensuring that your wealth is protected forfuture generations. Careful drafting of your Willshould help to defer, mitigate or avoid theimpact of inheritance tax on your estate, so thatit is your family who benefits rather than thetaxman.
