Tenant Improvement Construction Information

1. Please provide Landlord with one (1) full size set of prints and an electronic file (PDF/DWG) for the plan review/approval process. An email attachment will be acceptable or you can mail the file directly to the Tenant Manager on disc with your plan set. Your tenant improvement drawings must be approved by Landlord prior to commencing work. Please allow 5-10 working days for Landlord review.

2. Please note that tenant is required to provide Landlord with one electronic set of as-built tenant improvement drawings (including any plan check corrections or engineered plans) upon completion of the store construction.

Every tenant planning an exterior renovation of their space MUST submit photos of all existing conditions, colored building elevations AND a 3-dimensional perspective image of the proposed building improvements.

3. All tenant contractors must provide Landlord with an original signed copy of the Construction Rules (see following). The tenant contractor obtaining the tenant improvement permit is the contractor responsible for submitting all required information and certificates of insurance to the Landlord.

4. A tenant may not open for business without a signed executed lease.

5. By order of the Building Dept., Open Remodels are prohibited for any Tenant whose space is less than 5,000 SF.

6. Due to the structural engineering design of the roof system, Tenants and/or their contractors cannot attach to or construct anything on the bottom of the roof trusses unless approved by Landlord.

7. THE CENTER IS AN “OPEN SHOP”.

A representative of your company must be onsite to receive any deliveries for your store. The Landlord cannot accept any deliveries for your store. No provision has been made for on-site storage until your suite is ready for turnover.

9. Tenants and their contractors will be responsible for removal of all construction and store set up debris generated during tenant improvement construction. This includes all debris from store fixtures and initial merchandise deliveries. A trash bin must be ordered from the required contractor and the location of bin must be approved by the Building Department and Center Management, covered nightly and removed on weekends.

10. Tenants are to order their utility services (electricity, gas and telephone) to begin on their turnover date or their construction start date, whichever is the earlier.

11. Tenant shall make application for electrical service in Tenant’s name prior to start of Tenant’s work. If permanent electrical meters are not installed prior to start of Tenant improvement construction, Tenant’s electrical contractor shall be responsible to provide temporary power and lighting for the Demised Premises, per code, with ground fault protection. Upon completion of the permanent system of electrical power furnished by the Landlord, Tenant’s contractor may utilize the permanent power from the Tenant’s panel board.

12. All Tenants must provide regular maintenance of their HVAC system. Each Tenant is to provide a copy of their maintenance contract to the General Manager within one (1) month of their turnover date.

13. Protection for the HVAC unit(s) (construction filter) must be in place prior to the start of Tenant’s construction. The HVAC unit must also be cleaned when tenant construction is complete. This is the responsibility of the Tenant, NOT the Landlord. If painting ceiling, HVAC unit must be off – not running. Relocation of thermostat controls shall be at the Tenant’s expense and any repairs or failed installations resulting from incomplete or inadequate relocation shall be the Tenant’s responsibility.

14. KIOSK STRUCTURE CHANGES: Tenants are to submit preliminary design drawings ONLY and should not commence work on drawings until the design is approved by Landlord.

15. To meet new requirements set by the Town of Woodbury Fire Marshal, stores will be required to upgrade their fire alarm systems to meet the current local code and regulations. The REQUIRED firm authorized to perform work on the fire alarm system (please refer to required subcontractors list) Please contact them for information on additions, alterations and/or upgrading your system. All devices (smokes, pull stations, strobes, etc.) must be addressable and connected to our monitoring system. Please contact them at least 4 weeks in advance and provide them with a set of plans. No other types of fire alarm systems are permitted. If you are required by your insurance carrier to have an additional fire alarm for your store, plans and specs for this system must be approved by the Landlord prior to the start of construction.

There is a fine from the Town of Woodbury for false fire alarms. Call or visit the Administration Office so that the detectors, etc. can be taken “off-line” when you are working in the tenant space and there is a danger that a false alarm may occur. The addressable fire alarm system at WCPO is very sensitive and will go off if there is any paint spray, sanding, etc. that gets into an addressable smoke detector. Pull stations can be carefully moved (after disabling) and sprinkler systems must be disabled when work is done on that system or if there is a danger of a sprinkler head activating due to work being done. Contractor representative must report to the Administration office when alarms can be put back on line.

16. Two (2) complete stamped sets of tenant improvement plans will be required for plan check submittal to the Town of Woodbury. The Town of Woodbury Building Department has been taking two to three weeks’ time to process Tenant’s plans through plan check for permit. Your contractor will not be allowed to start any tenant improvement work before the TI permit is issued. In addition to the improvement plans it will be the Tenant’s responsibility to supply a copy of the Landlord Plan Approval Letter to the building department BEFORE a permit will be issued.

17. As of August 1, 2015, the Village of Woodbury Building Department is now limiting the hours of its inspections. Inspections will now be scheduled between the hours of 10:00 AM and 12:00 PM on a first come, first served basis.

18. All mechanical and electrical permits must be purchased by State licensed tradesmen, and separate permitting fees are charged.

19. Before a Certificate of Occupancy can be issued, a final inspection and approval must be made by the Building Inspector and by the Town of Woodbury Fire Marshal. Tenants cannot have merchandise delivered to their store until the store construction is complete and the Building Inspector has made a construction inspection. At that time the inspector will give the store the “OK” to merchandise. Once the merchandising is completed, the inspector is to be called back for the final inspection at which time the “CO” will be issued and the store may open for business. Please do not ship any merchandise to your store until you know when you have the release from the Town of Woodbury inspector to deliver your merchandise into the store.

20. All contractors and their sub-contractors performing work within your store must have a valid business license. Applications for said license can be obtained from the Orange County Planning Office.

21. Due to structural engineering design of the roof system, Tenants and/or their contractors CANNOT attach to or construct anything to the bar joist, girders, or metal deck. If your tenant improvement construction involves structural changes or attachments to the building shell, said work must be designed by a licensed structural engineer and submitted to Landlord’s structural engineer for review and approval. Any cost of this review is the responsibility of Tenant.

22. If tenants or their contractors saw cut / jackhammer the concrete floor slab, the replacement slab must be installed with doweling and reinforced concrete. Landlord’s onsite representative is to be notified and scheduled 24 hours in advance of any sawcutting work. Many areas of the building cannot be sawcut due to structural reasons . Tenants must verify with Landlord representative.

23. A fire rated exit corridor may or may not be required by the Town of Woodbury Building Department, depending on each store’s layout and size. Tenants are to consult with a State of New York licensed architect on this and all building code issues, or contact the Town of Woodbury Building Inspector.

24. The Town of Woodbury Building Department requires a building permit for ALL tenant improvement construction.

25. If a rolling rack type system is going to be used within the demised premises, based on the type and/or size, the Building Department will require perforated shelving in lieu of solid type shelves. These plans should be reviewed with the Fire Marshal prior to installation.

26. The Town of Woodbury has designated receiving areas behind tenant spaces as fire lanes. One construction vehicle may be allowed to park in these locations only when absolutely necessary and at the discretion of Woodbury Common management. Permits for parking may be obtained from the Administration Office in the Tower. There is a fine for illegal parking in a fire lane. All non-permitted vehicles are ticketed by the Town of Woodbury Police and subject to tow.

27. Post-construction inspection will be performed by Woodbury Common Premium Outlets. Contractor must notify Management Office at least 24 hours prior to completion of work to enable inspection to be scheduled. Any deficiency will be the responsibility of the Tenant Contractor. Please note that attic inspections are part of this process. All unused material in attics must be removed including old HVAC ducts, wiring, etc . Insulation must be in place and all sprinklers, electrical, HVAC, etc. must be installed per Code.

NOTE: Additional Town guidelines/requirements can be found as exhibits at the end of this handbook

28. Door replacement is the responsibility of the tenant. Any door replacement on a suite must have proper address signage replaced at the cost of contractor/Tenant and must be pre-approved.

29. Cutting, Welding and Grinding Activities

Welding and cutting is not permitted near large quantities of exposed, readily ignitable materials, in areas not authorized by Center Management, or on metal partitions, walls or roofs with combustible covering or with combustible construction.

Floors shall be free of combustibles, such as wood shavings. If the floor is of combustible material, it should be kept wet or otherwise protected.

If combustibles are closer than 35 feet to the welding, grinding, or cutting process, and the work cannot be moved or the combustibles relocated at least 35 feet away, they should be protected with flame proofed covers, metal guards, etc. (Note: only non-asbestos, flame-retardant materials should be used for protective covers. For information on the use of welding blankets and their selection, see Environment, Safety and Health Bulletin DOE/EH-0039. Issue 19, “Welding Blankets: The Unexpected Hazards,” dated March 1987).

Openings in walls, floors, or ducts within 35 feet of the work shall be covered.

Cutting, grinding, or welding on pipes or other metal in contact with combustible walls, partitions, ceilings, or roofs should not be done when close enough to cause ignition by heat conduction.

The Landlord shall be notified whenever welding, grinding, and cutting activities are scheduled to be performed, and also including when the following conditions exist:

Appreciable combustible materials (in the building’s construction or contents), are closer than 35 feet to the point of operation.

Appreciable combustibles are more than 35 feet away, but are easily ignited by sparks.

Wall or floor openings within a 35-foot radius expose combustible material in adjacent areas, including concealed spaces in walls or floors.

Contractors are required to notify the Center Management office 48 hours in advance of any cutting, welding or grinding work to be performed. Tenant must perform the work during non-business hours.

30. Burglar Alarms / Perimeter Intrusion Security Devices

All such devices must be approved by the Landlord prior to installation, including application of "riot glass" or any type of film to doors and/or windows. No exterior alarms, strobe lights, or other enunciator devices may be mounted on storefronts. Due to potential interference with the Center's fire alarm system, "Smoke Cloak", or similar systems which generate smoke, are prohibited. Application of any decals to storefronts referencing Security protection must be done in compliance with Premium Outlet's Storefront Criteria.

31. Tenant Ceilings

All ceiling mounted fixtures, lighting, track, signs, etc. must be supported and NOT be toggled to or supported in anyway by the ceiling system.

IMPORTANT INSULATION NOTE: The Village of Woodbury Building Dept. REQUIRES all Tenants to upgrade and or install new insulation above the ceiling (at rafters) and attic insulation to meet R49 standard, which is required by the current Building and Energy codes. Tenants with a smaller “scope of work” and/or “scale of work” for their respective build outs may be exempt from this requirement but the Building Dept. will review each project on a case by case basis. Tenants should contact Mr. Gary Thomasberger (Code Enforcement Officer P#845-928-6911) to review their prospective “scope of work” with Gary and to verify what the Building Dept. will require based off of this information!

32. Visitor Name Badges

No contractor is allowed on our property without wearing a visitor badge. A contractor may pick up badges for his entire crew at the mall office. These badges self destruct within 24 hours, thus every day you must get new ones. Everyone working in the suite must wear a badge. If security sees an expired badge, you will be asked to obtain a new one at the office before any other work can be performed.

33. Music Systems

SPEAKERS ARE NOT TO BE LOCATED NEAR OR MOUNTED TO DEMISING WALLS AND/OR OUTSIDE OF THE TENANT DEMISED SPACE.

34. Any exterior changes to storefront should revert to the Storefront Design Criteria which can be found at www.Simon.com

35. Contractor Parking

One parking pass is issued per store. Receiving areas are fire lanes and vehicles parked without pass are subject to tickets and towing at owner’s expense. Management office will provide pass and map as to where contractors can park.

Food Tenant Design Requirements

Below is the minimum design requirements that must be used by ALL Food and Food Court Tenants for all kitchen prep area’s.

This requirement is to prevent any mositure or dampness penetrating the demising wall(s) that can lead to damage to the food space and/or adjoining spaces.

Demising and/or concrete walls:

1. Demising walls must be moisture resistant gypsum board w/ Sporgard™ (National Gypsum) on metal studs. Other wall options acceptable by landlord would be Hardibacker prior to installing wall finishes or Ultracode drywall, by USG.All concrete walls, rear or demising, must be furred out with the above specs, no exceptions.

2. Install water proof membrane a minimum of 24” above floor.

3. FRP applied to all walls to a minimum height or 48” above wall base tile, and caulked with a silicone sealant.

4. Metal or PVC corner guard must be applied to all corners and caulked with a silicone sealant.

Flooring area:

1. Floor tile and flooring base installed must be sealed. This application should be re-applied semi-annually.

2. Floor drains must be installed in any food preparation area that require cleaning methods of hosing or washing walls. It is the tenant responsibility to make certain that all flooring is sloped for proper drainage to the floor drain(s).

3. Tile/Grout: Must have Durock and /or equal applied to studs.

Barricade Specifications

If a barricade will be used, the tenant is REQUIRED to supply and install graphics as outlined below.

Barricades must be erected if there is any construction that goes beyond or on the exterior front wall of the tenant space. These barricades must be painted with 3 coats of white paint, and Graphics are required. Tenant contractor must maintain a safe environment for customers and employees during construction period. All work areas must be inaccessible or blocked off from customer/employee flow.

1. CHECK-INVisitor Name Badges No contractor is allowed on our property without wearing a Visitor Badge. A contractor may pick up badges for his entire crew at the mall office. These badges change colors within 24 hours, thus every day you must get new ones. Everyone working in the suite must wear a badge. If security sees an expired badge, you will be asked to obtain a new one at the office before any other work can be performed.

*When construction is complete, the tenant/tenant contractor must submit a final set of “as builts”, on CD, in addition to a copy of the Certificate of Occupancy. The Landlord may also require a post-inspection of the store to ensure work was performed per Landlord approved plans.

2. INSURANCE REQUIREMENTSPer Pipino (October 2012) we are no longer allowed to give out sample COI’s. Please inquire at Center Management Office. Phone (845) 928-7467

4. LICENSE REQUIREMENTSTenant shall only employ contractors/subcontractors licensed, as required, by state and/or local jurisdictions, if applicable.

5. WORK AREAAll of contractor’s work, storage of materials, construction office, etc., must be confined to within the Demised Premises. Landlord shall have no responsibility or liability whatsoever for any loss or damage to property belonging to Tenant or its contractor, and left in the Demised Premises or anywhere else.

6. DELIVERIESDeliveries will be made only through entrances and routes designated by Landlord’s onsite representative. All deliveries through the public shopping area must be completed before the center is open to the public. Landlord will establish delivery routes which are subject to change. If items are too large to fit through the tenant’s rear entrance, contractor shall request and get the center’s prior permission to deliver through the main entrance. The common area corridors cannot be used as storage – they must remain clear and free of all obstructions at all time.

7. PARKINGParking for construction personnel will be permitted in Landlord designated areas only. Trucks and/or trailers must not be left on the property without permission from the Landlord.

8. LOADING ZONESLoading Zones will be kept open for deliveries when possible. Parking in Loading Zones is strictly PROHIBITED. Delivery vehicles must be completely unloaded at curb side and then moved out. Unattended parked vehicles in Loading Zones will be tagged or towed at the expense of the Tenant serviced by the vehicle.

9. PRE-OPENING SERVICESA. Electricity/Gas – If permanent power has not been installed prior to the start of tenant

improvement construction, Tenant’s contractor shall be responsible to provide temporary power and lighting for the Demised Premises, per code, with ground fault protection.

B. Temporary power by generator or electrical usage charges are the responsibility of the Tenant.

C. Trash Removal - Tenants, Tenant Contractors, all sub-contractors and suppliers are required to remove trash and construction debris from the Demised Premises and to arrange for dumpster service in designated areas. Contractor must provide a waste container schedule including placement, delivery and pick-up dates. *Placement of dumpster must be coordinated with on-site Landlord representative. Tenant trash and debris accumulating within the store, in the shopping center, in public areas or loading areas will be removed by Landlord at Tenant's expense. Tenant agrees to pay such expenses to Landlord upon demand. Order roll-off drop box from required contractor. *Containers are to be removed off premises on Fridays and returned on Monday (unless it is a holiday).

10. FIRE SPRINKLER PROTECTIONTenant contractors shall provide fire extinguishers within the premises as required by Public Safety Officials. All fire sprinkler system modifications must be performed by the required Sprinkler subcontractor and must be tied into Landlord’s existing fire sprinkler system, if applicable. Any changes to existing fire sprinkler system must be submitted to and approved by the Fire and Building Departments. Prior to deactivating sprinklers, Center Management must be notified 24 hours in advance of a shut down.

Any time a tenant/ tenant’s general or sprinkler contractor requires a fire sprinkler system shutdown, a check must be collected, payable to the center’s entity, in the amount specified by Center Management PRIOR to providing access to the space or taking any action to permit draining the system in order to perform the requested sprinkler work. Notification of a shutdown that extends after operating hours will require a fire watch. Should the fire watch entail additional unbudgeted Security hours, the center may invoice the tenant to cover these incremental costs.

11. FIRE ALARM - BUILDING MONITORING SYSTEMIf the Fire Department determines that additional alarm devices are required, all Building Monitoring System modifications must be performed by the landlord required Fire Alarm contractor and tied into the Landlord’s existing monitoring system, if applicable. Prior to deactivating monitoring system, Center Management must be notified. This procedure will be similar to the sprinkler process as stated in this section.

If the tenant’s General Contractor is installing duct work, the duct detector MUST be installed by the Landlords required contractor and tied into the Landlord existing monitoring system.

All Building Monitoring System pull stations and horn/strobes must be clear of all obstructions.  Tenant/Tenant Contractor to verify existing locations in field.

12. ELECTRICAL/SECURITY ALARMSThe contractor shall not enter any electrical room without the center’s permission. No security alarm boxes, horns, sirens or doorbells shall be installed on or above storefronts.

13. MECHANICAL SYSTEMTenant’s mechanical contractor will need to provide an HVAC balance report, at the end of construction to Landlord.

14. SLABTenant and Tenant flooring contractors are responsible for minor floor patching in accordance with good installation practices as well as for the determination of compatibility of flooring products and/or adhesive with Landlord's concrete slab. Landlord does not accept responsibility and will not be liable for water vapor emissions through the slab that exceed flooring manufacturer's recommendations or are due to the effects of saw cutting.

UNDERSLAB WORKAll work must be coordinated with and approved by the Operations Manager. All slab saw cutting or penetrations require that replacement slab be installed with reinforced concrete. In some suites, saw cutting is not allowed because it will interfere with the structural integrity of the building. The Tenant/Tenant’s general contractor is responsible to ensure that there are no underground utilities/services BEFORE cutting any concrete, anywhere on the property. The Tenant will be liable for all repairs and/or lost business due to a utility or service interruption as a result of cutting the slab.

Any requested structural modifications including, but not limited to, sawcuts, gradebeams, roof modification, HVAC framing, etc. is required to be performed by the Landlord's required structural engineer at tenant’s sole expense. 15. WORK PRACTICESAll work practices and personnel performing work in Tenant spaces must be compatible with the practices and personnel employed by Landlord. Upon notice that any work practices or personnel are not compatible, the Tenant shall be responsible for the immediate termination of said practices or the immediate removal of said personnel from the Shopping Center property.

Contractor work shall be performed in a thorough, first-class and workmanlike manner and shall be in good and usable condition at the date of completion thereof. If, in the center’s judgment the work fails to comply with this standard, the Tenant will not be allowed to open until any discrepancies are remedied.

The contractor’s employees must not curse, expectorate or otherwise act unprofessionally and must wear shirts and safety glasses as well as adhere to all other OSHA regulations on this project at all times.

16. USE OF SHOPPING CENTERAccess to the Mall shall be subject to control at all times by Landlord for purposes of Landlord security and for protecting the Shopping Center finishes from damage. At no time shall the Shopping Center be used by Tenant Contractor or its employees for lounging, eating, rest breaks, etc. Tenant shall be responsible for seeing that this rule is strictly observed by his contractor(s).

17. PROTECTION OF WORK AND PROPERTYTenant and Tenant Contractor shall protect their work from damage and shall protect the work of other Tenants and Landlord from damage by Tenant, Tenant Contractor and their employees and subcontractors. Work area is limited to your tenant space only.

Protection for the HVAC unit(s) (construction filter) must be in place prior to the start of Tenant’s construction. The HVAC unit must also be cleaned when tenant construction is complete. This is the responsibility of the Tenant, NOT the Landlord. If painting ceiling, sawcutting or heavy sanding, HVAC unit must be off – not running.

18. STRICTLY PROHIBITED WORK AND PRACTICESA. Any combustible materials above finished ceilings or in any other concealed non-sprinkle

space.B. Imposing any structural load, temporary or permanent, on any part of the Landlord’s

work or structure without the approval of Landlord’s Engineer.C. Cutting any holes or trenching in Landlord installed floor slabs. Cutting any holes in

19. CORRECTIVE WORK DONE BY LANDLORDAny sums which shall become due to Landlord by Tenant or its contractor as a result of and arising out of Tenant’s construction work (including without limitations, in-slab plumbing line installed by Landlord, electricity charges during construction, trash removal and damage to Landlord’s property) shall be considered as additional rent, and shall become payable immediately upon demand by Landlord.

20. ROOFINGTenant shall employ the Landlord’s required roofing subcontractor for such work as Tenant’s own agent and contractor. (See required subcontractors page) The work shall be performed in such a manner that the Landlord’s building schedule, Landlord’s roofing guarantee, and the work to be performed by other Tenants of the Shopping Center will not be affected adversely.

ROOF STRUCTUREFor items affecting structure (i.e. roof top units), Tenants are to submit preliminary design drawings ONLY and should not commence work on drawings until the design is approved by Landlord.

Due to the structural engineering design of the roof system, Tenants and/or their contractors cannot attach to or construct anything on the bottom of the roof trusses unless approved by Landlord. Drilling or bolting through structural members is prohibited. Uni-struts, C-Clamps, and tension brackets are allowed for attachments to structural joist system above. If a structural engineer is needed to determine any structural calculations with Tenant drawings, Tenant is responsible for these services and costs.

Roof openings, including necessary curbs and flashings to accommodate the installation of the Tenant’s work, shall be located as directed by the Landlord. All work to be coordinated in advance with the onsite management team.

21. CUTTING, WELDING AND GRINDING ACTIVITIESWelding and cutting is not permitted near large quantities of exposed, readily ignitable materials, in areas not authorized by Center Management, or on metal partitions, walls or roofs with combustible covering or with combustible construction.

22. DUST, DIRT, SMELLS AND NOISETracking dust and dirt into the common area is prohibited. Contractor’s employees should remove as much dirt and dust as possible before entering the common area.

Proper care must be taken when working with glues, paints and any other materials requiring special ventilation. Such smells must not waft into the common area or other tenant spaces.

Loud noises, particularly those created by the use of jackhammers, rivet guns and grinding equipment, shall not be used during center hours without the center’s prior permission. All radios and music must be kept at a low volume that cannot be heard outside the tenant space.

23. CLEAN-OUTSSome tenant suites may have furred out columns with access panels to an existing roof drain clean out.  Access panels, whether in front or rear of space, is to remain clear of all obstructions.  Floor clean-outs are also to remain clear of all obstructions.

24. ANIMALS/PETS Service Animals trained specifically to assist disabled person are permitted on property, all other animals as strictly prohibited.

25. WEAPONSPossession of any article defined as a weapon, whether illegal or not, is at no time permitted on property, unless such weapon is in the possession of a law enforcement officer required to carry such a weapon.

TO: ALL MANAGERS AT WOODBURY COMMON PREMIUM OUTLETS AND AFFILIATED CORPORATE FACILITIES COORDINATORS.

Recent and ongoing inspections by the Town of Woodbury Building Department Inspectors have uncovered numerous violations in many tenant spaces.

Many of these violations have been created by unauthorized contractors and “handymen” hired by tenants themselves or sent by their corporate offices without consulting the Premium Outlet’s Properties list of authorized contractors.

Tenants are reminded that violations that pose a hazard to public safety will result in an immediate closure of their store until such time that said violations have been verified for compliance.

Unauthorized electrical work dominates the list of violations and creates the most extreme hazard. All electrical work performed for tenant spaces is required to be inspected by the authorized electrical inspector (Fred Cocks, Commonwealth Electric Inspection Service Inc. 845 783 9309) and most electrical work requires permits from the Building Department. Again, electrical work that does not comply with code, (NFPA 70, 1999), poses a hazard and will cause the store closure until the problem is corrected.

Other types of work may also require permits and inspections by the Building Department (845 928-6911), please inquire before you start. Work done without permits or work that does not meet code will result in a Notice of Violation for immediate compliance to correct or remove the offending items. Non-compliance can result in fines of up to $1,000.00 per day, per violation.

Contractors hired by tenants or corporate owners must register at the Woodbury Common Premium Outlet offices located in 498 Red Apple Court, (the Tower 2 nd floor), before they begin work. Unauthorized, unregistered contractors will be issued a Stop Work Order until they comply with the Town and Woodbury Common codes, rules and regulations.

All tenants are asked to please forward this letter to their corporate offices in charge of maintaining your particular facility.

TOWN OF WOODBURY EGRESS LAW

Village of Woodbury Code Section 154:

A. General requirements. Property subject to the applicability of this Code shall be provided with safe means of egress.B. Obstruction.(1) Exits shall be maintained to provide free and unobstructed egress from all parts of the building or structure.(2) No barrier, lock or fastening device to prevent free escape from any building or structure shall be installed, except in institutions where supervisory personnel are constantly on duty and effective provisions are made to remove occupants in case of fire or other emergency.(3) Materials shall not be placed, stored or kept in stairways or corridors.(4) No aisle or passageway shall be obstructed so as to reduce its required width as an exit.(5) Exit enclosures shall be maintained free of building facilities which could interfere with use as an exit, such as piping for flammable liquids or gases. Interior decorations such as draperies, tapestries or mirrors shall not be permitted to obscure, conceal or confuse exit doors or signs or exit passageways.(6) Exit corridors shall be maintained clear of merchandise at all times and shall be marked by yellow striping on the floor in the corridor and a sign stating "fire corridor must be maintained clear at all times." Also, the exitway floor from the stock room to the exit shall be marked with yellow striping and shall be maintained clear at all times.(7) Exit access and exit discharge areas shall be so maintained as to provide a permanent, reasonable straight path of travel unimpeded by railings, barriers or gates dividing such areas into sections ancillary to adjoining individual rooms or spaces.(8) Aisles. In every portion of a building or area where seats, tables, merchandise, equipment or similar impediments to egress are present, required aisles shall be maintained free of all obstructions. Aisles, corridors or passageways leading directly to every exit shall be created and maintained in open floor areas where exits are not immediately accessible. Except where single exits or limited dead ends are permitted by the Building Code or other regulations, such aisles shall be so arranged as to provide access to at least two remote exits by separate paths of travel. 154-14. Penalties for offenses.A. Any person who shall violate any of the provisions of the Code hereby adopted or who shall fail to comply therewith or who shall violate or fail to comply with any order made thereunder or who shall build in violation of any detailed statement of specifications or plans submitted and approved thereunder or any certificate or permit issued thereunder and from which no appeal has been taken or who shall fail to comply with such an order as affirmed or modified by the Bureau of Fire Prevention or by a court of competent jurisdiction, within the time fixed herein, shall, severally, for each and every such violation and noncompliance, respectively, be guilty of a misdemeanor punishable by a fine of not less than $250 nor more than $500 or by imprisonment for not more than 30 days, or by both such fine and imprisonment. The imposition of one penalty for any violation shall not excuse the violation nor permit it to continue, and all such persons shall be required to correct or remedy such violations or defects within a reasonable time;

and when not otherwise specified, each day that prohibited conditions are maintained shall constitute a separate offense subject to the above fines.

TOWN OF WOODBURY EGRESS LAW

B. If the exitway floor to the exit in the stock room or the aisle is found blocked or has merchandise, equipment or similar impediments to egress, the store shall be closed until the following day when a further inspection shall be made by the Fire Marshal to determine if the exitway or aisle is cleared. Such violation shall be subject to a fine of $500 per day. Each day that the prohibited conditions are maintained shall constitute a separate offense subject to said fine. [Amended 2-4-1999 by L.L. No. 2-1999]C. If the exit corridor is found blocked or has merchandise, equipment or similar impediments to egress, the store shall be closed until the following day when an inspection shall be made by the Fire Marshal to determine that the corridor is cleared. The NYS Energy Code Sec 803.2.3.1 requires at least one programmable thermostat for each heating and cooling system in commercial occupancies that are new or remodeled.The energy code has also now requires the insulation R rating to be R-49 for commercial buildings.

Rules for Open Remodels:

 1) Total separation of work area with solid barricades (sheetrock walls, etc.)

2) Access to work area by store staff is not permitted for any reason!

3) Access to occupied store or stock areas by construction work force is limited to off hours.

4) All building codes shall be adhered to.

5) Temporary wiring shall comply with NEC.

6) Alarm and sprinkler systems shall remain in working condition.

7) Remodeled areas shall NOT be occupied or stocked until ALL tests and approvals are certified by Building Department officials.

8) Required exits shall remain unobstructed at all times.

9) For overnight work, Sales Areas SHALL be returned to code compliance configurations BEFORE the store is reopened.

10) The Building Dept. and Fire Marshall must approve a request for an open remodel.

THE FOLLOWING TEXT IS THE SECTION OF CODE AS IT APPLIES TO EXITS AND AISLES.

TOWN OF WOODBURY CODE: § 154 - 6. Means of egress.

(1) Exits shall be maintained to provide free and unobstructed egress from all parts of the building or structure.(2) Materials shall not be placed, stored or kept in stairways or corridors.(3) No aisle or passageway shall be obstructed so as to reduce its required width as an exit.(4) Exit corridors shall be maintained clear of merchandise at all times and shall be marked by yellow striping on the floor in the corridor and a sign stating "fire corridor must be maintained clear at all times." Also, the exitway floor from the stock room to the exit shall be marked with yellow striping and shall be maintained clear at all times.

§ 154-14. Penalties for offenses.A. Any person who shall violate any of the provisions of the Code hereby adopted or who shall fail to comply therewith or who shall violate or fail to comply with any order made thereunder or who shall build in violation of any detailed statement of specifications or plans submitted and approved thereunder or any certificate or permit issued thereunder and from which no appeal has been taken or who shall fail to comply with such an order as affirmed or modified by the Bureau of Fire Prevention or by a court of competent jurisdiction, within the time fixed herein, shall, severally, for each and every such violation and noncompliance, respectively, be guilty of a misdemeanor punishable by a fine of not less than $250 nor more than $500 or by imprisonment for not more than 30 days, or by both such fine and imprisonment. The imposition of one penalty for any violation shall not excuse the violation nor permit it to continue, and all such persons shall be required to correct or remedy such violations or defects within a reasonable time; and when not otherwise specified, each day that prohibited conditions are maintained shall constitute a separate offense subject to the above fines.B. Procedures for Electrical Power Failures

In the event of a major electrical power failure, the following shall apply:

Store management shall commence the evacuation of their respective stores.

1) The Food Court shall be closed and evacuated.

2) Thirty (30) minutes after the initial power loss, the Center Management Team will notify store management to complete the evacuation of their respective stores.

3) Management may remain at their stores. They shall use only battery powered artificial lighting. Candles or other heat producing lighting methods are not permitted at any time.

4) Customers are permitted to remain in the common areas of the property until the power returns. In the event of a prolonged power loss customers shall be directed to leave the property.

These measures are being taken in the interests of Public Safety. The Emergency power systems installed in the occupancies are rated to last for one (1) hour. The emergency power systems include the emergency lighting and the fire alarm audio and visual signaling systems.

Store Electrical Requirements

ALL electrical work being performed in a space including existing installations, (whether it be a retrofit or remodel) is required to have a complete and thorough inspection prior to opening by our authorized Electrical inspector. Please contact Fred Cocks at 90 Lakes Road, Monroe, NY 10950: (845) 783-9309. The center management office may be contacted for a summary of specifications that will be required. This inspection certificate will be needed to obtain the final “CO” in order to open for business.

When a major renovation and/or fit-up (walls and/or ceiling removed or constructed) is performed, all existing Romex and/or AC (BX) cables must be removed.

When a minor renovation and/or fit-up is performed, all discontinued cables are to be completely removed.

Properly secure ALL cables and conduits in or above ceiling areas.

All switches and receptacles shall be rated at 20 amps. Note: Circuit breakers are not to be used to switch lighting circuits unless rated for switching.

All lighting shall be supported independently from the suspended ceiling Tee Bars.

Provide proper identification for all junction boxes.

All circuits are to be property labeled.

All circuits shall be checked and balanced and recorded and submitted to the electrical inspector at the final inspection.

Copy of the underwriters certificate shall be given to the center management office.

If any unsafe conditions are encountered during construction, they shall be reported to the center Director of Operations.
