REGULAR MEETING MINUTES

90 Kerby Road January 8, 2018 7:00 p.m.

A regularly scheduled meeting of the City Council for the City of Grosse Pointe Farms was called to order at 7:05 p.m. on Monday, January 8, 2018, by Mayor Louis Theros, at 90 Kerby Road, Grosse Pointe Farms, Michigan.

Present: Mayor Louis Theros, Mayor Pro Tem James C. Farquhar, Councilmembers John J. Gillooly, Therese Joseph, Joe Ricci, Peter Waldmeir, and Lev Wood.

Absent: None

Also Present: Messrs.; Shane Reeside, City Manager; Derrick Kozicki, City Clerk/Assistant City Manager; Dan Jensen, Director of Public Safety; Terrance Brennan, Director of Public Services; Brian Keesey, City Planner; William T. Burgess, City Attorney; and Mlle. Deborah Peck, City Controller/Treasurer.

Mayor Theros led the Pledge of Allegiance.

Council considered the Minutes of the Regular Meeting held on December 4, 2017.

Mayor Theros moved to approve the Minutes of the Regular Meeting held on December 4, 2017. Motion carried.

Council held a ceremony for the promotion of Vincent Finn from Public Safety Officer to Seargent.

Council heard a presentation of the Fiscal Year End 2017 Audit and CAFR by Plante Moran, City Auditor.

Council considered a request from the Grosse Pointe Historical Society for a conditional use change at 375 Kercheval Avenue.

The following Exhibits were provided to the City Council: A) Memo from Terry Brennan, Public Service Director entitled, “375 Kercheval, Conditional Use Request;” B) Letter from Brian Keesey, City Planner entitled, “Grosse Pointe Historical Society Office/Resource Center;” and C) Site Plan Application Package.

Patricia O’Brien, President of Grosse Pointe Historical Society (GPHS), James Conway, Executive Board Member GPHS, and Bob Ross of Ross Construction Inc., gave a presentation on their request for a conditional use change at 375 Kercheval Avenue.

Waldmeir asked if there was a formal landscaping plan.

Bob Ross stated that there was not a formal landscaping plan but the GPHS would accept a conditional approval contingent on administrative approval of a landscaping plan.

Waldmeir asked if there was room for a garage to be built on the site if the building was used for a residence.

Bob Ross stated that there is room for a garage to be built and it would comply with the Zoning Ordinance.

Mayor Theros opened the Public Hearing at 7:25 p.m.

No written comments were received from the public.

Paul Hawk, 384 Kercheval spoke about an unrelated public safety matter.

Mayor Theros closed the Public Hearing at 7:30 p.m.

Waldmeir asked if the use of the property would change.

Patricia O’Brien stated that the properties use would not change.

Waldmeir motioned, Ricci seconded to approve the conditional use for the occupancy of the proposed one-family residential structure design at 375 Kercheval, by the Historical Society of Grosse Pointe for use as an office and resource center as outlined in Public Service Director Terry Brennan’s memorandum (Exhibit A). This use is the same use approved by City Council on September 12, 2016 for this property. Such motion is based on the proposed use meeting the standards in Section 2502 of the Zoning Ordinance described in the Brian Keesey’s Letter (Exhibit B). Furthermore, approval of the conditional use is subject to administrative approval of a landscaping plan. YES: Theros, Farquhar, Gillooly, Joseph, Ricci, Waldmeir, and Wood. NO: None. ABSENT: None. Motion carried.

Council held a Public Hearing for the consideration of the vacation of a public easement at 306 Provencal Road.

The following Exhibits were provided to the City Council: A) Memo from Derrick Kozicki, City Clerk entitled, “Vacation of Public Easement at 306 Provencal Road;” B) Letter from Stephen Brownell, Property Owner; and C) Resolution approving the vacation of the public easement at 306 Provencal Road.

Stephen Brownell, property owner of 306 Provencal Road, spoke to City Council about the request for a vacation of the public easement and how the original need for the easement is no longer valid.

City Attorney Burgess stated that he drafted the proposed resolution authorizing the vacation of the easement at 306 Provencal Road.

Waldmeir motioned, Ricci seconded to approve the resolution approving the vacation of the public easement at 306 Provencal Road. Motion carried.

Council considered the following five items on the Consent Agenda.

a. Approval of the reappointment of the Thomas Youngblood to the Board ofReview for a term expiring February 2021.

b. Consideration of a request from Administration to reschedule the March 27,2018 Board of Review Meeting to March 19, 2018.

c. Consideration of a request from the Water Superintendent to replace watermeter reading system.

d. Consideration of Wayne County Annual Permit renewals.e. Consideration of a request from the Finance Director to approve December

2017 invoices.

Gillooly motioned, Farqhuar seconded to approve the aforementioned items on the consent agenda. Motion carried.

Mayor Theros presented Council with his 2018 Committee assignments.

Waldmeir motioned, Gillooly seconded to approve the Mayor’s 2018 Committee assignments as presented. Motion carried.

Mayor Theros adjourned the meeting at 7:43 p.m.

Re: Proposed PY 2018 Community Development Block Grant Program Funding

The City is a participant in Wayne County’s Community Development Block Grant Program. As an entitlement county, Wayne County distributes funds to participating communities, such as Grosse Pointe Farms, through a formula grant application process. For Plan Year (PY) 2018 the City has been allocated $34,749.00 in CDBG funds.

The proposed activities include:

Resolution Approving PY 2018 CDBG Application

WHEREAS, Wayne County is preparing an Annual Action Plan to meet application requirements for the Community Development Block Grant (CDBG) program, and

WHEREAS, Wayne County has requested CDBG-eligible projects from participating communities for inclusion in the Action Plan, and

WHEREAS, the City of Grosse Pointe Farms has duly advertised and conducted a public hearings on December 27, 2017 and January 22, 2018 for the purpose of receiving public comments regarding the proposed use of PY 2018 Community Development Block Grant funds (CDBG) in the approximate amount of $34,749.00, and

WHEREAS, the City of Grosse Pointe Farms found that the following projects meet the federal objectives of the CDBG program and are prioritized by the community as high priority need.

Re: Recommendation to Authorize Lake Shore Road Sewer Interceptor Investigation Cleaning and Televising Program City of Grosse Pointe Farms

Gentlemen:

In accordance with your request, Hubbell, Roth & Clark, Inc. (HRC) solicited and is in receipt of a quotation from Inland Waters Pollution Control, Inc. (IWPC) of Detroit, Michigan to perform cleaning and televising of the Lake Shore Road Sewer Interceptor in order to evaluate its condition. This investigation is proposed to be undertaken as a result of meter data obtained from the Lakeside District over the last eight (8) months which revealed excessive infiltration/inflow (I/I), particularly during dry weather periods, as well as surcharging in the Lake Shore Interceptor during larger rain events. This data suggests that there is excessive I/I in the Lakeside District - in particular for an area with separated sewers – which necessitates further investigation. The Lake Shore Interceptor is the first step in aneffort to identify the sources of I/I in the Lakeside District.

The proposed Lake Shore Road Sewer Interceptor Televising and Cleaning Program will be comprised of investigation, cleaning and televising of the following length of sewers:

18” Dia. Sewer – 1,359.4 LF 24” Dia. Sewer – 4,538.2 LF 27” Dia. Sewer – 1,095.2 LF 30” Dia. Sewer – 3,156 LF

Based upon the quotation received from IWPC, construction is estimated at $137,312.75, which includes traffic control, bypass pumping, and debris/sludge handling and disposal, as per the attachment.

Inland Waters Pollution Control, Inc. has satisfactorily completed several sewer rehabilitation projects, including televising, cleaning, grouting and cured-in-place (CIPP) lining for Grosse Pointe Farms in the last five (5) years and is currently under contract to provide these services on an as-needed basis in the City.

Our office recommends that the City authorize the Lake Shore Road Sewer Interceptor Televising and Cleaning Program to Inland Waters Pollution Control, Inc. (IWPC) of Detroit, Michigan, with a total estimated construction cost of $137,312.75, which will be incorporated into a Change Order No. 5 under their current Sewer Rehabilitation Program contract with the City. Enclosed, please find IWPC’s signed proposal and breakdown of costs. Further, the total budget would include a not-to-exceed maximum of $35,000.00 for construction engineering fees and $15,000.00 for construction contingencies.

SCOPE OF WORK

We propose the following work items: • Provide localized traffic control measures.• Provide localized bypass using 4", 6" or 8" trash pump accordingly. Bypass pumping is for dry

weather flow only.• Pumps size larger than 8" will require manhole modification and removal of steps which is not

included in pricing.• Provide CCTV record of the sewer inspection, wherever possible, and confirming the areas

identified as Grade 4 and Grade 5 defects. The record will be prepared in PACP format.• Prepare and submit reports and documentations.• Removal, handling and disposal of sludge (2" debris assumed)

ADDITIONAL CONDITIONS AND REQUIREMENTS This permit is subject to the following conditions and requirements as indicated by the numbers checked in the "authorization" section.

1. Post a bond of sufficient amount to cover anticipated clean-up costs, in addition to other such penalties as may be stipulated by Part 89, littering, of Act 451, P. A. 1994, as amended.

2. Permittee must have proof of current American Power Boat Association membership in possession when testing watercraft.

3. All participants must have American Power Boat Association approved personal floatation device or Coast Guard approved personal floatation device.

4. Markers (buoys, trail markers, etc.) for intended event(s) must be placed on the day of event(s) and removed as soon after the completion of the scheduled event(s) as is practicable, except in cases where the State or Coast Guard buoy permit has been issued authorizing permanent establishments of buoys.

5. Any litter resulting from this event shall be cleaned up immediately after the event by the Permittee.

6. All craft participating in the event must have identification attached and the sponsor shall be responsible to have all craft removed from the area after the event.

11. This event and vessels participating in this event SHALL NOT impede commercial shipping and must yield the right-of-way to any commercial ship.

12. This permit does not authorize any special privileges regarding use of state owned public access sites. Special Use Permits for public access sites must be obtained from the Michigan DNR, Parks and Recreation Division at 517-373-9900. Hours of operation and site rules will not be altered.

13. This sanction is valid only if a resolution is obtained to waive the Special Watercraft ordinance on said body of water, and resolution must accompany this permit at time of application.

14. LIABILITY - Grantee hereby releases, waives, discharges and covenants not to sue the Slale of Michigan, no departments, officers, employees and agents, from any and all liabilfy to Grantee, no officers, employees and agents, for all losses, injury, death or damage, and any claims or demands thereto, on account of injury to person or property, or resulting in death of Grantee, its officers, employees or agents, in reference to the activities authorized by this permit.

7. All fishing laws, rules and Director's Orders of the Michigan Department of Natural Resources, when applicable with this sanction, must be complied wnh.

15. INDEMNIFICATION - Grantee hereby covenants and agrees to indemnify and save harmless, the State of Michigan, its departments, officers, employees and agents, from any and all claims and demands, for all loss, injury, death or damage, that any person or entity may have or make, in any manner, arising out of any occurrence related to (1) issuance of this permit; (2) the activities authorized by this permit; and (3) the use or occupancy of the premises which are the subject of this permit by the Grantee, its employees, contractors, or its authorized representatives.

8. Sponsor of the event(s) shall publish in the local paper a Notice To Boaters that a hazardous condition will exist in the area during the fireworks display or other authorized event.

9. If another organization requests the use of these waters on one or more of the sanctioned dates, this authorization will be subject to review and possible cancellation for that date or dates.

10. No registration or license is required for ORVs and snowmobiles participating in a special event under authority of this permit.

16. PENAL TY - The Michigan Department of Natural Resources reserves the right to cancel this permit at any time if conditions and requirements are not adhered to.

Instructions for Application for Fireworks Other Than Consumer or Low Impact

Applications shall be submitted to the legislative body of a city, village or township board. A permit may be issued as a result of official action by the legislative body. A permit shall be valid only for use within the limits of the jurisdiction of the legislative body of a city, village or township board.

1. Type of Permit - check all boxes that may apply to the type of permit needed. You may select several permit types depending on your fireworks display. You may check with your legislative body of a city, village or township board for assistance when making your selection. Please review the following definitions to determine which type of permit to select:

• Agricultural or Wildlife Fireworks - devices distributed to farmers, ranchers, and growers through a wildlife management program administered by the US Department of Interior or Michigan DNR.

• Articles Pyrotechnic - 1.4G fireworks for professional use only that is classified as UN0431 or UN0432. • Display Fireworks - 1.3G fireworks for professional use only • Special Effects Manufactured for Outdoor Pest Control or Agricultural Purposes - devices with a

combination of chemical elements or compounds capable of burning independently of the oxygen of the atmosphere and designed and intended to produce an audible, visual, mechanical or thermal effect for pest or animal control.

• Public Display- a fireworks display that is open to all persons for viewing. • Private Display - a fireworks display that is not open to the general public for viewing.

2. Name of applicant - list the name of the applicant. The applicant may be a person representing an organization, group, firm or corporation, or self. If the applicant is also the operator, enter the same name in the operator's section.

3. Address of applicant - complete the address of the applicant; include the street address, city, state and zip code.

4. Name of person or resident agent representing corporation, LLC, OBA or other- list the name of the person or resident agent that represents the corporation, LLC, OBA or other.

5. Address of person or resident agent that represents the corporation, LLC, OBA or other - list the address of the person or resident agent representing the corporation, LLC, OBA or other.

6. Non-resident applicant - list the name of the non-resident applicant. A non-resident applicant shall appoint a Michigan attorney or Michigan resident agent in writing to be the applicant's legal representative upon whom all service of process in any action or proceeding may be served.

7. Name of pyrotechnic operator- list the name of the pyrotechnic operator. The pyrotechnic operator is the person in charge of the display. The legislative body of a city, village or township board shall rule on the competency and qualifications of the operator before granting a permit and may require an affidavit from the applicant as to the operator's experience, former pyrotechnic accidents, criminal record, sobriety, etc.

8. Address of pyrotechnic operator - list the address of the pyrotechnic operator; include the street address, city, state and zip code.

9. Age of the pyrotechnic operator - list the age of the pyrotechnic operator; the operator must be 18 years of age or older.

10. Name of assistant - list the name of the assistant to the pyrotechnic operator;

11. Address of assistant - list the address of the assistant; include the street address, city, state and zip code. If there is more than one assistant, please list additional assistants on a separate sheet and include the address and age of those additional assistants.

12. Age of assistant - list the age of the assistant to the pyrotechnic operator; the assistant must be 18 years or older.

13. Name of other assistant - list the name of other assistant to the pyrotechnic operator.

14. Age of other assistant- list the age of the assistant to the pyrotechnic operator; the assistant must be 18 years or older.

15. Exact location of proposed display- list the address of the exact location of the proposed fireworks display.

16. Date of proposed display - indicate the date of the proposed fireworks display; only one display date can be used per application.

17. Time of proposed display- indicate the time of the proposed fireworks display.

18. Manner and place of storage - indicate the manner and place of storage within the legislative body of a city, village or township board of fireworks that are ready for display, just prior to the display in the area of exhibition. The legislative body of a city, village or township board shall obtain approval from the local fire authorities of the manner and place of storage before any permit is issued.

19. Amount of bond or insurance - the issuing legislative body of a city, village or township board shall set the amount of and proof of bond or insurance for the protection of the public to satisfy claims for damages to property or personal injuries arising out of any act or omission on the part of the person, firm or corporation, or any agent or employee of the applicant. The applicant shall assure the bond or insurance required is provided.

20. Name of bonding corporation or insurance company - provide the name of the bonding corporation or insurance company for which the bond was issued through.

21. Address of bonding corporation or insurance company- list the address of the bonding corporation or insurance company; include the street address, city, state and zip code.

22. Number of fireworks and kind of fireworks to be displayed- indicate the total amount of fireworks proposed for the display or use and a description of the type of fireworks for display; such as 10 aerial bombs, 30 aerial rocket bursts, etc.

23. The application is valid for the calendar year in which the application was received and permit was issued.

24. Permit fees shall be established by the legislative body of a city, village or township board and shall be submitted to and retained by legislative body of a city, village or township board.

25. Permitting will be in compliance with the Michigan Fireworks Safety Act, PA 256 of 2011, MCL 28.466, Section 16.

26. Mail the application to the legislative body of a city, village or township board within the location jurisdiction of the display. DO NOT mail the application to the Bureau of Fire Services (BFS). If mailed to the BFS, it will be returned to the sender.

GENERAL FUND

REVENUE

• Included in revenue is $4,084,184 related to bond proceeds and premium, which was not part of the original budget. Council will be asked to approve this amount as part of the annual budget amendments. With this item removed from our current review of activity through December:

o Total YTD Revenue=$ 11,970,951, or 84.1% of budget o Other Financing Sources - YTD total = $0, or 0% of budget

• Revenue (excluding bond proceeds and premium) through the 2nd quarter is up 3.6% as a percentage of budget when compared to last year.

• Building permit revenue totaled $139,537 vs. $48,657 for the same period last year. The increase in revenue to date is due to a number of large construction projects permitted during this first half of the year. We have already exceeded this budget line item with over 107% collected in this six months alone.

• Investment income is up $12,303 compared to last year.

• Charges for services is up $417,407 when compared to last year. This is largely due to the timing of receivables, including boat mooring fees and the Wayne County sewage lease which were billed later in the fiscal year in 2017. We expect this category to meet budgeted levels.

• State Shared Revenue payments for this fiscal year are received beginning November 1st and continue through August 2018, according to the State of Michigan's budget cycle. At this time, we expect those payments to be in line with our budgeted revenue.

EXPENDITURES

• Included in expenditures is $4,084,184 related to the payment of a lawsuit settlement from bond proceeds and the related issuance costs, which were not part of the original budget. Council will be asked to approve this amount as part of the annual budget amendments. With this item removed from our current review of activity through December:

o Total YTD Expenditures=$ 8,174,408, or 57.4% of budget o Contingency- YTD total= $13,696, or 26.8% of budget

• Expenditures through the 2nd quarter are down 2.1% as a percentage of budget when compared to last year.

• Other than mentioned above, those functions that are over 50% of budget are due to timing issues of annual payments made in the first half of the fiscal year which cover the entire year.

COMMENTS

• Overall the General fund revenues and ex·penditures to date appear in line with the budget, when taking into consideration timing differences and seasonal expenditures and when compared to the same period last year.

WATER/SEWER FUND

• Utility bill revenue is down for the first six months compared to last year by approximately $329,000. The first quarter consumption in 2016-2017 was considerably higher than the previous three years. The consumption billed through December 2017 reflects usage levels closer to historical averages, but down 15% from the same period in the prior year. We have budgeted for the sale of 61.5 million cubic feet of water in the 2017-2018 fiscal year. During the first six months, 37.7 million cubic feet was billed. We will continue to closely monitor our actual consumption to our budget estimate.

WINTER MAINTENANCE

• Our w inter maintenance cost for the first half of this year is $33,076, which is down $5,654 compared to the same period last year.
