This item presents for the Board’s consideration those citizens that have comments pursuant to GS 160-81.1.

§ 160A-81.1. Public comment period during regular meetings. The council shall provide at least one period for public comment per month at a regular meeting of the council. The council may adopt reasonable rules governing the conduct of the public comment period, including, but not limited to, rules (i) fixing the maximum time allotted to each speaker, (ii) providing for the designation of spokesmen for groups of persons supporting or opposing the same positions, (iii) providing for the selection of delegates from groups of persons supporting or opposing the same positions when the number of persons wishing to attend the hearing exceeds the capacity of the hall, and (iv) providing for the maintenance of order and decorum in the conduct of the hearing. The council is not required to provide a public comment period under this section if no regular meeting is held during the month. (2005-170, s. 3.) Time Limit: 5 minutes

At 10:00 a.m. Mayor Joyce Dunn called to order the Board of Commissioners Workshop Meeting.

Administrative Reports:

Town Administrator Report/Jon Mendenhall – On file at Town Hall. Mr. Mendenhall reviewed the report below: Administrative November administrative work has focused on a great deal of emergency management and responding to Hurricane Matthew and work is on-going in the following areas:

1. Farm at Brunswick – Phase 11 final plat is on the December agenda. 2. Calabash Lakes – Phase 3 asphalt down, Phase 4 engineering plans in review. 3. Lighthouse Cove – Phase 1 surface course installation pending, Phase 2 development

pending. 4. Village at Calabash – Nautical Lane capital project mobilized and starting demolition. 5. Carolina Shores Subdivision – drainage spot improvements pending.

Finance The audit will be presented in December. Finance is working on FEMA public assistance related to Hurricane Matthew. A budget amendment is needed for December, 2016 and will be presented as part of the monthly finance report at the conclusion of this report. Public Works Maintenance Maintenance is working in two areas: roadside ditch and roadside vegetative cutting. The current area on the roadside ditch program list is Bayberry. We expect to curtail roadside ditch once Bayberry is complete for the winter months and focus on roadside and drainage system vegetative cutting (drainage system will only be in those areas that are needed since our bi-annual program is fall and spring. We will resume the list of roadside drainage work in the

spring to accomplish the remainder: Sunfield and Pinewood which will afford Maintenance Division sufficient time to cut back the vegetative growth in those areas to allow for roadside ditch work to commence. FEMA – Category A (debris removal is complete), Category C – Roads, Category D – Drainage, Category E – Buildings/Facilities are all now eligible categories. Finance is working on how procurement needs to be handled for these items.

(sink-hole forming, need drainage systems repairs, patching). 8. Armor all wash-out areas in public canal/ditch system. 9. Armor run of Saltaire Canal in 90deg turn areas with rip-rap.

a. In emergency repair design with East Coast currently 10. There is a possibility of up to 6 individual spot improvements in close proximity to the

above listed 6 that are permanent repairs that would fall outside of FEMA reimbursement; we anticipate using the same contractor.

Asphalt Work - In-house we’re going to get up to a speed with the newly purchased asphalt equipment. In-line with FEMA permanent repair patching associated with culvert and wash-out repair, the plan is to do some vicinity patching with hot mix. It was the consensus of the Board to have the silt/much, debris hauled to an individual who will accept it if we haul it. Debris Removal Site – a reduction order is forthcoming for the contractor to reduce the vegetative debris, a private site has been identified that will accept muck/silt and a simple agreement is being drafted to enable the discontinuance of the Persimmon Road site. Inspections Inspections volume picked-up tremendously by the end of November. At one point there were 16 new home permits applied for just by 1 builder. As indicated in the budget, revenues are largely on track for the fiscal year. Public Safety Code Compliance is working on:

- Storm Ready Community Rating – training set for employees and public for January 19, 2017 at 10am.

- Employee ID badges – work in progress. - Roundtable emergency management training for the area in cooperation with Brunswick

County Emergency Services – suggestions sent, awaiting reply.

Project Drainage Drainage Spot Improvement Project (DSIP) Pursuant to the implementation guidance, implementation is proceeding as discussed in November. Town-wide Drainage Study Work in progress. Town Hall Campus Stormwater Improvements Being re-studied and needs discussion on R/W problems. Resurfacing Annual Resurfacing Project

1. Nautical Lane – mobilized, demolition is starting

Incorporations via Reference Inspections – please refer to the Inspections report as provided Public Safety – please refer to the Calabash VFD Report as provided Finance Report: (A copy of the report is on file with the Town Clerk).

Ms. Munday, Finance Director gave the Finance Report. Ms. Munday said the beginning balance was $4,655,256.00 with year-to-date expenditures totaling $1,283,892.00 and revenues at $590,184.00 leaving an ending balance on November 30th of $4,212,456.00. Ms. Munday said the Budget Amendment Ordinance is for the chipper. Ms. Munday said we will increase the Appropriated Funds by $36,760.00 and increase the Capital Outlay by $36,760.00. COMMISSIONER MANNING MADE A MOTION TO APPROVE THE BUDGET ORDINANCE AMENDMENT IN THE AMOUNT OF $36,760.00. COMMISSIONER BRENNAN SECONDED THE MOTION. MAYOR DUNN ASKED IF THERE WERE ANY DISCUSSION. MAYOR DUNN CALLED FOR A VOTE AND MOTION CARRIED BY UNANIMOUS VOTE.

Review of Annual Audit:

Mr. Isaac Norris gave the review of the annual audit. A copy of this audit is on file at Town Hall.

Committee & Volunteer Group Reports:

Calabash Fire Department – Commissioner Dale said the number of fire calls from the Calabash Fire Department through the end of November is 1,789 calls. Commissioner Dale said 2,000 calls is the projected number through the end of this year and would break the record by 10%. Commissioner Dale said so every year it seems to increase and I would like to say that I had a personal experience a couple of weeks ago to have 911 responders come to my house.

Commissioner Dale said they do a real professional job and I’m really proud of our Fire Department and what they do and how they do it. Commissioner Dale said the Fire Department Auxiliary is initiating a fund raiser and what these are, are house numbers that glow in the dark and they are available for $15.00. Commissioner Dale said a little bit of the money goes to the Auxiliary but most important, it’s really necessary to have reflective numbers like this in front of your house, particularly if you live in my subdivision where the house across the street from me is 25 different than my house number. Commissioner Dale said it is important that house number be visible and particularly at night. Commissioner Dale said I would encourage anybody and everybody to get one of these in front of your house. Keep Brunswick County Beautiful – Commissioner Dale said the quarterly newsletter just came out and usually they are a good newsletter but this one is really excellent and it has to do with recycling. Commissioner Dale said he would like copies and make it available to the Board. Recycle Center – Commissioner Dale said we have new stickers available and they started to be issued last Thursday and almost 200 have been issued by10:00 this morning. Commissioner Dale said I am going to appeal to Mr. Mendenhall and see if we can get the speed and counter sign placed at the Recycle Center for a whole week. Commissioner Dale said I think it would be really helpful. Commissioner Dale said he is guessing we are averaging over 2,000 vehicles there a week. Commissioner Dale said if we get the counter there, we can verify that. Commissioner Dale said it seems like there are more people using it. Mayor Dunn said unfortunately Commissioner Timothy had another appointment and hasn’t been able to get here yet and she probably had the most important report in the room today. Mayor Dunn said for those of us that were there on Saturday night for the first Annual Christmas Tree Lighting at Town Hall, we can all report for her that it was a really outstanding event. Mayor Dunn said a lot of people came out and I think we had the best Santa around Town. Mayor Dunn said if any of you are in need of a Santa, I know where there is a good one. Mayor Dunn said Mary and her group of volunteers did an amazing job and all the comments I have heard are very positive and I think next year we better plan for a lot more people.

Consideration of Liaison Appointments for Boards, Committees, and Volunteer Groups: COMMISSIONER MANNING MADE A MOTION TO APPROVE THE CONSIDERATION OF LIAISON APPOINTMENTS FOR BOARDS, COMMITTEES, AND VOLUNTEER GROUPS. COMMISSIONER DALE SECONDED THE MOTION. MAYOR DUNN ASKED IF THERE WERE ANY DISCUSSION. MAYOR DUNN CALLED FOR A VOTE AND MOTION CARRIED BY UNANIMOUS VOTE. d. Consideration of Solid Waste Collection and Disposal Contract Renewal: Mr.

Mendenhall discussed this item with the Board. It was the consensus of the Board of Commissioners to renegotiate the contract and make it a two year contract ending on December 31, 2018. Mr. Mendenhall to bring this item back to the Board of Commissioners once it’s revised.

e. Consideration of a Request to Relinquish ETJ for Parcel ID 24100033: Mr. Mendenhall

discussed this item with the Board of Commissioners.

COMMISSIONER DALE MADE A MOTION TO DISAPPROVE THE REQUEST TO RELINQUISH ETJ FOR PARCEL ID 24100033. COMMISSIONER DAVIS SECONDED THE MOTION. MAYOR DUNN ASKED IF THERE WERE ANY DISCUSSION. MAYOR DUNN CALLED FOR A VOTE AND MOTION CARRIED BY UNANIMOUS VOTE. f. Discussion of Improvements to the Town Website: Mr. Mendenhall discussed this item

with the Board of Commissioners. Mayor Dunn asked the Board to look at Ocean Isle Beach, Calabash and the Sunset Beach websites. Mayor Dunn said I would like to see a creative web design that we have control over, with more flexibility. Commissioner Brennan said we have to be careful because then you run a greater risk of being hijacked. It was the consensus of the Board to have Mr. Mendenhall put together a table with choices for the Board to select from.

Public Comment:

Dan Mann, 77 Persimmon Road – Mr. Mann said about the crossovers being blocked on Highway 17, I’m assuming and I hate to use the word assume but I’m assuming they are going to be Michigan turns. Mr. Mann said I am going to guarantee you that you are going to see a lot of people complain because people are going to start to use the Parkway to get to Highway 17. Mr. Mann asked if NCDOT notified anybody that this was going to happen. Grace Minerva, 56 Holly Court – Ms. Minerva said I have spoken to Jon regarding the ditch along Cedar Tree. Ms. Minerva said we have a lot of problems with flooding, not me particularly but several of my neighbors have had a problem. Ms. Minerva said I know you have an engineer but what I would like to know is has he come to any conclusion as to how that problem can be solved. Ms. Minerva said the other thing is, we have the County dumping there, right outside Cedar Tree, right outside our driveway and now the roadway is dug up. Ms. Minerva said I know this is not your problem but what I would like to know is if you know who we would call to discuss it. Ms. Minerva said the other thing is the mess that is on the other side of the ditch where there is digging on the back, it looks like a sand bar, it looks horrible. Ms. Minerva said we also had a problem with the water department; they put pipes in and again dug in the area where the County dumped all that stuff and they have completed our roadway. Ms. Minerva said they dug it up and they did put blacktop down there but when you drive over it,

there is a big bump. Ms. Minerva said one of my neighbors called them and they did come down and they said well no, we are within our right to be two inches high. Ms. Minerva said meanwhile you drive over it and it’s flat on one side and high on the other side, so according to them they did the right thing. Ms. Minerva said could you suggest who we could call for that. Ms. Minerva asked about the CawCaw and if that’s been addressed because the water has no place to go. Richard Burkett, 99 Cedar Tree Lane – Mr. Burkett said with the water department, when they ran the line in, they threw some grass seed down which kind of went away. Mr. Burkett said we called them and they said grass is dormant now and will this gentleman that you mentioned be able to help us with that as well. Mr. Burkett said I noticed they are doing a lot of work over there now and kind of shoring up the sides and stuff and what is this going to be down there, where they have dug all that cleared that area out. Mr. Burkett said your property on the Carolina Shores side or Persimmon Road and I wonder what that is going to be. Steve Gornick, 17 Sunfield Drive – Mr. Gornick said I believe you all just answered all the questions I have but just need some clarification. Mr. Gornick said the area out on Persimmon here, where all these stones and debris are right up to my back yard. Mr. Gornick said it’s an offensive sight; I stare at these piles all day every day. Mr. Gornick said how temporary is temporary. Mr. Gornick said is it possible in the future to put up some type of privacy fence. Mr. Gornick said its bad enough dealing with the noise of the vehicles everyday but having to stare at these mounds is bad. Thank you, Merry Christmas. Walter Goodenough, 905 Palmer Drive – Mr. Goodenough said the reason I am here is last year I mentioned that I didn’t want to see public money being spent on private property and I’ve realized that’s been happening in The Village recently with some trees being taken down. Mr. Goodenough said a resident in The Village was allowed to take down 22 undamaged, healthy trees because he was able to convince the Town they were damaged during the recent Hurricane. Mr. Goodenough said I am here to tell you that not one tree was damaged due to that hurricane. Mr. Goodenough said he had a private contractor come in and drop the trees more than four weeks after the storm and had the Town Maintenance Department, as well as the sub-contractor Brunswick Trucking remove the debris. Mr. Goodenough said I personally saw employees standing by his property waiting for branches to be chipped and then raked up whatever was left on the street. Mr. Goodenough said I believe the Town was using those 22 trees as an excuse to beef up the number for the FEMA things. Mr. Goodenough said and I’m just going to let you know that I am going to talk to FEMA and look into this and see what the procedure is to file a complaint about it. Mr. Goodenough said the other thing you mentioned, you mentioned about the Town Recycle Center being charged for your recyclables. Mr. Goodenough said my question is we have residents in The Village and all around Town that are paying 50, 60, 70 dollars a year additional to have blue containers at their houses. Mr. Goodenough said basically you are paying twice for the service which you guys don’t have a problem with that. Mr. Goodenough said have a nice day, thank you. Commissioner Timothy arrived at 11:15 a.m.

Commissioner Brennan – Commissioner Brennan said the Toys for Tots box has been put in the lobby, it’s available and it’s an annual program. Commissioner Brennan said you can put unwrapped toys in there and it will be there until December 12th. Commissioner Brennan said they showed up late this year; the one for the Village showed up Friday. Commissioner Brennan said it’s a worthwhile program and Toys for Tots has been going on for years. Brennan told Commissioner Timothy that the tree lighting was an excellent thing and I’m pleased to see that we are getting out of emergency stuff and getting back to normal type stuff and that’s a compliment to Jon and the rest of the staff. Commissioner Dale – Commissioner Dale said you have heard me talk about the plight of our attendant over at the Recycle Center. Commissioner Dale said a lot of residents have come forward and have provided some financial assistance, not a great deal but enough. Commissioner Dale said Christmas is coming up and she has three children, I’m not soliciting money. Commissioner Dale said what is more important is that she does not have a suitable place to live and if anybody knows of anything that may be available in the area, where our attendant and her three children can reside with a small rental stipend; I would really appreciate you passing that information along to me. Commissioner Manning – None Commissioner Davis – None Commissioner Timothy – Commissioner Timothy said I would like to say that I have the best group ever. Commissioner Timothy said they are wonderful and they pulled off the tree lighting which was really nice and everyone got to sit on Santa’s lap. Commissioner Timothy said I have heard from other people that they really enjoyed Santa and the whole thing was wonderful. Commissioner Timothy said we had volunteers that made cookies and we had hot chocolate. Commissioner Timothy said we are taking December off and in January we are starting next year’s annual events. Commissioner Timothy said it looks like it is going to be a 50’s style dance like a sock hop. Commissioner Timothy said we are separating the dance from the craft show; there will be two different events as it would be too difficult to do them both together. Commissioner Timothy said there will be more information on that later. Commissioner Timothy said I do have to say that I have the very best group of people. Mayor Dunn – Mayor Dunn said in my basket in the last week or so I received a card that I will read to you. Mayor Dunn said this is just one of many, many e-mails that I have received after we did the storm pick-up. Mayor Dunn read the card: “To all Concerned, Thank you for the clean up following Hurricane Matthew. I appreciate all you do on my behalf. Regards, Hazel Koontz on Mashie Court”. Mayor Dunn said I say to people when they say we are doing a marvelous job, I say it’s the staff. Mayor Dunn said the staff is doing an amazing job, we have the best staff and we are very blessed to have them.

Mayor Joyce Dunn called the December 8, 2016 meeting to order at 2:00 p.m. The Pledge of

Allegiance was recited and there was a moment of silence. Commissioners Present: Mary

Timothy, Gere Dale, John E. Manning, Greg Davis and Bill Brennan. Also Present: Jon

Mendenhall, Town Administrator; James E. Eldridge, Town Attorney and Nicole Marks, Town

Clerk.

Donald Lehman, 2 Pineridge Court – Mr. Lehman said three years ago I put in a request to have

the ditch cleaned in front of my place. Mr. Lehman said three years, every year I put it in and

I’m getting some work done from the Town because Mr. Mendenhall sent me a letter that they

are working my way and I was also told that I am 22nd

on the list. Mr. Lehman said but when I

came in here, which I do about once a month, the ditch foreman or whatever his title is, he said

they couldn’t find my name on the list. Mr. Lehman said I brought back a letter from Mr.

Mendenhall who said that I was on the list which was about a year old. Mr. Lehman said I

would still like to get the ditch cleaned. Mr. Lehman said the other item is the big pine trees, I

think it’s time we get a contract or get somebody to cut I would say the whole Village for the

people that want them cut so we get a better price. Mr. Lehman said those were my two items.

Mayor Dunn suggested that Mr. Lehman discuss the tree matter with Commissioner Dale.

WERE ANY DISCUSSION. Commissioner Manning said on the official calendars for 2017, is

there a reason why we have to change the July meetings. Commissioner Manning said the 4th of

July happens to be on Tuesday. Ms. Marks said when I made the schedules up for 2017, they are

just proposed schedules so the Board can make any changes they would like but last year the 4th

of July did throw things off. Ms. Marks said for 2017, July 4th falls on Tuesday and we didn’t

know if that would be in conflict with any of you being away. Commissioner Davis said that

also cuts into the amount of time you have between our first meeting and our second meeting and

that’s the reason we switched it last year. Mayor Dunn said may I suggest that we leave it the

way it is until we get close to that date and as we approach we realize there is work that we don’t

want to delay; we can always move the meeting. Commissioner Dale said it makes sense any

way because it is a four day weekend and there are those that may want to be out of Town.

Commissioner Davis said that is another thing we always looked at. Commissioner Brennan said

seriously it is a four day weekend. MAYOR DUNN CALLED FOR A VOTE AND MOTION

CARRIED BY UNANIMOUS VOTE.

Administrative Reports:

Administrative Report: Mr. Mendenhall said I don’t have anything to add but I want to wish the

public, the Mayor and the Board a Merry Christmas and a Happy New Year and he appreciates

everyone’s continued support.

Committee Report: Commissioner Dale said I want to bring something up for the Board’s

consideration. Commissioner Dale said early in this year we stopped taking plastic bags at the

Recycle Center because Waste Industries indicated that they were not functional as far as the

assembly line for the Recycle Center. Commissioner Dale said so we stopped taking them and

we have had the attendant put the bags in the garbage container and when it’s filled up, she puts

it in the compactor. Commissioner Dale said the publication that we got from Keep Brunswick

County Beautiful on Monday indicated that not only the plastic grocery bags but all sort of

plastic related materials can be recycled at our local Food Lion and Lowe’s Foods.

Commissioner Dale said I spoke to both of their managers; they are both really willing to take

our material. Commissioner Dale said I explained to them that there may be a large quantity as

much as 5 or 6 large garbage bags, the 96 gallon containers on a weekly basis. Commissioner

Dale said they said no problem, so I would like, if the Board has to endorse this to have the

Board agree to go ahead with this program. Commissioner Dale said I talked to Jon this morning

about the town pick up being used periodically to take the big bags of these bagged material

either over to Lowe’s or to Food Lion. Commissioner Dale said that is the only involvement of

the Town that I see, other than buying the large plastic bags to put into the garbage containers to

contain all of this plastic. Commissioner Dale said so does anybody on the Board have a

problem with that. There was a small discussion on this item. It was the consensus of the Board

to agree to go ahead with this program. There was discussion on whether the Town will accept

Christmas Trees at the Recycle Center and the answer was yes, we do accept them and they go

into the yard waste. Commissioner Dale said we do not pick them up and there are not many, less

than two dozen last year.

Sunfield and Pinewood being two of those streets as part of the program.

Commissioner Davis – Commissioner Davis said just wishing everyone a happy Christmas time

and a Happy New year and we will see you in January.

Commissioner Manning said for those of you who weren’t here on Monday, I think

Commissioner Timothy deserves a lot of credit for the tree lighting that we had for the very first

time here and her group also and I thank you.

Mayor Dunn – Mayor Dunn said I want to express my own gratitude for all the people who have

made my job so pleasant and easy for the past year. Mayor Dunn said we have had to deal with a

lot of major problems but I think we have been able to work our way through successfully on a

a Happy New Year. Commissioner Dale said as a history buff, yesterday was a very meaningful

day for me, the 75th anniversary of Pearl Harbor. Commissioner Dale said I know most of you

weren’t around on Pearl Harbor Day but I was a nine year old. Commissioner Dale said one of

the 10 or 12 days to me over the course of my 75 adult years that has been meaningful and I hope

that everybody recognizes that it was a special day. Thank you.

This report serves as the report of administrative activities undertaken by the Town in the previous month and summarizes administrative, operational, and project updates for the reporting period. Administrative Administrative work has focused on property acquisition as instructed by the Board, a contract is on the January 2017 agenda for review, and the Town pursuant to Board direction in open session in December is within its 30 day due diligence period for the lot in question. A change is being made based on the Arbor Foundation request to have an annual Arbor Day proclamation (this has been placed on the consent agenda for January 2017 and is a pre-requisite for Tree City USA status to continue). On-boarding of an additional office assistant has occurred and a training schedule is in place, there are some IT issues that are being worked through. Hazard mitigation grant funding for flood mitigation work has opened up and in consultation with Holland Consulting Planners (HCP), if it is the will of the Board, flood hazard mitigation work could bear out in a grant application to mitigate future flooding loss in the areas that were flooded during hurricanes Floyd and Joaquin. Redundant connection via the statewide VIPER network has been worked through and a quote received. It is my recommendation that we move forward with interconnecting to VIPER as soon as possible to strengthen our emergency communications redundancy with our intra-county partners as well as with the State Department of Public Safety.

Two important announcements need to be made:

1) Storm Ready Community Training – 10am January 19, 2017 Town is completing storm ready requirements and this is a National Weather Service Training on weather events and severe weather events in particular for staff and the public.

2) Floodplain Management Workshop – 1pm January 23, 2017 This is an informational workshop designed to give information on new floodplain maps, to gauge interest in flood hazard mitigation work, and to allow for one-on-one questions from residents with the North Carolina Division of Emergency Management, the Town Engineer, and the Planning Office. All residents that are concerned with flooding are invited to attend.

Operational Finance Finance is working on FEMA public assistance related to Hurricane Matthew. A budget amendment is needed for January 2017 and will be presented as part of the monthly finance report at the conclusion of this report. Public Works Maintenance Maintenance is working in one area: roadside vegetative cutting. FEMA – Category A (debris removal is complete), Category C – Roads, Category D – Drainage, Category E – Buildings/Facilities are all now eligible categories. Finance is working on how procurement needs to be handled for these items (FEMA has not provided any other guidance on permanent repair work).

BUILDING INSPECTIONS DIVISION MONTHLY ACTIVITY REPORT

November 2016

This report covers the period of November 1-30, 2016. The month of November was very active in all areas including building permits, inspections, plan reviews, and service requests. BUILDING PERMITS & CERTIFICATES OF OCCUPANCY ISSUED 13 permits for new single family attached have been approved (construction value $2,699,584). In addition, there are 6 building permits for repair/remodel underway. 18 certificates of occupancy were issued in November 2016 (construction value $3,363,632) There are 64 valid new home permits open now where the homes are in various stages of construction. OTHER PERMITS ISSUED Mechanical: 7 Electrical: 6 Plumbing: 3 Zoning: 16 Floodplain: 21 Driveway: 13 INSPECTIONS 303 building inspections have been completed. TREE PERMITS Permits: 7 Trees: 62 Approved: 45 Denied: 17 Replacement: 0 OTHER ACTIVITIES Approximately $48,267.15 in permit fees was collected in November 2016. YTD collected $164,043.02. All monthly reports to federal, state, and county have been completed in addition to weekly and monthly reports to construction statisticians. Building inspections staff issued 34 recycle center stickers.

public body in negotiations. The action approving the signing of an economic development contract or commitment, or the action authorizing the payment of economic development expenditures, shall be taken in an open session.

(5) To establish, or to instruct the public body's staff or negotiating agents concerning the position to be taken by or on behalf of the public body in negotiating (i) the price and other material terms of a contract or proposed contract for the acquisition of real property by purchase, option, exchange, or lease; or (ii) the amount of compensation and other material terms of an employment contract or proposed employment contract.

(6) To consider the qualifications, competence, performance, character, fitness, conditions of appointment, or conditions of initial employment of an individual public officer or employee or prospective public officer or employee; or to hear or investigate a complaint, charge, or grievance by or against an individual public officer or employee. General personnel policy issues may not be considered in a closed session. A public body may not consider the qualifications, competence, performance, character, fitness, appointment, or removal of a member of the public body or another body and may not consider or fill a vacancy among its own membership except in an open meeting. Final action making an appointment or discharge or removal by a public body having final authority for the appointment or discharge or removal shall be taken in an open meeting.

(7) To plan, conduct, or hear reports concerning investigations of alleged criminal misconduct.

(8) To formulate plans by a local board of education relating to emergency response to incidents of school violence.

(9) To discuss and take action regarding plans to protect public safety as it relates to existing or potential terrorist activity and to receive briefings by staff members, legal counsel, or law enforcement or emergency service officials concerning actions taken or to be taken to respond to such activity.

(b) Repealed by Session Laws 1991, c. 694, s. 4. (c) Calling a Closed Session. – A public body may hold a closed session only upon a motion

duly made and adopted at an open meeting. Every motion to close a meeting shall cite one or more of the permissible purposes listed in subsection (a) of this section. A motion based on subdivision (a)(1) of this section shall also state the name or citation of the law that renders the information to be discussed privileged or confidential. A motion based on subdivision (a)(3) of this section shall identify the parties in each existing lawsuit concerning which the public body expects to receive advice during the closed session.
