There is a great deal of interest in creating psychologi-cally healthy and safe workplaces. The question is, how does this relate to occupational health and safety and how do you get started? Come fi nd out how this emerging area of interest aligns with federal legislative requirements and how to include it in your hazard prevention program. Session leaders will provide suggestions and guidance on how to get started.

In this ‘hands-on’ session, you will work in groups with real life scenarios. Your group will move through the room to identify hazards, assess them and of-fer sound recommendations for control. Then you will speak to how you evaluate the controls suggested. By the end of both hazard identifi cation sessions, you will have a much better idea of what you need to be looking for when conducting your JHSC monthly workplace inspections.

Accommodating Employees Involved in Harassment CasesKevin MacNeill, Partner, Emond Harnden LLP

It is well known that employers have duties to maintain a harassment-free workplace. But navigating those du-ties is challenging and involves consideration not only of the rights of those alleging harassment, but also those who are the claimed harassers. The situation is made even more complex when, overlaying a potential harass-ment scenario, the duty to accommodate under human rights legislation or workers’ compensation legislation may be involved. In addition to a review of the legal principles, a number of case studies will be considered in an interactive discussion with attendees.

Nanotechnology is a rapidly evolving technology that is being studied by educational institutions, research labs and government regulators and is being applied in a multitude of industries. This presentation will provide an overview of nanotechnology and how it is likely to impact the health and safety fi eld, including insight on how and why nanomaterials are used,potential health e� ects, control strategies, and where Canada stands on this issue in the global world.

The fourth of the fi ve AODA standards, the Employment Standard, comes into e� ect on January 1, 2016. In ad-dition to AODA, WSIB, Ontario Human Rights Code and precedent-setting cases are all impacting how employ-ers interact with potential and existing employees. Mental illness in the workplace is more common than people may think. About 4.2 million employed Canadians live with a mental illness. Many of them have a psychological or mental disability that limits their daily activities. The Working Mind is an education-based program designed to address and promote mental health and wellness and reduce the stigma of mental illness in a workplace setting. The research shows it’s making a di� erence.

The legal climate around liability for psychological injury at work is in constant fl ux, leading to a great deal of un-certainty and unpredictability for employers. It’s impor-tant that workplace advisors have a basic understanding of where the law is going and what they might usefully say to their clients to help them avoid liability in this relatively uncharted area. We will examine a “high road” out of the jungle that, if taken, should help employers steer away from the worst problems.

Contracting Out Construction Services: Who is the Constructor? Paul-André Cyr, CRSP, CHSO, Health and Safety Consultant, Infrastructure Health & Safety Association

This session provides an overview of the duties and responsibilities of building owners when undertaking construction work at their facilities. This presentation will look at the burgeoning popularity of e-cigarettes including the emerging science, public health concerns and the regulatory policy options being considered by various agencies.

Unpaid Workers: Are You Taking Due Care? Jennifer Emmans, Associate, Gowlings

Do you have unpaid workers or interns in your work-place? If you do, or if you have plans to hire, there are recent legislative changes you should understand. This session will explore the historical problem of the exclu-sion from legal protections, and review the amendments in Ontario to the OHSA and ESA to include unpaid workers, and the new protections in the 2015 Federal Budget. We will discuss the Implications of these devel-opments for employers, and tips on how to best man-age unpaid workers.
