Since 1993 the ISM code has been introduced to worldwide shipping which requires a ship management company to have a Safety Management System (SMS)
ISM Code is Chapter 9 of SOLAS and is an international requirement. All ships must comply with SOLAS
The OHSMIAct is from an earlier period and has not recognised the significant changes to Shipping management of safety that has occurred since 1993.
ISM code is not recognised by the Act so HSR is not necessarily part of the SMS.

Mature and Auditable SMS should be robust enough to address OHS issues within their own processes, without the need for external reporting. HSR can play an important part in this process and therefore they need to be part of the company’s Safety Management System.
Also recognising that the ISM code requires compliance with relevant rules, regulations and guidelines of which OHSMIAct is one.
OHSMIAct should recognise the importance of the ISM code and SMS in promoting OHS issues on board ships
