EXTRAJUDICIAL SETTLEMENT OF ESTATE

KNOW ALL MEN BY THESE PRESENTS:

This SETTLEMENT made and entered into by the Heirs of decedents SPS. RESTITUTO H. BARRAZA and EDITHA APOLINAR BARRAZA:

ORLANDO A. BARRAZA, of legal age, Filipino, married and a resident of #98, Brgy. 95, Caibaan, Tacloban City, Tacloban City;

DR. ELMINDA B. ORACION, of legal age, Filipino, married and with postal address at Silliman Medical Center, Dumaguete City, Negros Oriental; and

ELMIRA B. MENDOZA, of legal age, Filipino, married and a resident of Unit 32, Bayview Garden Homes, 2 Roxas Boulevard, Parañaque City,

WITNESSETH: That—

WHEREAS, the above named parties are the sole heirs of SPS. RESTITUTO BARRAZA and EDITHA A. BARRAZA, who died on February 15, 2006 and March 6, 2006 respectively, leaving a certain real property in Tacloban City covered by Transfer Certificate of Title No. T-28867 registered in the name of EDITHA A. BARRAZA, married to RESTITUTO H. BARRAZA, and more particularly described as follows:

A parcel of land designated as Lot 3345-C-2-H, Psd-08-003178, situated in the Barangay of Calanipawan, City of Tacloban, Province of Leyte. Bounded on the NE. along line 6-1 & Lines 1-2-3 by Lot 3345-C-2-E (Road Lot) of the subdivision plan and Lot 3355, Tacloban Cadastre respectively; on the S. along line 3-4 by Lot 3354, Tacloban Cadastre; and on the SW. along line 4-5 by Lot 3349, Tacloban Cadastre and on the NW. along line 5-6 by Lot 3345-C-2-C of the subdivision plan, containing an area of 966 SQ.M. more or less.

WHEREAS, there are no known debts or obligations due against the estate of said decedents;

WHEREAS, it is to the best interests of the parties hereto to divide, partition and adjudicate among themselves this above described estate extrajudicially in a manner hereinafter set forth;

NOW THEREFORE, for and in consideration of the foregoing premises, and invoking the provision of Section 1, Rule 74 of the Rules of Court, the parties hereto have agreed to divide, partition and adjudicate the above described estate among themselves in (pro indiviso) equal share, to wit:

1) To ORLANDO A. BARRAZA

2) To Dr. ELMINDA BARRAZA ORACION3) To ELMIRA BARRAZA MENDOZA

Subject, however, to contingent liabilities to creditors, heirs or other persons who might have been deprived of lawful participation of the estate of the decedents, for a period of two (2) years from and after the settlement and distribution thereof, in accordance with the provision of Section 4, Rule 74 of the Rules of Court; and

That in the remote event that any other property of the decedents should ever be found which is not included hereinabove, the parties hereto further agree as they do so agree to settle and distribute the same in like manner and proportion as herein established and disposed.
