LLE PANY'S MOTION TO DISMIN

Now comes Appellee, The Fahey Banking Company ("Fahey Bank"), by and

through the undersigned counsel, and hereby moves this Court pursuant to S.Ct. Prac. R.

4.01(A) to dismiss the above captioned appeal for lack of jurisdiction. Specifically,

Appellant has availed itself of the proper procedural remedy under the Civil Rules and the

parties are awaiting a decision by the trial court. The Seventh District Court of Appeals

was therefore correct in sua sponte dismissing the appeal.

Appellant filed a direct appeal from a Magistrate's Order dated September 2, 2014.

Appellant then also filed a Motion to Set Aside Magistrate's Order pursuant to Ohio R. Civ

P. 53(D)(2)(b) on September 12, 2014.1 A copy of the Motion is attached hereto as Exhibit

"1 ". The Trial Court has not determined Appellant's pending Motion.

On November 3, 2014 the Seventh District Court of Appeals dismissed the appeal

sua sponte holding that "[a]n order of a magistrate is not directly appealable to this Court.

It must be reviewed by a Common Pleas Court pursuant to the Rules of Civil Procedure."

A copy of the Court of Appeals decision is attached hereto as Exhibit "2". The Common

Pleas Court is currently reviewing Appellant's Motion as the Court of Appeals directed.

Until the Common Pleas Court rules on the pending Motion to Set Aside Magistrate's

Order there is not an appealable order from which an appeal can be taken.

For that reason, this appeal must be dismissed.

MEMORANDUM IN SUPPORT

FACTS: The Order being challenged herein arose from the Motions filed by Imter City Transit,

LLC as a putative intervenor in the subject case as a result of its desire to purchase the subject real estate.

To suinmarize the case herein, Defendants are the owners of a residential property located at 3405

Kisvatlta Road, Youngstown, Oltio. Defendants were stied in foreclosure by Plaintiff. The Court found for

Plaiiatiff. A Sheriff Sale was conducted in Mahoning County on Noventber 26, 2013. Percy Squire Co

.LLC ("PSC"} was tlae successful bidder at the sale, ptirchasing the property ttt a price of $140,000.00.

PSC paid the required deposit at the time of sale and other expenses as required by this Cottrt and the

Ohio Revised Code. When it came time to pay the balance of the purehase price, PSC failed to produce

the required fuiids and the sale was not completed. Subsequently the confirmation entry of the sale was

vacated by an ordet• of this Court dated Mareit 25, 2014 and the Court also ordered that the property be

reset for sale.

The Marelt 251 Order stated that any third party bidding on the property in subsequent sales

would be reqtiired to make a deposit at the time of sale in the antount of $35,0U0. 't'he property was set for

sale ott July 8, 2014 and the bulletin/bidding instructions were issued by the Mahoning County Sheriff's

Departntent, a copy of which is attached as Exliibit "A" hereto. Nowhere in the bulletin was it noted that

the deposit, as set by this Cottrt, was required to be $35,000. As the bidding instructions were inconsistent

with the Court's Order, Defendants objected to the sale and the property was withdrawn from the July 8

sale by a Judgment Entry sigried by Judge Durkin. The Entry ordered the Sheriff to immediately re-

advertise the sale with the correct deposit stated in the bulletinfinstrttctions and reset for the earliest date.

Until this titne, Inner City was not involved itt the pending Slieriff Sales and had not shown an interest in

the property.

After the required three weeks of advertising the property, it was once again set for sale, on

Septeniber 2, 2014. At this time, huier City decided it would bid on the property with the intent of

bidding until it was the successful bidder. Initer City picked up a copy of the Sheriff s Bulletin prior to the

date of sale and found no special requirements for the property in questioti. Tlte btilletin, a copy of which

is attached as Exhibit "B-1" does not state that a $35,000 deposit is required. The date Inner City filed its

Motion to Itttervene and also its Motioti for a Temporary Restraining Order, August 28, 2014, was the

first time that Inner City learned of the Court's Order requiring tlte $35,000 deposit. Due to the

conflicting requirements of the bid instructions and the Court's Order,lnner City filed its Motions to have

the sale set aside for a clarification of the bidding procedure and reqttired deposit. Due to the late filing of

the Motions, no action was taken by the Cottrt until the morning of the scheduled sale.

On the mortting of tite scheduled sale, a brief hearing was held in the Magistrates office witlt

Plaintiff Fahey Bank's counsel by phone. Plaintiff s counsel objected to the intervention of Imier City and

the postponemetit of the sale, and the Magistrate rtaled in Plaintiff's favor. Defense Counsel discovered at

the time of sale, on Tuesday September 2, 2014, that the Sheriff's bulletitz had been revised late in the day

on the prior Friday to include the mitiimum bid requirements for the property (see Exhibit "B 2" attached

hereto). Due to the bulletin change late on Friday, and the Labor Day weekend falling itgunediately before

the day of the Sheriff's sale (banks being closed on Monday Septeanber 1), Inner City did not have time to

obtain the fitnds necessary to make the Court ordered deposit at the Sheriff Sale. Additionally, as the

Cotart liad ttot held a hearitig on Inner City's niotion ott the Friday prior to the sale, Inner City was tiot

even certain it would be pertnitted to bid at the sale. When the Magistrate denied hiner City's Motions on

the morning of the sale, Inner City could do nothing to cither obtain the necessary fttnds or delay the sale.

It is now Inner City's position that the decision rendered by the Magistrate was not valid under

Civ. Rule 53 atid that the Judge slioutd have rtzled on the Motions. For that reason, Inner City requests

that it's Motion for a Temporary Injunction be honored and that the sale be set aside until the bidding

instructions are issued in conformity to the Court's March 25 Order so that all potential bidders have the

same opportunity to obtain the required deposit for the sale.

CONCLUSIONS OF LAW. To support Inner City's argument that it has standing to file this

Motion, it attaches hereto, as Exhibit "C", its Memorandum fj(cd with the Motion to Intervene. Due to the

fact that the Magistrate conducted a hearing on the Motion for an iaijunction, it should be inferred that the

Court accepted Inner City as a party to this action making it subject to the jurisdiction of the Coutl.

Additionally, Ititier City believes that it sttbstantially supported its argument that it satisfied the criteria

required of a party to be granted a temporary restraining order (Sec. H of attaclied Memoranduin).

The action that Intter City objects to is the denial of Inner City's motions by the Magistrate ratlaer

than the Judge. Civ. R. 53 (D) (2) (a) (i);1Yatirre of Order, states as follows:

"Subject to the tertns of the relevant reference, a magistrate may enter orders without judicial

approval if tgeeessary to regulate the proceedings and if not dispositive of a claim or a

defense of a party."

The ruling by the Magistrate here is dispositive of a claivn requiring judicial approval for a tnagistrate to

adjudicate, for the reason that a motion to Intervene as of riglit, which was filed here, alleges that the filer

has a statutory or other established legal interest not protected by other parties to the action whicli gives

rise to a right to participate as a party. Here lnner City, as all other membets of the public, ltas a statutory

riglat to participate in a public auction, such as a Sheriff''s Sale. The Mahoning County Court of Appeals

ruled in JPMar^ara Chasel3arrk.N.N. v Veriessa Pel/i» , 2012-Oh.io-1151(2012) that denial of a cnotion to

intervene as of right is a fnial appealable order etatitling the putative intervenor to seek immediate
