Dehns currently represents 2 of the 3 Norwegian applicants with the most patent filings over the last 3 years, 6 out of the top 10, and 9 of the top 15.*

We are also proud that in 2019, Dehns filed 3,390 European Patent Applications, more than any other European firm.

However, in addition to working with multinationals, we also work with individual inventors, start-ups, Universities/TTOs and SMEs. This is a diverse group whose needs are not all the same; however, common themes arise again and again: value and cost effectiveness; accessibility and transparency; first rate and pragmatic advice.

Our Biotechnology and Chemical Groups specialise in working for these smaller organisations, helping them build, grow and develop their IP portfolios which in turn adds great value to their businesses.

Dehns' attorneys have numerous clients and have close working relationships with many of the innovation networks and technology incubators in Oslo and the rest of Norway, including Bergen, Trondheim, Stavangar and Tromsø.

In particular, Dehns is heavily involved in the Oslo innovation scene – we normally have attorneys travelling to Oslo to visit clients and prospective clients on a weekly basis. We also host a formal IP clinic (“DehnsDag”) where we offer free IP support and guidance on the first Tuesday of every month at The Science Park (Forskningsparken). We are also members of Norway Health Tech and have a regular presence within Aleap and ShareLab.

Through the provision of these IP clinics, working with start-ups and SMEs over the last 50 years and our involvement with the various incubators and hubs, Dehns’ attorneys have naturally acquired significant hands-on experience with the particular types of issues and concerns start-up and spin-out companies face, leaving them well equipped to provide focused and tailored advice to other such companies.

Professional ExperienceFor the past 30 years, Louise has worked with many different Norwegian clients in various sectors. Back in the early years, Louise worked with Nycomed in handling their ultrasound contrast agent portfolio of cases. Over the years Louise has worked with clients ranging from large corporates such as Equinor Energy AS and Borealis to start-ups, SMEs and University clients. Amongst her University clients are Inven2 and Vestlandets Innovasjonsselskap AS (previously Bergen Tecknologioverføring AS). Professional ExperienceRebecca has been working with Norwegian companies and research organisations for over 20 years. She is regularly in Norway visiting clients based all over the country, from Tromsø and Bodø in the north down to Trondheim, Bergen, Stavanger and Oslo. What began with Alpharma’s collaboration with Tromsø inventors who would go on to form Lytix Biopharma, has developed over the years into a varied practice working closely with TTO’s at some of Norway’s major universities and research organisations, including Norinnova, Vestlandets Innovasjonsselskap (previously Bergen Teknologioverføring) and SINTEF, as well as companies spun-out from these organisations. Working with technology and companies at an early stage means that Rebecca often takes the role of in-house IP advisor, advising on strategy, development of business plans, budgets, transactions and third party rights, as well as developing the patent portfolio.

One recent commercial success story, in which Rebecca was involved with both the original patent drafting and transactional support, was the sale of the Prophylix orphan drugs program to a US company. As well as working with numerous SME’s, including Amicoat, ODI Medical, GOE-IP, Biotec Pharmacon and ArcticZymes, Rebecca also handles cases in the life science field for Equinor.

Rebecca’s technical experience reflects the strengths of research in Norway and a trend towards multi-disciplinary innovation, biology teamed with chemistry, as well as life science based technology which includes medical device, manufacturing and computational elements.

Philip’s work is largely with start-ups, small/medium size companies and universities with inventions in the pharmaceutical or biotechnological fields. He has over 25 years’ experience in dealing with the issues which are important to such entities, such as the financial constraints of start-ups, the need to develop IP strategies for a company’s products and the pressures upon academics to publish their work.

Case study one

Understanding complex materials to draft patents

Inven2 is the Technology Transfer Office (TTO) for the University of Oslo, and Oslo University Hospital, and with whom Dehns has worked for more than 30 years.

IssueDehns Head of Biotechnology, Hanna Dzieglewska had been approached by Inven2 with a highly complex invention proposal being developed by an inventor at Oslo University Hospital. The invention proposal related to methodology in the preparation of immune cells for adoptive transfer therapy, and in particular, regarding cancer treatments. A patent application for this invention needed to be filed ahead of an imminent conference disclosure.

SolutionHaving reviewed the invention proposal, it was clear that a highly complex invention was involved, requiring background research and a detailed discussion with the inventors, to fully understand the invention, and to place it into context, and consider all possible ramifications and applications of the underlying biological observations. Our initial claim proposals and discussions prompted the inventors further to consider the scope and possible applications of their invention, leading them to expand and develop the inventive concept. The final, iterative, drafting process involved lengthy and very technical discussions with the inventors, and analysis of their data and ideas.

ResultThe patent application was filed ahead of the conference disclosure. Despite this work being completed in a relatively short time frame, the key issue in this case study is that the invention was incredibly technical; Dehns needed to really dig deep and assimilate very complex materials and data to understand and be able to draft a robust set of patent claims.

Rapid response during a global pandemic

In late March 2020, Dehns was asked by the Head of IPR at a Norwegian TTO to host an online workshop at 24hrs notice with two of their inventors. This related to a new test method for Covid-19, so was extremely urgent.

Following the workshop, new drafts were created within a "very intense" couple of days and applications successfully filed. The client was very pleased with the result and with the service Dehns had been able to provide.
