2. Condition 10 has been amended as follows.
Stormwater Quality Improvement Device
The proposed Stormwater Quality Improvement Device (Bioretention Basin with filter area of 121m2) shown in the WDD drawings TP07 to TP 11 must be amended as part of the Operational Works according to the following: a) Deleted b) The proposed couch grass in the bioretention basin must be replaced with plants
according Appendix A of WSUD Technical Design Guidelines
3. Condition 11 has been amended as follows.
Drainage Easement
The 5.0m proposed drainage easement shown on Drawing WDD OP-02 must in accordance with Council’s Engineering Design Guidelines and be included in the sealing of Survey Plan application
4. Condition 16 has been deleted. 5. Condition 17 has been amended as follows.
Uncovered Working Area
The uncovered working area including the driveway and carparking must be designed and constructed as part of the Operational Works. All uncovered working area must be sealed, linemarked and drained generally in accordance with WDD drawing OP-02, OP-03 and OP-04. The portion of the site (655.6m2) shown as hardstand on WDD Drawing OP-03 can be constructed as compacted gravel hardstand to provide an area to load and unload track vehicles only.
6. All other conditions remain unchanged. 7. The relevant period for this application remains unchanged as per the original

FILTER LAYERTHE FILTER MEDIA SHOULD BE BASED ON NATURAL OR AMENDED NATURAL SOILS OR IT CAN BE ENTIRELY ENGINEERED; IN EITHER CASE, IT CAN BE OF SILICEOUS OR CALCAREOUS ORIGIN. THE MEDIA SHALL HAVE HIGH PERMEABILITY UNDER COMPACTION AND SHALL BE FREE OF RUBBISH, DELETERIOUS MATERIAL, TOXICANTS, DECLARED PLANTS, WEEDS AND SHOULD NOT BE HYDROPHOBIC. THE FILTER MEDIA SHOULD CONTAIN SOME ORGANIC MATTER FOR INCREASED WATER HOLDING CAPACITY BUT BE LOW IN NUTRIENT CONTENT.IN THE CASE OF NATURAL OR AMENDED NATURAL SOILS, THE MEDIA SHOULD BE LOAMY SAND.
THE HYDRAULIC CONDUCTIVITY OF POTENTIAL FILTER MEDIA SHOULD BE MEASURED USING THE ASTM F1815-06 METHOD FOR A TROPICAL ZONE WITH FILTRATION RATE RANGING BETWEEN 100 TO 300mm/hr.
PARTICLE SIZE DISTRIBUTION (PSD) IS OF SECONDARY IMPORTANCE COMPARED WITH HYDRAULIC CONDUCTIVITY. THE FOLLOWING COMPOSITION RANGE (PERCENTAGE W/W) PROVIDES A GUIDE FOR SELECTING AN APPROPRIATE MATERIAL:-
● CLAY SILT <3% (<0.05mm)● VERY FINE 5-30% (0.05 - 0.15mm)● FINE SAND 10-30% (0.15 - 0.25mm)● MEDIUM TO COARSE SAND 40-60% (0.25 - 1.00mm)● COARSE SAND 7-10% (1.00 - 2.00mm)

THE FILTER MEDIA SHOULD BE WELL-GRADED WITH ALL PARTICLE SIZE RANGES PRESENT FROM THE 0.075mm TO THE 4.75mm SIEVE (AS DEFINED BY AS1289.3.6.1 - 1995). THERE SHOULD BE NO GAP IN THE PARTICLE SIZE GRADING, AND THE COMPOSITION SHOULD NOT BE DOMINATED BY A SMALL PARTICLE SIZE RANGE. A SINGLE PASS WITH A VIBRATING PLACE SHOULD BE USED TO COMPACT THE FILTER MEDIA. UNDER NO CIRCUMSTANCE SHALL THE MEDIA BE HEAVILY COMPACTED OR MULTIPLE-PASSES BE MADE.
TOP TRANSITION LAYERTHE TOP 100mm TRANSITION LAYER SHALL CONSIST OF FILTER MEDIA USED IN THE FILTER LAYER AMELIORATED WITH THE FOLLOWING ORGANIC MATTER, FERTILIZER AND TRACE ELEMENTS AS FOLLOWS:-

DRAINAGE LAYERTHE DRAINAGE LAYER COLLECTS TREATED WATER AT THE BOTTOM OF THE SYSTEM AND CONVEYS IT TO THE UNDER DRAIN PIPES. DRAINAGE LAYER MATERIAL IS TO BE CLEAN, FINE GRAVEL CONSISTING OF 2-5mm WASHED SCREENINGS. BRIDGING CRITERIA SHOULD BE APPLIED TO AVOID MIGRATION OF THE TRANSITION LAYER INTO THE DRAINAGE LAYER.

UNDER DRAIN PIPESTHE PERFORATIONS IN THE UNDER DRAIN PIPES SHALL BE SMALL ENOUGH THAT THE DRAINAGE LAYER CANNOT FALL INTO THE PIPES. THE D (DRAINAGE LAYER) IS GREATER THAT THE PIPE PERFORATION DIAMETER.
GEO-TEXTILE FABRICSGEO-TEXTILE FABRICS ARE NOT RECOMMENDED FOR USE BETWEEN LAYERS IN THE BIO-FILTRATION SYSTEM DUE TO THE RISK OF CLOGGING. AN OPEN-WEAVE SHADE CLOTH SHALL BE PLACED BETWEEN THE TRANSITION LAYER AND THE DRAINAGE LAYER TO HELP REDUCE THE DOWNWARD MIGRATION OF SMALLER PARTICLES. THE BASE AND SIDES SHALL BE LINED WITH A GEO-TEXTILE FILTER FABRIC TO PREVENT CONTAMINATION OF THE FILTRATION SYSTEM.

Sustainable Planning Act Appeals Chapter 7 Part 1 Planning and Environment Court:
465 Appeals about decisions relating to extensions for approvals
(1) For a development approval given for a development application, a person to whom a
notice is given under section 389, other than a notice for a decision under section 386(2), may appeal to the court against the decision in the notice.
(2) The appeal must be started within 20 business days after the day the notice of the
decision is given to the person. (3) Also, a person who has made a request under section 383 may appeal to the court
against a deemed refusal of the request. (4) An appeal under subsection (3) may be started at any time after the last day the
decision on the matter should have been made.
466 Appeals about decisions relating to permissible changes
(1) For a development approval given for a development application, the following persons may appeal to the court against a decision on a request to make a permissible change to the approval—
(a) if the responsible entity for making the change is the assessment manager for the
application— (i) the person who made the request; or (ii) an entity that gave a notice under section 373 or a pre-request response
notice about the request;
(b) if the responsible entity for making the change is a concurrence agency for the application—the person who made the request.
(2) The appeal must be started within 20 business days after the day the person is given
notice of the decision on the request under section 376.
(3) Also, a person who has made a request under section 369 may appeal to the court against a deemed refusal of the request.
(4) An appeal under subsection (3) may be started at any time after the last day the
decision on the matter should have been made.
467 Appeals about changing or cancelling conditions imposed by assessment manager or concurrence agency
(1) A person to whom a notice under section 378(9)(b) giving a decision to change or
cancel a condition of a development approval has been given may appeal to the court against the decision in the notice.
(2) The appeal must be started within 20 business days after the day the notice of the
decision is given to the person.
