Memo: For the Record From: M. Ohye Subject: Waikoloa MLR 1 & 2 (Well Nos. 5846-01 & 02)

Received a phone call from Dale Nishimoto (Hilo USGS) regarding the location for wells 5846-01,02. He noticed that out in the field the workers referred to the most Northern well as MLR 2. Our well maps and Database have the locations reversed. Upon checking the files, the Application form proposed location map has the wells reversed. Corrections were made to Database, files and noted in the Memo field, also marked on the working map.

SUBJECT: PUBLIC WATER SYSTEM NO. 160, DWS LALAMILO PARKER WELL NO. 2 STATE WELL NO. 8-5846-02

We have completed our review of the engineering report submitted for the Parker Well No.2, State Well No. 8-5846-02, prepared by Tom Nance Water Resource Engineering and the water quality data submitted on October 20, 1998 and November 10, 1998. The Department of Health hereby grants conditional approval for the use of the Parker Well No. 2 as a drinking water source for a public water system, provided that upon completion of construction, Mauna Lani dedicates the proposed facilities to the Department of Water Supply, County of Hawaii, for full operation and maintenance. Mauna Lani shall notify the Safe Drinking Water Branch at least ten (10) days in advance of the dedication.

In its operation of the Parker Well No.2, the Department of Water Supply, County of Hawaii, shall meet the following conditions:

1. The Parker Well No.2, State Well No. 8-5846-02, shall deliver potable water of the quality in compliance with Hawaii Administrative Rules, Title 11, Chapter 20, IIPotable Water Systems. II The water quality shall be subject to verification by the Department of Health.

2. The Hawaii Department of Water Supply, in its operation of the Parker Well No.2, State Well No. 8-5846-02, shall comply with all other relevant provisions of Hawaii Administrative Rules, Title 11, Chapter 20, IIPotable Water Systems. II

3. The Hawaii Department of Water Supply shall notify the Department of Health of any condition that may arise or be revealed which may contaminate the source and pose a threat to human health.

4. The Hawaii Department of Water Supply shall notify the Safe Drinking Water Branch of the planned well activation date(s), at least ten (10) days in advance. This will help the Department incorporate the well into its monitoring schedules.

5. The Parker Well No.2 shall be properly disinfected prior to entry into the distribution system.

6. Immediately prior to or upon startup, the Hawaii Department of Water Supply shall resample Parker Well No.2, State Well No. 8-5846-02, to retest for Fluoride, Nitrate, and Diethylphthalate to confirm the presence of these contaminants. The analyses must be performed by a laboratory approved by the Hawaii Department of Health, State Laboratories Division, using EPA approved drinking water methods. At a minimum, the chain of custody and laboratory reports need to be submitted. In the event that the presence of these contaminants in Parker Well No. 2 is confirmed, Mauna Lani Resort, Inc. or Hawaii Department of Water Supply will issue a press release.

7. The Hawaii Department of Water Supply must sample and analyze the Parker Well No. 2 for all required contaminants that are not analyzed by the Department of Health, State Laboratories Division.

Presently, the Department of Health cannot analyze the following EPA regulated contaminants:

Cyanide Benzo(A)Pyrene Dalapon Di(ethylhexyl)-Adipate Di(ethylhexyl)-Phthalate Dinoseb 2,3,7,8-TCDD (Dioxin)

Endothall Pentachlorophenol Picloram 2,4,5-TP (Silvex) 2,4-D Diquat

Please note that the drinking water regulations are frequently revised and the preceding list may be subject to change.

8. It is also important to note that the drinking water well(s) may affect future development plans. Hawaii Administrative Rules, Title 11, Chapter 23, Underground Injection Control, prohibits the siting of an injection well within 1/4 - mile of any drinking water well. In addition, Hawaii Administrative Rules, Title 11, Chapter 62, Wastewater Systems requires septic tank effluent disposal systems (page 9, section 4.e.4) to be located at least 1,000 feet from the drinking water well.

9. Hawaii Revised Statutes, Chapter 340E-24,requires suppliers of water to notify the Department of Health, in writing, of any previously undetected chemical contaminant found in a source of drinking water, within seven days of the positive detection.

The Department of Health reserves the right to suspend or revoke this conditional approval upon either a finding of violation on any of the above conditions or a determination of a threat to public health from factors which may arise in the future.

Enclosed are two (2) originals of your approved Pump Installation Permit for the captioned well(s) which authorizes permanent pump installation work for your well(s). As part of the Chairperson's approval, the following special condition was added and is part of your permit under Permit Condition 10:

Special Conditions

1. No Special Conditions

The well owner is responsible for all conditions of the permit. This includes ensuring that the pump installation contractor, or other party who installs the pump, submits a completed Part n of the Well Completion Report form (enclosed) within sixty (60) days after the pump installation work is completed. Be advised that you may be subject to fines of up to $1000 per day for any violations of your permit conditions.

To validate your pump installation permit, please sign and have the contractor sign both permit originals and return one for our files.

A copy of the Well Completion Report (Part II) and a copy of your water use report form are enclosed for your use. Except for the monthly water use report form, please provide copies of all the information in this packet to your pump installation contractor.

Finally, this letter is notice that we have accepted your Well Completion Report - Part I as complete.

1. The Chairperson to the Commission on Water Resource Management (Commis~~, P:P.l*o>l'S21; f.j6~olJi~\ HI 96809, shall be notified, in writing, at least two (2) weeks before any work covered by this permit commen~$a.nd sta.ff. $"h~lIbe alfo",~i:[tp(Ospect installation activities in accordance with §13-168-15, Hawaii Administrative Rules. t"lt., .. 2. The pump installation permit shall be for installation of a 1250 gpm capacity, or less, pump in the well.

3. The permittee shall provide and maintain an approved meter or other appropriate means for measuring and reporting withdrawals and water levels, and appropriate devices or means for measuring chlorides and temperature. These data shall be measured monthly and reported to the Commission on a monthly basis, on forms provided by the Chairperson (attached).

4. The proposed use shall not adversely affect existing or future legal uses of water in the area, including any surface water or established instream flow standards. This permit or the authorization to pump water from a well shall not constitute a determination of correlative water rights. The permittee is notified and by this provision understands that the quantity of water taken from the well could be reduced by the Commission in the future. This permit is not a commitment that the pump capacity permitted here oreven some lesser amount is guaranteed in the future.

5. The permittee shall complete and submit as-built drawings and Part II - (Permanent) Pump Installation Report ofthe Well Completion Report (attached) to the Chairperson within sixty (60) days after completion of work.

6. The permittee shall comply with all applicable laws, rules, and ordinances, and non-compliance may be grounds for revocation of this permit.

7. The pump installation permit application is incorporated into this permit by reference and is subject to the Hawaii Well Construction & Pump Installation Standards (1/23/97).

8. The permit may be revoked if work is not started within six (6) months after the date of approval or if work is suspended or abandoned for six (6) months, unless otherwise specified. The work proposed in the pump installation permit application shall be completed within two (2) years from the date of permit approval, unless otherwise specified. The permit may be extended by the Chairperson upon a showing of good cause and good-faith performance. A request to extend the permit shall be submitted to the Chairperson no later than three (3) months prior to the date the permit expires. If the commencement date is not met, the Commission may revoke the permit after giving the permittee notice of the proposed action and an opportunity to be heard.

9. If the well is not to be used it must be properly capped. If the well is to be abandoned then the permittee must apply for a well abandonment permit in accordance with §13-168-12(f) prior to any well sealing or plugging work.

10. Special conditions in the attached cover transmittal letter are incorporated herein by reference.

On behalf of Mauna Lani Resort, I am pleased to submit the enclosed Pump Installation Permit application with two copies and the $25 filing fee. The well's construction and pump testing was completed in 1993. It would now be outfitted with a 1250 GPM pump. When this work is completed, the well will be dedicated to the Department of Water Supply as an addition to its Lalamilo System.

We acknowledge receipt of your July 24, 1992 letter on the status of Waikoloa­Mauna Lani Well 1 (Well No. 5846-01), and your request for an extension of the start date for the drilling of Waikoloa-Mauna Lani Well 2 (Well No. 5846-02). We understand that you will be using the same drilling rig for the second well, and that the fIrst well will be completed in late August or early September 1992.

By this letter we are extending your start date for Waikoloa-Mauna Lani Well 2 an additional six months to February 03, 1993. Please note that the well should be completed within two years of the date of issuance, or by February 1994.

Dear Mr. Paty,

We wish to advise that we initiated construction of State Well No. 5846-01 (Waikoloa­Mauna Lani Well #1) on June 01, 1992. At the present time, we have completed the pilot hole and have reamed the hole to full diameter to a depth of approximately 600 ft. from ground elevation. We anticipate that we will complete construction of the first well in late August or early September.

As we intend to use the same drilling rig to construct the second well, it as apparent that we will not be initiating construction of the second well prior to the apparent August 03, 1992 construction start date called for in the well construction permit.

By copy of this letter, we hereby request an extension to the date before which construction must start for the second well, State Well #5846-02 (Waikoloa - Mauna Lani #2).

We will await your favorable response. Please feel free to contact us should you have any questions regarding this matter.

1. The Division of Water Resource Management (DWRM), P.O. Box 373, Honolulu, HI 96809, shall be notified, in writing, before any work covered by this permit commences.

2. The applicant shall contact the State Historic Preservation Division (Telephone: 587-0008) before starting any work on the project. The applicant shall obtain a written statement from the State Historic Preservation Division indicating that their concerns have been addressed, and a copy of that statement shall be sent to the Commission before work is started on the project.

3. This permit shall be for construction and testing only. No permanent pump may be installed and no water used from the well without a pump installation permit from the Commission.

4. The proposed well construction shall not adversely affect existing or future legal uses of water in the area, including any surface water or established instream flow standards. This permit or the authorization to construct a well shall not constitute a determination of correlative water rights.

5. The following shall be submitted to DWRM within 30 days after completion of the well:

a. Well Completion Report.

b. Elevation (referenced to mean sea level) survey by a Hawaii-licensed surveyor.

c. As-built sectional drawing of the well.

d. plot plan and map showing the exact location of the well.

e. Complete pumping test records, including time, pumping rate, drawdown, chloride content, and water quality data.

6. The applicant shall comply with all applicable laws, rules, and ordinances.

7. This permit may be revoked if work is not started within six months of the date of issuance or if work is suspended or abandoned for six months. The work proposed in the permit application shall be completed· within 24 months from the date of permit issuance.

Thank you for the opportunity to review and comment on the subject applications. We have examined the applications and have the following comments to offer:

1. The application indicates that the subject wells will be for municipal use. Thus, the names of the wells are inappropriate given their proposed use.

2. If each well is to serve 25 or more individuals at least 60 days per year or will have a minimum of 15 service connections, the applicant will be required to comply with the Department's Administrative Rules, Title 11, Chapter 20, "Potable Water Systems."

3. Section 11-20-29 of Chapter 20 requires that a new source of potable water serving a public water system be approved by the Director of Health prior to its use. Such an approval is based primarily upon the submission of a satisfactory engineering report which addresses the requirements set in Section 11-20-29.

4. The proposed wells are situated above the Underground Injection Control (UIC) line. Land areas above the UIC line are considered to contain underground sources of drinking water. Thus, it is essential that each well be designed and constructed to prevent the possibility of groundwater contamination. For example, each well should have a concrete well pad and full grouting to prevent seepage or floodwaters from migrating down the well shaft.

5. The operation of the wells should not be allowed to adversely affect the water quality of nearby drinking water wells. The map accompanying the application indicates that the proposed wells will be'located approximately 2,500 feet ,from the Lalamilo Wells A, B, C, and D (state well nos. 5946-01, -02, -03, and -04).

6. If the wells are also used for irrigation purposes, adequate measures must be taken to eliminate cross-connections and backflow conditions. The potable and non-potable water systems should be clearly labeled and physically separated by an air gap or an approved backflow preventer to avoid contaminating the potable water supply.

Well Construction Permit Applications for Two potable Well Sites in South Kohala, Hawaii

On behalf of Mauna Lani Resort, Inc. (MLRI), we are pleased to submit the enclosed permit applications for two potable wells to be constructed in South Kohala, Hawaii. The wells would be constructed by MLRI on two land parcels it owns in fee (refer to the enclosed property tax maps).

Supply from the wells is needed to meet MLRI's projected requirements for new development. Subject to the County Department of Water Supply's concurrence, the wells would be outfitted as additional sources of supply for the County's Lalamilo Water System which now serves Mauna Lani Resort.
