CITY OF TIMMINS BY LAW NO 2010 6896 BEING A BYLAW to amend City of Timmins Zoning By law No 1977 850 WHEREAS the Planning Act R S O 1990 c P 13 Section 34 as amended authorizes councils of municipalities to pass By laws to regulate the use of land and the character location and use of buildings and structures AND WHEREAS it is considered desirable to amend City of Timmins By law No 1977 850 NOW THEREFORE the Council of the Corporation of the City of Timmins enacts the following as a By law 1 THAT Schedule 29 of Zoning By law No 1977 850 be amended by changing the zoning of the lands identified as Item No 1 on Schedule 1 to this By law and further identified as being shaded from Holding Residential DR to Residential Low Density R1 2 THAT Schedule 1 shall form part of this By law READ a first time second and third time and finally passed this 19 day of April 2010 Tom Laughren MAYO Mayor City of Timmins CLERK

BYLAW NO 20106896

BEING A BYLAW to amend City of Timmins Zoning Bylaw No 1977850

WHEREAS the Planning Act RSO 1990 cP13 Section 34 as amended authorizes

councils of municipalities to pass Bylaws to regulate the use of land and the characterlocation and use of buildings and structures

AND WHEREAS it is considered desirable to amend City of Timmins Bylaw No 1977850

NOW THEREFORE the Council of the Corporation of the City of Timmins enacts the followingas a Bylaw

1 THAT Schedule 29 of Zoning Bylaw No 1977850 be amended by changing the

zoning of the lands identified as Item No 1 on Schedule 1 to this Bylaw and further

identified as being shaded from Holding Residential DR to Residential Low DensityR1

2 THAT Schedule 1 shall form part of this Bylaw

READ a first time second and third time and finally passed this 19 day of April 2010

1 Bylaw No 20106896 has the following purpose and effect

The subject property is located on the north side of Murray Street between Hart

Street and Patricia Boulevard More specifically the legal description and size of the

land particular to amending By law No 20106896 is detailed below

Part of Part 1 Plan CR155

Part of Lot 11 Concession 3 Tisdale TownshipPart 1 Plan 6R8182

Part of Parcel 2922 SWS

The subject land has a frontage of 100 metres 330 feet a depth of 75 metres 246feet and an area of 7500 square metres 187 acres

The location of this property in relation to other properties in this part of the City is

illustrated in the Key Map for Bylaw No 2010 6896

Presently the subject land is vacant

The subject land was divided into four parts through the consent approval process

Committee of Adjustment specifically with the approval of consent applications B

2709 to B3009 inclusive Each lot has a frontage of 25 metres 82 feet on MurrayStreet and an area of 1875 square metres 046 acres A single family dwelling is the

proposed land use for each residential lot

Schedule 29 of Zoning Bylaw No 1977850 zones the subject land HoldingResidential DR and Rural Hazard AH The proposed amending Bylaw changesthe zoning for the part of the subject property zoned Holding Residential DR to

Residential Low Density R1 The lands which are zoned Rural Hazard AH will

remain in this zoning category as they are low lying and prone to flooding

The Residential Low Density R1 will permit single family residential development on

the four residential lots created through the consent approval process Committee of

Adjustment in conformity with the Provisions for Residential Zones
