City Code, Chapter 500, Section 512.02,are amended to read as follows:

512.02 Open Burning Permit Required.Subdivision 1. Except as provided in

subdivision 2 herein, no person shallconduct open burning with the City with-out first obtaining an Open Burning Per-mit from the City Clerk.

Subdivision 2. No permit for openburning is required to be obtained forthe following kinds of open fires:

(1) a fire started when the ground issnow covered;

(2) a campfire or recreational fire;(3) a fire contained in a grill, camp

stove, or other device designed for thepurpose of cooking or heating;

(4) a fire to burn dried vegetativematerials and other materials allowedby Minnesota Statutes or State Rules ina burner of a design which has beenapproved by the Minnesota Commis-sioner of Natural Resources and withwhich there is combustible material withinfive feet of the bases of the burner andis in use only between the hours of 6:00p.m. and 8:00 a.m. of the following day,when the ground is not snow covered;

(5) a fire to burn leaves that havefallen in the that Fall season from de-ciduous trees.

Subdivision 3. Attendance required.Every open burning fire shall be attendedby a person 18 years of age or older,and the fire shall be completely extin-guished by the attendant before leavingthe vicinity of the fire.
