- Degree of familiarity amongst the public with the name in question

Regulation
The regulation must provide the following information:
– - the name and the address of the owner,
– - the purpose of the association
– - the legal representatives of the association,
– - the preconditions for a membership in the association,
– - the person who are allowed to use the mark,
- the conditions for the use and the sanctions in case of
violation of the conditions of use.

Agricultural products intended for human consumption:
• Fresh meat (and offal)
• Meat based products (cooked, salted, smoked, etc.)
• Cheeses
• Other products of animal origin (eggs, honey, milk products excluding butter, etc.) • Oils and fats (butter, margarine, oils, etc.)
• Fruits, vegetables, cereals, whether or not processed • Fish, molluscs, fresh crustaceans and ...-based products

• Beer
• Beverages made from plant extracts

The term qualified means that the geographical indication is not only the name of the place where a product got produced but that the product also possesses qualities due to this place of origin.For example due to: - climate,
- soil,- raw materials,- manufacturing know how.

Designation of Origin (Article 2 (1)(a)):
„The name of
a region,
a specific place or,
in exceptional cases, a country,
used to describe an agricultural product or a foodstuff:
- originating in that region, specific place or country,
- the quality or characteristics of which are essentially or exclusively due to a particular geographical environment with its inherent natural and human factors, and
- the production, processing and preparation of which take
place in the defined area.“

Geographical Indication (Article 2 (1) (b)):
„The name
of a region,
a specific place or,
in exceptional cases, a country,
used to describe an agricultural product or foodstuff:
- originating in that region, specific place or country, and
- which possesses a specific quality, reputation or other
characteristics attributable to that geographical origin, and
- the production and/or processing and/or preparation of
which take place in the defined area.“

Generic names
A name has become generic,
when it is the common name of an agricultural product or foodstuff
without that the consumer still associates the name with a region or specific place.
